In the United States, a “hands-off” approach to AI regulation means a federal preference for removing perceived barriers to AI development, relying on voluntary engagement for certain advanced models, and pushing toward a more uniform national framework. It does not mean that AI developers and businesses are exempt from existing law, federal agency authority, cybersecurity enforcement, or state requirements. The practical result is a changing and potentially overlapping set of obligations—not a blanket legal safe harbor.
What “hands-off” means in U.S. AI policy
“Hands-off” is a shorthand for a policy direction, not a legal category. The administration describes its approach as removing unnecessary red tape, updating older rules, and clarifying rules for particular sectors or uses. That is the administration’s stated rationale and objective; the policy materials do not, by themselves, establish whether the approach has improved innovation, competitiveness, or business outcomes. The White House’s December 2025 fact sheet sets out that rationale.
For developers, the distinction is between broad, mandatory federal controls on creating or releasing AI models and a federal preference for voluntary coordination and targeted enforcement. For businesses that build on or deploy AI, the distinction is not a choice between regulation and no regulation: the relevant rules may come from existing federal law and agencies, state laws, and rules specific to a sector or use case.

The policy also has a federalism dimension. The administration is seeking greater national consistency and has directed the executive branch to challenge certain state laws and prepare recommendations for federal preemption. That effort creates uncertainty about the future reach of state rules; it does not, on its own, establish that all state AI requirements have been displaced.

How federal policy shifted from 2025 to 2026
January 2025: a review of prior federal actions
On January 23, 2025, Executive Order 14179 revoked Executive Order 14110 and directed a review of actions taken under the earlier order. It instructed agencies, as appropriate and consistent with applicable law, to suspend, revise, or rescind actions identified as inconsistent with the new policy. It also called for development of an AI Action Plan within 180 days. The order preserved existing agency authority and said it must be implemented consistently with applicable law. The published text of Executive Order 14179 describes those directions.
That sequence matters because a direction to review or revise federal actions is not the same thing as an automatic repeal of every rule, agency action, or law affecting AI. The executive order specifies a process and policy; the status of a particular requirement depends on the relevant action and any later implementation.
December 2025: a push for a national framework
Executive Order 14365, “Ensuring a National Policy Framework for Artificial Intelligence,” directs the executive branch to identify state AI laws considered onerous or inconsistent with the administration’s policy. It establishes an AI Litigation Task Force to challenge such laws, calls for an evaluation of state measures, and directs preparation of a legislative recommendation for a uniform framework that would preempt conflicting state laws. The order also describes possible conditions on certain discretionary federal grants. The Federal Register text of Executive Order 14365 sets out these mechanisms.

The order’s proposed legislative recommendation is instructed to preserve specified areas from preemption, including otherwise lawful state laws concerning child safety, AI compute and data-center infrastructure—with a qualification relating to generally applicable permitting reforms—and state-government procurement and use of AI. These are directions about a proposed recommendation, not evidence that Congress has enacted a complete federal AI code or that every conflicting state law has already been invalidated.
June 2026: voluntary engagement and security measures for advanced AI
Executive Order 14409, signed June 2, 2026, applies the administration’s innovation-and-security framing to advanced AI. It directs cybersecurity work, a classified benchmarking process to identify covered frontier models, and a voluntary framework through which developers may engage with the government. Under that framework, a developer may provide the government up to 30 days of early access before planned sharing with other trusted partners. The order describes this as voluntary engagement, not a general requirement applying to every model developer.
The same order prioritizes enforcement of existing criminal laws against unlawful use of AI to access or damage computer systems. It expressly says that it does not authorize mandatory federal licensing, preclearance, or permitting for the development, publication, release, or distribution of AI models. What the policy does—and does not—change
The current approach differs from a broad, prescriptive federal regime in the kinds of controls it emphasizes. The comparison below describes policy mechanisms, not measured effects on companies or the AI sector.

The last row describes a possible trade-off, not a proven outcome. The cited policy documents establish instructions and objectives, not a quantified change in compliance costs, model performance, investment, or innovation.
Why state rules remain part of the business picture
While federal policy has moved toward challenging some state requirements, state activity has continued. An Associated Press report published June 14, 2026, described state actions involving children’s interactions with chatbots, AI used in employment, notice to employees and applicants, and provenance information embedded in AI-generated or altered digital content. The Associated Press report is a dated account of activity, not a comprehensive 50-state legal survey or a guarantee that each measure remains in force today.

For a company, the important distinction is between a federal policy objective and the current legal status of a specific state requirement. An executive order may direct federal officials to review, challenge, or seek changes to state laws; litigation, legislation, and implementation determine what happens to a particular rule. A national framework would also depend on the terms and enactment of any legislation, rather than the policy preference alone.
That uncertainty can affect organizations differently. A model developer, an employer using automated tools, and a company offering a consumer chatbot may face different questions because their activities, users, and locations differ. The policy fact sheet itself anticipates clarification for particular sectors or uses, so “AI company” is too broad a category for a reliable compliance conclusion.

What developers should do now
Separate optional federal engagement from legal requirements
If your organization develops advanced models, distinguish the voluntary covered-frontier-model process described in Executive Order 14409 from any obligations that arise under other applicable law. Do not treat the voluntary framework as a universal approval step, and do not assume that the order removes separate legal duties. For a specific model or program, verify whether it is covered by the described process and what the current implementing instructions say.

Keep security and lawful access in scope
A lighter approach to broad model controls does not remove the significance of cybersecurity. The June 2026 order directs cybersecurity work and emphasizes existing criminal enforcement for unlawful AI-assisted access to or damage of computer systems. Development and deployment planning should therefore continue to account for secure systems and lawful use; the order does not provide a substitute for assessing the rules that apply to a particular organization.
Track changes that affect your actual footprint
Map where models are developed, offered, and used, then monitor the federal and state developments relevant to those activities. Pay attention to agency implementation, litigation, legislation, and notices concerning federal grants if your organization or partners depend on discretionary federal funding. The point is not to treat every state proposal as binding everywhere; it is to identify which enacted and applicable rules matter to the product and the users it serves.
What businesses that use AI should do now
Start with the use case, not the “hands-off” label
Identify how the organization uses AI, who is affected, and where those activities occur. The state activity reported in 2026 illustrates that concerns can differ across contexts such as employment and consumer-facing chatbots. The cited materials do not establish that every business using AI is subject to a single set of AI-specific duties, so the use case and jurisdiction are essential to determining what applies.
Make compliance monitoring a continuing task
Maintain a process for reviewing applicable federal requirements and agency actions, state statutes and regulations, and litigation that could alter the reach of state rules. Monitor implementation rather than relying only on announcements: an executive order establishes instructions and policy, while subsequent agency action, court decisions, or legislation can change the practical position. This is operational guidance inferred from the orders and reported state activity, not a claim that every listed development affects every company.
Do not infer a blanket exemption
Executive Order 14179 says implementation is subject to applicable law, and Executive Order 14409 preserves a targeted federal focus on cybersecurity and enforcement of existing criminal laws. Neither order says that businesses may ignore applicable law because the federal policy favors fewer perceived barriers to AI development.
What remains uncertain
- How much state-law preemption will occur: Executive Order 14365 calls for challenges and a legislative recommendation. Its directions do not by themselves settle the status of each state requirement.
- How voluntary frontier-model engagement will work in practice: Executive Order 14409 describes a framework and a possible early-access period of up to 30 days, but specific applicability and implementation matter to any developer considering participation.
- What the measurable effects will be: The cited orders and fact sheets establish policy aims and instructions, not evidence quantifying effects on innovation, costs, competitiveness, or business compliance.
- Which state measures remain operative at a later date: The Associated Press account is dated June 2026 and is not a current, comprehensive survey. A company evaluating a particular law needs to check its present status and scope.
For developers and businesses, the most accurate reading is therefore conditional: federal policy is seeking less prescriptive model-development control and greater national consistency, while existing law, targeted enforcement, state activity, and the implementation of new federal directions remain relevant.
