If your home does not sell, a listing-preparation or bridge loan normally remains your debt. The signed note and related agreements—not the failed listing—set the maturity date, payment schedule, interest, fees, collateral, extensions and default remedies. Some providers publish a separate fallback, such as an option to sell the home to the provider, but that feature is contract-specific and is not a standard rule for all bridge loans.
The short answer: the loan usually still comes due
A listing-preparation loan is financing. Listing the property, reducing the asking price or failing to receive an acceptable offer does not automatically cancel, postpone or convert that debt into a sale to the lender. Unless your documents say otherwise, you remain responsible for the balance and all charges that continue to accrue.
The critical dates and remedies are in the signed promissory note, mortgage or deed of trust, and any separate preparation, listing, extension or purchase-offer agreement. Read those documents together. A marketing brochure or an agent’s explanation cannot replace the terms you signed.
| Question | Where the answer normally appears |
|---|---|
| When must the balance be paid? | Note, maturity clause and payment schedule |
| Does interest continue while the property is listed? | Interest and fee provisions in the note |
| What secures the debt? | Mortgage, deed of trust or security agreement |
| Can the due date be extended? | Extension clause or a separate written agreement |
| What happens after a missed payment? | Default, acceleration and enforcement clauses |
| Is there a provider purchase option? | Separate purchase-offer agreement and its conditions |
Possible outcomes when a listing expires or stalls
You sell later and repay from closing proceeds
If the home sells after the original marketing period, the settlement agent generally uses the proceeds to pay liens and the loan according to the payoff instructions. Ask for a current payoff quote rather than estimating from the original advance. Interest, servicing charges, extension fees and other permitted costs can change the amount.

You obtain a written extension
Some lenders will extend maturity after reviewing the property, your finances and the marketing plan. An extension may change the interest rate, add a fee, require an appraisal or impose a new sale deadline. It is not effective merely because a representative says it is available; obtain the approval and revised terms in writing before the original due date.
You refinance or use another source of funds
A refinance, home-equity loan, personal loan or other financing may repay the listing loan. Compare the new loan’s total cost, payment, collateral and maturity with the existing obligation. A lower monthly payment can still cost more if it extends repayment or carries substantial origination charges.
You exercise a contractual purchase fallback
A provider may have offered to purchase the home if it does not sell. That option can have a deadline, valuation formula, inspection requirement, listing-history requirement and rules for existing mortgages or other liens. Determine the net amount you would receive after the purchase price, payoff of liens, fees and adjustments. An option is not necessarily a guaranteed price or a promise that every balance will be covered.

You miss the due date or default
If you do not pay as required and no written workout is in place, the lender may assess late charges, declare the loan in default or accelerate the balance. If the debt is secured by a home, enforcement can ultimately involve foreclosure or another state-law remedy. A sale that fails does not prevent those contractual remedies.
What one named provider says: Knock’s six-month purchase option
Knock describes its Bridge Loan as financing intended to help sell an old home while buying another. Its FAQ says that if the home has not sold on the market within six months, the customer has the option to exercise an upfront Knock Purchase Offer. The FAQ’s wording is: “On the off chance the home doesn’t sell on the market, you’ll have the option to exercise the Knock Purchase Offer that we provide up front.”
That is a company-specific description, not a market-wide feature. It does not establish that every borrower qualifies, that the option is offered in every location, or that it covers every loan balance and closing cost. Check the executed offer for the valuation method, acceptance deadline, listing and preparation duties, treatment of liens, and the amount that would remain after payoff.

Those are current published descriptions; your approval, state availability and signed documents control.

What federal rules do—and do not—decide
The temporary bridge-loan ability-to-repay exemption
Regulation Z, at 12 CFR 1026.43, exempts a qualifying temporary or bridge loan with a term of 12 months or less from specified ability-to-repay requirements in sections 1026.43(c) through (f). The CFPB’s example includes financing a new dwelling when the borrower plans to sell a current dwelling within 12 months.

This is a qualification rule for a category of credit. It is not debt forgiveness, an automatic extension or a rule that sets your payoff date. Whether a particular product fits the exemption depends on its actual structure, term and governing law.
The general ability-to-repay rule
For covered transactions, the CFPB says a creditor generally must make a reasonable, good-faith determination at or before closing that the consumer can repay according to the loan terms. The rule also says the assessment cannot rely on an assumption that the consumer can repay only by later refinancing or selling the property securing the loan. These provisions do not provide an individualized answer for a particular listing-preparation product, and exemptions may apply.

Send the request early, identify the loan and property, and ask for the amount good through a specific date. Keep proof of delivery and the response.

Closing documents create the obligation
The Federal Trade Commission explains that consumers receive a Loan Estimate after applying for a mortgage and a Closing Disclosure before closing. The Closing Disclosure shows final terms, projected payments, fees and other costs. Review discrepancies before signing. The FTC also states: “Once you sign, you get the mortgage loan proceeds — and you’re now legally responsible to pay back the loan.”

- Promissory note: Find the principal, interest calculation, payment dates, late charges, maturity date, prepayment rules and events of default.
- Mortgage or deed of trust: Confirm whether the old home, new home or both secure the debt, and identify recording, lien-priority and foreclosure provisions.
- Preparation agreement: Look for spending limits, approved contractors, reimbursement rules and obligations to complete work before listing.
- Listing agreement: Check required listing price, agent, marketing period, showing access and reporting duties. Failure to follow these terms may affect a fallback offer.
- Purchase-offer agreement: Determine whether the offer is optional or mandatory, how the price is calculated, when it expires, and how mortgages, taxes, commissions and other liens are deducted.
- Extension or workout terms: Identify who can approve an extension, the required notice period, added cost and whether approval must be signed by a specified officer or servicer.
What to do if the home is still unsold near maturity
- Request a written payoff quote. Ask for the principal, interest through a stated date, fees, per-day interest, wire or payment instructions and the quote’s expiration.
- Contact the lender or servicer before the due date. Explain the listing status and request written details of an extension, repayment plan, refinance process or other workout.
- Ask about every contractual fallback. If a purchase offer exists, request the current net-price calculation and a list of required documents, inspections and deadlines.
- Protect the property and listing. Keep insurance, taxes, utilities, maintenance and agreed preparation work current. A neglected property can reduce sale proceeds and may violate the agreement.
- Compare replacement financing carefully. Obtain several written offers and compare total repayment, collateral, maturity, fees and consequences of another failed sale.
- Get professional help when the numbers do not work. A HUD-approved housing counselor, qualified budget counselor or real-estate attorney can review options. An attorney is especially important when foreclosure, a deficiency balance, bankruptcy or disputed lien priority is possible.
How to compare an extension, refinance and provider purchase
| Option | Key advantages | Questions and risks |
|---|---|---|
| Extension | May preserve the current sale plan without a new loan. | What is the new maturity, fee, rate and approval deadline? Does interest continue to accrue? |
| Refinance or replacement loan | Can replace a looming balloon payment with a longer schedule. | What is the total cost, new collateral, prepayment charge and ability to repay if the home remains unsold? |
| Provider purchase offer | May create a defined exit if market marketing has failed. | Is the option available in your market? How is net price calculated, and what liens or costs reduce proceeds? |
| Private sale after the original deadline | Could produce a better price than an immediate fallback. | How will the loan be kept current during the extra marketing time, and will the lender consent? |
Use the same assumptions when comparing choices: expected sale price, commissions, taxes, repairs, accrued interest, payoff date and cash you would receive. A higher headline price can leave less cash after liens and fees.
Common mistakes that make the situation worse
- Assuming the lender will wait: Silence is not an extension. A missed maturity date can trigger default even while negotiations are underway.
- Relying on an agent’s promise: Only the lender or authorized provider can amend loan terms, and the amendment should be written.
- Confusing a resale guarantee with loan forgiveness: A promise about resale proceeds does not necessarily change the amount or date owed under the note.
- Ignoring daily accruals: Interest and servicing charges can continue until funds are received and the lien is released.
- Waiting to request the payoff: A quote may take time to obtain, and its amount changes after the stated good-through date.
- Taking expensive emergency credit: Compare annual cost, fees, collateral and default remedies instead of focusing only on the payment.
A practical decision checklist
- Write down the maturity date, next payment date and the amount currently due.
- Mark the earliest date an extension or purchase option must be requested.
- Obtain a payoff quote valid through a date that matches your expected closing or refinancing.
- Calculate realistic net sale proceeds after the first mortgage, listing commission, taxes, preparation costs and the listing-preparation loan.
- Ask the lender to state in writing what happens if the home is unsold on the maturity date.
- Verify whether a proposed buyer or fallback purchaser will accept existing liens and who pays transfer costs.
- Escalate promptly to a housing counselor or attorney if you receive a default notice or cannot cover the projected payoff.
What is not known without your contract
No general statistic establishes how often listing-preparation loans end in repayment, extension, foreclosure or lender purchase. Outcomes vary by product, state, borrower finances, property value and contract language. The exact deficiency, lien-release, foreclosure and tax consequences cannot be determined from the fact that a home failed to sell. Obtain the executed agreements and current servicing information before choosing a response.
