There is no blanket right to train an AI system on a game demo. A demo usually combines copyrighted code, artwork, music, dialogue, cinematics, text and audiovisual files, each of which may have different owners and license terms. In the United States, fair use is a fact-specific defense rather than an automatic AI-training exception. In the European Union, text-and-data-mining rules depend on lawful access and whether a rightsholder has reserved mining rights. The demo’s end-user license agreement (EULA), platform terms, acquisition method and intended model use can be decisive. When those facts are uncertain, obtain written permission from the relevant rightsholders before copying the demo into a training corpus.
What a game demo contains, and why the distinction matters
A demo is not a single legal object. It is a package of works and data assembled for a particular release. Copyright can apply separately to each component, while contracts and technical access controls add another layer of restrictions.

One permission therefore may not clear the entire dataset. A publisher could own the code and some art while a music company, actor, middleware provider or external artist retains rights in other files. Build an asset and ownership inventory before deciding that a demo is “licensed.”

United States: fair use is a risk analysis, not an AI-training exemption
U.S. copyright law protects fixed literary, musical, dramatic, pictorial, graphic, audiovisual and sound-recording works. It does not protect ideas, procedures, processes, systems or methods of operation as such. That distinction can allow analysis of game mechanics without authorizing copies of the expressive files that implement them.

Section 107 of Title 17 sets out the fair-use defense. Courts weigh four factors together, and no factor automatically decides an AI-training case:
Purpose and character of the use
Nonprofit research, scholarship or a narrowly targeted technical study may present a different risk profile from commercial model development. A commercial purpose does not automatically defeat fair use, and a research label does not automatically establish it. Ask what the model is intended to do, who will receive it, and whether the use adds a materially different analytical function or simply supplies a corpus for generating similar entertainment assets.
Nature of the copyrighted work
Highly creative material—art, music, narrative, performances and cinematic scenes—usually receives stronger protection than factual or functional material. A demo’s code may contain functional elements, but its original expressive structure and accompanying audiovisual assets remain relevant. Separating functional observations from expressive files can reduce, but not eliminate, risk.
Amount and substantiality
Copying an entire demo, including every asset bundle, can weigh against fair use even if the files are never shown to users. The legally important question is not only the percentage copied; taking the “heart” of a work can matter. A project that extracts only the minimum material needed for a documented experiment has a different profile from wholesale corpus ingestion.

Effect on actual or potential markets
Consider whether the trained system could substitute for the demo, its artwork, music, dialogue or a licensed dataset. Memorization, near-duplicate output, asset regeneration and competition with a publisher’s licensing market can increase exposure. Controls that suppress memorization and prevent distribution of recovered assets may help the analysis, but they do not create a safe harbor.
The U.S. Copyright Office says it has been examining AI copyright issues since early 2023. Its August 2023 notice of inquiry received more than 10,000 comments by December 2023. Part 3, “Generative AI Training,” was released in pre-publication form on May 9, 2025, with a final version expected to follow. Those policy materials do not replace a court’s fact-specific decision for a particular demo.
European Union: lawful access, opt-outs and Article 53 duties
EU text-and-data-mining (TDM) rules can permit certain reproductions of lawfully accessible works. The permission is conditional, not universal. Rightsholders may reserve the right to prevent mining; when that reservation is expressed in an appropriate manner, authorization is required for covered TDM.
Check access and reservations together
“Lawfully accessible” can include access obtained under a license or other valid authorization, but it does not mean that any downloadable file is free for automated copying. Review the demo’s EULA, the platform’s terms and any notice attached to the download or website. For online material, determine whether the reservation is machine-readable and whether your crawler or ingestion system can detect and honor it. Keep a record of the exact notice and the date it was observed.

The U.S. Copyright Office’s discussion of EU TDM describes the exceptions as conditioned on lawful access and respect for opt-outs, while noting continuing controversy about how those exceptions apply to generative AI. A rightsholder’s effective reservation can move a project from an exception analysis to a licensing requirement.
General-purpose AI providers and Article 53
Article 53 of the EU AI Act requires covered providers of general-purpose AI models to maintain a copyright-compliance policy and publish a sufficiently detailed summary of training content. The consolidated text displayed by the European Commission AI Act Service Desk is dated July 27, 2026. The Act’s practical reach can extend to systems developed elsewhere when they are placed on the EU market, deployed in the Union or their output is used in the Union, subject to the Act’s scope and applicable exemptions.
Article 53 documentation does not itself grant permission to copy a demo. It creates provider obligations that make provenance, opt-out handling and training-data records important parts of the compliance file.
The EULA and platform terms can narrow your permission
Copyright is only one layer. A demo EULA is a contract governing the permission granted to the person who downloads or installs the software. Read the version accepted at acquisition, not a later web page that may have changed. Preserve a copy with the project records.

Clauses that deserve particular attention
- Copying and redistribution: restrictions may prohibit duplicating files, extracting assets or sharing an installation outside the permitted devices.
- Reverse engineering: decompilation, disassembly and modification clauses may cover techniques used to inspect code or unpack resources.
- Automated access and data mining: terms may prohibit bots, scraping, bulk extraction or using the software as training data.
- Commercial and research use: a personal-use grant may not extend to a commercial model, paid API or public checkpoint.
- Third-party materials: the publisher may disclaim ownership of music, middleware, fonts, voice performances or stock assets and direct you to separate licenses.
- Governing law and forum: these provisions affect where a contract dispute is heard and which law a court may apply.
A contract may impose obligations even when a copyright defense might otherwise be arguable. Contract enforceability varies by jurisdiction and facts, so treat restrictive language as a real project risk rather than assuming fair use overrides it.
Acquisition, DRM and preservation exemptions
Record how the demo was obtained: an official store, a publisher download, a physical disc, a mirror, or another source. An unauthorized copy can create separate problems before training is considered.
Do not assume that bypassing DRM is harmless. The Digital Millennium Copyright Act’s Section 1201 exemptions for video games are narrow, generally addressing preservation, security research or access in defined circumstances. They do not grant a general license to extract a demo and build an AI dataset. A preservation copy may be lawful for the exempt purpose while a subsequent training use remains outside that permission.

- Define the proposed use. Write down whether the project is nonprofit research, internal experimentation, a commercial model, a public checkpoint or an API. State where training and deployment will occur and whether outputs will be available in the EU.
- Inventory every input. Separate executable code, unpacked assets, screenshots, captured video, audio, dialogue, metadata and logs. Mark which items are copied verbatim and which are observations or labels.
- Trace ownership. Identify the publisher, developers, composers, performers, licensors and middleware providers. Do not assume the publisher can license rights it does not own.
- Collect governing terms. Save the EULA version, store or platform terms, privacy notice, download page and any machine-readable rights reservation. Note acceptance date, account and region.
- Assess access and technical measures. Document authentication, rate limits, DRM and whether any circumvention occurred. Stop and obtain advice if extraction requires bypassing a control.
- Analyze jurisdiction-specific permissions. For U.S. uses, apply all four fair-use factors. For EU uses, verify lawful access, opt-outs and Article 53 duties if you are a covered general-purpose-AI provider. Apply other countries’ rules where training or deployment occurs.
- Model output and market risk. Test whether the system can memorize dialogue, reproduce textures, regenerate recognizable characters or substitute for the demo or licensed assets. Plan technical limits before training.
- Get written clearance where uncertainty remains. Obtain a license that names the files, training method, model and outputs, territories, duration, sublicensing, opt-out handling, deletion and audit rights.

What a publisher license should cover
Ask for an express, written grant rather than relying on a general “research” permission. The document should identify the demo and edition, the specific code and assets, and any third-party materials included. It should authorize reproduction, preprocessing, training, evaluation, fine-tuning, storage, backup and—if intended—commercial deployment of the resulting model and outputs.

Negotiate territory, term, model type, public or private access, sublicensing, attribution, confidentiality, deletion on request, security controls, audit cooperation and treatment of opt-outs. Require the licensor to state which rights it owns and to identify approvals still needed from composers, performers, middleware licensors or other contributors. A license that covers only screenshots may not authorize executable extraction or music training.
Operational controls for a live project
- Keep a manifest linking each file to its source, owner, license, jurisdiction and permitted use.
- Store the exact EULA and platform terms accepted for every acquisition, including version and date.
- Implement an intake gate that checks EU rights reservations before automated collection.
- Maintain deletion and opt-out procedures that can remove source files and derived artifacts where required.
- Restrict corpus and checkpoint access; log downloads, preprocessing, training runs and output incidents.
- Evaluate models for memorized code, dialogue, music, images and near-duplicate scenes before release.
- Document why each copied element was necessary and whether a less extensive, licensed or synthetic substitute was available.
When to involve qualified IP counsel
Obtain advice before extraction when the EULA bans reverse engineering or data mining, when DRM must be bypassed, when ownership is split among several licensors, when the model is commercial or public, or when training and deployment span the United States, the EU and other jurisdictions. Counsel can assess contract enforceability, fair-use factors, TDM reservations, Article 53 scope and the wording of a license. Keep the final legal assessment with the acquisition records; a general statement that the project is “research” is not a substitute for that analysis.
The defensible default is simple: treat a game demo as a bundle of separately protected works, assume the EULA matters, honor documented opt-outs, and secure written permission whenever the intended AI use is not clearly authorized.
