In the United States, an employer may often monitor activity on company devices, accounts and networks, including work email, web use, computer activity, calls, location and some camera, microphone or wearable data. That permission is not unlimited. Federal and state wiretap laws, privacy statutes, employment-discrimination rules, labor rights, notice requirements and the difference between a company system and a personal system can change the result.
The practical test is to examine six facts: who owns the device or account, what data is collected, when and where collection occurs, what notice and consent were given, whether the purpose is legitimate and proportionate, and whether the monitoring interferes with a protected worker right. This is a U.S. overview, not individualized legal advice.
Why there is no single nationwide answer
U.S. law does not give employers a blanket right to monitor everything, nor does it create one rule for every workplace. The same software can be lawful on a company laptop during scheduled work and unlawful when it captures a private conversation in a home or records people who never received the required notice.

Start with four questions:
- System and ownership: Is the activity on an employer-owned device, account, network or application, or on your personal equipment and account?
- Data type: Is the employer collecting metadata, screen images, keystrokes, message contents, audio, video, location, biometrics or health information?
- Timing and place: Does collection occur during work in ordinary work areas, or off duty, at home, in a private room or near people who are not employees?
- Notice, purpose and rights: Did the employer clearly disclose the practice, obtain any consent required by state law, limit collection to a stated business purpose and avoid chilling legally protected activity?
A written acceptable-use or monitoring policy is important evidence, but signing a policy does not authorize conduct that another law prohibits. State law can be stricter than federal law, and the law of every state involved may matter when a conversation or message crosses state lines.

Work email, internet use and computer activity
Employer email and network traffic
Employers commonly review messages sent through an employer-provided mailbox, logs showing websites or services accessed through a company network, file transfers, security alerts and account metadata. Monitoring may be used for cybersecurity, compliance, preventing data loss, billing, safety or performance administration. A company account should not be treated as a private mailbox simply because you access it from home.
Content is more sensitive than metadata. Reading message bodies, scanning attachments or forwarding copies to a vendor can create additional privacy, confidentiality and employment-law issues. The policy should identify what is inspected, who can access it and how long records remain available. A policy that merely says the employer may monitor “systems” may not answer every question about audio, video, health or location data.
Keystrokes, screenshots and productivity tools
Computer-monitoring software can record application use, idle time, keystrokes, screen images, document activity or alerts generated by an algorithm. The legality depends on the same ownership, notice, purpose and proportionality factors. Collecting a security event needed to investigate malware is different from continuously capturing the contents of every document or private message visible on a screen.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsMonitoring should be limited to the work purpose stated to employees. Continuous capture can expose passwords, medical information, union activity or another person’s communications. If the tool operates while you are off duty or on a personal computer, ask how it is disabled and whether a separate work profile or application can provide the employer’s stated security function with less intrusion.
State notice example: Delaware
Delaware provides a concrete example of a state electronic-monitoring notice rule. An employer must provide electronic notice at least once each day an employee accesses employer-provided email or internet services, or provide a one-time written or electronic notice acknowledged by the employee. This is a Delaware requirement, not a national standard; other states use different rules or have no identical requirement.

Calls, meetings, chats and microphone audio
Why recording a call is legally different
Federal law defines wire, oral and electronic communications in 18 U.S.C. §2510 and supplies the framework for analyzing interception. Recording or intercepting a telephone call, video-meeting audio, open microphone, chat or other communication therefore requires a federal and state wiretap analysis.
Some states require consent from every party to a recorded communication. The 2025 Government Accountability Office report on digital surveillance notes that state laws can require both parties’ consent for certain communications. There is no single nationwide “one-party consent” rule that an employer can rely on for every call. The location of each participant, the type of communication and whether a recording or live interception occurs can all matter.
What notice should tell you
Look for a recording announcement, an audible tone, a meeting banner or a policy that identifies recording, transcription, quality review and automated analysis. Notice should be understandable before the communication begins. A statement that calls “may be monitored” may not resolve whether the employer records every call, keeps transcripts, uses voice analysis or shares files with a contractor.
Do not assume that a company meeting is automatically exempt because it occurs on a company platform. Conversely, an employer’s policy cannot erase a state consent requirement. If participants are in several states or countries, obtain advice before making a recording or asking others to do so.
Cameras and microphones
Video on company premises
Cameras may be used for physical security, safety, access control, inventory or investigation. A camera in a public work area is not equivalent to a camera in a restroom, changing area, medical space or another location where privacy expectations are high. Hidden or continuous cameras raise greater notice and proportionality concerns than a clearly identified security camera aimed at an entrance.
Ask whether video is live, recorded or analyzed by software; whether audio is enabled; the retention period; and which managers, security staff or vendors can retrieve footage. The stated purpose should determine the camera’s field of view and schedule. A camera installed for entry security should not silently become a tool for monitoring off-duty conduct.

Webcams and microphones at home
Remote-work software can activate or request access to a webcam or microphone. An employer may have a legitimate safety, customer-service or meeting reason to use those sensors during working time, but monitoring a private room continuously, recording family members or listening when you are not working creates substantially higher privacy risk. Separate work and personal profiles, use a physical camera shutter where appropriate, and confirm that the application stops collecting when the work session ends.
Audio is especially sensitive because a microphone can capture conversations unrelated to the job. State wiretap laws may apply even when the employer owns the laptop. Ask whether audio is actually required, whether it can be disabled, and whether the employer provides an alternative that does not record ambient sound.
GPS, geolocation and other location tracking
Employers may use vehicle telematics, a phone’s location services, a badge system, a delivery application or a tracking application to confirm routes, dispatch workers, protect equipment or document time and attendance. Location data can reveal a worker’s home, medical visits, religious services, organizing activity and other sensitive patterns.
Legality turns on scope and purpose. Tracking a company vehicle while it is assigned to a delivery route is easier to justify than tracking a personal phone around the clock. A policy should say when tracking begins and ends, whether it follows the device or the vehicle, what precision is collected, who receives the data and how long it is retained. Disable location collection outside working hours when the system permits it, or ask for a technical separation between work and personal use.

Wearable technology can collect location, heart rate, electrical brain activity, fatigue indicators or other physiological signals. The Equal Employment Opportunity Commission’s December 19, 2024 bulletin warns that employers using wearable technologies must comply with federal employment-discrimination law. The Federal Trade Commission has also identified privacy, autonomy, discrimination and security risks when worker data includes location, health, emotional or physical information.

A safety program does not automatically justify every biometric measurement. Ask:
- What specific safety or operational problem requires the signal?
- Is collection voluntary, required or tied to a benefit or discipline?
- Can an employee perform the job without disclosing unrelated health information?
- Are inferences, such as fatigue or emotional state, being used in hiring, scheduling, evaluation or termination?
- Who stores the raw data and derived scores, and when are they deleted?
Use of a health or disability-related signal can create accommodation and discrimination issues even when the employer never receives a formal diagnosis. A device vendor’s access, security controls and secondary uses should be addressed in the employer’s notices and contracts.

Company equipment used at home
Working from home does not turn a company laptop into a private device. The employer may generally enforce its security and acceptable-use rules on that equipment, but home monitoring can capture roommates, family members, visitors, private conversations and sensitive locations. The narrower the business purpose, the harder it is to justify unrelated collection.
Review whether the monitoring agent runs only during logged-in hours, whether it can see personal applications, and whether the employer offers a separate browser profile, virtual desktop or other boundary. Keep personal banking, medical care and private communications on a personal device rather than a monitored company system.
Bring-your-own-device (BYOD)
Installing a company management profile on a personal phone can expose device identifiers, application inventories, location, backups or security events. Before enrolling, obtain the BYOD policy and ask which data the employer can see, whether it can remotely wipe the entire phone, and how work data is removed when employment ends. A personal device does not eliminate the employer’s security obligations, and your consent to an app’s permissions may not answer every state privacy question.

Labor-law limits on monitoring
The National Labor Relations Act protects many private-sector employees who act together about wages, benefits, safety or other working conditions. National Labor Relations Board guidance states: “Your employer cannot discharge, discipline, or threaten you for, or coercively question you about, this ‘protected concerted’ activity.”
Electronic monitoring and algorithmic-management practices can be unlawful when they tend to interfere with or prevent a reasonable employee from engaging in activity protected by the Act. For example, a system that identifies employees discussing pay, tracks attendance at a workplace meeting about safety or automatically disciplines workers for participating in collective activity may create an unfair-labor-practice issue, even if the employer uses the same software for ordinary productivity measurement.
NLRA coverage is broad but not universal. Government employees, independent contractors, supervisors and some transportation workers are among the categories excluded from the Act. Other laws or public-sector rules may still apply. Monitoring connected to organizing, retaliation, discipline or coercive questioning should be discussed with the NLRB or an employment lawyer promptly.
How to compare two monitoring practices
| Comparison axis | Lower-risk pattern | Higher-risk questions |
|---|---|---|
| System and ownership | Company device, account or vehicle used for work | Personal device, account or shared household equipment |
| Data type | Security logs or limited metadata | Message contents, ambient audio, video, biometrics or health inferences |
| Timing and place | Scheduled work in ordinary work areas | Off-duty time, home, private rooms or sensitive locations |
| Notice and consent | Specific notice before collection, with acknowledgment where required | Hidden collection, vague policy language or missing all-party consent |
| Purpose and proportionality | Collection limited to security, safety, payroll or a defined operational need | Continuous collection, unrelated secondary use or indefinite retention |
| Worker rights | Neutral administration that does not target protected activity | Systems that chill organizing or produce discriminatory decisions |
A practical checklist before you challenge monitoring
- Collect the current policies. Obtain monitoring, acceptable-use, recording, BYOD, remote-work, privacy and retention policies. Save the version date.
- Identify the exact tool. Record the device, account, application, sensor, camera or vehicle involved and whether the employer owns it.
- Describe the data and schedule. Note whether the system captures metadata, content, audio, video, location, biometrics or health signals, and whether it runs off duty.
- Ask focused questions. Request the business purpose, access list, vendor involvement, retention period, deletion process and method for disabling collection outside work.
- Check every relevant state. Review the law where you work and where other call or meeting participants are located, especially for recorded audio and electronic-monitoring notices.
- Preserve evidence lawfully. Keep policies, notices, screenshots and communications. Do not copy confidential customer information or bypass security controls.
- Escalate to the right body. Contact the NLRB for protected concerted-activity concerns, a state privacy or labor regulator for state-law issues, the EEOC for discrimination concerns, or an employment lawyer for individualized advice.
Common mistakes to avoid
- “The policy says monitoring, so anything is legal.” Policies cannot override wiretap, discrimination, labor or other applicable laws.
- “Company-owned means unlimited access.” Ownership matters, but it does not erase state consent rules or make private-space audio automatically lawful.
- “One-party consent applies everywhere.” State laws can require consent from every party to certain communications.
- “A personal phone is invisible.” A BYOD management profile or work application may collect information under the permissions and settings you accepted.
- “There is a standard percentage of monitored workers.” No single authoritative nationwide prevalence figure establishes how many employers monitor workers; avoid treating an unsupported number as fact.
Bottom line for U.S. workers
Assume activity on an employer’s systems may be logged, but do not assume every form of surveillance is lawful. The decisive details are the device and account owner, the kind of data collected, the time and place, the notice and consent, the stated and proportionate purpose, and the effect on labor and discrimination rights. Monitoring that reaches into private homes, personal devices, recorded conversations, health signals or protected group activity deserves closer scrutiny than ordinary security logging on a company network.
