Crypto businesses operating in the European Union need a documented, risk-based anti-money-laundering and counter-terrorist-financing (AML/CFT) programme—not just an identity check at account opening. First map the services you actually provide to the crypto-asset service-provider (CASP) definitions used by the Markets in Crypto-Assets framework (MiCA), then identify the Member State, competent authority and interim national rules that apply. Covered firms must perform customer and beneficial-owner due diligence, monitor relationships and transactions, control risks involving self-hosted addresses, report suspicious and attempted transactions, and maintain governance, records and escalation processes.

The EU framework is a package of instruments with different dates. Regulation (EU) 2023/1113, the Transfer of Funds Regulation, applies from 30 December 2024. Regulation (EU) 2024/1624, the directly applicable AML Regulation, generally applies from 10 July 2027. Those dates do not replace current national requirements or supervisory guidance that apply before 2027.

Start by deciding whether your activities are covered

“Crypto business” is not itself a legal category. The AML framework brings covered CASPs into the definition of obliged entities by referring to services performed under MiCA, subject to specified exceptions. A company’s obligations therefore depend on what it actually does, not on its branding or on the fact that it uses blockchain technology.

Map services, entities and locations

Create an inventory of every service and entity in the group: for example, custody or administration, operating a trading platform, exchanging crypto-assets for funds or other crypto-assets, executing or transmitting orders, placing crypto-assets, providing transfer-related services, or giving advice or portfolio-management services where the MiCA definitions cover them. Document which legal entity performs each activity, where it is established, which customers it serves and whether another group company or contractor performs part of the process.

Compare that factual map with the MiCA and AML Regulation definitions, including their exceptions. Do not assume that an exchange, software developer, token issuer, miner, protocol contributor or analytics provider has the same status as a CASP. Conversely, do not assume that calling a service “non-custodial” removes every AML question; the legal analysis turns on the service delivered and the applicable definitions.

Identify the governing Member State

Before setting local procedures, identify the establishment, passporting and service-location facts that determine which Member State’s competent authority supervises the firm. The EU regulations provide a common baseline, but national legislation, registration arrangements, supervisory expectations and transitional rules matter—especially before 10 July 2027. Keep a written jurisdiction memo and update it when the business adds a product, changes its establishment or serves customers through a new entity.

Keep the EU instruments and dates separate

Instrument What it does for a crypto business Application point
Regulation (EU) 2023/1113 (Transfer of Funds Regulation) Requires information and traceability for covered transfers of crypto-assets, including the operational data that must travel with a transfer. Applies from 30 December 2024.
Regulation (EU) 2024/1624 (AML Regulation) Sets harmonised AML/CFT duties for obliged entities, including covered CASPs: governance, risk management, customer due diligence, monitoring, reporting and controls for specific relationships and activities. Generally applies from 10 July 2027 and is directly applicable in all Member States.
Directive (EU) 2024/1640 Addresses Member State mechanisms and the national architecture needed to support the AML framework. Member State implementation and national timing must be checked locally.
Regulation (EU) 2024/1620 Establishes the Anti-Money Laundering Authority (AMLA) and the institutional framework. Institutional provisions have their own implementation timetable; follow AMLA and national supervisory communications.

Article 78 of Regulation (EU) 2024/1624 states: “This Regulation shall be binding in its entirety and directly applicable in all Member States.” Direct applicability does not eliminate the need to identify the relevant national competent authority or to comply with national provisions that apply in the meantime. Treat 30 December 2024 and 10 July 2027 as dates for different instruments, not as one general AML start date.

Build a risk-based AML/CFT programme

A compliant programme is an operating system for decisions, not a policy document stored in a folder. Its controls should be proportionate to the firm’s size, services, customer types, transaction patterns, geographies, delivery channels and other relevant risks. The programme should cover both money laundering and terrorist financing (ML/TF).

Document the enterprise risk assessment

Assess risk across products and services, customers and beneficial owners, countries and territories, transaction types, distribution channels, technologies and outsourcing arrangements. For a crypto business, consider features such as rapid settlement, cross-border reach, privacy-enhancing functionality, use of intermediaries, exposure to mixers or other obfuscation methods, and the ability to move assets between hosted and self-hosted addresses. The assessment should explain the evidence used, the assumptions made, the risk rating and the control chosen for each material risk.

Set review triggers instead of relying only on an annual calendar. Reassess when the firm launches a new token or transfer route, enters a new market, changes a critical vendor, sees a new typology, receives a supervisory finding or detects a material change in customer or transaction behaviour.

Assign accountability and resources

Give a named person responsibility for AML compliance, define who can approve higher-risk relationships, and establish independent escalation routes to senior management. Board or equivalent oversight should receive meaningful information about risk, alerts, reports, staffing, training, control failures and remediation. Allocate staff, technology, training and time that match the risk assessment; an automated screening tool cannot substitute for accountable decisions and documented review.

Write procedures people can execute

Policies should translate legal requirements into workflows: who collects each data item, which evidence is acceptable, when a case is blocked or escalated, who decides whether to file a report, how records are retained, and how exceptions are approved. Test the procedures with sample cases and revise them when operations or law change.

Perform customer and beneficial-owner due diligence

Customer due diligence (CDD) applies at the start of a business relationship and to relevant occasional transactions. Establish and verify the customer’s identity, identify and verify the beneficial owner where applicable, understand the purpose and intended nature of the relationship or transaction, and apply measures appropriate to the risk.

Onboarding workflow

  1. Identify the customer. Collect the information required for the customer type and verify it using reliable, independent sources. For a legal entity, establish its legal existence, ownership and control structure.
  2. Identify the beneficial owner. Determine the natural person or persons who ultimately own or control the customer, resolve complex or opaque structures, and record how the conclusion was reached.
  3. Understand expected activity. Record the purpose of the relationship, expected products, jurisdictions, funding sources where relevant, anticipated volumes and counterparties. These expectations provide a baseline for later monitoring.
  4. Rate the risk. Apply documented factors consistently and assign enhanced measures when the risk warrants them. A low-risk rating does not remove CDD.
  5. Approve, restrict or decline. Route higher-risk cases to the designated decision-maker, record the rationale and apply any conditions or limits that the policy permits.

Keep information current

CDD is not a one-time screen. Update identity, ownership, risk information and expected activity on a risk-sensitive schedule and when a trigger occurs, such as a material transaction change, an ownership change, adverse information or an unusual alert. Keep an audit trail showing what was checked, when, by whom and what decision followed.

Simplified measures may be appropriate in genuinely lower-risk situations, but they still involve due diligence. They are not a blanket exemption from identifying the customer, understanding the relationship or monitoring activity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Monitor relationships and transactions continuously

Design monitoring to detect unusual or suspicious transactions and activity against the customer profile and the firm’s known risk. Combine rules, scenario-based detection and human review where appropriate. Calibrate thresholds to the service and document why a scenario should generate an alert.

Connect alerts to investigation

Every alert needs an owner, a deadline, an evidence trail and a disposition. Investigators should be able to see the relevant customer and beneficial-owner information, transaction history, linked addresses, prior alerts and previous decisions. Escalate unresolved concerns to the person responsible for AML compliance, and separate routine false-positive closure from a decision that requires a suspicious-transaction report.

Use monitoring outcomes to improve controls

Track recurring typologies, alert quality, review times, backlogs and control failures. Feed those findings into the risk assessment, scenario tuning, staff training and senior-management reporting. Monitoring that produces alerts but cannot demonstrate timely review and escalation is not an effective control.

Apply controls to transfers involving self-hosted addresses

A self-hosted address is an address that is not linked to a CASP or similar provider. Transfers to or from such an address require a risk-based control process; the cited provisions do not create a blanket ban on self-hosted addresses.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assess the transfer and the parties

Identify and assess ML/TF risk associated with the transfer, the customer, the counterparty information available and the origin or destination of the assets. Maintain policies, procedures and controls specifically addressing these transfers. The assessment should be reproducible, so another reviewer can understand why the firm accepted, delayed, restricted or escalated the transfer.

Use proportionate mitigating measures

Depending on the identified risk, measures may include risk-based identification and verification of an originator or beneficiary, obtaining further information about the origin or destination of the assets, applying transaction or relationship restrictions, and enhanced ongoing monitoring. Do not treat every self-hosted address as inherently illicit, and do not treat every transfer as automatically low risk because the customer is already onboarded.

Meet transfer-information and traceability duties

Regulation (EU) 2023/1113 applies from 30 December 2024 and extends transfer-information and traceability requirements to covered transfers of crypto-assets. Map the regulation’s data requirements to your product flow: capture the required originator and beneficiary information, transmit it with the transfer where required, protect it through the processing chain, and establish exception handling when data is missing or inconsistent.

Document which system or team validates the information, what happens when a transfer cannot proceed, how information is made available for investigation, and how the process works when another provider or a self-hosted address is involved. Keep this transfer process distinct from the broader 2027 AML Regulation programme, while integrating both into the same control inventory.

Report suspicious and attempted transactions

Under the AML Regulation, suspicious transactions—including attempted transactions—must be reported to the competent financial intelligence unit (FIU) regardless of transaction amount. A suspicion can also arise because the firm cannot complete customer due diligence. The reporting duty is not limited to completed transfers or to a monetary threshold.

Operate a clear escalation path

  1. Capture the trigger. Preserve the alert, customer information, transaction details and facts that created the concern.
  2. Investigate promptly. Obtain relevant internal records and, where permitted, additional information from the customer or counterparties. Record the questions asked and evidence reviewed.
  3. Make the reporting decision. The responsible AML officer or designated function should decide whether the legal threshold for suspicion is met and document the reasoning.
  4. File through the competent FIU channel. Follow the applicable Member State’s filing format, timing and contact requirements.
  5. Protect confidentiality. Restrict access to the report and related information. Do not disclose a report or its existence in a way prohibited by law, including to the subject of the report where that would constitute tipping-off.

A suspicious-transaction report is a communication for competent authorities, not an accusation or finding of guilt. The AML Regulation expressly states that a suspicious transaction is not an indication of criminal activity. Continue to manage the customer and assets according to law and policy after filing; do not automatically close every relationship without documenting the risk and legal basis.

Control cross-border correspondent relationships

Before establishing a cross-border correspondent relationship with a non-EU respondent that provides similar crypto-asset services, perform enhanced checks and obtain senior-management approval.

Checks before approval

  • Confirm whether the respondent is licensed or registered for the relevant services.
  • Understand its business, reputation and the quality of supervision it receives.
  • Assess its AML/CFT controls and obtain enough information to judge their effectiveness.
  • Define and document each party’s responsibilities, including information exchange, monitoring and escalation.

Payable-through arrangements

For a payable-through crypto-asset account, confirm that the respondent has verified and continues to conduct due diligence on customers with direct access to the account, and that it can provide the relevant CDD information on request. Set a process for obtaining that information quickly during an investigation.

Review and termination

Update correspondent diligence regularly and whenever new risks emerge. If the relationship must end for AML/CFT reasons, document the facts, decision authority, notice and risk-managed wind-down. A signed contract alone does not demonstrate that the controls operate in practice.

Prepare for implementation and supervision

Use the period before 10 July 2027 to close gaps against the AML Regulation while continuing to meet requirements that already apply under national law and the Transfer of Funds Regulation. Maintain a legal and regulatory change log with the application date, affected process, owner, implementation status and evidence of testing.

Implementation checklist

  • Map services to MiCA and AML definitions for every entity and product.
  • Identify the Member State, competent authority and current national requirements.
  • Complete and approve an enterprise ML/TF risk assessment.
  • Assign accountable AML leadership, escalation powers and sufficient resources.
  • Implement CDD, beneficial-owner verification, risk rating and refresh triggers.
  • Deploy transaction and activity monitoring with documented investigation standards.
  • Implement self-hosted-address risk assessment and mitigating controls.
  • Operate the 30 December 2024 transfer-information process for covered crypto transfers.
  • Test suspicious-activity escalation and FIU reporting, including attempted transactions and failed CDD.
  • Document correspondent-relationship approval, payable-through checks and periodic reviews.
  • Train staff, test controls, track defects and report meaningful metrics to senior management.

Common failure modes and corrections

“We completed KYC, so we are compliant.”

Onboarding is one part of CDD. Correction: connect current customer information to ongoing monitoring, periodic refreshes, event-driven reviews and reporting.

“Self-hosted addresses are prohibited.”

The requirement is risk assessment and proportionate mitigation, not an automatic ban. Correction: define evidence-based controls and escalation thresholds for transfers involving those addresses.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Only large transactions are reportable.”

Suspicious and attempted transactions are reportable regardless of amount under the AML Regulation. Correction: train staff and tune procedures around suspicion, not value alone.

“The 2027 regulation means nothing applies today.”

The Transfer of Funds Regulation applies from 30 December 2024, and national rules and guidance may apply before the AML Regulation’s general application date. Correction: maintain a dated obligations register and obtain Member State-specific advice.

“A vendor’s alert is the compliance decision.”

Technology can support screening, monitoring, evidence collection and workflow, but the CASP retains its legal obligations. Correction: assign human ownership, preserve explainable audit trails and test data, scenarios and escalation.

What good evidence looks like

A supervisor or auditor should be able to follow a control from legal requirement to operating evidence: the approved policy; the risk assessment; staff and system ownership; a sample onboarding file; beneficial-owner reasoning; monitoring alerts and case notes; self-hosted-address decisions; transfer-information exceptions; FIU reports and confidentiality controls; correspondent approvals; training records; testing results; and remediation tracked to closure. Keep records current enough to explain decisions made months earlier and specific enough to show who acted, when and why.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The practical sequence is therefore: classify the services, identify the governing Member State, build a proportionate AML/CFT system, perform and refresh CDD, monitor continuously, control self-hosted-address and transfer risks, report suspicion without a value threshold, and evidence every decision. Recheck the legal position whenever the business model or the applicable EU or national timetable changes.
