Genomic data sharing is the exchange or reuse of DNA sequence information from crops and related agricultural resources for a defined purpose, such as research, conservation or crop improvement. It is not automatically open access, and it does not create one universal ownership rule. What a recipient may do depends on the data involved, who contributed it, consent and permissions, security requirements, contracts, and any applicable national or international framework.
For farmers, sharing can support better varieties and conservation but may expose privacy, economic or community interests if governance is weak. Researchers gain evidence for identifying traits and protecting diversity, while seed companies may use data and breeding results commercially under specified conditions. A sound arrangement states the purpose, limits downstream use, protects people and communities, and explains how benefits will be returned.
What genomic data sharing includes
Genomic data is information derived from sequencing an organism’s DNA. CGIAR uses the term digital sequence information (DSI) broadly for detailed genetic information obtained by sequencing genomes. Researchers can compare sequences to pinpoint genes associated with characteristics such as disease resistance, drought tolerance, maturity or nutritional quality.
Recommended Free Tools
Sharing may involve raw sequence reads, assembled genomes, genetic markers, annotated datasets, analysis results or information linked to a physical seed sample. The physical material and the digital record are related but are not automatically governed by the same rules. A database containing a sequence is not, by itself, a transfer of the seed, and permission to inspect data does not necessarily authorize a recipient to obtain, reproduce or commercialize biological material.

Sharing also covers reuse. A dataset collected for a public breeding project might later be requested for conservation, a new research question or a commercial program. Whether that secondary use is allowed depends on the original notice and consent, the access agreement, the terms attached to the material and any restrictions imposed by law or an institution.
Why the distinction matters
- Trait discovery: Sequence comparisons can reveal genetic variants associated with useful characteristics and help breeders select parents or markers.
- Conservation: Data can document diversity in farmer varieties and help genebanks identify material that should be protected.
- Research efficiency: Shared analyses can reduce duplicate sequencing and allow teams in different regions to test findings.
- Commercial development: A company can use genomic evidence in a breeding pipeline, but its rights and benefit-sharing duties depend on the source material, purpose and contract.
- Trust: Farmers are more likely to participate when they understand who can access information, how long it is retained and what happens if a project changes direction.
CGIAR’s Responsible Data Guidelines recommend planning data management before collection, minimizing or avoiding personal information, obtaining informed consent and applying suitable confidentiality and access controls. The OECD report Issues around data governance in the digital transformation of agriculture: The farmers’ perspective, published 23 October 2020, describes the policy challenge this way: “A key challenge for policy makers lies in finding a balance between protecting the privacy and confidentiality of agricultural data, and farmers’ economic interests in those data, while making it possible to leverage their potential for the sector’s growth and innovation.”
What sharing means for farmers
Farmers may be contributors, custodians or data subjects
A farmer might provide seed from a locally adapted variety, permit sampling from a field, contribute observations about performance or operate equipment that generates genomic and farm-management records. A community may collectively conserve a variety even when no single individual can claim every interest in it. These roles create privacy, economic and cultural concerns, but they do not establish a universal legal ownership rule. Rights vary with the jurisdiction, the type of data, the source of the material, consent and contract terms.

Questions to answer before participating
- Exactly what will be collected: seed, tissue, sequence files, farm records or a combination?
- Will names, precise locations, production volumes or identifiable household information be attached to the dataset?
- Is access limited to a named project, or can other researchers and companies request reuse?
- Can the contributor withdraw future use, and what happens to analyses already completed?
- Will results be published, licensed or used in a commercial breeding program?
- What benefits are promised: reports, improved seed, training, payments, community investment or voluntary contributions to a shared fund?
A plain-language consent form should answer these points before sampling. If a project cannot explain who controls access or how a change in purpose will be handled, the farmer should seek advice from a cooperative, extension service, community representative or appropriate legal and ethics office.
What sharing means for researchers
Access is not a blanket licence
Researchers can use genomic data to investigate traits, study evolution, conserve diversity and inform breeding. However, the ability to download a file does not automatically authorize every downstream activity. Researchers must follow the purpose stated in the consent and data-use agreement, respect restrictions on identifiable information, and check whether a physical sample is covered by a transfer instrument.
Good research practice
- Plan before collection. Define the scientific question, the minimum data needed and the parties who may need access.
- Separate identifiers. Keep names, contact details and exact farm coordinates apart from sequence data whenever possible; use coded identifiers with controlled re-linking.
- Record provenance. Document who supplied the material, collection date and location at the level that is safe to disclose, consent language, permits and any transfer agreement.
- Set access tiers. Public results may be released openly, while raw data or sensitive locality information can remain in a controlled repository.
- Manage reuse. Require approval for a new purpose, prohibit attempts to re-identify contributors and specify deletion or return procedures when a project ends.
- Report limits. Publications should state important restrictions and avoid implying that a sequence proves a trait in every environment.
Institutional review, national access rules and the terms attached to plant genetic resources may impose additional duties. CGIAR guidance is an organizational resource, not a substitute for the law, ethics review or contract requirements applicable to a particular project.

What sharing means for seed companies
Commercial use follows the source and the terms
Seed companies can apply sequence information to select breeding lines, validate markers or prioritize field trials. Commercial value does not erase the conditions under which the data or material was obtained. A company should verify whether the relevant resource is covered by a treaty system, a national access-and-benefit-sharing rule, a material transfer agreement, a data-use licence or a private contract.
Do not collapse rules for physical plant genetic resources into a general rule for all sequence data. A company may receive a sequence from a public database while a related seed sample remains subject to separate access conditions. Conversely, a physical sample supplied under a standard agreement may carry obligations that also affect information generated from it.
Due-diligence records
- Source institution, farmer group or community and the chain of custody.
- Species, variety and whether the resource is a covered crop or material under development.
- Permitted purpose, geographic scope, publication rights and commercial-use language.
- Security controls for raw data and rules for sharing with contractors, affiliates or breeding partners.
- Benefit-sharing payments, non-monetary contributions or reporting obligations.
- Evidence that staff and collaborators understand the restrictions before using the data in a pipeline.

| Dimension | Questions to ask | Why it changes the outcome |
|---|---|---|
| Data or material | Is it raw sequence, an analysis, a database record, a seed sample or tissue? | Digital information and physical genetic resources may follow different rules. |
| Contributors and permissions | Who supplied it, who is represented and what consent, permits or community decisions exist? | Permission must match the people and interests represented. |
| Purpose and downstream use | Is the use research, conservation, breeding, training or a commercial product? Can the purpose change? | Authorization for one purpose is not automatically authorization for another. |
| Identifiability and security | Could a person, farm or community be identified? What encryption, access logging and confidentiality controls apply? | Controls reduce privacy and economic risks. |
| Transfer, access and retention | Who can download or receive the data, for how long and what happens at project close? | These terms determine whether reuse can be monitored or stopped. |
| Benefits and reporting | Are there treaty obligations, contractual payments, voluntary contributions or community benefits? | Benefit-sharing is tied to the resource and arrangement, not simply to the existence of a sequence. |
Common sharing models compared
| Model | Typical access | Main safeguards or limits |
|---|---|---|
| Open research release | Sequence or derived results are publicly downloadable. | Remove unnecessary personal information; publish provenance and any licence; understand that downstream control is limited once data are public. |
| Controlled-access research project | Approved users receive files through an application, data-use agreement or institutional repository. | Purpose limitation, user authentication, audit logs, no re-identification and defined retention or destruction. |
| FAO Treaty Multilateral System | Facilitated access to specified plant genetic resources for food and agriculture for research, breeding and training for food and agriculture. | Access uses the Treaty framework and Standard Material Transfer Agreement (SMTA); it is not blanket permission for every dataset or use. |
| Material under development | The developer can exercise discretion over access. | Terms may differ from those for resources already included in the Multilateral System; review the specific agreement. |
| Private or partnership exchange | Named parties receive data or samples under a contract. | Define permitted uses, sublicensing, publication, security, liability, benefits and what happens when the partnership ends. |
How the FAO Treaty framework fits
The International Treaty on Plant Genetic Resources for Food and Agriculture operates a Multilateral System for specified plant genetic resources for food and agriculture. The current overview covers 64 crops, which the FAO says collectively account for about 80 percent of human consumption derived from plants. In 2018, the pool contained about 2.5 million accessions. By September 2021, users had received more than 6.1 million materials for research, training and breeding.
Those figures describe the Treaty’s physical-resource system, not every sequence file held by a university, company or database. The Treaty FAQ explains that access for research, breeding and training for food and agriculture is governed through the Treaty and its SMTA. A different purpose may require different conditions. Plant genetic resources under development are also treated distinctly: the developer may exercise discretion over access.

Digital sequence information and benefit-sharing are still evolving
International discussions about DSI have not produced a single settled payment rule for every company or product. CGIAR’s account of the COP16 outcome describes a multilateral mechanism and notes that the outcome did not require tracking DSI use in individual commercial products. How the mechanism will be implemented, funded and connected to company incentives remains an open policy question as of that account.
That uncertainty does not remove existing duties. A project may still owe benefits under a contract, a national access-and-benefit-sharing measure, the SMTA or a community agreement. Keep a provenance record so that future rules can be applied without reconstructing the history of a sample or file.
Privacy, confidentiality and security controls
Genomic data can become sensitive when combined with farm identity, location, production records or community information. Minimize collection and use coded identifiers. Restrict raw files to people who need them, encrypt data in transit and at rest, log access, review permissions regularly and provide a process for reporting a breach. Share precise coordinates only when they are essential; a broad region may protect a rare variety or a contributor’s livelihood better than a point location.
CGIAR’s guidance reproduces a warning attributed to Paul Ohm in the UCLA Law Review (2010): “Data can be either useful or perfectly anonymous, but never both.” In context, this is a caution about the trade-off between utility and anonymity, not a universal technical law. Even data stripped of names can sometimes be linked with other datasets, so confidentiality should be treated as a continuing risk-management task.
A practical workflow for setting up a sharing project
- Classify the inputs. List sequence files, derived analyses, physical samples and associated farm or community information separately.
- Map the people and institutions. Identify farmers, communities, genebanks, researchers, companies, contractors and repositories represented in the data.
- Check authority. Review consent, permits, national rules, ethics approval, the SMTA where relevant and any existing data-use or material-transfer agreement.
- Write the purpose statement. Name the research, conservation, breeding or training objective and state whether commercial use, sublicensing or future purposes are allowed.
- Choose access levels. Decide what can be public, what requires an application and what must remain confidential. Set authentication and audit requirements.
- Set retention and exit rules. Specify the retention period, secure deletion or return, treatment of backups and handling of analyses already published.
- Define benefits and communication. State monetary or non-monetary benefits, reporting frequency, publication credit and how contributors will receive understandable results.
- Monitor and update. Review users, security, new downstream requests and changes in law or international policy; obtain fresh approval when the purpose materially changes.
Frequent mistakes and how to correct them
- “The database is public, so anything is allowed.” Check the database licence, source consent and restrictions on commercial or sensitive use.
- “A sequence is the same as the seed.” Track digital data and physical material separately and review the instrument governing each.
- “Removing names makes the dataset anonymous.” Assess re-identification risk from locations, variety names and linked farm records; reduce detail or use controlled access.
- “One consent form covers every future project.” Make purposes specific and create a process for new uses or re-consent.
- “Benefit-sharing is only a future international issue.” Check current contracts, national measures and Treaty terms now, and preserve provenance for evolving DSI rules.
- “A commercial partner can receive the raw files automatically.” Verify that transfer, sublicensing and commercial use are expressly permitted and apply the same security standards to contractors.
What readers should take away
Genomic data sharing is a governed exchange, not a binary choice between secrecy and unrestricted openness. Farmers need understandable consent and protection for personal, economic and community interests. Researchers need provenance, purpose limits and secure access. Seed companies need documented due diligence and a clear route through contracts, national rules and, where applicable, the FAO Treaty and SMTA. Treat every dataset and sample according to its actual source and terms, and obtain specialist advice when the legal or ethical position is uncertain.
