If a crypto custodian is hacked, fails financially, or stops allowing withdrawals, you may lose access to some or all of your assets—and recovery is not guaranteed. What happens depends on the custodian’s legal entity and jurisdiction, your agreement, how customer assets were held and recorded, and the law that applies. This article focuses on U.S. protections; rules and outcomes can differ elsewhere.
What can happen in each situation?
| Situation | What it may mean for customers | What is not established by the event alone |
|---|---|---|
| Hack or security breach | Assets may be stolen, or you may lose access to the account or wallet. | Whether the assets can be recovered, who bears the loss, or whether anyone will reimburse customers. |
| Insolvency or bankruptcy | Withdrawals may stop while a court, trustee, receiver, or estate determines which assets belong to customers and which belong to the firm or its creditors. | Whether customers can reclaim particular assets, how much they may recover, or how long the process will take. |
| Outage, withdrawal pause, or other unavailability | You may be unable to access or move assets while the service is unavailable. | Whether the cause is technical, regulatory, financial, or security-related—or when access will return. |
A service being unavailable does not by itself prove that assets were stolen or that the custodian is insolvent. Conversely, an account balance displayed by a platform does not alone establish what rights you would have in an insolvency. The contract, records, asset arrangements, and applicable law matter.
If the custodian is hacked
A breach might involve stolen private keys, compromised internal systems, or theft of assets, but an incident’s cause and consequences are specific to the custodian and event. Customers may lose access or assets, and there is no general promise that the firm, law enforcement, an insurer, or the government will make them whole.

What to do after a suspected breach
- Contact the custodian through an official channel that you verify independently, such as an address or phone number obtained from a source you already trust.
- Secure remaining accounts and credentials. Change passwords where appropriate, enable available account protections, and do not share a seed phrase, private key, password, or authentication code with anyone claiming to restore access.
- Save account statements, transaction IDs, wallet addresses, screenshots, notices, and communications. Keep copies in a secure location; these records may help establish what happened and support a complaint or claim.
- Report suspected theft to the relevant authorities. Reporting may help document the incident, but it does not guarantee recovery.
If the custodian becomes insolvent
Insolvency can combine a legal dispute over ownership with a practical delay in access. A proceeding may need to establish which assets are customer property, which belong to the firm, and what claims creditors or other customers have. Even when assets are determined to belong to customers, they may remain inaccessible while the matter is resolved.
The outcome can turn on the custody agreement, the firm’s records, whether assets were segregated, the customer’s property interest, whether the firm could use or lend the assets, how the assets are legally characterized, and the jurisdiction. Segregation can be important, but it does not by itself guarantee immediate return or a particular recovery.
How SIPC and securities rules may apply
SIPC generally addresses customer claims for securities entrusted to a SIPC-member broker-dealer; it is not blanket insurance for crypto losses. SEC Division of Trading and Markets staff guidance says SIPC generally does not protect custodial claims for non-security crypto assets, even where a SIPC-member broker-dealer holds them. Do not assume a token is a security or that a brokerage relationship makes every crypto asset eligible for securities protections.

The SEC staff FAQ describes one possible contractual approach: a broker-dealer and customer may agree to treat non-security crypto as “financial assets” carried in a securities account under Article 8 of the Uniform Commercial Code. Staff says this could help ensure the assets do not become part of the broker-dealer’s estate. But non-security crypto is not protected by SIPA and may lack another specific insolvency regime. These are staff views, not a binding determination for every account; the FAQ also says staff responses have no legal force or effect.
If the custodian is unavailable or pauses withdrawals
A technical outage, operational pause, regulatory freeze, security response, or insolvency can each prevent withdrawals, but they are different situations. Without reliable information about the particular custodian and cause, it is not possible to predict when withdrawals will restart or whether assets are missing.
- Check official company notices and relevant regulator notices for the stated reason, affected services, and any instructions.
- Keep copies of notices, account records, and attempted withdrawal details, including dates and transaction information.
- Do not send recovery phrases, private keys, passwords, or authentication codes to anyone who contacts you claiming they can restore access. The FTC warns that a platform shutdown may leave customers without help recovering funds.
What FDIC insurance does—and does not—cover
FDIC deposit insurance protects eligible deposits held at an insured bank if that bank fails. It does not insure crypto assets, and it does not protect customers against the insolvency or bankruptcy of a non-bank crypto custodian, exchange, broker, wallet provider, or similar company. A crypto service’s banking relationship, or a claim that it uses a bank, does not make crypto an insured deposit.

What to check before choosing a custodian
Read the custody agreement and look for specific answers, rather than relying on the words “custody,” “wallet,” or “insured” in marketing. Check the exact legal entity that holds assets and the jurisdiction governing the agreement.
- Ownership and records: Does the agreement explain the property interest you retain? How are customer assets and balances recorded?
- Segregation: Are customer assets kept separate from the custodian’s own assets and from other customers’ assets? What records show that separation?
- Use of assets: May the firm lend, pledge, transfer, or otherwise use your crypto? Is the arrangement custody only, or does it involve lending or an earn program?
- Sub-custody: Does the firm rely on another custodian? If so, who holds the assets and under what arrangement?
- Access and failure procedures: What does the agreement say about withdrawals, service interruptions, and insolvency?
- Legal framework: Which jurisdiction and insolvency rules may apply, and what process is described for customer claims?
New York State Department of Financial Services guidance dated September 30, 2025 says covered virtual currency entities should take possession of customer assets for the limited purpose of custody and safekeeping, without creating a debtor-creditor relationship. It also expects clear disclosure of segregation and accounting, the customer’s retained property interest, and limits on use of customer virtual currency. This guidance applies within NYDFS’s scope; it is not a nationwide rule.

Broader policy discussion is not the same as a binding customer protection. In April 2025, SEC Commissioner Crenshaw’s roundtable remarks identified insolvency, hacking, blockchain-specific risks, and investor disclosure as custody policy questions. In July 2025, the FDIC, Federal Reserve Board, and OCC reminded banks to manage crypto-asset safekeeping safely and follow existing laws; the agencies said their joint statement created no new supervisory expectations.
Would self-custody avoid the custodian risk?
Self-custody reduces reliance on a third party to control the private keys, but it makes you responsible for protecting those keys and recovery information. SEC Investor.gov explains that wallets may generate a seed phrase, also called a seed recovery phrase or mnemonic phrase, and warns that losing access credentials can result in losing crypto.

It also cannot reverse an on-chain transfer or resolve a claim against a custodian for assets that the custodian holds. Anyone who obtains a recovery phrase may be able to control the associated assets, so treat it as highly sensitive information.
