If you cannot pay the GST appeal pre-deposit, financial hardship alone generally does not remove the statutory filing condition. For a first appeal under section 107 of the Central Goods and Services Tax Act, 2017 (CGST Act), you normally must pay the amount you admit and the prescribed percentage of the remaining disputed tax before the appeal can be entertained.
The position can change where the issue is not lack of funds but a different legal question—for example, whether a penalty-only amendment applies to the proceeding, or whether you put money into the electronic cash ledger but a debit or payment step failed. Those situations require a separate analysis. This is general information as at 13 October 2026, not advice on an individual appeal.
The basic rule under section 107(6)
Section 107(6) makes payment a condition of filing a first GST appeal. The Delhi High Court has reproduced the provision beginning: “No appeal shall be filed under sub-section (1), unless the appellant has paid–”. In practical terms, the appellant must deal with two amounts:
| Amount | What it covers | When it is relevant |
|---|---|---|
| Admitted amount | The full tax, interest, fine, fee and penalty that the appellant admits as payable | Payable in full before filing |
| Statutory pre-deposit | A percentage of the tax still disputed | Required for the disputed portion, subject to the statutory ceiling applicable to the appeal |
The materials reviewed report the ordinary disputed-tax percentage as 10 per cent. The GST Council’s 55th-meeting agenda records that amendments made by the Finance (No. 2) Act, 2024 took effect on 1 November 2024 and reduced the disputed-tax pre-deposit to 10 per cent. Check the consolidated text in force for the relevant order before calculating the amount; the applicable ceiling is not established in the material available here and should not be assumed.

Payment of the pre-deposit does not concede the remaining dispute. It is a statutory condition intended to obtain a stay-related protection and access to the appellate process, while the balance of the demand remains contested.
What non-payment usually means
When a required deposit has not been paid, the first appeal may not be entertained on its merits. The defect is not normally treated as a minor procedural omission that an appellate authority can waive simply because the taxpayer is under financial pressure.
Impressive Data Services: hardship was not treated as a waiver
In Impressive Data Services, the taxpayer argued that the demand was wrong and referred to substantial receivables and securities held by government entities. The Delhi High Court considered whether section 107(6)’s deposit condition could be excused; it did not decide the underlying tax dispute in that petition. The decision is important because it frames inability to pay as a request to waive a statutory condition, not as an automatic ground for bypassing it.

Jiolat Auto Gas Industries: mandatory deposit, limited liberty
In Jiolat Auto Gas Industries, the petitioner sought waiver of the mandatory 10 per cent deposit. The Delhi High Court dismissed the waiver request, describing the deposit as mandatory. The court nevertheless left the petitioner free to approach the appellate authority for relief in terms of observations made in Impressive Data Services. That procedural liberty should be read narrowly: it does not establish that financial hardship entitles every taxpayer to a waiver, nor does it promise that alternative relief will be granted.
First identify which kind of order you are appealing
“I cannot pay the pre-deposit” is not enough information to determine the legal position. Before deciding what to do, classify the order and the payment history.
| Question | Why it matters | Evidence to collect |
|---|---|---|
| Does the order demand tax, or impose only a penalty? | Penalty-only appeals have a separate statutory proviso and transition issues. | Order, show-cause notice and adjudication record. |
| How much do you admit? | Admitted tax, interest, fine, fee and penalty must be paid in full. | Written grounds of appeal and a reconciliation of the order. |
| Was money actually paid toward the pre-deposit? | A ledger or debit failure can be a curable procedural issue in a particular case. | Challan, electronic-liability register, cash-ledger entry, debit record and portal acknowledgments. |
| What are the relevant dates? | The law changed for penalty-only cases, and transition depends on the proceeding’s history. | Show-cause notice date, order date, communication date and attempted-payment date. |
Penalty-only orders and the 1 October 2025 change
The ordinary 10 per cent disputed-tax rule should not be applied mechanically to an order that imposes a penalty without a tax demand.

What changed
The GST Council’s 55th-meeting agenda records a recommendation to add a 10 per cent deposit for penalty-only orders. In its 31 July 2026 judgment in Gaurav Jain, the Delhi High Court described the substituted proviso to section 107(6) as effective from 1 October 2025. The judgment states that the amendment introduced a 10 per cent penalty deposit for penalty-only cases and reduced the section 129(3) penalty deposit from 25 per cent to 10 per cent.

In Gaurav Jain, the court held that the new penalty-only requirement did not govern the petitioners’ appeals because their adjudicatory proceedings began with show-cause notices dated 25 June 2025. The ruling was tied to those facts and the transition issue before the court. It is not a blanket exemption for every proceeding that began before 1 October 2025.
For a penalty-only order, compare at least the notice date, the order date and the date on which the appeal requirement is being applied. The court also made clear that admitted amounts remained payable. A taxpayer cannot treat the transition argument as eliminating an admitted liability.

Attempted payment is different from inability to pay
The strongest distinction in the available decisions concerns a taxpayer who tried to fund the pre-deposit but did not complete the required debit.
Ssukrit Forwarding Agency: cash ledger funds and a payment defect
In Ssukrit Forwarding Agency, the appellant had deposited funds into its electronic cash ledger but had not debited the amount as the appeal pre-deposit. The Jharkhand High Court considered that the record could show a procedural glitch rather than complete non-payment. It held that natural justice and fair play required notice of the defect and a reasonable opportunity to cure it before dismissal.
This decision does not create a hardship exception. It addresses a taxpayer who had put funds into the system and then failed to complete, or was unable to complete, the prescribed debit. A taxpayer with no funds at all cannot rely on the case as proof of an automatic waiver.

What to do when you cannot fund the deposit
- Obtain and read the complete order. Record the tax, interest, fine, fee and penalty amounts separately. Confirm the date and method of communication because the applicable appeal period and portal workflow depend on the current statutory text and the facts of the order.
- State the admitted amount precisely. Do not describe the entire demand as disputed if any component is admitted. Prepare a written reconciliation showing what is admitted and what is challenged.
- Classify the disputed component. Decide whether it is an ordinary tax demand, a penalty-only order, a section 129(3) matter, or a payment-process failure. The percentage and transition analysis may differ.
- Calculate the deposit under the law in force for that appeal. For ordinary disputed tax, the materials report 10 per cent from 1 November 2024, subject to the applicable ceiling. For a penalty-only order, examine the substituted proviso effective from 1 October 2025 and the proceeding’s dates.
- Check the electronic records before concluding that payment failed. Match the challan, cash-ledger credit, debit entry, liability register and appeal acknowledgment. If money was credited but not debited, preserve screenshots and transaction references and raise the defect promptly.
- File any appeal or application in the form and time allowed by the current section 107 procedure. The material used for this article does not independently verify the current limitation rule, so confirm the consolidated Act, applicable rules and the order’s communication date rather than relying on an assumed number of days.
- Present a hardship request as a carefully framed legal request, not as an assumed entitlement. Explain the cash-flow facts, available assets, attempted payments and the precise statutory or procedural ground relied on. The Delhi decisions do not recognize financial hardship alone as a general waiver basis.
- Obtain case-specific professional advice quickly. A GST practitioner or advocate can test whether the issue is a transition question, a payment defect, jurisdictional error or another ground that may support relief. That is different from asking the authority to disregard section 107(6) solely because the taxpayer lacks funds.
When a High Court petition may be relevant
A writ petition can raise a distinct legal error, but the decisions summarized here do not support using writ review as a routine substitute for paying the statutory deposit. The petition should identify the legal basis for intervention: for example, an amendment- transition problem supported by the record, a portal or debit defect after funds were made available, or another recognized public-law error.
Simply repeating that the assessment is wrong, the business has receivables, or payment would cause hardship does not convert the statutory condition into a discretionary one. The court may examine whether the authority applied the correct law, but that is different from granting a general financial-hardship waiver.
Common mistakes that lead to avoidable rejection
- Confusing a cash-ledger credit with a completed pre-deposit. Funds sitting in the ledger may not satisfy the requirement if the prescribed debit was never made.
- Using the wrong base amount. The ordinary calculation concerns the disputed tax after the admitted amount is dealt with; it is not automatically a percentage of every figure printed in the order.
- Ignoring penalty-only wording. An order with no tax demand may fall under the substituted proviso rather than the ordinary disputed-tax calculation.
- Relying on a notice date without checking the whole procedural history. The Gaurav Jain transition holding depended on the particular show-cause notice and proceedings before the court.
- Assuming a hardship paragraph preserves the appeal. A request for financial relief does not itself complete the statutory filing condition.
- Waiting until the appeal is rejected to investigate the portal record. Download and preserve every payment, ledger and acknowledgment record as soon as the transaction is attempted.
How to frame the issue for a decision-maker
A clear application or petition should answer four questions in this order:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- What is the order type? Identify tax demand, admitted dues, penalty-only liability or another category.
- What does the statute require for this order and date? Cite the version of section 107(6) and, where relevant, the 1 November 2024 or 1 October 2025 change.
- What actually happened to the money? Distinguish no funds, funds credited but not debited, a rejected transaction, and a debit that was completed but not reflected.
- What legal remedy is being requested? Ask for correction of a payment record, an opportunity to cure a procedural defect, or review of a transition/legal error. Do not describe a general hardship request as if it were an established exemption.
That structure helps the authority distinguish a statutory non-compliance case from a curable portal problem or a genuine dispute about which version of the law applies.
Bottom line for taxpayers
Under the decisions and amendment dates available as at 13 October 2026, inability to pay by itself does not ordinarily remove the section 107(6) pre-deposit condition. Pay the admitted amount, determine the correct deposit for the order type and applicable date, and verify every electronic payment step. If funds were made available but the debit failed, or if a penalty-only transition issue changes the calculation, focus the challenge on that specific legal or procedural ground rather than presenting hardship alone as a waiver.
