A rejected permit does not automatically end a data center project. In England, the developer normally has three practical choices: change the proposal and submit a revised planning application, appeal the refusal within the applicable deadline, or stop pursuing the site. Which route makes sense depends on the refusal reasons, the evidence available, the development plan and the project’s commercial case.

An appeal is not a second chance to submit an unrelated or substantially improved scheme. If new evidence or amendments are what could overcome the objections, the Planning Inspectorate’s current procedural guidance directs applicants toward a revised application. The exact rules differ outside England, so the decision notice and the rules for the relevant planning system must come first.

What a refusal actually means

A planning refusal means the local planning authority has decided that the application, as submitted, should not receive permission. It does not by itself decide whether the land can never host a data center, whether a different design would be acceptable, or whether the developer must abandon the project. Those questions require a separate assessment.

In England, the authority assesses a proposal against the development plan and other material planning considerations. The official overview identifies matters that can include the building’s size, layout, siting and appearance; infrastructure such as roads and water supply; landscaping; the intended use; and effects on the surrounding area, including increased traffic. A data center may raise additional technical issues, but there is no universal list of data-center-specific refusal reasons established by the official material. The refusal notice is therefore the controlling document.

The three routes available after refusal

1. Redesign and submit a revised application

If the refusal reasons can be addressed by changing the scheme or supplying better supporting material, the developer can work with the local planning authority and make a new application. Typical changes might involve the building envelope, site layout, landscaping, access arrangements, traffic mitigation, water infrastructure or the way the use is described, but the necessary changes must be derived from the actual decision notice and applicable policies rather than assumed data-center objections.

A revised application is the route for a materially changed proposal or for new evidence that is intended to overcome the refusal. It starts a new planning assessment. The authority will validate the submission, consult as required and determine it under the rules and timetable that apply to that application type. A revised application still can be refused; changing the drawings or adding reports does not create an entitlement to permission.

2. Appeal the refusal

An applicant may appeal when there are sound grounds for challenging the refusal. The appeal decision-maker examines the planning merits, relevant policy and the circumstances of the case. An appeal can be allowed or dismissed, and the decision-maker can refuse permission for reasons different from those stated by the local authority.

The current England procedural guide makes an important distinction: an appeal should not be used simply to introduce a better version of the project. For applications submitted on or after 1 April 2026, the guide says that where an applicant believes an amendment or new evidence would overcome the refusal, the applicant should submit a revised planning application instead. The amount of new evidence that can be introduced at appeal depends on the procedure. It is generally limited in the expedited Part 1 written-representations route, except where there has been an exceptional material change in circumstances.

3. Stop pursuing the proposal

The developer can decide that redesigning or appealing is not commercially worthwhile and discontinue the project. This is a business decision, not an automatic planning consequence of refusal. The available evidence does not establish a reliable statistic showing how many rejected data centers are redesigned, win an appeal, are abandoned or are eventually built.

Revised application or appeal?

The choice should be made by matching the remedy to the refusal, not by assuming that one route is always faster or more likely to succeed.

Question Revised planning application Appeal
Does the scheme need to change? Yes, where changes or new supporting material are intended to address the refusal. Not necessarily; the case challenges the refusal on its planning merits, subject to the appeal rules.
What must the applicant show? That the amended proposal complies with policy and resolves the identified harms or deficiencies. That the refusal should be overturned on the evidence and policies applicable to the application.
Deadline A new application has no appeal deadline; it follows the authority’s application and validation process. Deadlines vary by application type. Most England appeals must be received within six months of the decision notice, but shorter periods apply to some cases.
Evidence The new submission is the opportunity to provide the amendments and supporting reports needed for the changed scheme. Evidence and amendments are controlled by the selected appeal procedure. Part 1 written representations generally restrict new evidence.
Who decides? The local planning authority determines the new application. Usually a Planning Inspector; a recovered appeal can be decided by the Secretary of State.
Main uncertainty The revised scheme may still conflict with policy or create impacts the authority considers unacceptable. The appeal may be dismissed, or the decision-maker may identify different refusal grounds.

The GOV.UK appeals guidance and the Planning appeals procedural guide should be checked before selecting a route. They do not guarantee permission or a particular outcome.

How to evaluate the refusal before acting

Read the decision notice line by line

List every reason for refusal, the policy wording cited for each reason and any requested mitigation. Separate a fundamental policy conflict from a missing document or a design issue that could plausibly be corrected. Do not rely on a summary from a meeting, press report or consultant presentation when the formal notice says something else.

Map each reason to evidence

For each refusal reason, identify whether the developer has evidence that already answers it, needs a new technical study, or would have to alter the project. For example, a traffic objection may require a different access plan or additional mitigation; a landscape objection may require a changed massing strategy; an infrastructure concern may require confirmed capacity or a different servicing design. These are examples of analytical categories, not a standard list of data-center refusal grounds.

Check the development plan and material considerations

The authority’s decision should be read alongside the adopted development plan and any policies it relied on. A revised design that solves a localised impact can still fail if the proposed use conflicts with a strategic policy. Conversely, an appeal may succeed where the authority misapplied policy or gave insufficient weight to material considerations, but that conclusion requires a case-specific planning argument.

What happens in an England planning appeal

Submit within the correct time limit

Most England planning appeals must be received within six months of the date on the decision notice. Some application types have shorter periods, and a 28-day period can apply in specified cases involving enforcement notices. The deadline is not safely inferred from the project’s size or from another appeal. Check the decision notice and the current GOV.UK guidance immediately; an out-of-time appeal may not be accepted.

The Planning Inspectorate selects the procedure

The Planning Inspectorate may determine an appeal by written representations, a hearing or an inquiry. The updated guide says that most eligible appeals concerning applications submitted from 1 April 2026 use the Part 1 written-representations procedure, although some appeals can be transferred to another procedure.

Written representations normally rely on the application, the authority’s statement and the parties’ written cases. A hearing allows the inspector to explore issues directly with participants. An inquiry is the most formal route and is used where testing evidence and cross-examination are necessary. The procedure affects what evidence can be filed, when it must be filed and how interested parties can participate.

Interested-party comments depend on the procedure

Under Part 1 written representations, existing representations made at the application stage are forwarded to the appeal. The current guidance says further representations are not accepted at the appeal stage under that procedure. A hearing or inquiry can have different arrangements, so participants should follow the case-specific instructions issued by the Planning Inspectorate.

The outcome can differ from the local authority’s reasoning

An inspector considers the planning merits rather than conducting a simple procedural check on the council’s wording. The appeal can be allowed or dismissed, and permission can be refused on grounds that were not in the original decision notice. An appeal therefore requires a complete merits case, not only an argument that the authority made a mistake on one paragraph.

Appeal timing and published performance targets

The Planning Inspectorate’s guidance, updated 2 April 2026, states targets of 98% of written-representation appeals being decided within 16 to 20 weeks and 98% of hearings and inquiries within 24 to 26 weeks, with work toward those targets by 2027. These are service targets, not guarantees and not statistics about how many data-center projects obtain permission after refusal. The actual timetable can change with the procedure, the complexity of the evidence, procedural directions and other case circumstances.

The procedural guide for applications dated on or after 1 April 2026 was published on 12 February 2026 and updated on 16 July 2026. Older applications can be governed by the previous guide. Confirm which guide applies before relying on an evidence rule or timetable.

Costs, risk and commercial consequences

An appeal consumes planning, legal, technical and project-management resources. A revised application also requires new drawings, reports, consultation and professional work. Neither route guarantees permission, and a delay can affect land-control periods, grid or utility arrangements, financing, procurement and customer commitments.

The England guidance warns that parties who pursue an appeal unreasonably and without sound grounds may face an award of costs. That risk is separate from the ordinary cost of preparing the appeal. A developer should therefore document the planning basis for each ground, identify the evidence supporting it and avoid using the appeal merely to delay or to introduce a scheme that should have been submitted as a new application.

A practical decision framework for developers

  1. Secure the dates. Record the decision date, the date the notice was issued and the last possible appeal date shown by the applicable rules.
  2. Extract the refusal reasons. Copy each reason and the policies cited, then distinguish policy conflicts from remediable design, evidence or mitigation issues.
  3. Test whether the project can change. Ask whether the required changes preserve the site’s power, cooling, access, security, resilience and commercial assumptions. If not, the project may need a fundamentally different site or concept.
  4. Seek clarification from the authority. England guidance encourages applicants to re-engage with the local planning authority about whether changes could make the proposal acceptable. Such discussions do not extend an appeal deadline.
  5. Choose the correct submission. Use a revised application when amendments or new evidence are the solution. Use an appeal when the submitted scheme is defensible and the refusal is considered wrong on planning merits.
  6. Build a complete evidence plan. Assign every refusal reason to a drawing, report, policy analysis or mitigation commitment. Do not assume that material omitted from the application can automatically be added at appeal.
  7. Model the commercial downside. Compare professional fees, delay, land and infrastructure commitments, financing exposure and the probability that the authority or inspector will still refuse permission.
  8. Make a stop decision deliberately. If the required redesign destroys the project’s economics or the planning conflict cannot realistically be resolved, document the decision to withdraw rather than allowing costs to accumulate.

What this means outside England

Planning and permit systems differ by country and can also differ by permit type. The appeal deadlines, decision-makers, evidence rules and procedures described above are for England planning permission. They should not be presented as universal data-center rules.

Scotland has a separate planning system. A Scottish Government Directorate for Planning and Environmental Appeals record concerns a proposed green data center, but the accessed case record does not establish the outcome. It therefore cannot be used to infer that a Scottish project was approved, refused or redesigned. Developers in Scotland, Wales, Northern Ireland or another country must use the relevant jurisdiction’s notice and guidance.

Questions a refusal does not answer by itself

  • Is the site permanently unusable? No. The refusal applies to the submitted proposal; a different application may be assessed separately.
  • Will an appeal automatically reopen the application? No. It is a merits procedure with its own evidence and timetable rules.
  • Can the developer add a better design during the appeal? Not as a general substitute for a revised application. The current England guide directs applicants to submit a revised application when amendments or new evidence would overcome the refusal.
  • Does a fast appeal target mean the data center will be built within that period? No. The published percentages and weeks are Planning Inspectorate service targets for deciding appeals, not construction or project-success measures.
