A data center moratorium is a temporary pause on specified government approvals or permit actions. It may give officials time to study electricity demand, water use, air quality, land use, noise, or community effects; gather public input; and write permanent rules. The label itself does not tell you what is paused.

The controlling ordinance, executive order, statute, or agency notice determines which facilities are covered, which approval stage is affected, how existing applications are treated, what exemptions apply, and when approvals can resume. A pause on new or specified approvals is not automatically a cancellation of existing permits, a stop-work order, a ban on construction, or a permanent prohibition.

What “moratorium” means in data-center policy

In ordinary language, a moratorium “presses pause.” Legally, it is a temporary restriction created by a particular government instrument. A city might stop accepting zoning applications, a county might stop processing permit applications, or a state agency might withhold discretionary environmental permits. Those actions can affect different projects at different stages.

For example, Madison, Wisconsin, describes its moratorium as a planning tool that “presses pause” on potential proposals while the city develops responsible rules for a new land-use category. That description explains the policy purpose, not a universal legal result. To know what happens to a project, read the operative text and compare it with the project’s permits and application status.

What a moratorium can pause

  • Acceptance of new applications.
  • Processing or consideration of applications already filed.
  • Issuance of zoning approvals, building permits, certificates of occupancy, or other development approvals.
  • Issuance of specified state environmental permits, such as discretionary permits that have not been deemed complete.

A measure can cover one of these actions, several of them, or a narrower subset. It may also apply only to a defined use, size, capacity, location, or application stage.

What the word does not establish

“Moratorium” alone does not establish that every data center is prohibited, that a project under construction must stop, that an approved permit is revoked, that utility interconnection is unavailable, or that tax treatment changes. Those effects require language in the applicable ordinance, order, statute, permit, or a separate agency decision.

How to determine the real effect of a pause

Use the following sequence whenever a headline or public statement announces a moratorium.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify the legal instrument. Determine whether the action is an ordinance, executive order, agency directive, emergency rule, enacted statute, proposed bill, or a nonbinding announcement. A legislative proposal is not law unless enacted.
  2. Find the issuing authority and jurisdiction. A city, county, state environmental agency, governor, or utility regulator may have authority over different approvals. A state permit hold does not automatically suspend local zoning.
  3. Read the covered-project definition. Look for terms such as “data center,” “telecommunications center,” principal use, floor area, megawatts, water demand, or facility type. Check whether the measure covers expansions, conversions, co-location, or only new facilities.
  4. List the exact approvals affected. Separate zoning approval, site-plan review, building permits, certificates of occupancy, environmental permits, utility approvals, and construction inspections. A pause on one is not necessarily a pause on the others.
  5. Check application status rules. Find out whether the text distinguishes submitted, accepted, complete, approved, issued, vested, or in-progress applications. These categories often determine whether a project is protected or paused.
  6. Look for exemptions and savings clauses. State law, previously approved projects, facilities serving another primary use, public projects, or applications deemed complete may be excluded.
  7. Record the start date, duration, and end condition. Note whether the pause ends on a fixed date, after a stated number of months, when permanent rules are adopted, or when an agency completes a study. Check for authority to extend it.
  8. Check later amendments and court decisions. A subsequent ordinance, agency notice, injunction, or settlement can change the practical effect. Confirm the current status before relying on an older announcement.

What happens to projects at different stages?

Projects with no application filed

These are usually the clearest targets of a moratorium. If new applications are excluded from acceptance or consideration, an applicant may have to wait until the pause ends or an exemption applies. The applicant may still be able to perform design, financing, site acquisition, or studies, but those private activities do not create a right to government approval.

Applications submitted but not complete

Many measures distinguish an application that has merely been filed from one that an agency has formally accepted as complete. An incomplete application may be rejected, held, or prevented from advancing if the measure pauses processing. The text may specify whether a filing date, completeness determination, or vested-rights rule controls.

Applications deemed complete

Some pauses preserve complete applications. New York’s 2026 state announcement, for instance, says the Department of Environmental Conservation will not issue discretionary permits that were not already deemed complete while a generic environmental impact statement is developed. That is a state environmental-permit rule, not a blanket suspension of all local approvals.

Projects already approved or under construction

An approval pause generally operates prospectively, but the answer depends on the measure. Charlotte, North Carolina, tells readers in its local FAQ that previously approved projects may continue and that some projects can be exempt under state law. That is an example of a local explanation, not a nationwide rule. Verify whether an issued permit remains valid, whether construction deadlines still apply, and whether separate inspections or occupancy approvals are affected.

Projects serving another primary use

A facility’s classification can matter as much as its size. Madison’s FAQ excludes a data center or telecommunications center that serves another primary use. The city’s threshold applies when the data center is the property’s primary use, so a mixed-use or accessory facility must be analyzed under the city’s definitions rather than assumed to be covered.

Examples of different moratorium mechanisms

These official examples show why one jurisdiction’s announcement cannot be used to predict another’s result.

Jurisdiction and date Authority and mechanism What is paused or restricted Duration or end condition Important status rule
Madison, Wisconsin, January 13, 2026 Common Council zoning moratorium Zoning approvals for new principal-use data centers and telecommunications centers over 10,000 square feet; related building-permit and occupancy consequences follow. The city describes a 12-month planning period in its current policy materials. Floor area counts only space used by the data center or telecommunications center. A center serving another primary use is excluded.
New York State, July 2026 Governor’s executive action involving the Department of Environmental Conservation Discretionary environmental permits that were not already deemed complete while a generic environmental impact statement is prepared. The standards-development process is expected to take up to one year. After standards are finalized, projects may proceed subject to state, zoning-code, and other local approvals.
Montgomery County, Maryland, June 12, 2026 County Executive order directing the permitting department Acceptance, processing, and consideration of new data center permit applications. Six months, with possible earlier termination if permanent zoning amendments are adopted. The order creates time for the County Council to establish a legislative framework.
Texas, September 21, 2026 Governor’s direction to the Texas Commission on Environmental Quality Data-center permits sought through TCEQ pending ERCOT and Texas Water Development Board audits and collection of electricity- and water-related information. The announcement called for an update to the Governor’s office by October 19, 2026; that date had not yet occurred as of the announcement. The announcement describes an audit-linked permit hold, not a permanent statewide ban.
Charlotte, North Carolina Local moratorium FAQ describing a temporary pause on specified development approvals Potentially zoning or building permits, depending on the applicable local measure. Confirm the current local end date in the ordinance or official notice. Previously approved projects may continue, and state-law exemptions may apply.

Madison’s 10,000-square-foot example

Madison’s policy illustrates how a definition can narrow a moratorium. The city says its January 13, 2026, action covers new data centers over 10,000 square feet when the data center is the property’s primary use. The FAQ says those projects cannot receive the covered zoning approvals and therefore cannot obtain the related building permits or certificates of occupancy for that use.

The 10,000-square-foot figure is a Madison threshold, not a national standard. The city also says floor area is counted only for the data-center or telecommunications-center space. A facility supporting another primary use is exempt under the FAQ. Madison presented possible zoning-framework recommendations to its Plan Commission on September 29, 2026, but no final action was taken at that meeting; a proposal should not be described as adopted without a later official decision.

New York’s state environmental-permit pause

New York’s July 2026 announcement uses a different mechanism. While a generic environmental impact statement is developed, the Department of Environmental Conservation is directed not to issue discretionary permits that were not already deemed complete. The stated review topics are energy demand, water use and quality, and air quality. The announcement also calls for community-investment guidance.

This action should not be paraphrased as a halt to every New York data-center approval. A project may still face local zoning, code, and other state requirements, and the announcement says projects may proceed under those requirements after standards are finalized. Its expected duration—up to one year—is tied to standards development, not a universal legal expiration date for every local process.

Montgomery County’s application-processing pause

On June 12, 2026, Montgomery County Executive Marc Elrich announced an order directing the permitting department to pause acceptance, processing, and consideration of new data-center permit applications for six months. He said the order would “create time for Montgomery County to establish clear rules and expectations before applications begin moving through the permitting process.”

The order could end earlier if permanent zoning amendments were adopted. Because it addresses permit applications, readers should still check how the county treats applications filed before the order, projects with other approvals, and construction already authorized under an issued permit.

Texas: permits tied to electricity and water audits

On September 21, 2026, Texas Governor Greg Abbott announced a direction to the Texas Commission on Environmental Quality to halt data-center permits until the Electric Reliability Council of Texas completes an audit. The announcement also ties agency approvals to gathering electricity- and water-related information and describes audits involving ERCOT, the Public Utility Commission, and the Texas Water Development Board.

Abbott summarized the stated condition this way: “Data centers must pay their own way, protect our grid and water, and complete the ERCOT and TWDB audits.” That is the governor’s policy rationale and instruction. It does not establish that the audits were complete, that every permit was legally frozen in the same way, or that a separate local approval was suspended. The announcement identified October 19, 2026, for an update to the Governor’s office; do not treat that future-to-the-announcement deadline as proof of a completed review.

Why governments use moratoriums

A pause creates time for analysis and rulemaking before additional projects enter an approval pipeline. Official materials in these examples identify several questions:

  • How much electricity new facilities will require and how that demand affects grid planning.
  • Whether cooling systems need substantial water supplies or could affect water quality.
  • Potential air-quality effects, including emissions associated with backup generation or electricity production.
  • Land-use compatibility, building scale, noise, traffic, and distance from homes or sensitive uses.
  • How communities might receive infrastructure, tax, workforce, or other investments.
  • Which technical standards, disclosure requirements, or mitigation conditions should apply.

These are issues for study or policy design. A government’s statement that it is investigating an impact is not proof that every facility creates that impact or that a particular project violates a rule.

Moratoriums, bans, and stop-work orders are different

Term Typical function Question to ask
Moratorium Temporary pause on specified approvals or processing. Which action, project type, and application stage are covered?
Permanent ban or prohibition Ongoing rule that disallows a use or activity in defined circumstances. Was a permanent law enacted, and where does it apply?
Stop-work order Directive to halt physical construction or activity at a particular site. Does the order name this project and identify a violation or safety basis?
Permit revocation or suspension Agency action affecting an issued authorization. Does the agency have authority and has it followed the required process?

Calling a moratorium a “ban” can therefore mislead readers about projects with vested rights, issued permits, or statutory exemptions.

How long can a data-center moratorium last?

There is no universal duration. The examples range from a six-month county pause to a state process expected to take up to one year. Madison’s materials describe a 12-month period for gathering insight from a newly created Dane County advisory committee. Some measures end on a calendar date; others end when permanent zoning amendments, standards, or legislation take effect. A court order or later amendment can also shorten, extend, or suspend the practical period.

Always distinguish an announced target from the legal end date. If the text says “until rules are adopted,” determine which body must adopt them and whether adoption requires an effective date, implementing regulations, or a separate vote.

A project-owner checklist

  • Download the current ordinance, order, rule, or agency notice from the issuing authority.
  • Confirm the facility’s location, principal use, floor area, capacity, expansion status, and permit types.
  • Ask the permitting office for a written determination of whether the application is accepted, complete, vested, approved, or exempt.
  • Separate local land-use approvals from state environmental permits and utility or grid processes.
  • Check filing deadlines, construction-expiration dates, and any rights preserved by prior approvals.
  • Review amendments, appeals, injunctions, and agency updates issued after the original announcement.
  • Obtain jurisdiction-specific legal advice before changing construction, financing, or application strategy.

What the 2025–26 legislative activity shows

A North Dakota Legislative Council committee memorandum reports that 15 states introduced legislation to establish data-center moratoriums during the 2025–26 legislative session. That figure counts introduced bills, not enacted moratoriums. It demonstrates legislative interest, but it does not show that all 15 states adopted pauses or that the proposals used the same legal mechanism.

Bottom line for readers

A data-center moratorium is best understood as a jurisdiction-specific pause button on named government actions. To determine its effect, match the measure’s definitions, approval stage, exceptions, and end conditions to the project’s actual status. Until that comparison is made, statements such as “construction is banned,” “all permits are canceled,” or “every data center is blocked” go beyond what the word moratorium can prove.
