Professional liability insurance—also called errors and omissions (E&O) or professional indemnity insurance—addresses claims that a designer’s professional work contained an error, omission, negligent act, inaccurate advice or another covered service failure that caused a client financial harm. A policy may pay for a covered legal defense and covered damages, subject to its limits, deductible, exclusions and reporting rules. It does not automatically cover every dispute, accident, damaged laptop or data breach.
The controlling documents are the issued policy and applicable law. Insurer web pages are useful explanations of particular products, not guarantees that every professional liability policy responds the same way.
What a designer’s professional liability policy is meant to cover
The exposure is tied to the service you agreed to provide. A client does not have to prove at the outset that you were negligent for a claim to be made; an allegation that your professional act or omission caused financial loss can trigger the policy’s claims procedure. Whether the insurer must defend or indemnify you depends on the insuring agreement, definitions, exclusions, endorsements and local law.
Typical allegations include:
- An error in plans, specifications, drawings, calculations, layouts, copy or other deliverables.
- An omission, such as failing to communicate a material requirement or leaving out information the agreed service required.
- Negligent professional advice or a recommendation that allegedly caused a client to spend money, lose revenue or incur remediation costs.
- Work that allegedly failed to meet the written scope, agreed performance or expected professional standard.
These are claim allegations, not automatic findings of fault. A disagreement about creative taste, an unhappy customer or a project that simply performs poorly does not by itself establish a covered claim. The contract, the alleged financial loss and the policy wording all matter.

Examples by design discipline
Interior and spatial design
The Hartford’s interior-design guidance describes possible disputes involving materials or specifications, project delays or additional expense attributed to plans, and differences about contracted scope or expected costs. For example, a client might allege that a specified material was unsuitable and that replacing it caused a measurable expense, or that an omission in the plans delayed a build. The facts, contract and exclusions determine whether the insurer treats the allegation as a covered professional claim.
Graphic design
In its graphic-designer explanation, The Hartford gives the example of a client alleging that a logo or other agreed work caused business loss or did not meet the agreement. A claim might concern a missed requirement, an error in a production file or an alleged failure to deliver the contracted result. The example illustrates the type of professional-service allegation E&O is designed to address; it is not a promise that every logo dispute is insured.
Web, UX, product and technical design
Policies can include many disciplines, but a label such as “designer” is not enough. Before buying, ask the insurer or broker to confirm in writing that the definition of professional services covers your actual work: for example, web or UX research, interface specifications, product design, technical drawings, accessibility consulting, content design or production management. If you combine design with implementation, engineering, construction administration, advertising or software development, those activities may require specific wording or endorsements.

What the insurer may pay when a covered claim is made
Legal defense
Some policies provide a defense when a claim falls within the insuring agreement, even if you dispute the allegation. Confirm whether the policy imposes a duty to defend, permits the insurer to appoint counsel, and requires your consent for settlement. Also check whether defense expenses reduce the policy limit. A $1 million limit with defense costs inside the limit can leave less money for a judgment or settlement than a policy with defense outside the limit.
The Hartford says its interior-design coverage may help with defense costs and subpoena assistance, along with certain damages awarded by a judge and libel or slander claims. Those features belong to that insurer’s offering; they should not be assumed to be standard across the market.
Settlements and covered damages
Where the policy responds, it may pay a negotiated settlement or damages that meet the policy’s definition. Intentional penalties, fines, disgorgement and losses outside the covered professional service are often restricted or excluded. Read the definitions of “claim,” “loss,” “damages” and “wrongful act,” and ask how consent-to-settle and hammer-clause provisions operate before a dispute occurs.

What professional liability normally does not replace
Professional liability is one part of a business insurance program. Important boundaries identified in designer-focused guidance include:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →- Bodily injury: If a visitor is injured in your studio or a person is hurt because of an occurrence unrelated to your professional advice, general liability is the usual policy to examine.
- Damage to your own property: Computers, cameras, samples, furniture and other business property generally call for commercial property coverage, not E&O.
- Cyber and data incidents: Malware, ransomware, unauthorized access, privacy violations and restoration of lost data may require cyber or information-security coverage. Some professional policies include a narrow extension, but do not assume it is sufficient.
- Intentional or illegal conduct: Deliberate wrongdoing and illegal acts are generally excluded. An insurer may also reserve rights while investigating whether an exclusion applies.
- Purely commercial disputes: Unpaid invoices, a client’s change of mind or a demand to redo work may be a contract or collections matter rather than a negligent professional-service claim.
General liability, property, workers’ compensation, automobile and cyber policies address different hazards. A broker can map the policies to your contracts and operations instead of treating E&O as a blanket business policy.
Claims-made coverage, retroactive dates and old projects
The Hartford describes graphic-designer E&O as claims-made coverage with a retroactive date. Under a claims-made structure, the timing of the claim and the required notice can be as important as when the design work occurred. A project completed years ago may be relevant if a claim is first made and reported during the active policy period and the act falls on or after the retroactive date. The exact trigger and reporting language differ by policy and jurisdiction.

Before changing carriers, reducing limits or closing the business, verify:
- The retroactive or prior-acts date and whether it remains continuous at renewal.
- What the policy calls a claim, circumstance or potential claim, and when each must be reported.
- The notice address, deadline and information the insurer requires.
- Whether an extended reporting period (sometimes called tail coverage) is available after cancellation or non-renewal, its duration and its cost.
- How a known circumstance, demand letter, mediation or lawsuit is treated if it began under an earlier policy.
Do not wait for a lawsuit if the policy requires reporting circumstances that could reasonably lead to a claim. Notify the insurer using the policy’s procedure and preserve contracts, briefs, approvals, versions and correspondence.

Travelers identifies additional design-professional features in its own offering, including network and information-security protection, crisis expenses, automatic-acquisition wording, design-build or joint-venture provisions, pre-claim assistance, rectification costs and worldwide coverage. These are carrier-specific examples, not a universal list of included benefits. Ask for the actual endorsement and its sublimits, conditions and exclusions.

- Inventory your services. List each discipline, deliverable, advisory activity, implementation task and subcontracted function. Include work performed for clients outside your home country.
- Review your contracts. Note indemnity clauses, required limits, additional-insured language, venue, governing law, intellectual-property promises, warranties and deadlines. Send representative agreements to the broker.
- Describe your risk accurately. Give the insurer revenue by service, firm size, locations, claims history, largest projects, use of subcontractors and whether you accept design-build or joint-venture responsibility. Inaccurate applications can create coverage problems.
- Request comparable quotes. Hold limits, retention, retroactive date and major endorsements constant so a low price is not merely a narrower policy.
- Read the issued documents. Check the declarations, insuring agreement, definitions, exclusions, conditions and endorsements. Confirm the named insured, policy period, territory, limits and reporting instructions.
- Set a renewal and incident process. Keep a calendar for renewal and extended-reporting decisions. Tell staff where to send a demand, threat of suit or circumstance notice, and preserve the project record.
Travelers publishes design-professional applications and supplements, including design-build materials and separate graphic-designer material under miscellaneous professional liability. The existence of an application does not establish eligibility or coverage; the underwriter’s issued policy does.
How much does it cost?
The Hartford’s page, last updated September 17, 2024, gives a rough estimate of $500–$1,000 per year per employee for graphic-design firm E&O. It expressly says price varies with the coverage amount and retroactive date, firm size, location, claims history and revenue. That is a dated insurer estimate, not an independent market average, a guaranteed price or a quote for your practice. A policy with broader services, higher limits, worldwide work, a lower retention or costly prior-acts protection can price differently.

- Read the demand carefully and identify the service, project, alleged error or omission, requested remedy and claimed financial loss.
- Do not admit liability, promise payment or alter records before receiving advice.
- Notify the insurer or broker through the address and method in the policy, even if the allegation seems weak or you believe the work was correct.
- Provide the contract, scope, approvals, change orders, files, invoices, timeline and relevant communications. Keep originals and preserve metadata where possible.
- Ask whether counsel is being appointed, whether defense costs erode limits, and whether the insurer treats the notice as a claim or circumstance.
- Coordinate with any general liability, cyber or property insurer if the facts also involve injury, physical damage or data compromise.
Cooperation duties, consent requirements and reporting deadlines are contractual conditions. Missing them can complicate the insurer’s response even when the underlying allegation concerns legitimate professional work.
Questions to ask a broker or insurer
- Is my exact service description covered, including revisions, advice, implementation and subcontractor oversight?
- What happens if a client alleges both professional negligence and bodily injury or property damage?
- Are intellectual-property, media, privacy and cyber allegations covered, excluded or available by endorsement?
- Do defense costs reduce limits, and what retention applies to defense and settlement?
- Will the retroactive date cover my existing portfolio, and what happens if I retire or change carriers?
- Where are claims covered, and are overseas clients, remote staff, joint ventures and related entities included?
- Which policy provisions require my consent before settlement or admission?
Travelers’ description of design-professional insurance emphasizes that traditional business insurance may not address the risk created by providing professional services. That is the insurer’s characterization, not a rule of law; the declarations, policy language and applicable law control the result in a particular dispute.
