Before a data centre is approved, residents should obtain the project’s decision map, demand project-specific electricity and water figures, require independent impact studies, and turn promised benefits into enforceable conditions. The exact permits, hearing rights, utility rules, appeal deadlines and legal limits depend on the site and the project’s stage. Use the questions below to identify the right agency, the right records and the commitments that must be written into permits or agreements—not merely announced.
1. Map who decides what—and when
Start by listing every decision needed for this site. A data centre may involve land-use approval, a site plan, building permits, air and water authorisations, stormwater controls, utility interconnection and road or access work. Different agencies may decide different parts, and a public comment period for one approval does not necessarily apply to another.
Questions about the application
- What zoning, site-plan, building, air, water, stormwater and other permits are required?
- Is the use allowed at this parcel, or does it need a rezoning, special exception, variance or public hearing?
- Which body decides each issue, and what findings must it make?
- When may residents submit written comments, speak at a hearing, request records, appeal a decision or ask for reconsideration?
- What are the actual local notice and filing deadlines for this application?
Do not assume that a rule described in another state applies locally. Fairfax County, Virginia, for example, says some data centres can be built by-right in designated industrial zones while other proposals trigger hearings. It also distinguishes local land-use decisions from state authority over energy rates, transmission and some air and water matters. Pennsylvania’s planning toolkit similarly treats inquiry, zoning, permitting and long-term planning as connected but distinct steps. Treat these as examples of questions to ask, not as a template for another jurisdiction.

Build a decision timeline
- Obtain the application number, parcel map, site plan and proposed development schedule from the planning authority.
- Ask each agency for its next filing, notice, hearing and decision date, including deadlines that have already passed.
- Identify the utility regulator, consumer advocate or grid operator handling interconnection and rate questions.
- Request the environmental regulator’s permit list and instructions for accessing technical studies and public comments.
- Record which decisions can still change the design, operating limits, infrastructure route or mitigation package.
2. Demand project-specific electricity and grid information
A headline megawatt figure is not enough. Ask for the facility’s peak demand, how that demand changes during construction and each operating phase, and the evidence behind the requested connection date.

Load, connection and infrastructure
- What is the expected peak electricity demand, and what assumptions produce that number?
- When will each phase need service, and which utility or grid studies support the schedule?
- Will the site use grid electricity, on-site generation, batteries or another mix?
- How much on-site generation will run routinely, during outages, for testing or for grid support?
- Are new substations, transmission lines, feeders or other upgrades required?
- Who pays the initial construction cost, and how are ongoing costs allocated?
- Which tariff and regulator determine whether shared infrastructure costs enter utility rates?
ERCOT’s 2026 information request covers developers of data centres of 25 MW or more pursuing interconnection to the ERCOT system. That is the scope of that request, not a universal legal threshold. It asks about grid dependence, on-site generation, ownership, water and other local impacts. Obtain the actual utility study and tariff analysis for the proposal rather than assuming the project will—or will not—raise household bills.
Could residents pay more?
The facility’s direct electricity bill is different from the cost of shared grid infrastructure. Fairfax County explains that infrastructure costs can be recovered through utility rates, depending on the regulatory arrangement. Ask the utility and regulator to show which upgrades are dedicated to the facility, which are shared, the proposed cost allocation and the protections for existing customers. Request sensitivity cases for a delayed phase, a cancelled expansion and lower-than-promised load so that residents can see who bears unused capacity costs.
3. Examine water supply, cooling and drought risk
Require separate figures for withdrawal and consumption. A withdrawal is water taken from a source; consumption is the portion not promptly returned to that source. Ask for monthly or seasonal values for construction, initial operation, full build-out and each expansion.

Water questions
- What is the source: potable supply, surface water, groundwater, reclaimed water or another source?
- What are expected withdrawals and consumptive use by season and operating phase?
- Which cooling design is proposed, and were air-cooled, closed-loop and non-potable options compared?
- How would demand change during a drought, water restriction or other system stress?
- Could the withdrawal affect existing customers, water quality, streams, aquifers or sensitive habitats?
- What water-efficiency, withdrawal and consumption data will be reported publicly, how often and in what format?
Maryland’s 2026 executive-order framework asks whether supply is adequate without adverse effects, whether cooling alternatives and non-potable sources were considered, and how drought and cumulative effects will be addressed. ERCOT’s 2026 request also seeks water-source, consumption and cooling information. Neither establishes a universal water-use figure for data centres, so insist on numbers for this facility and its planned expansions.
Compare cooling choices on the same basis

4. Require credible studies for noise, light, traffic and construction
Ask for studies that model normal operations and unusual but foreseeable events together. A sound assessment should include cooling equipment, transformers, backup generators, generator testing and nearby existing or proposed facilities—not just an empty-site baseline.
Noise and lighting
- Where and when were sound levels measured, including at nearby homes, schools, hospitals and other sensitive sites?
- Are the model assumptions, measurement locations, raw data and uncertainty disclosed?
- What limits apply at property boundaries and at night?
- How will barriers, setbacks, equipment placement, building orientation and facade design reduce noise and visible equipment?
- What lighting levels, shielding and curfews apply to security, loading and construction lighting?
- Who receives complaints, how quickly must an investigation begin, and what correction deadline is binding?
Fairfax describes noise studies, visual screening, design standards and setbacks. Tucson’s adopted standards include sound studies, screening and operational limits. ERCOT’s 2026 request identifies noise, light and traffic as local-impact topics. The limits and measurement methods in your community may be different; obtain the applicable ordinance and proposed permit conditions.

Traffic and construction
- What truck routes, delivery volumes, road improvements and construction hours are expected?
- How will traffic controls, pedestrian safety, emergency access and school-zone conflicts be handled?
- Will blasting, pile driving, night work or temporary lane closures occur?
- What construction dust, mud, noise and vibration controls are enforceable, and who can order a stop or correction?
5. Check air emissions, stormwater, heat and cumulative effects
Backup generation and air quality
- How many generators are proposed, what fuel do they use and what emissions controls are installed?
- What are the permitted testing hours and operating hours during outages or grid-support events?
- What pollutants are expected during routine tests, prolonged outages and any other operation?
- Do the calculations include nearby facilities and cumulative effects?
- Will air monitoring, vegetative buffers or other safeguards be used, and who receives the results?
Maryland’s framework specifically raises generator numbers, emissions tiers and hours, reduced diesel use, monitoring, buffers and cumulative effects. Fairfax identifies state responsibilities for air pollution and certain cooling-water discharges. Ask the relevant regulator which permits, modelling methods and public-reporting requirements apply to this site.

Land, water pollution and climate resilience
- How will stormwater runoff, flood risk, erosion and any cooling-water discharge be controlled?
- What heat, habitat, farmland, wetland, forest or environmental-justice impacts were evaluated?
- Were previously developed or brownfield sites considered as alternatives?
- What happens during extreme heat, wildfire smoke, flooding, drought or a prolonged grid outage?
- Who pays for monitoring, corrective work and restoration if controls fail?
6. Test the financial case: incentives, jobs and public services
Separate gross investment and tax promises from net, enforceable public value. Request a fiscal analysis over a realistic time horizon that includes incentives, road and utility work, emergency services, inspections, water and other public costs.
Questions about money and employment
- What tax abatements, grants, credits, infrastructure support or other public assistance is requested?
- What is the projected net fiscal effect after incentives and public-service costs?
- How many construction and permanent jobs are expected, at what wages, benefits and skill levels?
- What share of hiring, apprenticeships and procurement is committed locally?
- What community benefits were negotiated, who represented residents and how will performance be reported?
Make promises measurable
Ask that commitments be written into a permit, zoning condition, development agreement or other enforceable instrument. Each should specify a target, deadline, reporting method, responsible party, remedy for non-performance and review date. Maryland’s framework identifies measurable and time-bound commitments, community-benefit agreements, successor obligations, remedies, decommissioning and site restoration as relevant considerations. ERCOT’s 2026 request asks developers about public financial assistance and tax benefits; that request does not prove that a particular project has made or will meet any promise.

7. Identify the owner, occupant and long-term contact
A project can change owners, tenants, equipment and load after approval. Ask for the applicant’s parent company and controlling owner, the expected operator or anchor tenant, and any lease or capacity arrangement that affects demand. Request disclosure of material changes before expansion or transfer.
- Who is legally responsible during construction and operation?
- Who is the named community contact, and what response time applies to complaints?
- Which project details are public, and do confidentiality terms withhold information needed to assess public impacts?
- Will annual actuals for power, water, emissions, jobs, taxes and compliance be published against promised figures?
- Do conditions bind successors, tenants, expansions and a future sale?
- What financial assurance covers decommissioning, removal of equipment and site restoration?
Maryland’s framework calls for ownership and anchor-tenant disclosure, public statements of commitments, annual reporting, accurate information about load, timing, end users and jobs, and binding successor obligations. Pennsylvania grid-planning standards call for early outreach and input on siting, noise mitigation, viewshed and facade design.

8. Compare alternatives instead of accepting a single design

9. Use official examples without exporting their rules
Local figures illustrate why project-specific evidence matters. Fairfax County reported 20 standalone data centres operating and 11 under construction as of August 2026. It reported about $110.6 million in data-centre revenue for tax year 2026, approximately 1.9% of its FY 2027 General Fund revenue. Those are locality-specific figures, not a typical revenue estimate.

Massachusetts Executive Order 658 addresses projects with peak electricity demand exceeding 25 MW. That is a state policy threshold, not a general definition of a large data centre. Fairfax describes additional disclosure requirements for high-energy-use facilities of 100 MW or more in specified local applications. Again, the threshold is Virginia-specific. Ask your planning authority whether any local disclosure trigger exists and exactly how it is calculated.

10. Turn questions into an evidence file
- Create a document index with the application, maps, studies, permits, meeting notices, utility filings and correspondence.
- Submit focused public-records requests for missing studies, models, interconnection analyses, invoices for public work and draft conditions.
- Mark every promise with its measurement, deadline, reporting duty, enforcement mechanism and successor language.
- Ask qualified independent specialists to review technical documents where residents lack expertise; a consumer sound meter, air monitor or water-testing kit cannot substitute for permitted studies or agency review.
- Submit comments that cite the decision criteria, identify a specific defect or unanswered question and request a precise condition or additional study.
- Track revisions after each hearing. Compare the latest load, water, generator, traffic and mitigation figures with earlier filings.
What cannot be answered without the location
No general checklist can supply the actual hearing date, notice window, local noise limit, permit list, rate treatment, appeal right or enforceability of a benefit promise. Those depend on the jurisdiction, facility design and stage of approval. Contact the planning authority, the utility regulator or consumer advocate, and the environmental permitting agency for the proposal’s controlling rules and deadlines.
