Yes, you can use Bitcoin to pay a Virginia merchant that accepts it, but Virginia does not publish a comprehensive current directory of accepting businesses, and the available state sources do not establish how widespread acceptance is. The key recent change is a separate framework for virtual-currency kiosks scheduled to take effect July 1, 2027—not a new rule for every Bitcoin payment. Until then, check the terms and risks of the specific service you use.
What counts as a Bitcoin payment in Virginia?
Three activities are easy to confuse, but they are not the same:
- Paying a merchant: You send Bitcoin to a seller that chooses to accept it. Acceptance depends on the seller; a kiosk law does not require merchants to take Bitcoin.
- Buying or holding Bitcoin through a service: An exchange or custodial wallet may facilitate a purchase, sale, transfer, or storage. Who controls the keys and whether the service transfers fiat currency can affect the risks and regulatory analysis.
- Using a virtual-currency kiosk: A kiosk transaction is covered by Virginia’s distinct kiosk framework. Its future requirements apply to kiosk operators and kiosk transactions, not automatically to ordinary merchant payments.
Virginia’s official materials do not provide a current merchant list or a statewide Bitcoin-acceptance rate. Confirm directly with a business before relying on Bitcoin as a payment option.
What has changed in Virginia?
State oversight of virtual-currency services
The Virginia Bureau of Financial Institutions says it “does not currently regulate virtual currencies.” The Bureau also cautions that a virtual-currency transaction involving a transfer of fiat currency may fall under Virginia’s money-transmitter provisions, Chapter 19.1 of Title 6.2. This is not a blanket statement that every related business or transaction is unregulated; the outcome can depend on the service and transaction structure. See the Virginia SCC’s Notice to Residents Regarding Virtual Currency, revised August 11, 2026.

- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
Kiosk rules scheduled for July 1, 2027
Virginia Code Chapter 22.2 establishes a licensing framework for virtual-currency kiosk operators and sets requirements that are scheduled to take effect July 1, 2027. The chapter addresses transaction disclosures, fraud controls, identity checks, transaction limits, holds, and charges. These are future-effective kiosk rules according to the cited provisions; they should not be treated as current requirements or as rules for all Bitcoin payments. Check the current text of Virginia Code Chapter 22.2 for effective dates and operational details.
What the 2027 kiosk framework is set to require
The following figures and conditions describe the provisions scheduled to take effect July 1, 2027. They concern virtual-currency kiosks, not the price or limits for paying a merchant directly. Consult the current Code before making a transaction or designing a compliance process.

| Identity and fraud prevention | Provisions call for identity checks, fraud-prevention policies, blockchain analytics for relevant fraud detection, and specified staff education. |
| Daily and monthly limits | A new user is subject to a $2,000 daily limit; the maximum daily limit for a user is $5,000; the monthly limit is $10,000. |
| New-user hold | A new user’s transaction is subject to a 48-hour hold. |
| Single-transaction charge | A charge for a single transaction is capped at 18 percent. |
| Qualifying fraud cases | The statute provides for fee refunds in qualifying cases, subject to deadlines and documentation requirements. |
The official descriptions identify these as statutory requirements with a future effective date; they do not establish what any particular kiosk currently charges or how many kiosks operate in Virginia. See Chapter 22.2 of Title 6.2 and the Virginia General Assembly bill record.

The SCC warns that virtual currencies are highly volatile and can lose all value. It also says they are not insured against loss, may be stolen if not stored securely, and that transactions are final and irreversible. These are general risks, not a prediction of Bitcoin’s price or a claim that every wallet works the same way. The agency’s consumer notice recommends researching exchanges, platforms, administrators, sellers, and ATMs before using them.

- Check the recipient and amount: Verify the seller’s payment instructions and the amount before confirming. A completed transfer may not be reversible through the payment network.
- Understand the total cost: Review the exchange rate, service charges, and any other displayed transaction terms before you proceed. For kiosks, the future framework specifically addresses disclosure of charges and exchange rates.
- Know who controls access: With a custodial service, the provider holds or manages access to funds; with a self-custody wallet, you are responsible for safeguarding the recovery information and signing transactions. Losing access or exposing credentials can put funds at risk.
- Research the service: Check the provider’s terms, custody arrangements, support and recovery process, and whether the transaction involves fiat currency. Do not assume the Bureau’s statement about virtual currencies resolves the legal status of a particular service.
Wallets, kiosks, and merchant payment tools are different
A hardware wallet is a physical device for secure storage and transaction signing. It is not a merchant payment processor and does not make a business accept Bitcoin. The SCC’s security warning supports considering how funds are stored, but it does not endorse a wallet model or establish that a particular device is safer for every user.
A kiosk, by contrast, is a service point for virtual-currency transactions and is the subject of Virginia’s upcoming licensing and transaction rules. Before using one, compare its displayed terms and verify that you understand the exchange rate, charges, identity steps, and any delay. Do not assume kiosk limits or holds apply when paying a merchant directly.

Taxes and records
The 2024 Virginia Joint Commission on Technology and Science annual report records discussion that the IRS treats digital assets as property for federal tax purposes and that Virginia state tax guidance was limited at that time. That report is dated context, not a complete answer for a particular purchase or a current determination of its tax consequences. Keep records of relevant transactions and consult current federal and Virginia tax guidance or a qualified tax professional for your circumstances.
