In U.S. courts, video evidence is evaluated first by asking whether the recording is what the party offering it says it is. That is authentication—not proof that every detail shown is true or that the video is automatically admissible. Under the federal framework, authentication, an expert’s reliability, and the recording’s ultimate meaning are separate questions. State rules and controlling cases vary by jurisdiction.

How do courts authenticate video evidence?

Federal Rule of Evidence 901(a) requires the party offering an item to provide enough evidence for a factfinder to conclude that it is what the party claims. Rule 901(b) gives examples of ways to do that, but they are illustrative rather than an exhaustive video-specific checklist. A suitable foundation depends on the recording and the particular claim being made about it.

Be precise about that claim. A party may offer a clip as footage from a particular camera, as a fair depiction of an event, as an unaltered file, or as a recording made at a stated time or place. Evidence supporting one of those claims does not automatically establish all the others.

Testimony from someone familiar with the event or recording

A witness with personal knowledge may identify a recording or testify that it fairly depicts what the witness observed. Other witnesses may be able to explain how footage was created, retrieved, or preserved. The relevant testimony depends on what the proponent needs to establish; a witness who recognizes a location, for example, may not be able to establish that a disputed event was recorded accurately.

Evidence about the recording system

Video may also be authenticated without a witness who saw the event, through evidence about the camera or recording process. In United States v. Harris, a military appellate court discussed this “silent witness” approach for automated-camera evidence. The court described a foundation addressing whether the system was reliable and working when the recording was made, and whether the recording was properly handled and safeguarded before trial. It noted that reliability evidence may come from an expert but need not.

Harris illustrates one approach; it is not a universal test for every federal, state, or military court. Practical questions that may help explain a system-based foundation include who operated or retrieved the footage, how the system recorded it, whether relevant settings or clocks were known, how the file was preserved, and who had access. These are useful questions, not a single mandatory checklist. Chain-of-custody evidence may support an integrity claim, but no one form of custody record is established here as dispositive.

Can security-camera footage be used as evidence?

It can be offered, but whether it is admitted depends on the foundation and the rules applicable in the particular proceeding. Security footage can be supported by a witness familiar with the event or camera, or by testimony and other evidence about how the system operated and how the recording was handled. The absence of an eyewitness to the event does not, by itself, resolve whether a system-based foundation is adequate.

Authentication is only one part of admissibility. A court may also need to consider matters such as relevance, hearsay, unfair prejudice, and rules concerning the original or a copy. The federal framework discussed here does not decide those separate questions, and applicable state law may differ.

What if someone says a video is a deepfake?

A claim that footage is fabricated or manipulated makes it especially important to distinguish contextual corroboration from proof that the depicted event is genuine. In Matter of M.S. (M.H.), the New York Court of Appeals explained: “In the authentication context, what matters most is whether the events depicted are as real as the proponent claims them to be, not whether there are some identifying features of the video that can be corroborated in real life.” That statement comes from a specific New York opinion; it is not a nationwide rule.

In practical terms, confirming a place, person, or other contextual detail may help, but it does not necessarily establish that the recorded event happened as shown. The dispute should be framed around the exact claim at issue: for example, whether the clip came from the claimed source, whether it depicts the event as asserted, or whether it has been altered in a relevant way.

The New York opinion also discussed proposed language for a federal Rule 901(c) addressing generative-AI fabrication. The language it quoted was a committee working draft, not an enacted rule. It should not be treated as current federal law on the basis of that opinion.

Does a video need a witness to be admitted?

Not necessarily. A witness with personal knowledge is one possible authentication route, but evidence about an automated recording system and the handling of its output may provide another. Whether that foundation is sufficient depends on the claim made for the video, the evidence presented, and the law of the forum.

For a particular recording, it is useful to separate the questions a witness or other evidence is meant to answer: who or what produced it, whether the system was functioning as claimed, whether the file was preserved and handled appropriately, and what the footage actually establishes about the disputed event. No one answer automatically establishes every point.

Can an expert prove that a video was edited?

An expert may offer specialized analysis, but the expert’s testimony faces a separate reliability screen under Federal Rule of Evidence 702. The proponent must show that the testimony will help the factfinder, rests on sufficient facts or data, uses reliable principles and methods, and reflects a reliable application of those methods to the case.

That inquiry is distinct from whether the video itself has been authenticated. A party may need a sufficient foundation for the recording and a sufficient basis for the expert’s conclusions. Credentials alone do not satisfy Rule 702. When a forensic opinion is disputed, the useful questions are what the expert examined, what data and method supported the opinion, and how that method was applied. Neither a particular tool nor a single metadata field is established as proof of authenticity in every case.

What determines how much a video proves?

Authentication asks whether the exhibit is what its proponent claims; it does not settle the weight or meaning a factfinder should give it. Once admitted, a recording may still be incomplete, unclear, or open to competing interpretations. Its significance depends on the claim it is offered to support and the other evidence in the record.

When comparing competing clips or forensic opinions, keep the comparison tied to the actual dispute. Relevant considerations can include the precise claim made for each clip, its source and recording-system history, preservation and handling, contextual corroboration, the nature of any alleged alteration, and the expert’s data, method, and application. These are analytical considerations drawn from the federal rules and cited decisions, not a court-mandated scoring system.

The outcome depends on the forum, the purpose for which the recording is offered, the applicable evidentiary rules, and the record developed in that case. Federal Rule 901, a military appellate decision, and a New York Court of Appeals opinion do not establish one universal result for every video dispute.
