If a production has used your image or voice without permission, preserve the material and your paperwork, then compare the use with the release or contract you signed. Whether you can require a correction, payment, removal, or other remedy depends on the agreement, the kind of use, and the law where the dispute is connected. The steps below are U.S.-focused, not a substitute for advice about your situation.
What can I do if a production used my image without permission?
Start by documenting what happened before contacting the production or posting publicly about the dispute. A clear record can help a lawyer, union, or platform understand what was used, when it appeared, and what you had agreed to.
- Save the use. Keep the URL, the date you found it, screenshots, and—where practical—a recording or downloaded copy of the material. Preserve enough context to show how and where it appeared.
- Save the paperwork. Collect the contract, release, voucher, digital-replica rider, and communications describing the project or intended use. Keep copies of relevant messages with the production.
- Identify the use. Note whether the material is an existing recording or photograph, an edited performance, advertising, or a newly generated image or voice replica. Record the project and medium in which it appeared.
- Contact your union if you are covered. Ask which agreement and provisions apply to your work category and project. Contract protections differ; a union can help identify the relevant consent and payment terms.
- Seek local entertainment-law advice promptly. An attorney can assess the agreement, the production and publication locations, the applicable law, and possible remedies before you make demands or start a legal process.
This is a practical documentation checklist, not a universal legal evidence rule. Do not assume that an apparently broad release settles every question: its effect depends on the complete wording and applicable law.

Does the kind of use change what I can do?
Yes. An unauthorized advertisement, reuse of an existing performance, and a newly generated replica raise different questions. The table is a way to organize the facts for a union representative or lawyer, not a decision about whether a particular use is lawful.

Can a production use my voice without my consent?
There is no single U.S. answer that applies to every actor, production, and use. The first question is often what you authorized in writing and whether the use falls within that authorization. A voice may be part of an existing recording, an altered performance, or a replica; those are not necessarily treated alike.
For union-covered work, consult the agreement that governs the specific job. SAG-AFTRA’s television and theatrical AI materials describe contract protections covering voice and likeness, including situations where new consent may be needed for use in another project or in a way different from the initially approved use. They also address how ownership of materials created from work interacts with contractual consent and payment conditions. That is not a blanket rule that every use requires fresh consent under every contract.
SAG-AFTRA’s 2025 audio-commercial contract materials describe agreement-specific provisions for a reasonably specific description of intended use, clear and conspicuous written consent, additional consent when use exceeds the original description, and compensation terms. These terms apply to the relevant agreement, not automatically to every voice actor or production.

What if they cloned my voice or made an AI version of me?
Find out, if you can, how the replica was made and what work or material it draws on. The applicable rules may depend on whether the replica was created from work covered by a collective bargaining agreement, whether it was independently created from public data or material, what consent was obtained, and how the replica is being used.
For example, a February 2026 SAG-AFTRA Interactive Media Agreement bulletin distinguishes a digital replica created from covered work from an independently created replica using public data or material. For the agreement covered by that bulletin, it says consent must be in writing, separately signed, checked, or initialed, and tied to a reasonably specific description of intended use. Those requirements should not be assumed to govern actors outside that agreement or other types of production.
Preserve the replica and its context, and bring the relevant rider, release, and job agreement to your union or attorney. A useful question is not only whether you agreed to a replica, but whether the actual project, purpose, and scope match the consent you gave.

What laws might apply?
Publicity, privacy, and digital-replica rules vary by jurisdiction, and other law may affect the analysis. The examples below illustrate why location and context matter; neither is a nationwide rule.

California Civil Code § 3344 addresses knowing, unauthorized use of a person’s name, voice, signature, photograph, or likeness on products or for advertising or selling goods or services. The statute has qualifications, and its application depends on the facts and other law. An amendment was reported as effective January 1, 2026, so check the current statutory text with a qualified attorney rather than relying on an older summary.
New York and deceased performers
New York Civil Rights Law § 50-f addresses post-mortem publicity rights and digital replicas of deceased performers under statutory conditions. It is not a general rule for living actors or for every jurisdiction.

Expressive uses
Satire, parody, commentary, criticism, biographical works, documentaries, newsworthy uses, and educational uses can raise First Amendment considerations, as SAG-AFTRA’s overview notes. Whether those considerations affect a particular use is fact-specific: a film is not automatically exempt, and an unauthorized commercial use is not automatically unlawful.

Possibly, but there is no general federal takedown process established here for every unauthorized image, voice, or performance. Whether you can require removal—or obtain another remedy—depends on the applicable contract and law, the context, and the facts. A lawyer can help determine whether to request removal, seek a correction or payment, enforce an agreement, or pursue another route.

The federal TAKE IT DOWN Act is narrower: it concerns covered nonconsensual intimate photos or videos. The FTC says platform notice-and-removal obligations under the Act became effective May 19, 2026. The process does not apply to every unauthorized performance or voice clone merely because it appears online. If your situation involves covered intimate imagery, consult the FTC’s current guidance and consider getting legal help with the platform process.

What if the performer has died?
Rights concerning a deceased performer’s image or digital replica can depend on the applicable agreement and state law. SAG-AFTRA’s statement on the reported Val Kilmer digital replication said: “The applicable SAG-AFTRA collective bargaining agreement, as well as state law, requires consent from the estate to use a digital replica of a deceased performer in a motion picture.” SAG-AFTRA published the statement on March 20, 2026; it describes the union’s position in that matter, not a universal rule for all productions or states. What to bring to a lawyer or union representative
- The saved material, its URL, and the date and context in which you found it.
- Your contract, release, voucher, replica rider, and communications about intended use.
- The production and publication locations, if known, and your connection to those places.
- A concise account of what you consented to, what appeared, and what outcome you want—such as payment, a correction, removal, or enforcement of a contract.
No universal damages amount, filing deadline, or likelihood of success applies to every case. The actor’s location, production location, contract language, consent documents, publication context, and whether the performer is living or deceased can all matter. For an actual dispute, seek prompt advice from a qualified entertainment lawyer in the relevant jurisdiction.
