A reported UK High Court ruling has been described as improving the government’s chances of retaining Bitcoin seized in a major fraud case. But the official case materials cited here do not establish what the court decided, or whether the government will ultimately keep the Bitcoin. They show that the 61,000-Bitcoin holding is subject to civil recovery proceedings—a separate process from the defendants’ criminal convictions and sentences.

What happened in the case

The Metropolitan Police said it seized 61,000 Bitcoin from Zhimin Qian, also known as Yadi Zhang, during an investigation launched in 2018. Police described it as a record-scale cryptocurrency seizure. The underlying scheme defrauded more than 128,000 people in China between 2014 and 2017, according to the Metropolitan Police; the Crown Prosecution Service later characterized the fraud losses as approximately £600 million.

Qian pleaded guilty in September 2025 to acquiring and possessing criminal property, namely cryptocurrency. Seng Hok Ling pleaded guilty to transferring criminal property. On 11 November 2025, Qian was sentenced to 11 years and eight months in prison, and Ling to four years and 11 months, the CPS reported. Those convictions and sentences address criminal conduct; they do not, by themselves, determine the final legal ownership or distribution of the larger Bitcoin holding.

How the criminal case differs from the Bitcoin recovery process

The CPS says Qian’s assets were frozen during a civil recovery investigation before the High Court. Its case study says the recovered 61,000 Bitcoin remains subject to High Court civil recovery proceedings. Civil recovery is the process relevant to whether the assets can be recovered under the law; seizure and a criminal conviction are not the same as a final civil recovery order.

Bitkey Bitcoin Hardware Wallet, No Screen - Self-Custody, No Seed Phrase
  • BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
  • SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
  • NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
  • 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
  • BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.

There is also a separate confiscation order against Ling. In January 2026, the CPS reported that he was ordered to pay £5,603,305.81. That order concerns Ling, not the value or final disposition of Qian’s 61,000 Bitcoin. The CPS announcement quotes Security Minister Dan Jarvis saying, “This order sends a clear message: we won’t allow crime to pay.” The statement refers to Ling’s confiscation order, not a ruling over the Bitcoin holding.

Why published values for the Bitcoin differ

The figures in official accounts refer to different valuation dates and different things. The victims’ losses are not a live valuation of the seized cryptocurrency, and none of the figures below establishes what the Bitcoin is worth today.

Figure What it describes Source and qualification
Approximately £600 million Estimated losses from the fraud The CPS’s 2026 case study characterization; not the Bitcoin’s market value.
About £300 million Value of the recovered 61,000 Bitcoin at the time of seizure CPS Specialist Prosecutor Joanna Ingle, in the CPS Annual Report and Accounts 2025–2026 case study.
More than £5.5 billion Value attributed to the seizure in the police announcement Metropolitan Police, September 2025; this is a time-specific figure, not a current quote.
More than £1.5 billion Value of cryptocurrency in Qian’s possession when police recovered it during the period June 2021 to September 2025 The sentencing judge’s remarks; the judge noted that Bitcoin volatility makes valuation dependent on the date used.
£5,603,305.81 Confiscation order against Ling CPS, January 2026; it is not the value of Qian’s Bitcoin.

The judge put the valuation problem plainly: “All agree the volatility of Bitcoin means that determination of value is not a straightforward exercise.” The sentencing remarks therefore should not be read as a current market estimate or a final amount available for recovery.

What is known about the reported High Court ruling

The official CPS and police publications cited here confirm the background and the existence of the civil recovery proceedings, but they do not state the holding of the newly reported ruling. They do not identify the ruling’s date, the case name, the legal test applied, or whether an appeal is possible or pending. Without those details, it is not possible to conclude from these materials that the government has won the Bitcoin or that a final order has been made.

Could victims receive money from the Bitcoin?

The case materials establish the scale of the alleged victim losses and the ongoing civil recovery process, but they do not establish whether victims have made claims in that proceeding, whether they have a legal entitlement to any recovered assets, or how any proceeds would be distributed. The approximately £600 million loss estimate cannot be treated as a promise that victims will receive that amount from the Bitcoin, just as the much larger market valuations do not show that the state can retain the surplus.

The outcome depends on the court process and any orders made in it. Until a final recovery and distribution decision is documented, the distinction between assets being seized, assets being recovered under a civil order, and money being paid to victims remains essential.
