The answer depends on which company closes. If a business that uses Flock Safety ends its operations or its Flock agreement, the business remains the owner of its Customer Data. Flock’s current Terms and Conditions allow customer-authorized users to access and download that data through the Web Interface during the applicable Retention Period. They do not promise an automatic export at termination.
If Flock Safety itself becomes insolvent or stops operating, the public contract identifies that as a possible termination event but does not explain who would run the service, how customers would retrieve records, whether a buyer would take over, or whether data would be placed in escrow. Ownership language is helpful, but it is not a guarantee of uninterrupted access after a vendor shutdown.
First identify which company is shutting down
“A company shuts down” can describe two very different events. The data outcome, the available deadlines and the practical steps are not the same in each case.
A Flock customer closes or ends its contract
The customer’s signed agreement controls its retention period and other service terms. Flock’s Terms and Conditions state that, as between Flock and the customer, all right, title and interest in Customer Data belong to and are retained by the customer. Flock’s Evidence Policy uses similar ownership and control language for data generated through platform use.

That ownership does not mean the account stays open indefinitely. The contract says customer-authorized users can access and download Customer Data through the Web Interface during the applicable Retention Period. It does not require Flock to create an automatic end-of-contract export or to provide a different transfer channel outside that interface.
Flock Safety itself stops operating
The same agreement lists a bankruptcy petition, adjudication of bankruptcy, appointment of a receiver over all or a substantial portion of assets, insolvency, suspension of business, and cessation of ordinary business as events that can support termination. It still says the customer owns Customer Data and may access and download it during the applicable Retention Period.
However, the published terms do not describe an insolvency escrow, a mandatory successor operator, a customer-transition process, or a guaranteed post-shutdown download window. They also do not say that data automatically transfers to each customer, a purchaser of Flock’s assets or a public agency. Those unanswered operational questions matter because a contractual right is difficult to exercise if the platform is no longer available.

Customer Data remains the customer’s property
Flock’s Terms and Conditions contain this sentence: “As between Flock and Customer, all right, title, and interest in and to Customer Data belong to and are retained by Customer.” That is the clearest answer to “Who owns the footage if a business closes?” under the published contract: the customer, not Flock, owns its Customer Data.

Ownership does not override a law, a legal hold, an evidence rule, a public-records schedule, or another provision that controls preservation and disclosure. It also does not convert every item associated with an account into one undifferentiated category. Customer Data, Confidential Information, audit records and evidentiary metadata can be treated under different contractual or legal rules.
Download access is time-limited
The terms make Customer Data available to customer-authorized users through the Web Interface during the applicable Retention Period. The period is tied to the customer’s Order Form rather than to one universal number in the contract. A business that waits until its account has been disabled may lose the practical ability to use that interface even though the ownership clause still exists.
There is no promise in the published terms that Flock will proactively package all footage, metadata or other records and send them to the customer when service ends. Anyone responsible for a wind-down should therefore treat an in-account download as a required preservation task, not as an optional convenience.

Several Flock statements describe different clocks. They are not interchangeable, and the shortest or most familiar number should not be applied to every customer.

The Associated Press reported on August 13, 2026, that Flock announced a reduction in its standard retention from 30 days to seven days, with an exception for records preserved as evidence tied to a case number. The live Flock FAQ is the better source for the current stated default, while the customer’s contract determines the account-specific Retention Period.
What termination does to hardware and deletion requests
Hardware removal
Flock’s Terms and Conditions say applicable Flock Hardware will be removed within a commercially reasonable time after termination. “Commercially reasonable” is not a fixed number of days, so the customer should coordinate access, site contacts and removal logistics in writing rather than assume a particular pickup date.
Confidential Information deletion
The contract also says: “Upon termination of this Agreement, at Customer’s request, all Confidential Information will be deleted within 90 days.” The same provision preserves information Flock is required to retain under a legal obligation or policy.
That sentence has three important limits. The customer must make the request; the clock is 90 days after termination; and retention exceptions remain. It should not be rewritten as “Flock deletes all footage after 90 days.” The contract’s Customer Data access rule, the Order Form’s Retention Period, evidence preservation and legal requirements can produce a different result.

How a closing customer should preserve its records
A business or public agency preparing to close should complete these steps while authorized access is still working.
- Locate the governing documents. Find the signed Order Form, amendments, state-specific terms, retention settings and any customer records schedule. Record the Retention Period and the named account administrator.
- Identify required holds. Check for case numbers, subpoenas, litigation holds, public-records obligations, evidence rules, privacy requirements and internal retention policies. Do not request deletion of material that must be preserved.
- Appoint a wind-down authority. Decide which officer, records custodian or successor entity can authorize downloads, communicate with Flock and approve deletion. Update user access before departing employees lose their credentials.
- Download Customer Data through the Web Interface. Use customer-authorized accounts to retrieve footage and associated data that the organization is entitled to retain. The contract does not promise another export method, so do not wait for Flock to send one automatically.
- Verify the copy. Keep a record of the download date, account used, camera or case scope and any available metadata. Open a sample of the files and confirm that the downloaded material is readable before decommissioning the account.
- Protect the exported records. Store them in an access-controlled location with encryption, an integrity or chain-of-custody process where evidence rules require it, and a documented retention owner. Ownership does not remove the organization’s privacy and security duties.
- Make a written deletion request if appropriate. If the organization wants Flock to delete Confidential Information after termination, send a dated request through the contract’s designated contact and identify the agreement. Ask Flock to confirm the effective termination date and any information it must retain under law or policy.
- Document the closeout. Preserve correspondence, download logs, hardware-removal arrangements, the final user list and the reason for retaining or deleting each category. This record helps a successor explain what happened if a request arrives later.
What is and is not known if Flock shuts down
What the published terms establish
- The customer owns Customer Data.
- Authorized users may access and download it during the applicable Retention Period.
- Flock may terminate for listed insolvency and cessation-of-business events.
- Applicable hardware is to be removed within a commercially reasonable time after termination.
What the published terms do not establish
- No public commitment guarantees an escrow copy for every customer.
- No public procedure names a successor operator or requires a buyer to keep the platform online.
- No public schedule states how long customers would have to retrieve data after an abrupt vendor shutdown.
- No provision says ownership alone forces an automatic transfer of records to each customer.
Consequently, a customer should not assume that a bankruptcy court, purchaser or government agency will provide a working download portal. The prudent protection is to maintain authorized exports during normal service and to ask procurement or legal counsel whether the organization needs additional continuity, escrow or transition terms in its own agreement.

Flock’s FAQ says images and metadata are encrypted throughout their lifecycle. It identifies AWS cloud storage and KMS-based encryption, and says CJIS data is stored in AWS GovCloud and made available only to law-enforcement agencies. These are storage and access-control descriptions; they do not create a vendor-insolvency recovery plan.

Flock’s Privacy Policy also reserves access, preservation and disclosure in circumstances involving legal process and specified safety, security, fraud or technical concerns. That is why an absolute statement such as “all records disappear on day seven” is unsafe. A record can be preserved under a case number, a legal obligation, a policy exception or a jurisdiction-specific rule.

For a specific account, the signed contract and Order Form should be read together with applicable public-records, evidence, privacy and records-retention law. The 90-day Confidential Information clause is a contractual observation, not legal advice, and it cannot eliminate a duty to preserve records.
Practical answers to common shutdown questions
Can a company get its footage before the account closes?
Yes, the contract allows customer-authorized users to access and download Customer Data through the Web Interface during the applicable Retention Period. The safest time is before termination, while administrators and authorized users can still sign in. The terms do not promise an automatic export or a replacement transfer channel.
Does Flock delete camera data exactly 90 days after termination?
No. Ninety days applies to deletion of Confidential Information when the customer requests it, subject to legal and policy exceptions. Customer Data follows the applicable Retention Period and other preservation rules; the contract does not establish a universal 90-day deletion date for every camera record.
Is seven days the retention period for every customer?
No. Seven days is the current FAQ’s stated default for device data, accessed October 13, 2026. The Order Form, state or municipal law, approved law-enforcement extensions and evidence-preservation rules can require a different period.
Does customer ownership guarantee recovery if Flock becomes insolvent?
No. Ownership defines the customer’s contractual interest, but the public terms do not guarantee a successor, escrow, uninterrupted operation or a post-shutdown export window. Recovery depends on access to the platform, the complete agreement and any applicable insolvency or legal process.
