Data-center zoning rules determine where a facility may be built, what approval path it needs, and how its buildings, equipment and operations must coexist with nearby uses. Typical controls cover zoning districts, hearings, setbacks, height and floor area, landscaping, appearance, noise, generator testing, water and wastewater, electric capacity, environmental review, and post-construction monitoring. There is no single national template: the controlling requirements are the adopted code and related permits for the specific parcel and jurisdiction.

What zoning is deciding

A data center is a land use as well as a building full of servers. Zoning decides whether that use belongs in a district, whether neighbors get a formal opportunity to comment, and what physical and operating safeguards are required before the project can open. A project can satisfy building and electrical codes and still fail to obtain land-use approval if the use is not allowed in that location or the application omits required studies.

Local governments may define “data center” as its own principal use, place it under an industrial or warehouse category, or apply special rules only above a size or power threshold. Read the definitions, use table, dimensional standards and procedural sections together; a planning summary may not contain every condition in the adopted code.

1. Zoning district and approval route

Permitted districts and use definitions

The first question is whether the parcel is in a district where a data center is allowed. Some codes permit facilities by right in selected industrial zones. Others require a conditional use permit, special exception, planned-development review or rezoning. The answer can change with the facility’s size, server-room area, electrical demand or accessory uses such as substations and fuel storage.

Calvert County, Maryland, illustrates why the definition matters. The county said data centers had previously been handled where warehouses were allowed, then formally defined and restricted them in a 2025 update. Its current framework limits them to industrial zones: a facility in Heavy Industrial I-2 requires conditional approval, while a facility in Light Industrial and Mixed Use I-1 requires conditional-use approval that includes a Board of Appeals special exception. Applicants must also hold a public meeting before Planning Commission consideration.

Conditional and special approvals

Kearney, Nebraska, requires a conditional-use permit in its BP, M-1 and M-2 districts, with hearings before the Planning Commission and City Council. A conditional process lets the authority impose site-specific conditions—such as acoustic barriers, landscaping, equipment placement or reporting—rather than granting an unrestricted right to operate.

Tucson handles large-scale facilities through its existing Planned Area Development and Planned Community Development processes. The process includes neighborhood coordination, a public hearing, Zoning Examiner review and final consideration by the Mayor and Council. Tucson’s large-scale rules became effective September 4, 2026, so an older article or staff presentation may describe a process that has since changed.

Public notice and hearing rights

Approval type determines who must be notified, which hearing body acts, and whether an approval can be appealed. Check notice radii, mailing and posting requirements, hearing dates, evidentiary deadlines and appeal windows. A “by-right” project may still need site-plan, building, stormwater, noise or environmental permits, but it generally does not receive the same discretionary land-use hearing as a conditional or special-exception project.

2. Separation, setbacks and site layout

Data-center campuses can contain large, windowless buildings, cooling equipment, transformers, generators, fuel systems and security fencing. Zoning standards manage their relationship to homes, property lines, roads and sensitive uses such as schools or health facilities.

Setbacks and separation distances

Setbacks establish the minimum distance from a property line or public right-of-way. Separation rules may require a larger distance from a residence, a residential building permit or another sensitive use. Calvert County states a 200-foot setback from property lines and 400 feet from a parcel containing a residence or active residential building permit, subject to a stated common-ownership exception. Those distances are county-specific, not a general national standard.

When comparing jurisdictions, record whether a distance is measured from the property line, the building wall, a generator or another piece of equipment. Also note whether a common ownership, road, zoning-district or existing-building exception changes the calculation.

Buffers, screening and lighting

Landscape buffers can include trees, berms, opaque fencing and planted setbacks. Screening requirements often apply to rooftop units, cooling yards, transformers, loading areas, fuel tanks and emergency generators, not only to the main building. Lighting standards may limit glare, spill onto neighboring property, fixture height and hours of operation. A plan that shows only the building footprint is therefore incomplete; the equipment yard and its visual treatment are part of the zoning review.

Height, floor area and server-room limits

Codes can regulate maximum building height, total floor area, the portion devoted to “white space” (server rooms), lot coverage or the number of buildings in a campus. Tucson’s earlier proposed summary included a 50-foot height limit; that proposal should not be treated as adopted without checking the effective text. Minneapolis describes preliminary recommendations that would limit new or expanded facilities through conditional-use review, restrict them in downtown districts, cap white space at 175,000 square feet and favor use of existing buildings. Minneapolis labels those recommendations preliminary and its hearing dates tentative, so they are not equivalent to an effective ordinance.

3. Building form and neighborhood compatibility

Some ordinances regulate the appearance of a data center even when the interior is industrial. Facade treatments can require varied materials, articulation, entrances, windows or architectural screening along public streets. The purpose is to prevent a long, blank wall and to make a large utility-like structure fit an established corridor.

Review the elevation drawings, not just the site plan. Confirm where loading doors, intake and exhaust openings, rooftop equipment, security fencing and service drives face neighboring parcels. A facade condition can affect mechanical design and cost if it requires a parapet, screen wall or equipment relocation.

4. Noise, cooling systems and generator operation

What gets measured

Noise is a recurring issue because cooling equipment can run continuously and generators may produce distinctive tonal or low-frequency sound. Rules may set a sound level at the property line, at a dwelling or at another measurement point. They may distinguish daytime and nighttime limits, account for existing ambient sound, and require special treatment of tones or low frequencies.

Kearney lists tonal and low-frequency standards, property-line sound limits, sound studies, emergency-generator measures and air-quality information. A study should identify equipment assumptions, operating loads, weather conditions, receptor locations, octave or one-third-octave analysis where required, and the mitigation included in the design.

Preconstruction modeling and postconstruction verification

Fairfax County’s staff report describes worst-case modeling with cooling equipment at full load and a post-construction study before a Nonresidential Use Permit is issued. This two-stage approach matters: approval is based on predicted performance, but occupancy or operating authorization can depend on measured results. Conditions may require barriers, silencers, equipment isolation, revised operating controls or additional monitoring if the completed facility exceeds the limit.

Generator testing and emergencies

Generator provisions often separate routine testing from emergency operation. Fairfax’s framework describes exceptions for routine backup-generator testing and emergency use under the county’s noise rules. Fort Worth’s web materials, which separate existing and proposed standards, describe proposed weekday testing hours, a baseline ambient-noise study near residential areas and a limit relative to that baseline. Those Fort Worth items are proposals, not adopted requirements unless the current code says otherwise.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask the applicant’s acoustic engineer and electrical designer to coordinate. A generator schedule that is acceptable for air-quality or reliability purposes may still violate a local testing-hour or noise condition.

5. Water, wastewater and cooling requirements

Cooling technology affects both land-use review and utility capacity. Authorities may request projected average and maximum-day water use, wastewater flows, cooling-tower cycles, make-up water, blowdown, reuse plans and drought contingencies. Even an air-cooled design can require water for humidification, fire protection or maintenance.

Tucson says large-scale projects must demonstrate adequate water and power and undergo environmental review. Kearney lists water and wastewater feasibility studies. Fort Worth’s development materials describe water-loading and wastewater studies. These submissions help a utility and planning authority determine whether the project can be served without shifting unreasonable costs or risks to existing customers.

Pennsylvania’s Department of Community and Economic Development describes a state GRID consent-order framework that includes annual water-use reporting, maximum-day tracking, evaluation of feasible recycling or closed-loop cooling, and generator limits and logging. That is state-level program guidance interacting with local zoning; it is not a rule that automatically applies across the country.

6. Electricity, substations and backup generation

Large facilities can require dedicated substations, transmission upgrades, multiple utility feeds, batteries and on-site generators. A zoning application may need a utility letter confirming available capacity, the proposed peak demand, interconnection status, substation location, fuel type and storage volume. The land-use approval may cover the building while separate utility, air-quality, fire-code and hazardous-material permits govern the infrastructure.

Ask whether the code treats a substation, battery enclosure, fuel tank or generator yard as an accessory use or as a separate principal or conditional use. That classification can change setbacks, screening, emergency-access design and hearing requirements.

7. Environmental, stormwater and air-quality review

Environmental review can enter through zoning conditions or through separate state and local programs. Typical submissions address stormwater detention and water quality, wetlands or habitat, tree removal, traffic, air emissions from generators, fuel storage, hazardous materials and construction impacts. A planning approval does not replace an air permit, stormwater authorization, wastewater approval or building permit.

Pennsylvania’s GRID framework adds enhanced safeguards for designated Environmental Justice Areas and requires proof of local land-use approvals before specified environmental permits can be issued or receive final review. The sequence matters: a project may need local approval before an environmental agency will complete its review.

8. Monitoring, reporting and enforcement after approval

Conditions can continue after construction. Common obligations include a post-construction acoustic test, annual generator-testing logs, annual water-use reports, utility reporting, inspections, landscape maintenance and complaint-response procedures. Kearney lists annual reporting, while Fairfax describes verification before operating authorization.

Read the enforcement section and the approval conditions for deadlines, responsible parties and remedies. Failure to meet a condition can lead to a notice of violation, fines, suspension of an operating permit or a requirement to install additional mitigation. Keep records that prove testing times, sound levels, water use and corrective actions.

9. How to compare a local code with examples from other cities

Use a common checklist, but do not copy another city’s numbers into a new project. Record the following for each jurisdiction:

  • Definition and thresholds: data-center definition, server-room or white-space limit, building-size and power thresholds.
  • Location: eligible zoning districts and whether an accessory substation, generator yard or battery system is treated separately.
  • Approval: by-right, site plan, conditional use, special exception, planned development or rezoning; hearing bodies and appeal rights.
  • Physical form: setbacks, separation from homes, height, floor area, lot coverage, buffers, facade design, fencing, lighting and equipment screening.
  • Noise: baseline study, modeling assumptions, measurement locations, property-line limits, tonal or low-frequency treatment, testing hours, emergency exceptions and post-construction verification.
  • Utilities and environment: water, wastewater, electric capacity, generators, air quality, stormwater, traffic and environmental-review documents.
  • Continuing duties: annual reports, inspections, monitoring, complaint handling, enforcement and expiration or renewal terms.

Compare the adopted ordinance, official application checklist, staff report and approval conditions. A staff report may describe a proposal, and a web page may summarize a rule that was later amended.

10. A practical application sequence

  1. Confirm jurisdiction and parcel status. Identify the city, county, planning area, zoning district, overlay zones and any annexation or development-agreement terms.
  2. Find the operative definition. Search the code for “data center,” “server farm,” “warehouse,” “telecommunications” and related infrastructure.
  3. Map the approval path. Determine whether the use is permitted, conditional, a special exception, a planned-development use or a rezoning request. Calendar notice and hearing deadlines.
  4. Test the envelope. Map property-line and residential setbacks, height, floor area, lot coverage, buffers, access, fire lanes and equipment locations.
  5. Commission technical studies early. Prepare acoustic modeling, utility-capacity confirmation, water and wastewater estimates, stormwater design, air-quality information and environmental documents.
  6. Coordinate operations with design. Align generator testing, cooling loads, maintenance access, fuel deliveries and emergency procedures with noise, air-quality and fire requirements.
  7. Review conditions before construction. Identify post-construction tests, reporting schedules, landscaping obligations and enforcement consequences, then assign an owner for each duty.
  8. Recheck effective dates. Verify that every standard is adopted and effective on the filing date. Do not rely on a draft, preliminary recommendation or superseded staff summary.

What these rules do not establish

Examples from one jurisdiction do not establish a national setback, a universal noise limit or a standard water-use allowance. Fairfax County’s public materials, for example, cite a regional figure that approximately 40 percent of data centers use air cooling, attributed to the Interstate Commission on the Potomac River Basin; they also cite Northern Virginia and the Potomac River basin estimates of less than 100,000 gallons per day of regional data-center water use and less than 0.1 percent of total upstream consumptive use. Those figures are geographically limited and should not be generalized to every market.

Fairfax also states that facilities using 100 megawatts or more are subject to additional information requirements under new laws, and reports more than 20 stakeholder meetings during its 2024 rule-development effort. Such thresholds and engagement histories explain why a local process looks the way it does; they do not replace the parcel’s current code.
