Cancelling an Indian GST registration stops future registration obligations from the effective cancellation date, but it does not wipe out earlier tax dues or unfinished compliance. Depending on the taxpayer and inventory held, a final GSTR-10 return, payment or reversal relating to stock and capital goods, and settlement of earlier returns may still be required.

The short answer

Under India’s Central Goods and Services Tax (CGST) framework, cancellation is not a tax amnesty. Three separate questions must be dealt with:

  • Earlier periods: tax, interest, penalties, other dues and outstanding obligations for periods before cancellation continue.
  • Final return: a person who was required to file returns under section 39 generally has to file GSTR-10 within three months of the cancellation date or the cancellation-order date, whichever is later.
  • Inventory and assets: inputs, goods containing inputs, and capital goods or plant and machinery held immediately before cancellation can create a rule-based amount payable or input-tax-credit reversal.

The discussion here concerns GST registration under India’s CGST Act. SGST and UTGST provisions apply alongside it, and the correct treatment depends on the taxpayer’s category, return obligations, cancellation order and current rules.

Do I still have to pay GST after cancelling my registration?

Yes. Section 29(3) of the CGST Act expressly preserves liabilities and compliance duties for periods before cancellation. It applies whether the tax or other dues were determined before or after the cancellation date. The statutory wording is:

“The cancellation of registration under this section shall not affect the liability of the person to pay tax and other dues under this Act or to discharge any obligation under this Act or the rules made thereunder for any period prior to the date of cancellation whether or not such tax and other dues are determined before or after the date of cancellation.”

Read the full provision in the Central Goods and Services Tax Act, 2017.

In practical terms, cancelling a GSTIN does not forgive unpaid tax, an incorrect earlier return, a pending assessment, interest, late fee or another statutory obligation. A later departmental determination can still relate to the pre-cancellation period.

Cancellation date and order date are different

The effective cancellation date is the date from which the registration is treated as cancelled. The officer’s cancellation order may be issued or served on a later date. Keep both dates: the effective date determines the “immediately preceding day” inventory snapshot for the section 29(5) calculation, while the later of the cancellation date and order date controls the GSTR-10 deadline.

Do I need to file GSTR-10 after GST cancellation?

Section 45 requires a final return from a registered person who was required to furnish a return under section 39 and whose registration has been cancelled. Rule 81 prescribes GSTR-10 for this purpose. The statutory deadline is three months from the cancellation date or the cancellation-order date, whichever is later. The deadline is therefore not automatically three months from the day the application was submitted.

The obligation must be assessed against the taxpayer’s actual return category. Do not assume that every form of GST registration has identical section 39 filing duties. Check the cancellation order, the returns previously required for the GSTIN and the current rules applicable to that category. The deadline and section 45 text are available in the CGST Act.

What GSTR-10 asks you to report

The prescribed form requires the taxpayer to disclose the closing position relevant to cancellation, including goods and assets on which tax or input tax credit is being accounted for, the resulting liability and how it is paid or offset. The official form is included in the CGST Rules (FORM GSTR-10).

Before opening the return, assemble the effective cancellation date, the order date, details of inputs in stock, inputs contained in semi-finished or finished goods, capital-goods records, available invoices, previous return data and the electronic cash and credit ledger balances.

General filing sequence on the GST Portal

  1. Sign in to the GST Portal for the cancelled GSTIN and open the GSTR-10 final-return function in the Returns area.
  2. Enter or verify the cancellation and order details requested by the form.
  3. Report inputs in stock, inputs in semi-finished or finished goods, and capital goods or plant and machinery covered by the reversal/payment calculation.
  4. Enter the corresponding tax or input-tax-credit amount and the amount to be paid from the electronic cash ledger, electronic credit ledger or both, as permitted by the form.
  5. Use the portal’s preview facility and reconcile every figure to your inventory and asset records before submission.
  6. File using the authentication method available to the authorised signatory, then download the filed return and acknowledgement for your records.

The GST Portal GSTR-10 manual describes preparation, preview, filing and downloading. After successful filing and set-off, the portal manual states that the electronic cash ledger, electronic credit ledger and electronic liability register are updated.

What happens to ITC on stock when GST registration is cancelled?

Section 29(5) creates a separate cancellation calculation for specified goods held on the day immediately preceding cancellation. It is not a rule that automatically forfeits every amount ever appearing in the credit ledger. The calculation is tied to the goods and assets covered by the Act and rules.

Category held immediately before cancellation Statutory comparison What to document
Inputs in stock Input tax credit attributable to the goods versus output tax payable, with the higher amount used for the relevant liability. Item, quantity, invoice and attributable tax-credit records.
Inputs contained in semi-finished or finished goods The relevant input-tax-credit amount versus output tax payable, with the higher amount used. Bill of materials or other support for the input content, quantities and valuation.
Capital goods or plant and machinery The Act uses the ITC taken reduced by the prescribed percentage points, or tax on the transaction value under section 15, whichever is higher. Asset register, purchase invoices, ITC taken, dates and transaction-value evidence.

The capital-goods calculation is different from the input calculation. The statute refers to a prescribed reduction and to section 15 transaction value; apply the current rules to the facts rather than using a blanket percentage or treating all assets alike. The underlying section 29 text and the GSTR-10 table are in the CGST Act and CGST Rules.

If stock invoices are missing

Where invoices for inputs in stock are unavailable, the CBIC input-tax-credit rules provide for an estimate based on the prevailing market price on the relevant date. The resulting amount is directed into output-tax liability and reported through GSTR-10. That estimate should be supported by a contemporaneous valuation record rather than an unsupported guess. See the CBIC Input Tax Credit Rules.

How payment or offset works

The cancellation and final-return forms ask for the liability and the amount to be offset from the electronic cash ledger, credit ledger or both. A ledger balance does not by itself determine the section 29(5) amount: first compute the amount attributable to the relevant stock and assets under the applicable rules, then report and settle it in the manner the form permits. The portal’s cancellation instructions describe these offset fields at Cancellation of Registration.

What records should I keep?

Cancellation does not end the need to substantiate earlier returns or the final calculation. Keep a file that allows another person to reproduce the figures:

  • the cancellation application, officer’s order and both the effective cancellation date and order date;
  • purchase invoices and tax amounts for inputs still held;
  • stock statements showing quantities in raw materials, semi-finished goods and finished goods on the relevant date;
  • capital-asset register, invoices, dates of purchase, ITC claimed and evidence of transaction value;
  • working papers showing the comparison required for each category under section 29(5);
  • filed GSTR-10, acknowledgement and payment or offset references;
  • all earlier GST returns, challans, ledgers, notices, assessments and correspondence.

The cancellation form itself asks for stock values and corresponding tax liability, so the inventory snapshot should reconcile to what was entered online.

What if I do not file my final GST return?

Non-filing does not remove the obligation. CBIC’s cancellation standard operating procedure sets out an escalation route:

  1. If GSTR-10 is not filed by its due date, the proper officer is to issue a notice in GSTR-3A.
  2. If the return remains unfiled 15 days after receipt of that notice, the officer is to issue a best-judgment assessment in ASMT-13 under section 62, using available information to determine the section 29(5) amount.
  3. If the taxpayer files the required return within 30 days of service of the assessment order, the SOP states that the assessment order is deemed withdrawn.
  4. Interest and late fee can still remain payable even when the assessment is treated as withdrawn.

The sequence comes from CBIC Circular No. 69/43/2018-GST. Current amendments, portal notices and the wording of the individual order should be checked because procedures can change.

Can a cancelled GST registration be restored?

When the proper officer cancelled registration on the officer’s own motion, the law and registration rules provide a route to seek revocation, subject to prescribed conditions and time limits. Eligibility depends on the cancellation order and the current rules.

Where cancellation followed failure to file returns, the registration rules require the outstanding returns to be filed and the tax, interest, penalties and late fees paid before a revocation application can be pursued. Revocation is therefore not a substitute for clearing the default. Review the current CBIC Registration Rules and the exact order before applying.

A practical cancellation-compliance checklist

  1. Identify the dates: record the effective cancellation date and the date of the cancellation order.
  2. List outstanding periods: identify every return, payment, notice or assessment relating to periods before cancellation.
  3. Confirm section 39 status: determine whether the cancelled person was required to file the return covered by section 45.
  4. Calculate the deadline: count three months from the later of the two relevant dates for GSTR-10.
  5. Freeze the inventory snapshot: document inputs, goods containing inputs and capital goods held on the day immediately before cancellation.
  6. Apply the right calculation: use the higher-of comparison for inputs and goods containing inputs, and the distinct statutory method for capital goods or plant and machinery.
  7. Resolve missing invoices: where permitted, support a prevailing-market-price estimate under the ITC rules.
  8. Reconcile and file: match the form to books, ledgers and payment records, preview it, submit it and save the acknowledgement.
  9. Monitor notices: respond promptly to GSTR-3A or any assessment, and do not assume cancellation ends departmental powers over earlier periods.

Important jurisdiction and timing caveat

This is a general explanation of the CGST framework, not a calculation for a particular GSTIN. State and Union Territory GST laws operate with the central law, and special taxpayer categories, amendments, notifications and portal changes can affect the filing or computation. Confirm the current form, rule and deadline for the relevant jurisdiction and cancellation order before filing.
