Discovering a deep-sea species does not protect it. Conservation requires documenting the animal and its habitat, establishing a baseline, identifying the legal jurisdiction and pressures at the site, and adopting measures that can be monitored and enforced. The right approach depends on where the species lives and which activities threaten it.
Discovery is the start of protection, not protection itself
A species can be scientifically documented without being rare, threatened, or automatically covered by a new legal safeguard. Those conclusions require evidence about the species and its location. A discovery becomes useful for conservation when it is connected to a reliable account of where the animal lives, what conditions it depends on, what activities could affect it, and which authority can act.
That work is difficult in the deep sea because the environment is poorly understood. If scientists do not know what was present before an activity begins, it is harder to distinguish its effects from natural variation or to recognize losses after the fact. The International Union for Conservation of Nature (IUCN) calls for rigorous, transparent impact assessments based on comprehensive baseline studies in its May 2022 deep-sea mining brief. A baseline is therefore not simply an inventory of an animal; it is the reference needed to assess change.
Build a scientific record of the species and its habitat
Researchers need to record the species in enough context for others to identify it and understand its ecological setting. The relevant record should connect observations of the animal to the place where it was found and to the habitat conditions and ecological relationships known at the site. A sighting or specimen without that place-based context cannot, by itself, show how wide the species’ range is or whether a particular activity puts it at risk.

Next, define the habitat area that should be studied. A species may depend on conditions beyond the point where it was first observed, so a site assessment should not assume that the discovery location is the full extent of its habitat. The available evidence may be incomplete; where it is, that uncertainty should be visible in the assessment rather than converted into false precision.
Establish a pre-impact baseline before potentially damaging activity begins, and identify reference areas that can help interpret later observations. In a resolution adopted in 1981, IUCN recommended comprehensive ecological surveys and baseline reference areas before commercial deep-sea mining. Its resolution on deep-sea mining and protected areas is an organizational recommendation, not a universal legal rule. The same underlying principle appears in IUCN’s 2022 call for comprehensive baseline studies: later monitoring is much more informative when there is a credible picture of conditions before an impact.
Map the location before choosing a legal tool
The first governance question is where the species and its habitat are. A discovery might be within a state’s maritime zones, on a continental shelf, or in the international seabed Area beyond national jurisdiction. Seabed jurisdiction is not the same thing as the status of the water column above it, so a location assessment should identify both rather than treating a marine site as one undivided legal space.

Different locations are governed by different regimes. NOAA’s overview of seabed activities explains that the International Seabed Authority facilitates international cooperation on mineral development in the Area for parties to the UN Convention on the Law of the Sea. NOAA also notes that U.S. citizens’ deep-seabed mining activities beyond national jurisdiction are addressed by the U.S. Deep Seabed Hard Mineral Resources Act. These examples illustrate why the same species-protection proposal may involve different authorities depending on its location and the states involved; they do not establish which rules apply at every site.

The table is a starting point for identifying the governance question, not a substitute for site-specific legal analysis. In particular, the presence of an international agreement does not establish that every country is a party or that a particular habitat already has a designated protected area.
Identify threats and assess them together
Protection should address the pressures that actually apply at the site, including their combined effects. Deep-sea mining is one concern, but the assessment should not assume it is the only one: fishing, shipping, pollution, noise, and climate pressures may also matter, depending on the species and location. The aim is to understand which activities could affect the animal, its habitat, or the ecological relationships on which it depends.

Mining impacts can extend beyond the immediate footprint of equipment. Suspended sediment plumes can smother animals or harm filter feeders. Noise, vibration, light, and pollution are additional concerns identified by IUCN’s deep-sea mining brief. An assessment that measures only direct contact with the seabed could therefore miss pathways of harm outside the work area.

Environmental impact assessment is the process for examining proposed activity and its likely effects. To be useful for conservation, it should draw on transparent baseline data, consider alternatives and cumulative pressures, and include monitoring and public consultation. IUCN supports rigorous assessment, a precautionary principle, polluter-pays approaches, public consultation, and transparent governance in this context. These are IUCN policy positions; they should not be presented as universally binding requirements unless the relevant treaty or domestic law makes them so.
Where the baseline is weak or important effects remain uncertain, decision-makers should make that uncertainty explicit and take it into account rather than treating missing evidence as proof of safety. IUCN’s 2017 statement on deep-sea mining quoted senior adviser Kristina Gjerde saying, “The new rules governing deep sea mining must take its full costs to society and the environment into account,” as part of its call for a comprehensive view of consequences. That was a dated statement of IUCN’s position, not a description of a current universal legal requirement. See IUCN’s 7 June 2017 statement.

Choose protection by its rules, not its label
A marine protected area (MPA) or another area-based management tool sets measures for a geographic place. The designation alone does not tell you which activities are prohibited, what features are protected, or how the rules are enforced. NOAA describes MPAs as ranging from simple declarations protecting a resource to extensively regulated places, with different objectives and legal bases. A reader assessing a proposed MPA should ask what it actually allows, not infer a level of protection from its name. NOAA’s MPA overview explains this range.
For a particular deep-sea species, evaluate the measure against the habitat and threats documented at the site. Useful questions include:
- Protected feature: Does the measure address the species, its habitat, or an ecological feature on which it depends?
- Spatial coverage: Does its boundary cover the relevant habitat and the area where identified pressures could cause harm?
- Permitted activities: Which activities are restricted, allowed, or subject to assessment? Check the actual rules rather than relying on the MPA label.
- Connectivity and changing conditions: Could the measure respond if species, ecosystems, or patterns of human use shift? IUCN notes that broader area-based measures may be needed for these changes.
- Monitoring and enforcement: Who will check whether ecological conditions are changing and whether the rules are being followed?
IUCN’s guidance on governing areas beyond national jurisdiction says fully and highly protected areas offer the most certain benefits, while broader area-based measures may be needed to respond to shifting species, ecosystems, and human use. The choice is not simply between an MPA and no action: the strength and coverage of the measure must match the evidence and the activities at issue.

Understand what the BBNJ Agreement changes—and what it does not
The Agreement on Marine Biological Diversity of Areas Beyond National Jurisdiction, commonly called the BBNJ Agreement, entered into force on 17 January 2026. Its subjects include marine genetic resources and benefit sharing; area-based management tools, including MPAs; environmental impact assessments; and capacity-building and technology transfer. The United Nations’ official BBNJ Agreement portal describes the agreement and its scope.
Entry into force is an important legal milestone, but it does not automatically designate an MPA around every newly discovered species or establish that every state is bound in the same way. Site-specific measures still depend on implementation, applicable party obligations, and the relevant seabed and sectoral rules. The United Nations scheduled the agreement’s first Conference of the Parties for 11–22 January 2027; that is a future institutional milestone, not proof that a particular species already has a protection plan. On 17 January 2026, UN Secretary-General António Guterres stated: “The Agreement on Marine Biological Diversity of Areas Beyond National Jurisdiction, the BBNJ Agreement, is now in force.” His statement marks entry into force; it does not claim that a specific deep-sea site has been protected. Monitor the site and adapt protections as evidence improves
Protection is an ongoing management task. Monitoring should compare later observations with the baseline, track the pressures identified in the assessment, and check whether the adopted restrictions are being followed. Without a defined reference point, it is harder to tell whether conditions have changed; without an authority able to act on the findings, monitoring alone cannot prevent harm.
As knowledge of the species or its habitat changes, managers may need to revise the area covered, the permitted activities, or the monitoring approach. This is especially important when uncertainty about a species’ distribution or sensitivity remains. Monitoring is not a substitute for precaution before an irreversible impact; it is how decision-makers test whether measures are working and respond when they are not.
Restoration or biodiversity offsets cannot be assumed to replace a species that has been lost. IUCN’s 2017 statement warns that out-of-kind restoration or preservation cannot compensate for the loss of unknown deep-sea species. That matters because a habitat elsewhere may not reproduce the ecological conditions or relationships of the affected site. Treat offsets as no proven substitute for avoiding damage to a poorly understood species, rather than as a guaranteed remedy. The warning appears in IUCN’s dated statement.
A practical sequence for conservation decisions
- Document the discovery. Record the species and the conditions, boundaries, and ecological context of the habitat where it was found.
- Establish a baseline. Survey the site before potentially harmful activity where possible, and identify reference areas so later change can be assessed against known conditions.
- Map jurisdiction. Determine whether the site is within a state’s maritime zones, on a continental shelf, or in the international seabed Area. Consider the seabed and water column separately.
- Assess pressures and alternatives. Identify relevant activities, including indirect effects such as sediment plumes, and assess cumulative impacts using transparent evidence.
- Select enforceable measures. Choose a protected area or other management tool with boundaries, restrictions, responsible authorities, and enforcement appropriate to the risks.
- Monitor and revise. Compare observations with the baseline, check compliance, and update measures as evidence or conditions change.
The outcome is not a label for a newly found animal, but a chain of evidence and action: a documented habitat, an assessment of applicable threats, a legally appropriate measure, and continuing oversight. The particular measures cannot be determined from the fact of discovery alone; they depend on the site, the evidence, the jurisdiction, and the rules that apply there.
