Possibly—but the official UAE sources do not establish either a blanket requirement that every school keep exam data in the country or a blanket permission to send it abroad. Cross-border processing of personal data is regulated, and schools have student-confidentiality and assessment-quality duties. Before using an AI marking service, a school needs to map the actual data flow, establish which transfer requirements apply, and check its education authority’s current rules.
Does UAE law require student data to stay in the UAE?
The UAE Government’s summary of Federal Decree-Law No. 45 of 2021, Regarding the Protection of Personal Data, says the law covers electronic processing of personal data inside or outside the UAE and establishes requirements for cross-border transfer and sharing for processing. The law came into force on 2 January 2022, according to that portal. The summary does not set out the detailed transfer mechanisms, and it does not say that every student record must be stored in the UAE.
That means the answer is not simply “all data must stay here” or “an overseas service is fine.” A school considering overseas processing needs to establish the applicable transfer conditions and safeguards from the full law and the particular arrangement. The government summary alone is not enough to decide whether a specific vendor workflow complies.

What counts as student information in an AI marking workflow?
Consider every item that might reach the provider, not only the student’s name. A script may include a student ID, handwriting, personal details in an answer, teacher comments, a school or class identifier, or the mark itself. Also account for prompts, uploaded files, generated feedback, logs, backups, and any information sent to subprocessors or accessible to remote support staff.

The National Child Protection Policy in Educational Institutions applies to public and private educational institutions across the UAE, including remote learning, and identifies protection of confidential student information as an institutional duty. Treat identifiable scripts, IDs, and marks as protected student information in this context. That is a practical application of the confidentiality duty, not a substitute for checking the full policy and applicable data law.
Removing names can reduce exposure, but it does not by itself establish that a script is anonymous: details in the answer or other identifiers may still make a student identifiable. Ask what the service receives and whether the school can reasonably link the data back to a student.

Does using a UAE-based provider keep the data in the UAE?
Not necessarily. A provider’s location or a “UAE hosting” description does not, by itself, establish where every part of the workflow takes place. Processing, storage, backups, subprocessors, and support access may need separate verification. Conversely, the fact that a service is overseas does not by itself answer whether a particular transfer is permitted; the school must establish the applicable conditions.

| Workflow option | What it may reduce or change | What still needs checking |
|---|---|---|
| Keep marking within a school-controlled environment | Can avoid sending scripts to an external marking provider, depending on how the environment is configured. | Who can access the environment, where it is hosted and backed up, and how assessment quality is reviewed. |
| Remove direct identifiers before sending scripts | Can reduce the amount of directly identifying information disclosed. | Whether the remaining content can identify a student, where data is processed, and whether transfer requirements still apply. |
| Use a provider with UAE-only processing configured and confirmed | May keep specified processing and storage in the country if the arrangement actually does so. | Contractual confirmation of processing, backups, subprocessors, remote access, retention, deletion, and any onward transfer. |
| Use an overseas provider | Allows the school to consider a service that processes data outside the UAE. | The applicable cross-border transfer conditions and safeguards, all data destinations and access, vendor terms, and the school’s regulatory requirements. |
These are workflow choices, not verified features of any particular product. “Data stays in the UAE” should be treated as a claim to verify across the full data flow, not as a conclusion drawn from a provider’s address.
What should a school check before uploading exam scripts?
Use this sequence to assess the proposed arrangement. It is a practical due-diligence approach, not a checklist quoted from legislation or legal advice.

- Map what leaves the school. List the files, identifiers, marks, prompts, feedback, logs, and other information sent to the AI service. Identify which items are personal or confidential, including information that may identify a student indirectly.
- Trace processing and access. Ask where data is processed, stored, and backed up; which subprocessors handle it; and whether personnel outside the UAE can access it for support or other purposes. Check whether data is sent onward.
- Establish the transfer requirements. Have the school’s responsible legal or data-protection adviser assess the full law and the actual transfer arrangement, including the conditions and safeguards that apply. Do not treat the UAE Government summary as a complete legal determination.
- Review the contract and settings. Confirm permitted uses of scripts and outputs, retention periods, deletion arrangements, access controls, security commitments, subprocessors, and how the provider will notify the school of relevant changes. Get any UAE-only processing commitment in writing and check that it covers the entire workflow the school intends to use.
- Check the relevant education authority. Identify the school’s emirate and type, then verify current requirements with the appropriate authority. The UAE Government describes the Ministry of Education as overseeing private-school registration except in Abu Dhabi, Dubai, and Sharjah, where ADEK, KHDA, and SPEA have roles. This division is a reason to verify the school’s own oversight, not to assume that one authority’s requirements apply everywhere.
- Set assessment controls before use. Decide who reviews uncertain or disputed outputs, how marks are moderated, how errors are corrected, and who remains accountable for assessment decisions. Keep a process for documenting and addressing marking disagreements.
Can AI assign final marks under the Ministry’s assessment policy?
The Ministry of Education describes its Student Assessment Policy Guide for academic year 2025–2026 as the official reference across UAE school levels. Its scope includes continuous, school-based, and centralized assessment, and it identifies moderation and quality-assurance mechanisms. The available policy page does not expressly authorize automated grading. A school should therefore not treat the guide as approval for an AI system to assign final marks; it should check the full guide and applicable local requirements.

1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesThe UAE National AI Literacy Curriculum Framework emphasizes human governance, privacy, transparency, fairness, and critical engagement with AI. Those principles support meaningful school oversight, but they are not a specific legal authorization for automated grading. In practice, AI can be considered as one part of an assessment workflow only with clear review, moderation, error correction, and educator accountability.
