Useful accommodations are individual, practical changes to communication, the interview environment, pacing and support. Before questioning, ask the autistic person what helps and what causes overload; do not infer needs from a diagnosis, eye contact, speech or apparent confidence. Clear language, extra processing time, predictable breaks, suitable sensory conditions and an appropriate support person can make it easier to understand questions and give an accurate account.

The legal options depend on the person’s role (suspect, witness or victim), the type of interview and the jurisdiction. The formal safeguards described here are principally for England and Wales; Ireland and other countries use different frameworks.

Start with the person’s own needs

Autism is not a single communication or sensory profile. One person may need written prompts and a quiet room; another may communicate fluently but struggle with implied meanings, rapid questioning or fluorescent lighting. Ask the person, their carer or another trusted supporter what is likely to help. Record those preferences in advance and tell the police before the interview whenever possible.

  • Ask what forms of address, question style and communication aids work best.
  • Identify sounds, lighting, smells, room layouts, clothing or waiting arrangements that can trigger distress.
  • Ask how the person signals that they need a pause, clarification or help.
  • Check whether a familiar supporter, communication device, written information or visual aid is useful.
  • Explain which requests are preferences to negotiate and which legal safeguards may apply in the person’s circumstances.

Do not treat fluent speech as proof that the person has understood. A person can have a strong vocabulary and still need direct wording, extra processing time or a check-back on meaning.

Make the interview room and sensory conditions workable

Sensory overload can reduce concentration and make it harder to retrieve information. Discuss the setting before questioning starts. The National Autistic Society gives examples such as removing a ticking clock, considering a familiar location, permitting stimming and allowing a suitable calming object. These are options to consider, not automatic entitlements or universally effective solutions.

Possible environmental adjustments

  • Noise: use a quieter room where feasible, reduce interruptions and remove avoidable sounds such as a ticking clock.
  • Lighting: discuss harsh or flickering lights and whether a different room or seating position would help.
  • Smells and furnishings: consider cleaning products, perfumes, ventilation, uncomfortable chairs and room temperature.
  • Location: a familiar place may reduce stress when the police can lawfully and practically use one. A witness can raise room or location concerns during planning.
  • Movement and regulation: allow harmless stimming where it does not compromise safety or the recording. A small fidget item or other calming object may be appropriate if it suits the individual and police agree it can be used.
  • Waiting: explain where the person will wait, how long delays may last and what to do if the environment becomes overwhelming.

Agree in advance how a request will be handled if the preferred room is unavailable. Offering a quieter alternative, changing the seat, reducing interruptions or scheduling a pause may still prevent overload.

Use clear language and allow processing time

Questions should be concise, concrete and addressed directly to the person. Avoid sarcasm, irony, metaphor, idiom, jargon and ambiguous wording. Instead of “Can you talk us through what happened?” an interviewer might explain what period, place and level of detail is required, then ask one point at a time.

Communication practices that help

  • Use short sentences and one question or instruction at a time.
  • Say exactly what a word means when it could be interpreted in more than one way.
  • Allow a noticeable pause after each question. Do not treat silence or a delayed answer as refusal or lack of knowledge.
  • Tell the person when the interviewer has finished a question and when it is their turn to answer.
  • Offer written information, diagrams, a timeline, sketches or a communication device when these match the person’s usual communication.
  • Ask the person to explain important information back in their own words to check understanding.
  • Keep the same agreed terminology throughout the interview; changing labels can create avoidable confusion.

For a suspect interview, the National Autistic Society advises checking that the person understands the separate elements of the caution. Asking the person to explain the caution back is a communication check, not a replacement for legal advice. A person should be able to request legal advice where the relevant rules provide for it.

Plan question style without distorting the evidence

Very broad prompts can leave someone unsure whether the interviewer wants a short answer, a complete chronology or a particular detail. However, closed or leading questions can suggest an answer. The solution is not to use one rigid question format for every autistic person; it is to use clear, specific, non-leading prompts that fit the person’s role and the legal framework.

A balanced approach

  1. Explain the subject and time period covered by the question.
  2. Ask an open invitation where the person can give their own account, but explain what kind of detail is wanted.
  3. Use neutral follow-up prompts to clarify time, place, sequence or people, without proposing the answer.
  4. Separate facts the person remembers from guesses, interpretations or information they learned later.
  5. Check whether the person has understood the wording before treating an answer as complete.

An interviewer should not convert an accommodation into a suggestion about what happened. Communication support is intended to improve access to the person’s account, not to coach it.

Build predictable breaks and a distress plan

Some people need frequent pauses, especially during a long interview or after difficult questions. Agree how breaks will be requested and explain what happens during one. A predictable plan can state when the break starts, its expected length, where the person will go, who may speak with them and when questioning will resume.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Distress may appear as repetitive speech or movement, shouting, self-injury or physical behaviour, but the meaning is individual. These signs can indicate overload, fear, pain, confusion or another need; they should prompt a calm check rather than an automatic conclusion about credibility or cooperation.

  • Pause the questioning and use the person’s agreed signal or plain-language check-in.
  • Reduce sensory demands and move to the planned break space if appropriate.
  • Ask whether the person needs the question rephrased, more time, a supporter or medical help.
  • Document agreed adjustments and any change to the plan.

In police custody in England and Wales, PACE Code H includes fitness-to-be-interviewed considerations, including whether conducting an interview could significantly harm a detainee’s physical or mental state. That assessment is separate from simply offering a preferred room or a fidget object.

Know which support role applies

Support Usually relevant to What the role does Important limit
Appropriate adult A child or vulnerable person in specified police detention or voluntary interview settings in England and Wales Safeguards rights and welfare, supports communication, helps the person understand rights and can help ensure access to legal advice Autism alone does not automatically mean every adult qualifies, and the role is not available for every informal police conversation
Registered intermediary Witnesses, including adult witnesses with autism, where communication assessment indicates a need Impartially assesses communication and advises police on phrasing questions and understanding answers It is not an appropriate-adult role or an interpreter; the guidance discussed here does not establish a statutory intermediary framework for suspects
Familiar supporter A witness, victim or suspect where police agree participation is suitable Provides reassurance or practical help based on familiarity with the person A parent, carer, social worker or advocate is not automatically an appropriate adult or intermediary

Appropriate adults in England and Wales

GOV.UK says an appropriate adult is needed when a child or vulnerable person is arrested and held in police detention, attends a voluntary interview under caution, or is detained for a specified intimate strip search. The official description says: “The appropriate adult’s role is to safeguard the child or vulnerable person’s interests.” Read the full role guidance at GOV.UK’s Being an appropriate adult.

The appropriate adult should help the person understand their rights, support communication and enable private discussion. They can help ensure that legal advice is available, but they do not replace a solicitor. Whether an adult is legally treated as vulnerable depends on the applicable rules and circumstances; do not promise this safeguard solely because the person is autistic.

Intermediaries and supporters for witnesses

For a witness, a registered intermediary can assess communication needs and advise the police about questions and answers. Crown Prosecution Service guidance says intermediaries should be considered for adult witnesses with autism. Their function is impartial communication facilitation, not advocacy for one side.

A familiar carer, parent, social worker or advocate may also be discussed with police when arranging a witness or victim interview. Ask in advance whether that person may attend, where they may sit and what they may say. Their presence does not automatically create the legal functions of an appropriate adult or intermediary.

Use the person’s role to decide what to request

The same sensory or communication adjustment may be useful to a suspect, witness or victim, but the legal route and available support can differ.

  • Suspect: discuss legal advice, any appropriate-adult requirement, communication needs, interview fitness and non-leading questions. Do not assume witness-intermediary arrangements apply.
  • Witness: ask about a communication assessment, registered intermediary and special measures where relevant, as well as room, pacing and supporter arrangements.
  • Victim: ask the investigating force what communication and trauma-informed adjustments are available and whether a trusted supporter can attend. Victim support should not be described as the suspect safeguards in the table above.

Prepare before the appointment

  1. Confirm the interview status: ask whether it is voluntary, under caution, part of custody or a witness/victim account, and which jurisdiction’s rules apply.
  2. Write a communication profile: list preferred wording, processing time, communication aids, distress signs and the person’s break signal.
  3. Request environmental changes: raise noise, lighting, smell, seating, location and waiting concerns with the police contact.
  4. Clarify who will attend: establish whether an appropriate adult, intermediary, solicitor or familiar supporter is required or agreed, and each person’s role.
  5. Plan breaks: agree how often pauses may be needed, how they will be requested and what happens afterward.
  6. Check practical items: ask whether a communication device, written notes, visual aid or calming object can be brought and used.
  7. Arrange legal advice where applicable: accommodations improve communication but do not replace independent legal advice.

Keep requests factual and specific. “Needs a quiet room because sudden noise causes overload” is more useful than “needs special treatment.” If a request cannot be met, ask what alternative will reduce the same barrier and have the answer recorded.

During and after questioning

At the start

  • Tell the interviewer the agreed communication preferences and how the person signals a break.
  • Check that recording, seating and support-person arrangements are understood.
  • Ask the interviewer to explain the order of topics and expected length, while acknowledging that timing can change.

When a problem appears

  • Say that the wording was unclear and request a rephrasing rather than guessing.
  • Ask for a pause if processing is taking longer or sensory stress is rising.
  • Correct an apparent misunderstanding immediately and ask for the corrected question to be recorded.
  • Tell the solicitor, appropriate adult or agreed supporter if the person cannot understand or continue safely.

Afterward

Note which adjustments were used, which were refused and what effect they had. If the person later discovers that a question was misunderstood, tell their solicitor or the investigating team promptly. A record of the communication barrier and the steps taken is more useful than a general statement that the interview was difficult.

Jurisdiction matters

The custody and appropriate-adult information above is for England and Wales, where PACE Code H and GOV.UK guidance apply. Ireland has separate justice guidance from its National Disability Authority, and it should not be treated as English or Welsh law. The material here does not establish legal entitlements in Scotland, Northern Ireland, the United States, Canada or any other jurisdiction. Before making a legal request, verify the local police-interview rules or obtain advice from a qualified local solicitor or advocate.

What a good accommodation plan achieves

A sound plan removes avoidable barriers while preserving an accurate, non-leading account. It identifies the individual’s sensory and communication needs, assigns the correct support role, sets a predictable pace and gives the interviewer a way to check understanding. It does not assume that every autistic person needs the same room, object, question format or formal safeguard.
