An informal food vendor is generally a person or small business selling food while operating at least partly outside formal systems such as business registration, vending licenses, tax arrangements, or approved trading locations. The label describes a business’s relationship to those systems—not simply what it sells or whether it uses a cart. The exact legal meaning depends on the country, municipality, and trading site.
What makes a food vendor informal?
“Food vendor” describes the activity: selling food. “Informal” describes how that activity relates to formal rules, records, and protections. Depending on the context, a researcher or authority may consider whether the seller has registered a business, holds the required food or vending license, pays applicable taxes, is permitted to trade at that location, or has access to formal services and protections.
These are possible indicators, not a single mandatory checklist. A study could classify vendors by business registration alone, while another could look at licenses, taxes, location permissions, business structure, or several factors together. The physical arrangement may be recorded too, but appearance is not a substitute for checking status: a cart or outdoor stall does not by itself establish informality, and a permanent-looking shopfront does not establish that every requirement has been met.

There is no single worldwide checklist. One study may classify businesses by registration; another may focus on vending permits, taxes, location permissions, or several factors together. For a useful definition, state the geography and the criteria being used. In legal writing, verify the current rule for the specific jurisdiction before describing a vendor as unlicensed or unauthorized.

This matters because “informal” can be a broad description of a business’s relationship to formal systems rather than the name of one legal category. A seller may meet one requirement but not another, or may have access to some formal protections while lacking others. Without knowing which indicators are being used, two writers can use the same word while describing different groups.
What kinds of food selling can it include?
The activity is broader than selling cooked meals from a roadside cart. Informal food vending can include preparing food, processing it, or reselling it through fixed, temporary, or mobile arrangements. A seller may operate in a market, near a transport hub, in an industrial area, on a street corner, or from another public-facing location. Small scale or outdoor work alone does not establish informality.
The range of food and settings is important. A vendor might sell food ready to eat, or sell food that needs further preparation; food might be made at the selling site or prepared elsewhere. The FAO/WHO account of street foods includes a range of products and locations, not just one familiar image of a cook beside a road. Its Zimbabwe-prepared definition says: “Street-vended foods are defined as those foods prepared on the street and ready to eat, or prepared at home and consumed on the street without further preparation.”

That sentence is a definition of street-vended foods, reproduced in the FAO/WHO Regional Conference on Food Safety for Africa report. It is useful for understanding the breadth of street-food activity, but it is not a universal legal definition of an informal food vendor. Read the FAO/WHO conference report.
In practical descriptions, it helps to separate what the seller does from how the seller operates. “Prepares ready-to-eat food at a street stall” describes an activity and arrangement. It does not, without more information, say whether the business is registered, licensed, taxed, or authorized to use the site. The same distinction applies to a market seller who resells prepared food or a mobile seller who changes locations.
Is a street-food vendor automatically informal?
No. “Street-food vendor” identifies a selling arrangement, while “informal vendor” refers to a relationship with formal systems. A street-food seller may comply with local licensing and site rules. Conversely, informal food activity can take place beyond a roadside stall, including through food preparation, processing, or retail in other settings.

The FAO/WHO account describes street foods across varied products and locations, including markets, transport sites, industrial areas, and street corners. The location may help describe the business, but it does not settle whether it is formally authorized.
Think of the terms as answering different questions. “Street food” asks where or how food is sold, and sometimes what kind of food activity is involved. “Informal” asks how that activity relates to formal systems. They often overlap in everyday use and research, but treating them as interchangeable can misclassify sellers: a street seller may be authorized, and an informal food business need not be a roadside stall.
The same caution applies to the word “illegal.” A description of a business as informal does not, by itself, establish that the vendor has broken a law. The relevant rules vary by jurisdiction and trading site, and an accurate legal conclusion requires checking those current rules. Research categories are also not automatically legal findings: a study’s definition is an operational tool for that study, not a universal verdict on individual sellers.
How to assess a specific vendor
To classify a particular seller accurately, separate the food activity, the way it is sold, and the seller’s formal status. Then check the rules that apply in the precise location and at the time in question. A clear assessment should explain which facts were observed and which formal requirements were checked.
- Describe the activity. Note whether the seller prepares, processes, or resells food, and whether it is ready to eat or requires further preparation. This describes the food business; it does not determine formal status.
- Describe the arrangement. Record whether the operation is fixed, temporary, or mobile, and whether it is in a street, market, transport area, or another site. A location is relevant context, not proof that the seller is authorized or unauthorized.
- Identify the relevant jurisdiction. Specify the country and municipality, and the particular trading site where permission may matter. The local rules, rather than a general definition, determine the legal answer.
- Check the applicable formal requirements. Look for business-registration rules, food-safety or vending licenses, tax obligations, and permissions for the trading location. Requirements and responsible agencies vary. Do not assume that one permit covers all these areas.
- State the test you used. If the classification is for a report or study, say which indicators count—for example, registration, licensing, tax status, location authorization, or a combination. Avoid treating one study’s definition as a universal standard.
A visible feature such as a cart, outdoor stall, small quantity of stock, or lack of a permanent shopfront cannot by itself establish a seller’s legal status. Likewise, a seller’s apparent compliance with one requirement does not prove compliance with every other applicable rule.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteFor example, if a report counts only unregistered businesses as informal, its result may differ from one that also counts businesses without site authorization or a vending license. Neither method should be presented as the sole correct definition without explaining the study’s purpose and setting. This is why naming the criteria is part of a sound classification, not a technical footnote.

For an individual case, use neutral wording until the applicable requirements are verified. It is reasonable to describe what is visible—such as a mobile seller at a market—without turning that observation into a claim that the person lacks a license or is trading unlawfully. Where rules have not been checked, say so.
Informality, legality, and food safety are different questions
Informality is not a synonym for illegal activity. A vendor may lack one form of registration but have permission to trade at a site; another may be registered but still need a separate food-handling or location permit. Only the relevant local rules can determine whether a specific operation is authorized.
Food safety is also a separate assessment. A vendor’s formal status does not, on its own, prove that food is safe or unsafe. Hygiene, handling, facilities, and compliance with food-safety rules must be evaluated on their own terms. Keeping these questions distinct avoids unfairly treating all informal vendors as unsafe or all formally registered vendors as safe.
These distinctions do not mean that formal requirements or safety concerns are unimportant. They mean that a definition should identify the issue actually being discussed. If the concern is food handling, assess food-safety practices and applicable rules. If the concern is registration or permission to trade, assess those requirements. Conflating the two risks replacing a specific question with a broad label that does not answer it.
Why the distinction matters
Informal food businesses can support livelihoods and contribute to access to food. FAO’s discussion of the informal food sector describes its employment and food-access role alongside barriers vendors can face in gaining recognition and services. A definition focused only on enforcement or food hazards misses these economic and practical dimensions. See FAO’s background on the informal food sector.
Recognizing this broader role does not mean overlooking licensing or safety. It means describing the sector in a way that accounts for both its contribution and the constraints sellers may face. For instance, “informal” can point to limited recognition or access to formal services, not simply to a seller’s chosen location. A useful account identifies the particular dimension rather than treating all vendors as one uniform group.

Policy discussions therefore need to identify the particular gap—such as business registration, licensing, site permission, or access to services—rather than using “informal” as a blanket judgment about a vendor. FAO/WHO guidance has recommended measures such as vendor training, suitable facilities, and affordable licensing as ways to address safety and livelihood concerns. Those recommendations are institutional guidance, not proof of a current law in any particular place. Consult the FAO/WHO report.
The recommendations also show why a definition-led discussion should avoid reducing the subject to enforcement alone. Training, facilities, and licensing address different practical and policy concerns. They are examples of guidance in the report, not a universal package every vendor must have, nor evidence that a specific program is currently required in a particular municipality.
What the available figures do—and do not—show
A 2023 study of 406 female street-food vendors in Ghana’s Greater Accra and Central regions reported that approximately 62% of enterprises in its study context were wholly informal. That is a sample- and geography-specific result, not a global estimate or a rate that can be applied to all vendors in Ghana. The study’s measures also illustrate why the definition used should be stated when reporting a prevalence figure. Read the study in Cities.
The figure should be read with all those limits in view: the study examined female street-food vendors, the sample included 406 vendors, and the locations were two regions in Ghana. “Approximately 62%” describes enterprises in that study context; it does not mean that 62% of all food vendors, all street-food sellers, or all businesses in Ghana are wholly informal. Comparisons with another place or study are meaningful only if the samples and definitions are sufficiently clear.
The available sources do not establish a reliable worldwide prevalence figure for informal food vendors. Estimates should be compared only when their geography, sample, and operational definition are clear. A number without those details can make unlike groups appear comparable and can create a false impression of a universal rate.

For a general explanation, describe an informal food vendor as a food seller operating at least partly outside formal systems, while making clear that the term is not a universal legal category. For a particular location, name the jurisdiction and identify the specific registration, licensing, tax, or trading-site criteria that apply. If those requirements have not been checked, describe the activity without asserting that the seller is unlicensed, illegal, or unauthorized.

For research or reporting, state the operational definition near the first use of the term. Say whether informality means lack of business registration, a vending or food license, tax compliance, location permission, or a combination. Then give the geography and population being described. If the writing uses “street-vended food,” distinguish that food-and-selling description from the broader question of formal status.
That precision makes it easier for readers to understand what a claim does—and does not—mean. It also avoids turning a broad description of a diverse food sector into an unsupported conclusion about an individual seller’s legal status or food-safety practices.
Frequently Asked Questions
Does selling food from a cart automatically make someone an informal food vendor?
No. A cart describes the selling arrangement, not the seller’s registration, license, tax status, or permission to use a site. Those indicators and the applicable rules must be checked separately.
Recommended Free Tools
Is an informal food vendor necessarily operating illegally?
No. “Informal” is not a universal legal category or a synonym for illegal. Whether a particular seller is authorized depends on the current rules in the relevant jurisdiction and trading location.
Are street-food vendors and informal food vendors the same thing?
No. Street food describes a selling arrangement or food activity; informality describes a relationship to formal systems. The terms overlap, but a street-food seller may comply with local rules, and informal food activity can occur in other settings.
What should a study specify when it calls vendors informal?
It should identify its geography and operational criteria—for example, whether it considers business registration, vending or food licenses, tax status, location authorization, or a combination. One study’s definition is not a universal standard.
Is there a global estimate of how many food vendors are informal?
The reviewed sources do not establish a reliable global prevalence figure. A 2023 study reported approximately 62% wholly informal enterprises in its sample of 406 female street-food vendors in Ghana’s Greater Accra and Central regions, but that result is limited to its study context.
The Bottom Line
An informal food vendor is generally a food seller operating at least partly outside formal systems, but neither the food sold nor a cart or street location settles the question. To classify a seller or report a figure accurately, specify the criteria and check the current rules for the relevant jurisdiction and trading site.
