Owning a video game usually means owning a particular physical copy, such as a cartridge or disc—not owning the game’s copyright. Licensing usually means a publisher or platform gives you contractual permission to access software under an end-user license agreement (EULA). A one-time payment does not automatically guarantee permanent access, transferability, offline play, or continued support.
The practical difference is what you can keep, move, resell and use when an account, storefront or server changes. Physical media generally gives you a tangible copy that can remain usable without a digital store account, while digital purchases commonly attach access to an account and platform rules. Both formats can still depend on patches, authentication, online services and local law.
“Owning” a game has two different meanings
People use “own” in two ways. In everyday speech, it can mean that you paid for and possess a copy. In copyright law, ownership refers to the intellectual-property rights in the game’s code, art, music, story and other creative elements. Buying a copy normally transfers neither the copyright nor the publisher’s exclusive rights.

Ownership of a copy
If you buy a cartridge or disc, you normally own that particular physical object. You can possess it, lend it and, where local law permits, transfer or sell it. The copy may contain the game software, or it may be a key that still requires a download. A disc can also be only a partial installation source while updates, licenses or servers remain necessary.

A license to access software
A digital transaction commonly grants a license rather than transferring a standalone copy for unrestricted use. The license is defined by the store’s terms, the game’s EULA and technical controls such as account authentication and digital-rights-management (DRM). Those terms can limit copying, transfer, commercial use and the devices on which the software runs.
The U.S. Federal Trade Commission explains the distinction this way: “When you buy a physical item, you’ve got it. It’s yours. But when you click the ‘buy’ button on a digital product, it really depends.” It notes that access may last only while an account or platform remains available and that DRM can prevent playing a game on another console brand.
Physical copy versus digital license
| Question | Physical cartridge or disc | Digital purchase |
|---|---|---|
| What you receive | A tangible copy, although it may need downloads, patches or an online account. | Permission to access software through an account, store and device ecosystem. |
| Transfer or resale | Often possible under applicable first-sale or exhaustion rules, subject to regional law and any account-bound components. | Commonly restricted by contract and account design; digital resale remains legally unsettled in many jurisdictions. |
| Account dependence | May work without the original purchaser’s account for offline features, but some titles require authentication. | Usually tied to the purchasing account and the platform’s continued operation. |
| Technical controls | Less dependent on storefront DRM, but updates, activation keys and servers can still be required. | DRM, periodic sign-in, remote updates and platform compatibility can limit use. |
| After support ends | The installed version may remain playable if it does not require servers or authentication. | Access can be lost if the account is closed, the license is revoked, the store disappears or required servers shut down. |
| Copyright | You own the object, not the game’s copyright. | You receive contractual access, not the game’s copyright. |
These are general patterns, not guarantees. A particular title’s packaging, EULA, account requirements and server architecture control the result.

An EULA is a contract describing the permission attached to the software. It commonly says that the publisher retains ownership of the game and grants you a limited, revocable or non-transferable license. Read the EULA together with the store’s purchase terms and privacy or account rules; one document may contain restrictions that another summarizes.

Common restrictions
- Copying: You may be barred from duplicating the software except for narrow backup or technical exceptions recognized by local law.
- Distribution and resale: The license may prohibit selling, renting, leasing, sublicensing or transferring the software or account.
- Device and region limits: Activation can be restricted to specified hardware, operating systems or geographic regions.
- Modification: Reverse engineering, decompiling, circumventing DRM or creating unauthorized derivatives may be prohibited, subject to statutory exceptions.
- Online conduct: Multiplayer access can be conditioned on behavior rules, anti-cheat systems and a separate service agreement.
Remote changes and suspension
The Epic Games Store EULA, for example, states that the operator may remotely patch software and may “modify, suspend, discontinue, substitute, replace, or limit your access” at any time. It also warns that game data may cease to be available without notice. This is an example of how a paid license can remain subject to continuing platform control; another publisher’s wording may differ.
A clause does not automatically override consumer-protection law. Whether a suspension, termination or unilateral change is enforceable depends on the contract, the reason for the action and the law where you live.
Can a platform revoke a game you paid for?
Potentially, yes—especially for a digital license. A platform may suspend an account for alleged fraud, chargebacks, serious terms violations or other listed reasons. If the license is account-bound, losing the account can remove access to every game attached to it. A publisher can also stop selling a title, remove it from a storefront or discontinue the servers needed to launch or play it.

Steps to reduce account-related risk
- Use a current email address and enable the platform’s strongest available multi-factor authentication.
- Keep recovery codes and proof of purchase in a secure location.
- Read the account-suspension and termination sections before buying expensive add-ons.
- Avoid chargebacks except through the platform’s stated dispute process; a payment reversal can trigger account restrictions.
- For an offline-capable title, test launching it while disconnected before relying on it for travel or long-term access.
Can you resell or transfer a digital game?
Digital resale is commonly restricted because the transaction is framed as a personal, non-transferable license. Store systems also bind the entitlement to an account, making it technically difficult to transfer only one game without handing over the entire account. Account sales can violate the platform’s terms and expose the buyer to later recovery or suspension.
Physical resale is different. In the United States, the first-sale doctrine generally limits a copyright owner’s ability to control redistribution of a lawfully made copy after that copy is sold, although the rule has exceptions and does not authorize copying. Other countries apply their own exhaustion rules. The Australian Competition and Consumer Commission warns that some games sell only a license to play and that access may not be recoverable after cancellation, suspension or discontinued support, including access to in-app purchases.
Because rules differ by country, a local legal analysis is necessary before treating a digital entitlement as transferable property. A marketplace policy cannot by itself settle every copyright or consumer-law question.
What happens when servers shut down?
Server dependence is the decisive issue for many modern games. A single-player title that runs entirely from a cartridge or installed files may continue working after online services end. A game that checks a server at startup, stores progression remotely, uses cloud-streamed content or requires multiplayer matchmaking can lose core functions—or all functionality—when that service closes.

Three common shutdown outcomes
- Offline preservation: The publisher releases a patch or the game already contains a complete offline mode. Your copy remains usable, though online features disappear.
- Partial loss: The campaign works, but multiplayer, events, leaderboards, cloud saves or purchased virtual items do not.
- Total loss: Launch authentication, streaming or essential game logic depends on a server that is no longer available.
Paid downloadable content and in-app purchases can be lost along with the underlying service. Keeping installation files does not recreate a closed server or bypass an authentication requirement lawfully.
Owning the copy is not owning the copyright
The U.S. Copyright Office explains that copyright owners control reproduction, preparation of derivative works and distribution, subject to licenses and statutory limits such as first sale. If you own a cartridge, you generally may use and transfer that copy as the law allows, but you may not duplicate the game for others, upload its files, sell unauthorized copies or create and distribute an unlicensed derivative merely because you bought the cartridge.
Modding illustrates the boundary. A publisher may permit certain modifications through a toolkit or workshop while prohibiting commercial redistribution, online cheating or use of copyrighted assets outside the game. Your rights depend on the permission granted and on applicable exceptions, not simply on possession of the original media.

- What You Get: Anker 332 USB-C Hub (5-in-1), welcome guide, our worry-free 18-month warranty, and friendly customer service.
- Identify the format: Is it a cartridge, a disc, a download code or an account entitlement?
- Check the packaging or store description: Look for “requires download,” “online connection required,” “account required” and region restrictions.
- Open the EULA and store terms: Search for license scope, transfer, termination, suspension, offline use, refunds and remote changes.
- Map the dependencies: Determine whether first launch, future launches, saves, DLC or multiplayer require a server.
- Check update and patch policy: A disc may ship an incomplete or bug-prone version that depends on a now-unavailable patch.
- Separate optional purchases: Cosmetic items, season passes and virtual currency may have different expiration or refund rules.
- Save evidence: Keep receipts, the product page, the EULA version and any promised offline or preservation statements.
Choosing between formats for different priorities
If long-term offline access matters
Prefer a physical release that contains a playable build and test it without an internet connection while returns are still possible. Confirm whether updates are optional and whether the game launches without the purchasing account. This approach reduces, but cannot eliminate, dependence on servers or future hardware compatibility.
If convenience and instant access matter
A digital license provides immediate download, automatic updates and no disc to store. Accept that access is tied to the account and platform, and that a storefront closure, account action or licensing change can affect availability.
If resale or lending matters
A physical copy is generally the more practical choice, provided local exhaustion rules apply and the copy is not merely an activation code. Digital lending and resale are usually blocked by account design or contract.

If multiplayer is the main reason to buy
Evaluate the service as well as the software. Check whether matchmaking, progression and purchased content are server-dependent, and whether the publisher has described an offline or private-server fallback. Ownership of media cannot guarantee that a discontinued network will return.
Consumer protection and jurisdiction
The legal result depends on your country, the seller, the platform, the game’s format and the wording shown at purchase. Consumer-protection laws may require clear disclosure, honor statutory guarantees or prohibit misleading claims even when an EULA calls the transaction a license. They may also limit unfair termination or provide remedies when a paid digital service is not supplied as promised.
Do not assume that a “buy” button proves ownership or that a license label eliminates every consumer right. Save the terms that applied when you paid, because platforms can change online wording later. For a dispute involving substantial money, an account ban or a cross-border transaction, consult your jurisdiction’s consumer agency or a qualified lawyer.
Bottom line for buyers
A physical cartridge or disc usually gives you ownership of that object, with whatever transfer rights local law recognizes. A digital purchase usually gives you a conditional license tied to an account, platform and technical systems. Neither transaction gives you the game’s copyright. Before paying, determine whether the title can run offline, whether access can be suspended, whether you can transfer the copy and what happens if servers or the storefront disappear. Those details—not the “buy” label—define what you really have.
