Before approving a data center, a community should know exactly what decision is pending, what the facility will demand from water, sewer, electricity, roads and emergency services, who will pay for upgrades, and which protections are legally enforceable. Ask for the underlying studies, operating assumptions and draft approval language—not just a presentation or press release.
The University of Iowa Hubbell Environmental Law Initiative decision tool, New Jersey Economic Development Authority (NJEDA) municipal guidance and recent state and local examples provide a practical framework. They do not create a nationwide approval process. Zoning authority, utility regulation, environmental permits and hearing rights depend on the location.
1. Identify the decision that is actually pending
Start with the public notice, application, hearing agenda and staff report. A vote described as “data-center approval” could involve a zoning change, site plan, building permit, utility agreement, tax incentive, development agreement or several actions at once. Each may have a different decision-maker, deadline and appeal process.

Build a decision map
- Name the action. Record the exact approval requested and the legal body considering it.
- Identify the decision-maker. Determine whether the authority is a planning commission, zoning board, city council, county board, utility regulator or state agency.
- List approvals already granted and still required. Include land-use changes, environmental permits, water or sewer approvals, interconnection agreements, road work and incentive authorizations.
- Calendar every public opportunity. Note application deadlines, hearing dates, comment periods, technical-review windows and the expected final vote.
- Request a public-facing timeline. It should show when residents can inspect records, submit questions and comment before each decision, not only at the final hearing.
Keep a dated log of documents, questions, answers and unresolved issues. If an agency says a matter is outside its authority, ask which agency or proceeding handles it and where that record can be reviewed.

2. Demand numbers with units, assumptions and source documents
Every projection should be traceable. Ask for the document that produced the number, the units, the time period, the operating scenario and the assumptions. Annual averages can hide peak-day water or electricity demand. A construction-worker estimate is not a permanent-job commitment, and projected tax receipts are not guaranteed revenue.
- Request both average and maximum values, plus the duration and frequency of peaks.
- Ask whether figures describe the first phase, full build-out or an optional expansion.
- Separate normal operations, commissioning, generator testing, emergency operation and construction.
- Ask who prepared each study, what data it used and whether an independent reviewer checked it.
- Require maps showing off-site facilities such as substations, transmission lines, pipelines, wells, treatment plants and access roads.
NJEDA’s municipal resource work specifically identifies water projections, grid and interconnection filings and fiscal estimates as areas where local governments may need technical assistance. A community can use the same categories even where that assistance is unavailable.
3. Water, cooling and sewer capacity
Establish the source and legal availability of water
Ask, “What is the source of water for the data center?” Require the identified utility, watershed, aquifer, reservoir or reclaimed-water system, along with the applicant’s right to use it. Clarify whether the supply is potable, reclaimed, industrial or a combination, and whether a new intake, well, pipeline or treatment expansion is required.

Ask for the average day, maximum day, annual total, peak-hour demand and consumptive use. The University of Iowa tool recommends asking explicitly how much water will be returned as wastewater or discharge. A facility that withdraws a large volume but returns most of it has a different effect from one that consumes the majority through evaporation. The application should state both conditions rather than using one annual average.
Useful literal questions include:
- “What amount of water will the data center need each day and each year (average day, maximum day, annual total, peak hours, and consumptive use versus water returned as wastewater or discharge)?”
- “What is the cooling strategy?”
- “How will water usage be reported?”
Test the system under stress
Ask whether water and sewer systems can meet maximum demand during drought, low-flow conditions, heat waves, equipment outages and competing municipal or industrial use. Request a regional analysis that considers existing residents, businesses, agriculture and ecological flows. The University of Iowa tool cautions that utilities may face planning burdens when projected peak demand and actual usage patterns do not align.

For sewer service, request hydraulic capacity, treatment limits, discharge characteristics, pretreatment requirements and the destination of blowdown or other cooling wastewater. Ask who pays for treatment-plant, trunk-sewer, pumping or source upgrades and whether those costs remain with existing ratepayers if the project is delayed or cancelled.
Require a reporting and drought plan
A permit or agreement should identify meters, reporting frequency, public access to data, responsible personnel and corrective action when limits are exceeded. Ask what happens during drought declarations, water emergencies or mandatory conservation periods: reduced operations, alternative water, temporary curtailment or another enforceable measure.
4. Electricity, generation and the wider grid
Obtain the full load profile
Request the facility’s connected load, expected peak megawatts, typical load, ramp rates, seasonal variation, redundancy configuration and projected load at each construction phase. Ask whether the estimate includes cooling, batteries, backup generation, offices and future expansion.
Review interconnection and off-site upgrades
Seek the utility interconnection request, system-impact study, facility-study results and queue status. Identify new substations, transmission lines, gas pipelines, generation resources, road work and rights-of-way. Ask whether local code requires review of supporting power infrastructure and its environmental and long-term capacity effects. A permit focused only on the parcel may miss substantial impacts elsewhere.
Make cost allocation explicit
Ask who pays for each upgrade, how costs are allocated among the applicant and other customers, and whether a special large-load rate or discounted service is proposed. Request an analysis of bill effects, stranded-asset risk and what happens if the facility uses less power than forecast. Pennsylvania’s 2026 framework announcement states that project infrastructure costs should not be shifted to households and businesses; that is a state-specific policy description, not a universal rule.

Clarify reliability and emergency operation
Ask whether the utility assumes emergency curtailment, interruptible service, on-site generation or battery support. For generators, request fuel type, emissions controls, testing schedule, operating-hour limits and noise controls. Distinguish routine testing from an outage response and identify who can order curtailment during a grid emergency.
5. Set measurable protections for neighbors and the site
Ask for the studies and permit conditions behind each protection. A general promise to “minimize impacts” is difficult to enforce.
- Sound: Set numerical limits at property lines and nearby residences, including low-frequency noise and tonal components. Specify measurement locations, operating conditions and independent post-construction testing.
- Generators: Cover equipment type, fuel storage, emissions, testing hours, cumulative runtime and emergency exceptions.
- Lighting: Require shielding, maximum illumination, controls, curfews where appropriate and limits on glare beyond the site.
- Setbacks and buffers: Define distances from homes, schools, waterways and public rights-of-way, with landscape or visual screening standards.
- Construction: Set work hours, haul routes, dust and vibration controls, delivery scheduling and restoration duties.
- Traffic and roads: Analyze construction and operating traffic, intersection improvements, heavy-haul routes, pavement damage and who funds upgrades.
- Stormwater: Require retention, treatment, flood protection, erosion controls and maintenance responsibilities for the full build-out.
- Emergency access: Confirm fire-water supply, turning radii, responder access, hazardous-material information, backup communications and coordination with police and emergency medical services.
Ask for independent verification after construction, not merely an applicant certification. The approval should state who selects the verifier, who pays, when tests occur and how results become public.
6. Separate public costs, revenues, jobs and benefits
Evaluate the project’s fiscal story line by line. Ask for the cost of utility, road, drainage, fire, police, inspection and planning services, as well as recurring maintenance. Include debt service, foregone tax revenue and the risk that an incentive survives while promised investment does not.
| Claim to examine | Question that makes it testable |
|---|---|
| Tax revenue | Is the amount a forecast or a contractual minimum? Which taxes, exemptions and assessment assumptions apply? |
| Jobs | How many are permanent, what wages and benefits apply, and are construction jobs counted separately? |
| Local hiring | What percentage, definition of “local,” reporting interval and remedy apply? |
| Community benefit | Who receives it, when is it paid, and is payment secured if ownership changes? |
| Infrastructure | Who pays capital and operating costs, and what happens if the project is smaller or late? |
NJEDA frames municipal review broadly: understand demand on local infrastructure, utilities, emergency services and the surrounding community before finalizing community-benefit terms. Ask for sensitivity cases showing lower occupancy, delayed phases and early closure.

7. Turn promises into enforceable conditions
For every mitigation or benefit, request six elements: a measurable target, deadline, reporting interval, verification method, responsible party and remedy for nonperformance. Put the requirement in the permit, development agreement, utility agreement or other governing document. A slide deck, testimony or press release is not a substitute.
Use project examples carefully
The City of St. Louis announcement of April 21, 2026 illustrates how detailed terms can be written for one project. Its community-benefits term sheet described a contribution of $30 per square foot of approved data-center development, estimated at $15 million for the stated city fund. It set minimum permanent jobs at 25 in year one, 50 in year two and 100 thereafter, with $2,000 in liquidated damages for each job below the required total. It also described closed-loop cooling, energy and noise conditions, reporting, shortfall damages and decommissioning provisions.
Those figures and conditions are not a benchmark for other jurisdictions. They show the level of specificity a community can seek: a defined calculation, a schedule, a reporting duty and a remedy.
Protect obligations through ownership changes and closure
Ask whether commitments bind successors, lenders and contractors. Require notice before transfer, continuing access for inspectors, financial security where appropriate and a decommissioning plan covering equipment removal, hazardous materials, site restoration, abandoned utility capacity and unpaid obligations.
8. Compare designs and agreement terms on the same axes
When applicants offer alternatives, use one matrix rather than evaluating each proposal with different assumptions.

9. Make public tracking possible after approval
Before the vote, obtain the final permit, agreement, site plan, utility commitments and incorporated studies. Mark every obligation with its measurement method and due date. Ask for a public dashboard or regular reports covering water, energy, noise, jobs, payments, incidents and complaints.
The governing documents should name the enforcement authority, inspection rights, cure periods, penalties or damages, suspension or revocation options and dispute process. Ask how residents can submit a complaint and receive a response. If a condition cannot be measured or enforced, describe it as a goal rather than a protection.
10. Use state and local tools without treating them as national law
University of Iowa Hubbell Environmental Law Initiative
Its decision tool covers community engagement, planning and zoning, water, energy, incentives and construction. Depending on local law, its questions may point toward zoning amendments, site-plan conditions, utility or road agreements, state permits, third-party technical review or other local actions.

NJEDA’s Municipal Resource Hub describes assistance with grid and interconnection filings, water projections, fiscal impacts and community-benefit-agreement templates. Confirm current scope and eligibility with the agency, and consult the relevant state energy and environmental agencies for specialized questions.
Pennsylvania’s 2026 announcement
The Commonwealth describes GRID requirements, disclosure and review involving binding commitments, local approvals, public reporting, energy-cost allocation and environmental protection. Verify current implementation documents before relying on any detail. The announcement reported more than 100 data-center projects identified through publicly sourced databases, 58 that had engaged with the Pennsylvania Department of Environmental Protection at some level of formality, 15 that had applied for at least one DEP permit and five reported as having received all permits needed for their first phase. These are Pennsylvania-specific awareness and permitting figures, not a national count.
Questions to put on the hearing record
- “When and how do you plan to engage with residents to assess their perspectives about data center development in the jurisdiction?”
- “Could any public infrastructure or utility upgrades, special rates, discounted service, TIF, tax abatement, or other incentives offered to the developer/applicant shift costs or risk to existing residents, businesses, or taxing entities?”
- “Does the code or ordinance require review of off-site power infrastructure or supporting utility (gas pipeline and/or high voltage transmission) upgrades that will affect environmental impact, and long-term capacity?”
- What approvals remain, who decides them and when can residents review the underlying studies?
- What happens if water, power, job or community-benefit commitments are missed?
Limits of any checklist
No checklist determines whether a particular project should be approved. The reviewed sources do not establish a nationwide approval sequence or a uniform impact threshold. Check local zoning and hearing rules, state and federal permit dockets, utility filings, technical studies and the exact draft conditions.
Do not assume that a St. Louis condition or Pennsylvania requirement applies elsewhere. Treat estimates as estimates until they are converted into signed, enforceable terms with reporting and remedies. The most useful public record is one that lets residents compare promised performance with measured performance after the facility opens.
