The key difference is the basis for qualifying: H-1B is for specialty-occupation employment, L-1 is for a qualifying transfer within a related multinational organization, and O-1 is for a person with extraordinary ability in a covered field. The right category depends on the job, the worker’s record, and the employer’s circumstances—not simply on which visa sounds most desirable.

All three involve an employer petition and distinct eligibility requirements. An H-1B approval, L-1 approval, or O-1 approval is not itself a guarantee that a visa will be issued or that the worker will be admitted to the United States.

How the three visa categories differ

H-1B, L-1, and O-1 are temporary-worker classifications, but they answer different eligibility questions. H-1B focuses on the nature of the employment: it must qualify as specialty-occupation work. L-1 focuses on the relationship between a U.S. organization and a related foreign organization, as well as the worker’s qualifying employment abroad and proposed U.S. role. O-1 focuses on the beneficiary’s extraordinary ability in a covered field.

That distinction matters at the outset. A worker’s education or accomplishments do not, by themselves, establish that an H-1B or L-1 petition qualifies. Likewise, an employer’s international presence does not establish that a particular L-1 transfer meets the requirements. Each petition is considered under the classification requested; meeting one category’s requirements does not automatically establish eligibility for another.

Category Qualifying basis Central issue
H-1B Specialty-occupation employment Whether the proposed position qualifies and how cap rules apply
L-1 Intracompany transfer Whether the related organizations, prior foreign employment, and U.S. role meet the requirements
O-1 Extraordinary ability in a covered field Whether the beneficiary meets the applicable extraordinary-ability standard

The comparison is necessarily uneven in one respect: the available USCIS material provides detailed L-1 requirements and historical H-1B cap and duration context, but only a broad description of O-1. It does not establish O-1’s full evidentiary criteria, stay limits, filing rules, or current fees. Those details should be checked against current USCIS guidance rather than inferred from this high-level comparison.

H-1B: employment in a specialty occupation

H-1B is the category to examine when a U.S. employer is petitioning for a worker to perform specialty-occupation employment. USCIS Form I-129 instructions describe the form as an employer petition for a beneficiary to come temporarily to the United States to perform services or labor, or receive training. The filing is not simply a request based on a worker’s qualifications: the proposed employment must fit the category too.

Cap and duration context

USCIS’s FY 2023 H-1B report describes an annual cap of 65,000 regular H-1B numbers and an additional 20,000 exemption for qualifying U.S. advanced-degree holders. These are figures from that FY 2023 report, not a current guide to a particular cap season, registration process, or the availability of numbers in 2026. Employers and workers should check current USCIS information for the relevant filing period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The same report says H-1B admission is generally limited to six years and that an initial petition is generally approved for up to three years. “Generally” is important: the report provides historical category context, not a complete account of every exception, extension, or individual case. It should not be used alone to calculate a particular worker’s permitted stay.

What to assess

  • The position: Is the proposed work a specialty occupation under the applicable requirements? A worker’s credentials do not answer that question by themselves.
  • The cap context: Does the case depend on the annual cap or an exemption, and what procedures and dates apply for the relevant filing season? The FY 2023 figures above do not settle current-season questions.
  • The petition and travel steps: Petition approval is not the same as visa issuance or admission. The worker may need to address additional steps applicable to their circumstances.

L-1: transfer within a qualifying organization

L-1 is built around an intracompany transfer, not merely a job offer from a company that operates in more than one country. USCIS policy guidance calls for evidence of a qualifying relationship between the U.S. petitioner and the foreign entity—such as a parent, branch, affiliate, or subsidiary relationship—and evidence that the organizations are doing business. The worker must also have qualifying employment abroad for at least one year during the three years preceding the petition and be coming to the United States for a qualifying role.

The organization must document the relationship and business activity, the beneficiary’s qualifying position abroad, the proposed U.S. role, and the required period of employment. The precise facts and supporting evidence matter: a corporate connection alone does not establish that every employee or U.S. assignment qualifies.

L-1A and L-1B are different role categories

  • L-1A: For executives and managers. USCIS also recognizes that a foreign company may send an executive or manager to establish a U.S. office, subject to the requirements for that situation.
  • L-1B: For employees with specialized knowledge. The petitioner should explain what the specialized knowledge is and why it is needed for the U.S. role.

The distinction is consequential: a petition should support the role category it claims, rather than treating “manager,” “executive,” and “specialized knowledge” as interchangeable labels. USCIS notes that L-1B requirements differ from those of other classifications; a worker who could potentially meet more than one category still needs to qualify under the one being sought.

New U.S. offices require additional support

A petition to send an executive or manager to establish a new U.S. office has additional requirements. USCIS guidance identifies matters including premises for the operation and the organization’s ability to support the proposed business activity. The intended U.S. role and the organization’s capacity to carry it out therefore need to be addressed, in addition to the qualifying relationship and the worker’s employment abroad.

This is a practical distinction for employers considering an initial U.S. operation: a plan to open an office does not by itself establish eligibility. The petition needs to address the required organizational relationship, the worker’s qualifying foreign employment, the premises, and the proposed operation’s ability to support the role. The specific documentation will depend on the facts and should be checked against current USCIS guidance.

Family members in L-2 status

USCIS says dependent spouses and children may seek L-2 classification. Its employer guidance specifically states that spouses admitted with the L-2S class of admission are employment authorized incident to status. That statement is specific to spouses admitted in L-2S status; it should not be generalized to every dependent, every admission record, or other immigration categories.

O-1: extraordinary ability in a covered field

O-1 is based on extraordinary ability in a covered field. USCIS Form I-129 instructions identify fields that include arts, sciences, education, business, or athletics. It is not simply a synonym for “highly skilled,” “experienced,” or “successful.” The applicable legal standard must be met for the relevant field.

The available official material for this comparison establishes that broad category description but does not provide enough detail to explain the full O-1 evidence framework, the initial period of stay or extensions, the rules for employer or agent petitions, or current filing fees. Do not assume that an impressive résumé alone establishes O-1 eligibility, or that the H-1B or L-1 rules answer O-1 questions. Those details require current, O-1-specific USCIS guidance and case-specific assessment.

A practical way to screen the options

Use these questions to identify which category may merit further review. They are screening questions, not a legal determination or promise of approval.

  1. Start with the proposed work. If the case rests on specialty-occupation employment, examine H-1B first. The job itself must fit the category; a worker’s background alone does not resolve that issue.
  2. Check for a genuine qualifying transfer. If the U.S. role is with an organization related to the worker’s foreign employer, determine whether the entity relationship, ongoing business, qualifying employment abroad, and proposed U.S. role satisfy L-1 requirements. Then distinguish L-1A from L-1B based on the role.
  3. Consider the worker’s record against the O-1 standard. If the potential basis is extraordinary ability in a covered field, obtain current guidance on the applicable evidence and filing rules. Do not equate general accomplishment with meeting the legal standard.
  4. Compare timing and practical consequences. Check current cap-season information where relevant, the employer’s ability to document the case, and any family or work-authorization questions. The historical H-1B figures and the L-2S guidance above do not determine the outcome for every person.
  5. Verify the filing details. Form editions, fees, procedures, and adjudication guidance can change. Confirm current USCIS requirements and, where relevant, Department of State visa information before filing or making travel plans.

Petition approval, visa issuance, and admission are separate steps

USCIS describes Form I-129 as a form an employer uses to petition for a beneficiary to come temporarily to the United States to perform services or labor, or receive training. The January 17, 2025 edition of the instructions states: “This form is used by an employer to petition U.S. Citizenship and Immigration Services (USCIS) for a beneficiary to come temporarily to the United States as a nonimmigrant to perform services or labor, or to receive training.” That language describes the petition’s purpose; it does not mean the petition decision alone resolves every later step.

USCIS’s H-1B report expressly notes that approval does not itself guarantee visa issuance or admission. In practice, keep the petition decision distinct from any visa application and from the decision at admission. Which steps apply, and when, depend on the person’s circumstances. A petition approval should not be treated as a guarantee of travel, entry, or permission to work under assumptions that have not been confirmed for the individual case.

What this comparison can—and cannot—tell you

The strongest category-level distinctions are clear: H-1B concerns specialty-occupation employment; L-1 requires a qualifying intracompany relationship and transfer; O-1 concerns extraordinary ability in a covered field. The L-1 requirements described here come from USCIS Policy Manual guidance, while the H-1B cap and duration figures come from a USCIS FY 2023 report. They are useful orientation, not a substitute for current filing instructions.

This comparison does not establish current fees, current cap-season procedures, the correct form edition for a filing, or the complete O-1 evidentiary rules. Nor can category names alone determine whether a particular job, organization, worker, or family member qualifies. For an individual case, verify current official guidance and have the relevant facts reviewed by a qualified U.S. immigration professional.

Frequently Asked Questions

What is the main difference between H-1B, L-1, and O-1?

H-1B is based on specialty-occupation employment, L-1 on a qualifying transfer between related organizations with qualifying employment abroad, and O-1 on extraordinary ability in a covered field. They are separate classifications with distinct requirements.

Can someone qualify for more than one of these visa categories?

Potentially, but eligibility for one category does not establish eligibility for another. Each petition is assessed under the classification being requested, based on the relevant job, employer relationship, worker’s experience, and supporting evidence.

What are the H-1B cap and stay figures?

USCIS’s FY 2023 report described 65,000 regular H-1B numbers and an additional 20,000 exemption for qualifying U.S. advanced-degree holders. It also described a generally six-year admission limit and initial petitions generally approved for up to three years. These are report-era figures, not a current cap-season guide or a complete account of individual exceptions.

Does an approved petition guarantee a visa or entry to the United States?

No. Petition approval, visa issuance, and admission are separate steps. USCIS notes that H-1B petition approval does not itself guarantee visa issuance or admission; the applicable steps depend on the person’s circumstances.

Can an L-2 spouse work in the United States?

USCIS says spouses admitted with the L-2S class of admission are employment authorized incident to status. This guidance is specific to L-2S spouses and should not be generalized to every dependent or immigration category.

What do the available sources say about O-1 evidence and fees?

The sources reviewed support only the broad description of O-1 as extraordinary ability in fields including arts, sciences, education, business, or athletics. They do not establish the full evidentiary criteria, stay limits, employer or agent petition rules, or current filing fees. Check current O-1-specific USCIS guidance.

The Bottom Line

Bottom line: Start with the basis that fits the case: specialty-occupation work for H-1B, a documented transfer within a qualifying organization for L-1, or extraordinary ability in a covered field for O-1. Verify current filing procedures and the evidence required for the specific category; no category is a guaranteed shortcut, and petition approval alone does not guarantee a visa or admission.
