In most major digital stores, buying a game gives you a personal license to access and use the software, not ownership of its copyright or an unrestricted copy. Steam’s EULA states: “Your license confers no title or ownership in the Content and Services.” The account, contract, digital-rights management (DRM), required servers and platform rules can all affect how long and where you can play.
A disc or cartridge gives you possession of physical media, which can make lending, resale and preservation easier. It still does not transfer copyright, and the game may require an account, patches, activation or online services. The practical question is therefore not simply “digital or physical?” but which rights and dependencies come with this particular release, platform and country.
Four different meanings of “owning” a game
People use own to describe several legally and practically different things. Separating them prevents most confusion about digital purchases.

The publisher or developer normally retains copyright and the rights to reproduce, modify, distribute and commercially exploit the game. Paying for a copy does not make you the copyright owner, whether the copy is downloaded or stored on a disc.

Possession of a copy
A cartridge or disc is a tangible object you can possess. You may be able to lend it or transfer it to another person under ordinary property rules, subject to the platform’s terms and the game’s technical requirements. Physical possession is not the same as owning the copyright or every service connected to the game.
Contractual access
A digital storefront records a license against your account. The EULA defines what you may install, run, copy, transfer or use, and can limit use to a named account, device or platform. The store’s payment screen may look like a conventional sale even when the contract describes a license.
Service dependence
Authentication servers, DRM checks, account status, mandatory patches and multiplayer services can determine whether the software works. A license can remain listed in your account while a technical dependency prevents play. The U.S. Federal Trade Commission has identified DRM as a mechanism that can restrict use on another console brand and has warned that digital-service terms may change.
What a digital purchase normally grants
Most major storefronts grant permission to use the game under their subscriber agreement and the publisher’s EULA. That permission is usually personal, limited and tied to the account that bought it. It may cover installation on permitted devices, access to patches and use of online features while the service is available.
It generally does not grant title to the software, a transferable copy, the right to make unrestricted backups or the right to continue using every associated service after a business or platform decision. Steam’s Subscriber Agreement also says users are not entitled to future updates or enhancements unless the law requires them.
Read the current EULA rather than relying on a store button labelled “buy.” The legal effect can differ by country, product type and platform, and a later update to the service terms may apply under the agreement you accepted.

Can a digital game be taken away?
Access can be affected by several events, and they are not all the same.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Account suspension
If a platform suspends or closes an account under its rules, the licenses recorded on that account may become inaccessible. Losing access to an account, its email address or its authentication method can have a similar practical result even when the game remains available to other customers.
Delisting
A publisher can stop selling a game while existing customers may retain access. Delisting does not automatically mean every existing license is immediately revoked, but it removes the ability to obtain a new license through that store and can complicate re-downloads if the service later changes.
Revocation clauses
Some license contracts reserve suspension or revocation rights. California’s AB 2426 legislative materials describe a license that “may be unilaterally revoked by the seller” and require that possibility to be disclosed when ownership language is used. A disclosure rule does not convert the license into unrestricted ownership; it informs the buyer about the limitation.
Server or authentication failure
A shutdown, outage or change to an always-online check can make a game unusable even if no one deletes the entry from your library. A local single-player mode is more resilient when the game can be installed and launched without a continuing server check, but that must be verified for the specific edition.

Usually not through the major stores. Digital licenses are commonly personal and non-transferable, and EULAs often prohibit selling or transferring the account. The World Intellectual Property Organization reports that game EULAs commonly prohibit account transfers and second-hand sales.

Giving someone your account credentials can violate the platform’s rules and exposes every other license, payment method and personal detail on that account. A family-sharing feature, where offered, is a permission granted by the platform—not a sale or transfer of the underlying license—and can be changed or withdrawn under its terms.
Physical media is easier to hand over because the object can change possession. The recipient may still have to accept the EULA, create an account, download a patch, purchase downloadable content again or lose access to online entitlements that were redeemed by the original owner.
Is a physical disc or cartridge safer?
Physical media improves your control over the copy, but it is not a guarantee of permanent, unrestricted play.
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- What it helps: you can possess the disc or cartridge, lend it, and often resell it; you may be able to reinstall from the media without re-downloading the entire base game.
- What it does not solve: copyright remains with the publisher; an account or EULA may still be required; patches can be mandatory; multiplayer and other features can depend on servers; and a disc can be damaged, lost or tied to a region or console generation.
- What to check: whether the disc contains a complete playable build, whether a day-one or large post-launch download is required, whether the activation code is single-use, and whether the console can launch the game offline.
A physical release with only an installation stub is not meaningfully independent of the store. Conversely, a well-mastered disc that runs offline can be a stronger preservation option than an account-bound download.
Digital license versus physical copy
| Issue | Digital license | Physical disc or cartridge |
|---|---|---|
| Transfer and resale | Usually personal, account-bound and non-transferable under the EULA. | The media can generally be handed over or resold, although the recipient may need an account, EULA acceptance or new entitlements. |
| Offline play | Depends on activation, DRM, installation and the store’s offline mode; verify before buying. | More likely to install locally, but patches, account checks or online services may still be required. |
| Revocation and delisting | Store or publisher decisions, account status and license terms can affect access. | Possession of the media reduces dependence on a storefront, but revoked services, activation and server requirements can still block play. |
| Portability | Normally limited to supported devices and the account or platform that issued the license. | Portable between compatible hardware, but format, region, generation and hardware compatibility matter. |
| Refunds | Controlled by storefront policy and mandatory local law; digital-content withdrawal rights can end when supply or downloading starts after consent. | Usually handled as a goods return under local consumer law and retailer policy, with separate rules for opened software. |
| Preservation and backup | Re-download, patches and authentication may depend on the store remaining operational. | The original media is a physical fallback, but it can degrade and may not contain the complete game. |
| Total cost | Consider the game price plus required subscriptions, storage, patches, compatible hardware and any lost access if the account or service changes. | Consider the media price plus compatible hardware, storage for patches, subscriptions for online play and replacement cost if the disc or cartridge is damaged. |
Offline play, DRM and portability
Before purchase, distinguish three questions: can the game be installed, can it be launched, and can the desired features work without a network connection? A store may advertise offline mode for its client while an individual title still performs an activation check. A single-player campaign may work offline while multiplayer, cloud saves, leaderboards or downloadable content do not.
DRM can also bind a game to a platform family. The FTC notes that DRM may prevent use on another console brand. A license for one console, PC operating system or storefront should therefore not be treated as a license for every device you own.

Updates, patches and shutdowns
Digital access does not promise indefinite maintenance. Steam’s Subscriber Agreement says buyers are not entitled to future updates or enhancements unless required by law. A physical copy is also not a promise of a patch, bug fix or compatibility update.
For an online game, the server is part of the product’s operation. If the publisher closes it, the purchased license may remain visible while the central game mode no longer functions. For an offline game, a shutdown matters mainly when launch authentication, cloud saves or downloadable files are mandatory.
Preservation is strongest when the release includes a complete local build, does not require recurring authentication and can be installed on hardware that remains available. Keep the original media, installers and documented patches where the license and law permit; do not assume that bypassing DRM is lawful in every country.

Refund rights depend on the platform and jurisdiction. Steam’s EU and UK guidance says the statutory withdrawal period for digital content ends when downloading begins or after 14 days, whichever comes sooner, once the consumer has consented to early supply. Local law can provide additional mandatory rights, including remedies when digital content is defective or not supplied as promised.

Why jurisdiction changes the answer
There is no single worldwide definition of digital-game ownership. EU consumer law provides mandatory protections for digital content and distinguishes digital-content contracts from sales of goods. Those protections can give consumers remedies without turning a license into copyright ownership.
California AB 2426 materials address marketing language: sellers generally cannot use “buy,” “purchase” or similar ownership wording for a digital good unless they provide a conspicuous license disclosure or obtain affirmative acknowledgment listing restrictions and possible revocation where applicable. The rule changes what must be disclosed, not the underlying copyright or every contractual limitation.
For a legal dispute, identify the seller, your country or state, the platform, the edition and the exact terms accepted at purchase. A statement that is accurate for an EU consumer may not describe the remedies available elsewhere.
What to check before paying
- Read the current EULA and store agreement. Look for “license,” “non-transferable,” suspension, revocation, account closure and governing-law clauses.
- Confirm account binding. Determine whether the game can be used by another account, on a second device or after changing platforms.
- Identify DRM and activation. Check for always-online requirements, periodic authentication, a one-time code or a separate launcher.
- Verify offline behavior. Find out whether installation, launch, saves and the particular mode you want all work without a connection.
- Check the shutdown plan. Look for an offline patch, local server option or stated end-of-service policy; absence of a promise is not a guarantee of continued operation.
- Record refund deadlines. Note the platform’s time limit and the event that ends digital-content withdrawal rights in your jurisdiction.
- Separate the products. Review the license for the base game separately from DLC, season passes, virtual currency, mods and community content.
- Compare a compatible physical release. Check whether the disc or cartridge contains the game, whether patches are optional, and whether online entitlements are reusable.
What the 56% figure tells you
The Australian Competition and Consumer Commission reported in 2025 that 56% of surveyed game players were unaware that some digital-store purchases provide a license rather than ownership. The finding reflects consumer understanding, not a rule that every digital transaction has identical terms. It is a useful warning to inspect the contract and technical requirements instead of inferring rights from the word “buy.”
A practical way to choose
Choose digital when convenience is the priority
A digital license can be the sensible choice when you value instant delivery, a unified library, automatic updates and access across the devices supported by one account. Accept that those benefits come with account, platform and service dependence.
Choose physical when possession and resale matter
A compatible disc or cartridge is preferable when you want something that can be lent, resold or retained independently of a storefront. Confirm that it is not merely a download key and that the game’s important features do not require a server that could disappear.
Use a risk-based decision
For a short-lived online game, the server dependency may be the decisive risk regardless of format. For a replayable single-player game, offline launch, a complete local build and the ability to reinstall may matter more than the purchase button. For a collector, physical possession can outweigh convenience; for a traveler, tested offline behavior can outweigh resale value.
