Choose a broker who can prove recent, relevant multifamily work; explain exactly what they did on those deals; provide owner references; and discuss financing, due diligence, timelines, and commercial documents in practical terms. Require a property-specific marketing plan and a written agreement that states representation, conflicts, compensation, duration, exclusivity, expenses, and termination.
Broker licensing, agency, disclosure, and contract rules differ by state. Treat designations such as CCIM as supporting evidence, not a guarantee of performance, and independently verify a candidate’s license and references before signing.
What a commercial broker does for an apartment owner
A multifamily broker can advise on value, position a property, find buyers or tenants, coordinate offers, and help move a transaction through financing and due diligence. The useful question is not whether someone has a real-estate title; it is whether that person has recently handled properties like yours and can manage the commercial details that determine whether a deal closes.
Decide first what you need: a sale, a purchase, a lease-up, a refinancing-related valuation, or help with a disposition strategy. A broker who excels at institutional apartment sales may not be the right fit for a small owner-managed building, and a leasing specialist may not have the buyer network or transaction experience needed for a sale.

Start with recent, relevant apartment transactions
Ask for a deal sheet, not a general résumé
Request several transactions completed in the last few years that resemble your property in location, unit count, price range, physical condition, occupancy, and ownership strategy. For each example, ask for:
- Property type, size, market, and approximate closing or lease date.
- Whether the assignment was a sale, acquisition, leasing assignment, valuation, or another service.
- The broker’s personal role, the names and roles of other team members, and which work was performed by the firm rather than by that individual.
- The marketing approach, buyer or tenant profile, major obstacles, and how the matter concluded.
- Permission to speak with the owner or another decision-maker who can describe the service.
“Multifamily experience” should be specific enough for you to recognize the operating and financial issues in your asset. A list of every commercial property in a firm’s database is not a substitute for a record of comparable apartment assignments.
Check references for process, not just outcomes
Ask references whether the broker set realistic expectations, surfaced bad news quickly, protected confidential information, kept commitments, and explained decisions. Ask how often the broker reported activity, how offers were evaluated, and what the owner would do differently next time. A successful closing alone does not show whether the broker’s process suits your communication style or risk tolerance.

The National Association of REALTORS® (NAR) reported that the number of its members identifying both commercial and residential work as their primary specialty increased by nearly 50,000 from 2021 to 2024. That figure is not a count of apartment specialists, so use an individual’s verifiable deal history rather than a broad industry trend.
Test commercial transaction competence
Financing and underwriting
Ask the candidate to explain how likely buyers or lenders will underwrite the property. The answer should address rent roll quality, collections, concessions, operating expenses, capital expenditures, debt-service coverage, loan assumptions, and the effect of interest rates or refinancing constraints where relevant. You are not asking the broker to replace a lender or accountant; you are testing whether the broker can anticipate questions and assemble information in a form that keeps the process moving.
Due diligence and timelines
Have the broker map the expected sequence from preparation through closing or lease commencement. The discussion should identify document collection, inspections, environmental or physical reviews, title and survey work, lease audits, tenant estoppels, lender approval, and the points at which a buyer can renegotiate or terminate. Ask which deadlines are customary in your market and which are negotiable in the proposed agreement.

Commercial forms and negotiations
NAR’s description of commercial transaction knowledge includes timelines, financing, due diligence, and commercial forms. Ask which forms the broker commonly uses, who prepares or reviews them, and when an attorney should take over. A broker should be able to explain business terms in plain language without presenting legal advice as a substitute for counsel.

Ask who will coordinate the lender, attorney, property manager, inspector, engineer, tax adviser, and insurance contacts, and how unresolved requests will be tracked. The broker should identify the owner’s decisions rather than silently making them.
Understand representation and conflicts before signing
Agency options depend on state law and the written relationship. NAR’s consumer guide describes single agency, dual agency, subagency, designated agency, and non-agency arrangements; the choices and required disclosures vary by jurisdiction.
| Arrangement | What it generally means | Questions for the broker |
|---|---|---|
| Single agency | The broker represents one client in the transaction. | What duties are owed to me, and can another agent in the firm represent the counterparty? |
| Dual agency | The same brokerage or agent represents both sides where state law permits it. | What conflicts arise, what information can be shared, and what written disclosure and informed consent are required? |
| Designated agency | Different agents in one firm are assigned to represent different parties, subject to local rules. | Who is designated for me, who handles the other side, and what confidential information is protected? |
| Subagency | An agent may act through or for another broker under an arrangement recognized in some jurisdictions. | Who is the actual agent, who pays whom, and what duties apply to each participant? |
| Non-agency or transaction brokerage | The broker facilitates a transaction without the full fiduciary representation associated with agency, where allowed. | Which duties are excluded, and who is responsible for protecting my negotiating position? |
Ask whether the firm or an affiliated agent could represent a buyer, tenant, landlord, or seller with an interest in your property. If dual agency is allowed, NAR generally describes disclosure and informed consent as requirements. Do not rely on an informal assurance that conflicts will be handled later; have the proposed arrangement and any consent language reviewed before execution.
Use credentials as supporting evidence
CCIM is a commercial and investment real estate designation. NAR notes that its membership includes people from several property professions, so the letters alone do not establish that a particular person has led apartment transactions comparable to yours. Ask what training the designation reflects, then verify the candidate’s actual brokerage role, current license, and recent multifamily record.
Recommended Free Tools
Check the real-estate regulator for the state where the property is located. Confirm the license is current and look for publicly available disciplinary information. If the broker works across state lines, verify the rules and license status in each relevant jurisdiction. A trade-association membership or directory listing can help you find candidates, but it does not establish suitability or expected results.

For REALTORS® covered by the NAR Code of Ethics, the 2026 Code, effective January 1, 2026, states in Article 1 that a REALTOR® representing a client pledges to protect and promote the client’s interests while treating all parties honestly. That ethical commitment applies to covered REALTORS®; it does not replace state law, agency disclosures, or the signed agreement.
Demand a property-specific marketing plan
A credible plan explains how your asset will reach the people most likely to transact, not merely that it will be “put on the market.” Ask the broker to provide the plan in writing and to identify:
- Target buyer or tenant types, such as local operators, regional owners, institutional investors, affordable-housing specialists, or owner-occupants where applicable.
- Positioning: the proposed pricing logic, investment story, operating strengths, and material weaknesses that must be disclosed.
- Commercial listing services, property-data sources, direct outreach, email campaigns, broker-to-broker networking, and other channels the broker will actually use.
- Preparation requirements, including photographs, floor plans, rent rolls, operating statements, utility data, leases, and a secure document repository.
- A schedule for launch, tours, offers, negotiations, due diligence, and closing or lease execution.
- Reporting: the frequency and format of activity reports, inquiry counts, feedback, offer summaries, and recommended adjustments.
NAR identifies commercial listing platforms, property data, marketing services, education, and research as resources available to commercial practitioners. Access to a platform is only an input; ask what the broker will do with the data and how results will be measured. Require a review point at which the broker can recommend a pricing or outreach change based on documented response.

| Term | What to clarify |
|---|---|
| Services | Valuation guidance, preparation, marketing, tours, offer analysis, negotiations, due-diligence coordination, closing support, or leasing administration. |
| Compensation | Amount or formula, whether it changes by price or lease term, when it is earned and payable, and how a cooperating broker is handled. |
| Expenses | Photography, advertising, data access, travel, staging, printing, or other reimbursable costs; require approval thresholds and receipts. |
| Duration | Start date, expiration date, renewal process, and what happens to a transaction introduced during the engagement but completed later. |
| Exclusivity | Whether you may use another broker, sell or lease directly, or engage a specialist for a separate channel. |
| Termination | Notice period, grounds for termination, fees after termination, and treatment of prospects already introduced. |
| Confidentiality and disclosures | Handling of financial records, tenant information, offers, conflicts, material facts, and legally required notices. |
Listing, buyer or tenant representation, property-management, disclosure, and authorization requirements vary by jurisdiction. A February 2014 bulletin from the North Carolina Real Estate Commission illustrates how state-specific rules can address written listing and buyer-agency agreements, advance written authorization for dual agency, written landlord-management agreements, disclosure of material facts, and retention of transaction records for three years. That bulletin concerns North Carolina and is dated 2014; verify current requirements with the relevant regulator or qualified local counsel rather than treating it as nationwide or current law.
Questions to ask every candidate
- Which apartment or multifamily properties have you sold, leased, or represented recently that resemble mine in size, location, condition, occupancy, and ownership strategy?
- What was your personal role on each assignment, who else worked on it, and may I speak with those owners?
- How would you position this property and identify likely buyers or tenants?
- Which listing, data, and marketing channels would you use, and what reporting would I receive and how often?
- What financing, due-diligence, timeline, or commercial-document issues most often affect transactions like mine?
- Who exactly would represent me day to day, and who would make decisions if that person is unavailable?
- Could your firm or an affiliated agent represent a counterparty, and what disclosures, consents, or alternative arrangements would apply?
- What are the engagement’s scope, duration, exclusivity, compensation, reimbursable expenses, and termination terms?
- How can I verify your current license and any disciplinary record with the relevant state regulator?
Ask the same core questions in the same order so that differences are attributable to the candidates rather than to your interview process. Request written answers to material promises.

| Category | Evidence to record |
|---|---|
| Relevant deal experience | Comparable properties, dates, market knowledge, personal role, and reference quality. |
| Commercial execution | Specific answers on financing, due diligence, timelines, forms, specialists, and negotiation strategy. |
| Marketing reach | Named audiences, channels, preparation plan, launch schedule, reporting, and adjustment rules. |
| Representation clarity | Agency model, conflict disclosures, confidentiality limits, and consent process. |
| Communication | Primary contact, response expectations, decision logs, report cadence, and escalation path. |
| Economic and contractual fit | Compensation, expenses, duration, exclusivity, renewal, and termination language. |
A designation can strengthen a résumé, but it should not outweigh thin deal evidence, vague reporting, or unclear conflicts. Likewise, a large firm’s brand does not tell you which individual will perform the work or how much senior attention your property will receive.
Verify the broker before granting authority
- Confirm the individual’s license and the brokerage’s license with the property state’s regulator.
- Search the regulator’s public records for disciplinary actions or restrictions, if available.
- Call at least two references using independently obtained contact information.
- Review the proposed agency disclosure, representation agreement, marketing authorization, and compensation provisions with your attorney.
- Reconcile every promised service with the written scope, including who pays each expense.
- Provide sensitive rent rolls, tenant data, and financial statements only after confidentiality terms and secure file-sharing procedures are clear.
Keep a dated copy of the executed agreement and all amendments. If the broker changes personnel, ownership, or representation status, ask for a written explanation and determine whether a new disclosure or consent is required.

Choosing the highest valuation promise
An optimistic price can win an engagement while producing weak showings and later reductions. Ask for the assumptions behind the pricing opinion, comparable transactions, expected buyer pool, and a decision rule for changing price or terms.
Confusing a directory listing with qualification
Commercial directories and listing platforms are useful discovery tools. They do not verify apartment experience, service quality, licensing, or outcomes. Perform the independent checks above.

Leaving expenses and termination vague
Unspecified advertising, data, travel, or post-termination fees can create disputes even when the transaction succeeds. Require amounts, approval procedures, and end-of-engagement obligations in writing.
Expecting a broker to replace specialists
A broker can coordinate a process but cannot substitute for legal, tax, engineering, environmental, insurance, or lending advice. Identify where each specialist’s responsibility begins and ends, and budget time for their review.
A decision process that protects the owner
- Write a one-page assignment brief covering the property, objective, timing, constraints, confidentiality needs, and desired outcome.
- Invite several brokers with demonstrable multifamily work in the relevant market.
- Run the same interview and request the same deal-sheet and written proposal from each.
- Check references, licenses, disciplinary records, and potential conflicts before ranking candidates.
- Have counsel review agency disclosures and the proposed agreement before you authorize marketing or disclose sensitive information.
- Choose the broker whose evidence, process, communication, and contract fit your assignment—not simply the person with the most impressive title.
- Set reporting dates and decision checkpoints in the signed agreement so performance can be evaluated while there is still time to adjust the strategy.
Special attention for leasing assignments
Leasing work can expose owners to operating costs and lease-language issues that are easy to underestimate. Ask how the broker will compare proposals on term, escalations, expense recoveries, renewal options, tenant improvements, concessions, maintenance responsibilities, and after-hours services. In an example reported by NAR in 2026, Michica Guillory described after-hours air-conditioning at $65 per hour and $234,000 in additional costs over a five-year lease. That is an illustrative lease example, not a market-wide statistic; use it as a reminder to model operating provisions rather than focusing only on headline rent.
For a lease-up, require a unit-level reporting plan: availability, traffic sources, tour-to-application conversion, concessions, executed leases, cancellations, and budget variance. Clarify whether the broker’s assignment ends at signed leases or includes coordination through possession and required documentation.
When the broker is not the right fit
Pause or seek another opinion if a candidate cannot identify comparable apartment assignments, refuses to provide references, avoids explaining conflicts, promises a result without assumptions, pressures you to sign immediately, or presents a contract that leaves compensation and termination unclear. A smaller specialist may be preferable to a broad commercial practice when your property requires hands-on knowledge, while a larger team may be useful for a complex, multi-market or institutional assignment. The deciding evidence is the fit between the broker’s demonstrated work and your property’s actual needs.
Bottom line for apartment owners
The strongest selection is evidence-based: comparable multifamily deals, a clearly defined personal role, credible references, command of commercial process, a concrete marketing plan, transparent agency and conflict disclosures, and a written agreement with complete economic terms. Verify the license and local rules independently, involve qualified counsel where appropriate, and judge credentials as supporting signals rather than substitutes for recent, relevant performance.
