A delayed employer-sponsored green card does not create a new work visa or automatically extend your permission to work. You need a separate, valid basis to work in the United States—such as maintaining or extending your current status, qualifying for H-1B portability, meeting the requirements for AC21 adjustment portability, or qualifying for an L-1 transfer within a related multinational organization. Which route is available depends on your status, filings, job, employer, and dates.

Keep temporary work authorization and permanent-residence processing separate: a pending green-card case does not, by itself, authorize employment. Before you change jobs, travel, or rely on a pending filing, have an immigration attorney assess your facts and check the current USCIS instructions and Visa Bulletin.

Can I keep working in the U.S. while my employment-based green card is delayed?

Possibly, but the delay itself does not answer the question. A green-card case and authorization to work are distinct. You must qualify for a separate work-authorized status or benefit, and its conditions may depend on your employer and the work you perform. USCIS’s general employment guidance describes the need for an employer to follow the process for the worker’s nonimmigrant category, with a limited portability provision for some H-1B workers. USCIS’s nonimmigrant employment reference is a starting point, not a substitute for checking current rules and your individual record.

First identify exactly what currently authorizes you to work, who the authorization is tied to, and when it expires. Then assess whether you can maintain or extend that status, change employers under a rule that applies to you, or pursue a separate route. Do not treat an immigrant petition, a pending adjustment application, or an employer’s promise to file as interchangeable with permission to work.

Which route addresses which problem?

Route What it may address Main eligibility question What it does not provide
Maintain or extend current status Continuing to work under the existing classification Do your status, employer, petition history, and expiration permit it? A green-card delay does not itself extend status.
H-1B portability Potentially starting with a new H-1B employer after a qualifying filing Do you meet the applicable prior-status, stay, and filing conditions? A general job-change rule for every visa category.
AC21 adjustment portability Changing jobs or employers in certain employment-based adjustment cases Is the approved petition in a covered category, has the I-485 been pending long enough, and is the job same or similar? Automatic work authorization or permission to take any job.
L-1 intracompany transfer Moving to a U.S. role with a qualifying related organization Do the corporate relationship, overseas employment, and U.S. role meet L-1 requirements? A route to an unrelated employer based only on technical expertise.
A new employment-based immigrant petition Potentially pursuing permanent residence through another qualifying category Do you meet that category’s requirements, including any job-offer or labor-certification rules or an applicable exception? Immediate work authorization by itself.

Can I change employers on H-1B while waiting for my green card?

Some H-1B workers may be able to begin work for a new employer after that employer files a qualifying Form I-129 petition under H-1B portability. This is separate from portability under the employment-based adjustment rules. USCIS’s reference describes conditions that include a prior lawful admission, timely filing before the prior authorized stay expires, and no unauthorized employment after admission and before the new filing. Meeting one condition does not establish that every other condition is met.

Do not assume that having an H-1B approval, an H-1B history, or a pending green-card case automatically makes a job change safe. The details of your admission and stay, prior work, and filing dates can matter. USCIS’s reference is a useful description of the process, but it may not capture every later policy development. The prospective employer and an immigration attorney should verify current USCIS rules and your eligibility before you start work.

What to confirm before relying on portability

  • Identify the status and authorized-stay dates reflected in your immigration record, not just the expiration date on an employment document.
  • Confirm who will file the new petition, what classification it requests, and when USCIS receives it.
  • Review whether you have worked only as authorized and whether your prior admission and stay satisfy the requirements that apply to your case.
  • Get advice on your proposed start date. Do not infer it solely from a receipt notice, an employer’s filing plan, or the existence of a green-card case.

Can I switch jobs while my I-485 is pending?

In certain employment-based cases, AC21 adjustment portability can permit a job or employer change after the I-485 has been pending for at least 180 days. USCIS describes the provision for some applicants with an approved EB-1, EB-2, or EB-3 immigrant petition, provided the new job offer is in the same or a similar occupational classification. The 180-day period is a minimum threshold for the covered portability provision—not a general waiting period after which an applicant can take any job. See the USCIS Policy Manual chapter on transfer of underlying basis.

This provision concerns an adjustment applicant’s ability to continue the employment-based permanent-residence process following a qualifying job change. It is not the same as H-1B portability and should not be treated as a blanket grant of temporary work authorization. A person changing jobs must separately establish a valid basis to work, if needed. The job’s actual duties and occupational classification matter; a similar-sounding title alone is not enough to establish that two positions qualify as same or similar.

Important AC21 limitations

  • The covered petition must be approved and in EB-1, EB-2, or EB-3, and the I-485 must have been pending for at least 180 days.
  • The new job offer must be in the same or a similar occupational classification. Evaluate the work itself, not just job titles or the fact that both roles are in technology.
  • USCIS identifies exceptions for adjustment applicants whose approved immigrant petition is based on extraordinary ability or a national interest waiver.
  • If you request to transfer the adjustment application to a different employment-based category using a new I-140, USCIS says the 180-day clock for portability eligibility begins again after that transfer request.

Before accepting a role, compare the approved petition and the position that supported it with the proposed job’s responsibilities and classification. Preserve the relevant job descriptions and petition records, and ask counsel to assess whether the move fits the rule and what documentation USCIS may require.

Can my company transfer me from an overseas office to the U.S.?

An L-1 intracompany transfer may be relevant if you have qualifying employment abroad and will move to a qualifying U.S. role at a related organization. It is not a general alternative for joining an unrelated company, and technical expertise by itself does not establish eligibility. USCIS’s L-1 documentation and evidence guidance describes the employer’s evidence burden.

The organization must have qualifying U.S. and foreign business presences and a qualifying relationship between the entities. The beneficiary generally must have worked full-time abroad for the qualifying organization for at least one year within the relevant three-year period. The proposed U.S. role must primarily involve managerial or executive work, or specialized knowledge. For a technology employee, the actual duties, work history, and relationship between the employing entities are central; a company’s use of a shared brand or the employee’s technical skill alone does not settle the question.

Questions for the employer to resolve

  • Which foreign and U.S. entities are involved, and what evidence establishes their qualifying relationship?
  • Where and when did you work abroad for the qualifying organization, and does that employment meet the required period?
  • What will you actually do in the U.S., and how do those duties meet the managerial, executive, or specialized-knowledge standard?
  • What evidence will the petitioning employer submit to support the organization, your work history, and the proposed role?

Could another employment-based green-card petition help?

A different immigrant petition can be a possible permanent-residence strategy if you qualify for its category, but it is not a temporary work visa and does not by itself authorize immediate employment. The Department of State’s overview of employment-based immigrant visas describes categories with different requirements. Some require an employer-sponsored job offer and labor certification followed by an employer-filed I-140. For EB-2, a job offer and labor certification generally apply, while a national interest waiver may be available to applicants who qualify for that exception.

Do not assume that a new immigrant petition replaces the need to maintain work-authorized status while it is pending. A potential category change, an employer’s willingness to file, or a new petition’s approval can affect the permanent-residence strategy without automatically solving the separate question of whether you can work now. Discuss both tracks with counsel: the immigrant petition route and the independent basis for employment authorization during processing.

What happens if my priority date retrogresses?

Employment-based immigrant visa numbers are limited by category and priority date. The Department of State’s Visa Bulletin warns that demand and annual limits can cause dates to move backward (retrogress) or a category to become unavailable. A priority date that was current can cease to be current, affecting when a visa number is available. It does not, by itself, create or cancel temporary work authorization; that question depends on your separate status or employment authorization basis.

Read the latest Visa Bulletin for your employment category and chargeability, and check USCIS’s instruction for the relevant month on which chart applicants may use to file an adjustment application. The Department of State’s July 2026 Visa Bulletin is a dated snapshot, not a prediction of current or future availability. Do not use dates in that bulletin as if they were still current in a later month.

How to assess your options before changing jobs or traveling

Use this sequence to organize a decision with your employer and immigration attorney. The right answer depends on the records and rules that apply to your case, so treat this as a preparation checklist, not an eligibility decision.

  1. Establish your current work basis. Record your nonimmigrant classification, employer, authorized-stay period, petition history, and any separate employment authorization. Identify the document and approval or filing that supports each fact.
  2. Build a green-card timeline. Collect your I-140 approval and category, priority date, I-485 receipt date and status, and any request to transfer the adjustment application to another basis. A day count matters for AC21, and a new transfer request can affect that clock.
  3. Describe the proposed work accurately. Gather the prospective job description, duties, reporting structure, location, and employer identity. For AC21, the question is whether the role is same or similar; for L-1, the qualifying relationship, foreign employment, and U.S. duties must be assessed.
  4. Match the proposed move to a specific route. Ask whether the plan relies on maintaining current status, an H-1B petition filing, AC21 adjustment portability, L-1 eligibility, or a new immigrant petition. Do not combine requirements from one route with another.
  5. Verify the current filing and travel implications. Have counsel check current USCIS policy, forms and instructions, the relevant Visa Bulletin and USCIS chart instruction, and the effect of travel or a job change on your specific filings before acting.

Why a one-size-fits-all answer is unsafe

The same delay can lead to different options because the decisive facts vary: citizenship and chargeability, current classification and expiration, admission and employment history, the employer’s structure, actual job duties, overseas work, immigrant petition category and approval, I-485 filing date, and any later transfer request. A tech title does not establish eligibility for a particular category. Nor does an employer’s willingness to sponsor resolve timing, status, or visa-number availability.

This guide covers H-1B portability, AC21 adjustment portability, L-1 transfers, employment-based immigrant categories, and visa-number availability. It is not a complete comparison of every temporary visa classification. For any planned employer change, travel, or reliance on a pending filing, get advice based on your documents and verify the current official requirements.
