Data residency and data sovereignty answer different government-cloud questions. Residency is about the physical or geographic location of data, normally while it is at rest. Sovereignty is about which laws and authorities can govern access to that data, and which organization has practical control over the systems and operations that handle it. A region selector answers the first question only partially; it does not, by itself, prevent a provider, parent company, employee, subcontractor or support system in another jurisdiction from being subject to a foreign legal demand.
Government agencies therefore need a classification-specific assessment of storage, processing, management, personnel access, encryption keys, contracts, lawful-access procedures and resilience. The correct outcome may be a domestic-only design, a controlled multi-region design or an overseas service with strong safeguards. There is no universal rule that every government dataset must remain inside its country of origin.
Residency, sovereignty, localization and digital sovereignty
Data residency: where the data is
The Government of Canada defines data residency as “the physical or geographic location of an organization’s data while at rest.” In cloud terms, that usually means the country or region in which the provider stores primary databases, object storage, snapshots and backups. Residency can be specified in a service contract or region policy, but the precise scope matters: a promise covering a production database may not cover logs, telemetry, support tickets, metadata, disaster-recovery copies or a separate software component.
Data sovereignty: which law can govern it
Data sovereignty concerns a country’s right to control access to and disclosure of digital information under its legislation. The relevant jurisdiction can be connected to the location of the data, the provider entity that controls the service, the provider’s parent company, the people who can administer it, or the place where a legal order is issued. Data stored in a domestic facility can therefore still be exposed to a foreign law if an overseas provider or affiliate has legal control or technical access.

Localization is a requirement, not a synonym
Data localization is a law, regulation, policy or contract rule requiring data, processing or particular operations to remain in a specified territory. A localization rule may be narrow, such as keeping a record in-country, or broad, such as requiring local support and encryption-key control. Residency describes a state of affairs; localization directs what must happen. Neither term automatically establishes full sovereignty.
Digital sovereignty is broader still
Digital sovereignty can include an institution’s ability to govern, operate, maintain and sustain its systems, infrastructure and data. That brings in operational independence, supply-chain exposure, technical skills, portability and continuity. Canada’s 2025 framework notes that complete digital autonomy is impossible in an interconnected digital world. For procurement, sovereignty is more useful as a set of capabilities and controls than as an absolute label.
Why a cloud region is only part of the answer
Selecting a country or region in a cloud console establishes only what the service promises to place there. A service can still process information elsewhere for identity, billing, security monitoring, customer support, abuse prevention, software updates or artificial-intelligence features. A SaaS product may use components outside the principal service region even when its storage setting appears local.
UK multi-region and software-as-a-service guidance specifically warns agencies to examine those boundaries. International vendors must comply with the laws of their home countries and, in many cases, the laws of the countries where they operate. A foreign authority may seek information from a provider under its own data-access legislation even when the customer selected a domestic region. A contract can require notice and challenge procedures where lawful, but it cannot cancel an applicable statute or court order.

- Where are primary data, backups and replicas stored?
- Where is data processed, including temporary caches and analytics?
- Where are management planes, logs, metadata, support records and SaaS dependencies operated?
- Where are the provider entities, subcontractors and personnel that can access or control those functions located and legally established?
The answers should be documented for the exact service edition and configuration. A provider’s marketing description of a “local region” is not a complete jurisdictional analysis.
Does government data have to stay in the country?
The answer depends on the government, classification, statute, contractual policy and risk decision. Canada and the United Kingdom illustrate why a single global rule would be misleading.
Canada: Protected B, Protected C and Classified information
The Government of Canada’s current Guideline on Service and Digital directs chief information officers to identify and evaluate facilities in Canada, or specified government premises abroad, as a principal delivery option for government-controlled sensitive information categorized Protected B, Protected C or Classified. The guideline does not say that an approved facility must be owned by a Canadian corporation. It also applies its residency policy to storage, not data in transit, while requiring appropriate security controls wherever the data resides.
For those classifications, departments still have to apply the relevant encryption, access, monitoring, assessment and authorization requirements. The guideline is a Canadian government policy example, not a rule for every organization that handles Canadian data.
United Kingdom: OFFICIAL is not a universal UK-location mandate
UK Government Digital Service guidance published 5 February 2025 states: “Government data at OFFICIAL (including the SENSITIVE marking) can be stored and processed in data centres or Cloud regions overseas when satisfactory legal, data protection and security practices are in place; there is no universal requirement for government data classified as OFFICIAL to be physically located in the UK.” It recommends controlled, considered multi-region use that remains compatible with UK law.

The same guidance draws a firm boundary around higher classifications: public cloud is not designed to protect SECRET and TOP SECRET information. That limitation should not be generalized to OFFICIAL data, and OFFICIAL flexibility should not be treated as permission to move every dataset overseas without an assessment.

1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesEuropean Union: a multidimensional procurement model
The European Commission’s June 2026 sovereign-cloud framework reports an overall sovereignty score built from 48 criteria in eight categories: legal jurisdiction; data and artificial intelligence; operations; supply chain; technology; security and compliance; strategy; and environmental sustainability. The count demonstrates the breadth of a sovereignty assessment. It is not a universal certification, a legal definition that applies in every country or proof that a particular vendor is sovereign.
Can a provider be compelled to disclose data stored abroad?
Potentially, yes. The possibility depends on the provider’s corporate structure, the service terms, the applicable laws and the facts of the demand. A foreign authority may order a provider or an affiliated entity to produce information within its legal reach, even if the bits are stored in another country. The provider may also receive a request from the country in which the facility is located.
Residency can reduce some risks, such as routine physical access or a conflict with a local storage rule, but it does not erase legal reach over a company. Sovereignty analysis should therefore examine:
- Which legal entity signs the contract and controls the service?
- Which parent, affiliate or subcontractor can administer systems or obtain support data?
- Which countries’ disclosure, interception, national-security or data-protection laws may apply?
- Can the provider technically retrieve plaintext, or are customer-controlled keys required?
- What validation, minimization, escalation and customer-notification process applies to a legal demand?
Encryption can reduce exposure, especially when the government controls the keys and the provider cannot decrypt content on its own. It does not make metadata, account records or operational logs invisible, and key custody must be tested against the actual service workflow.

How shared responsibility changes the security decision
Cloud security is shared and service-specific. Canada’s cloud white paper describes the provider as responsible for security of the cloud, while departments remain responsible for security to, from and in the cloud. The division changes between infrastructure, platform and SaaS services, so an agency should map every control rather than rely on a generic responsibility chart.
Customer responsibilities
- Classify the information before selecting a service.
- Configure identity, least privilege, network boundaries, logging and retention.
- Decide who controls encryption keys and who may authorize decryption.
- Approve integrations that export data to support, analytics or SaaS components.
- Test restoration, incident response and exit procedures.
Provider and supplier responsibilities
- Secure facilities, hardware, hypervisors and managed service components within the contracted boundary.
- Control and monitor privileged personnel and subcontractors.
- Disclose service locations, subprocessors and material changes.
- Operate lawful-access and incident-notification processes.
- Maintain continuity, recovery and supply-chain safeguards.
The exact allocation must be recorded in the service description, security documentation and contract. “The provider is certified” does not transfer the agency’s classification or configuration duties.
A practical sovereignty assessment
Use the following sequence for each dataset and proposed service. Record evidence for the specific region, edition and date rather than relying on a platform-wide statement.
- Classify the information. Identify the government classification, personal-data obligations, records rules, secrecy statutes and mission impact if confidentiality, integrity or availability fails.
- Define the service boundary. List production storage, replicas, backups, caches, logs, metadata, support systems, management planes, disaster-recovery sites and every SaaS dependency.
- Map legal and operational control. Identify the contracting entity, parent company, subprocessors, staff locations, administrator access and jurisdictions that can issue or enforce a demand.
- Examine cryptography. Document encryption in transit and at rest, key generation, custody, rotation, recovery and the people or systems able to authorize decryption. For Canada’s Protected B, Protected C and Classified information, the current guideline requires encryption in transit.
- Review lawful-access handling. Require a documented process for authenticating demands, challenging overbroad requests, minimizing disclosure and notifying the customer where legally permitted.
- Test resilience and exit. Determine what happens if a region, provider entity, identity system, network path or critical subcontractor is unavailable. Confirm that data can be restored or migrated in a usable form.
- Make the policy decision. Compare domestic, multi-region and overseas designs against classification, legal exposure, security capability, continuity and practical cost. Obtain the required authorization before production use.
Comparison framework for cloud options
A useful comparison makes trade-offs visible instead of treating “local” as an automatic verdict.

|---|---|---|
| Storage and processing | Where are primary data, replicas, backups, temporary files and processing jobs located? | Processing or recovery may cross a border even when primary storage does not. |
| Management and personnel | Where are control planes, support desks and privileged administrators located? | Human and administrative access can create jurisdictional exposure. |
| Provider jurisdiction | Which entity, parent and subcontractors are subject to which laws? | Corporate legal reach may differ from facility location. |
| Classification fit | Does the service meet the government’s classification-specific policy? | Rules for OFFICIAL, Protected B or Classified information are not interchangeable. |
| Encryption and keys | Who holds keys, and can the provider decrypt without the customer? | Key control can limit content disclosure but does not cover every data type. |
| Lawful access | Are validation, minimization, challenge and notification procedures defined? | A clear process reduces unnecessary disclosure; it cannot override law. |
| Continuity | Can the agency operate through a regional outage, supplier failure or exit? | Operational sovereignty includes maintaining essential services. |
| Capability and cost | What resilience, latency, features, staffing and migration costs do alternatives impose? | A stricter location choice can reduce available capability or increase dependency. |
Contract and governance controls
Contracts should state the approved locations and service components, provider security and privacy duties, permitted access, subcontractor responsibilities, breach and change notification, audit evidence, continuity objectives and exit assistance. Include a process for government or judicial demands: authentication, scope review, minimization, escalation and notice where lawful.

ENISA advises public bodies to extend data-handling obligations to third-party providers and to maintain mechanisms ensuring that only relevant data is surrendered in response to legitimate judicial demands. A contract cannot nullify applicable law, but it can assign responsibilities, require cooperation and make non-compliance actionable.
Governance should include periodic reassessment. Providers change regions, subprocessors, support models and product features. Recheck the service boundary after a major release, contract amendment, incident, legal change or classification change. Keep an evidence register containing architecture diagrams, location statements, key-management records, subprocessors, access logs, assurance reports and recovery-test results.
Common mistakes and how to correct them
“The domestic region makes the data sovereign.”
Correction: map provider entities, personnel, subcontractors, management systems and applicable laws in addition to storage location.
Recommended Free Tools
“All government information must remain within national borders.”
Correction: identify the country and classification first. UK OFFICIAL guidance expressly permits overseas storage and processing when legal, data-protection and security practices are satisfactory, while other classifications and Canadian policies impose different constraints.
“The provider’s infrastructure certification solves the problem.”
Correction: certifications support assurance but do not replace classification, configuration, key control, lawful-access review or continuity planning.
“SaaS uses the region selected for the main service.”
Correction: obtain a component-level data-flow description and identify analytics, support, identity, logging and backup services outside that region.
“Encryption means no disclosure is possible.”
Correction: verify who controls keys and what information remains available in plaintext, including metadata, account details and logs.

What a defensible decision looks like
A defensible government-cloud decision names the dataset, classification, service version, regions, processing paths, provider entities, access roles, key arrangement, applicable laws, contractual protections and recovery design. It explains why the chosen architecture meets the governing policy and what residual risks remain. In some cases that will be a domestic service with customer-held keys; in others it will be a controlled multi-region deployment or an overseas service approved for the classification. The important distinction is that geography is one control among several, not a substitute for sovereignty analysis.
