Suppression of facts under Section 74 is narrower than an ordinary GST error. For tax periods up to financial year (FY) 2023-24, Explanation 2 to the CGST Act describes suppression in two situations: not declaring facts or information that the Act or rules require in a return or other prescribed document, or failing to provide information after the proper officer asks for it in writing.

That definition alone does not make every omission a Section 74 case. Section 74 also requires the unpaid or short-paid tax, erroneous refund, or wrongly availed or utilised input tax credit (ITC) to be connected with fraud, wilful misstatement, or suppression of facts to evade tax. The notice must therefore identify the omitted information, the applicable declaration or written request, the tax effect, and the alleged connection with evasion.

The statutory meaning of “suppression”

Explanation 2 to Section 74 supplies the definition used throughout the CGST Act:

“For the purposes of this Act, the expression ‘suppression’ shall mean non-declaration of facts or information which a taxable person is required to declare in the return, statement, report or any other document furnished under this Act or the rules made thereunder, or failure to furnish any information on being asked for, in writing, by the proper officer.”

  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

This wording creates two separate routes. The first concerns a required disclosure in a GST document. The second concerns a failure to answer a written information request from the proper officer. A factual mistake that does not fall within either route is not “suppression” under this statutory definition merely because it contributed to a tax difference.

Route 1: an omitted required declaration

The alleged fact must be something the taxpayer was required to declare in a return, statement, report, or another document furnished under the Act or rules. The analysis should identify:

  • the exact fact or information said to be missing;
  • the document in which it had to be declared;
  • the provision or rule creating that disclosure duty; and
  • how the omission produced the unpaid tax, erroneous refund, or ITC issue alleged in the notice.

An incorrect classification, arithmetic error, or disputed interpretation may still create a liability, but those facts do not automatically establish that a required fact was deliberately suppressed. The notice and the underlying record must show what disclosure duty applied.

Route 2: failure to answer a written request

Explanation 2 also covers failure to furnish information after the proper officer asks for it in writing. The request should be identifiable by its date, issuing officer, subject and scope. A casual conversation, an informal email whose authority or questions are unclear, or a request that never reached the taxpayer is not the same evidentiary situation as a documented statutory inquiry.

Whether a response is adequate depends on what was requested and what was supplied. A taxpayer who cannot produce a particular record should explain that limitation and provide available alternatives rather than simply ignore the request. Keep the request, proof of receipt, response, attachments and any extension correspondence together.

Why the definition is not enough for a Section 74 demand

Section 74(1) addresses tax that was not paid or was short-paid, an erroneous refund, or ITC wrongly availed or utilised “by reason of fraud or any wilful-misstatement or suppression of facts.” The provision also states that the conduct is connected “to evade tax.” Thus, a Section 74 case has several linked elements:

  1. There must be a specified tax shortfall, erroneous refund, or wrongly availed or utilised ITC.
  2. The department must rely on fraud, wilful misstatement, or suppression of facts as the statutory reason for that result.
  3. Where suppression is alleged, the facts must fit one of Explanation 2’s two routes.
  4. The alleged conduct must be tied to evasion, not merely to the existence of an accounting or reporting difference.

The same omission can therefore have different legal consequences depending on the evidence. An omitted fact may satisfy the descriptive part of Explanation 2, yet the department still has to establish the Section 74 connection and explain why the case is not an ordinary, non-fraudulent default.

Section 74 compared with Section 73

Section 73 covers the same broad categories of unpaid or short-paid tax, erroneous refunds and wrongly availed or utilised ITC when the reason is other than fraud, wilful misstatement or suppression of facts to evade tax. The choice of provision affects the allegations, procedural consequences and potential exposure, so a notice should be read for its stated grounds rather than its headline alone.

Question Section 73 Section 74
What default is addressed? Unpaid or short-paid tax, erroneous refund, or wrongly availed or utilised ITC. The same categories of default.
Stated reason Reasons other than fraud, wilful misstatement or suppression to evade tax. Fraud, wilful misstatement or suppression of facts to evade tax.
What should the notice explain? The calculation, period and legal basis for the ordinary default. The calculation plus the particular conduct said to constitute fraud, wilful misstatement or suppression and its tax-evasion link.
Disclosure or request identified? Not a defining requirement of Section 73. For suppression, the notice should identify the required declaration or written information request and the failure alleged.
Period covered by the current consolidated text Determinations pertaining to periods up to FY 2023-24. Determinations pertaining to periods up to FY 2023-24.

A tax officer cannot turn every discrepancy into Section 74 simply by selecting the harsher provision. The factual allegations must support the statutory ground chosen.

Does an omission in a GST return automatically amount to suppression?

No. An omission is only the starting question. Check whether the information was legally required, whether it was actually absent, whether the omission caused the identified tax consequence, and whether the record supports an inference of evasion. A bona fide interpretation of an unclear provision, a computational mistake, a reconciliation difference or a documentation error may be disputed without necessarily meeting Section 74’s suppression standard.

Conversely, the absence of a statement that the taxpayer intended to evade does not by itself end the matter. The department may rely on surrounding records, the nature of the omitted fact, repeated non-disclosure, responses to inquiries and the tax effect. The decisive issue is whether the notice and evidence establish the statutory ingredients, not whether the word “suppression” appears in a return or order.

  • Where was it required? Identify the return field, statement, report, invoice-related record or other document and the provision or rule requiring disclosure.
  • Was there a written request? If the department relies on the second route in Explanation 2, record the request date, issuer, delivery and precise unanswered question.
  • What is the tax consequence? Reconcile the department’s calculation to invoices, ledgers, returns, payment records and ITC registers.
  • How is evasion alleged? Look for facts connecting the omission to the short payment, refund or ITC, rather than a bare restatement of statutory labels.
  • Which financial year applies? Confirm that the period falls within the version of Section 74 the department is invoking.

If the notice provides only a mismatch, a demand figure and the words “fraud,” “wilful misstatement” or “suppression,” without the underlying particulars, that lack of detail can be a material objection. It does not automatically win the case; the notice must be assessed with its annexures and the complete record.

What recent court treatment indicates

Supreme Court report concerning an audit-based notice

A report published by SCC Times on 1 September 2026 describes a Supreme Court decision concerning audit objections for FY 2018-19 through FY 2020-21. According to that report, the Court treated Section 74 as requiring the assessing officer’s satisfaction, supported by foundational facts, that fraud, wilful misrepresentation or suppression led to the mismatch or short payment. The report says the notice and consequential order were set aside because a mechanical allegation was insufficient in that case.

The report is secondary coverage, not the official judgment text. Before relying on the decision in a filing, verify the case name, judgment, exact reasoning and any later order. The reported outcome illustrates the importance of factual particulars; it should not be presented as resolving every Section 74 dispute or as excusing a taxpayer from answering a properly supported notice.

Allahabad High Court illustration from 2024

In an official 2024 judgment page, the Allahabad High Court considered a Section 74 notice involving allegedly wrongful ITC. The Court noted that the notice did not state that the ITC was attributable to fraud, wilful misstatement or suppression to evade tax, and found that the proceedings lacked the basic ingredients of Section 74. This is a fact-specific High Court illustration. Another notice may contain additional allegations or evidence, so the text and annexures must be examined in each matter.

Does Section 74 apply after FY 2023-24?

The current CBIC-hosted consolidated text states that Sections 73 and 74 apply to determinations pertaining to periods up to FY 2023-24. Do not automatically apply Section 74 to a later tax period. First identify the period covered by the notice, then check the statutory provisions and amendments governing that period. A notice spanning several years may require separate analysis for each period rather than one conclusion for the entire demand.

A practical response workflow

  1. Separate the periods. Prepare a schedule by financial year, tax head, return and notice paragraph.
  2. Reconstruct the department’s calculation. Match the alleged shortfall, refund or ITC to returns, invoices, books, payment challans and reconciliation statements.
  3. Classify the alleged suppression route. Mark whether the department relies on an omitted required declaration, an unanswered written request, or both.
  4. Collect disclosure evidence. Save the relevant return fields, amendments, supporting reports, correspondence and contemporaneous explanations.
  5. Answer written requests directly. Respond item by item, identify unavailable records, provide substitutes where possible and retain delivery proof.
  6. Address the Section 74 elements separately. Explain why the facts do or do not establish the required declaration failure, tax connection and evasion allegation.
  7. Check the applicable period and provision. For periods after FY 2023-24, verify the replacement or amended framework before making a submission.
  8. Obtain professional advice for a live notice. Limitation, penalty, payment options and litigation strategy depend on the notice date, period, amount and record.

Common mistakes when challenging or defending suppression allegations

  • Arguing only that there was no intention. Intention is relevant to the statutory grounds, but the response should also address the required disclosure, written request and factual tax link.
  • Ignoring the information request. A taxpayer who disputes the demand should still preserve a complete, timely response to document requests.
  • Discussing the mismatch without the period. A calculation may combine years governed by different provisions.
  • Treating a label as proof. The words “suppression” or “fraud” do not identify the missing fact, legal duty or evidence by themselves.
  • Relying on a case summary without checking the judgment. Secondary reports can omit qualifications, procedural history or later developments.

The safest reading of Section 74 is therefore specific rather than formulaic: identify the exact information, the legal place where it had to be disclosed or the written question that went unanswered, the resulting tax effect, and the evidence said to connect that failure with evasion. Only then can the choice between Section 73 and Section 74 be evaluated for the relevant period.
