For an Indian technology professional, the most plausible U.S. work routes are usually an employer-sponsored H-1B, an intracompany L-1 transfer, or an employment-based immigrant case in EB-2 or EB-3. O-1 can fit a much smaller group with documented extraordinary achievement. H-1B1 and E-3 do not apply to Indian nationality alone. The right choice depends on the actual job, your credentials, your employer’s corporate structure, whether you are already working for a related foreign entity, and whether you need temporary authorization or permanent residence.
Start with the decision: which route matches your situation?
Visa labels do not create eligibility by themselves. Your employer must match the position, the company structure and your qualifications to a specific legal classification. Use this first-pass triage before discussing forms or filing dates.
| Route | Best fit | What the employer must establish | Main constraint for an Indian professional |
|---|---|---|---|
| H-1B | A U.S. specialty-occupation technology role requiring a qualifying degree or equivalent | A Labor Condition Application (LCA), wage and working-condition attestations, and the applicable USCIS petition or consular process | Many new cases are subject to the annual cap and selection process |
| L-1A | Transfer to a related U.S. organization for primarily managerial or executive work | A qualifying U.S.-foreign relationship, qualifying overseas employment and a managerial or executive role | It is not a general visa for any Indian worker who receives a U.S. offer |
| L-1B | Transfer to a related U.S. organization for specialized-knowledge work | Corporate relationship, qualifying overseas employment, the particular knowledge and the business need | The employer must document why your knowledge is specialized and relevant to the proposed work |
| O-1 | A worker with extraordinary ability or achievement and substantial supporting evidence | An evidence-intensive petition under current USCIS standards | Professional seniority or strong technical skill alone does not make it an ordinary alternative |
| H-1B1 | Specialty-occupation work by a national of Chile or Singapore | Nationality eligibility and the required LCA and application procedure | Indian citizenship alone does not qualify |
| E-3 | Specialty-occupation work by an Australian national | Australian nationality, specialty occupation and the E-3 consular process | Indian citizenship alone does not qualify |
| EB-2 or EB-3 | Employer-supported permanent residence for a qualifying professional or skilled worker | Usually labor certification where required, followed by Form I-140 and an immigrant-visa or adjustment process | India chargeability can make visa-number availability a decisive issue |
These categories also differ in whether authorization is temporary or permanent, whether the job must be tied to a particular degree, how much evidence is required, what the employer must attest to, and whether an annual cap or immigrant visa number is available.

What qualifies as a specialty occupation
H-1B is designed for a specific position that requires specialized knowledge and normally a degree in a directly related specialty, or an equivalent qualification. A software-engineering title is not enough. The employer should describe the actual duties, the knowledge those duties require and why the position normally calls for the relevant degree or equivalent. Your education and experience must match that specialty rather than merely being generally technical.
The U.S. Department of Labor describes a regular annual cap of 65,000 H-1B numbers and an additional 20,000 exemption for people with a U.S. advanced degree. Those figures are annual statutory allocations, not a promise that an individual registration will be selected. Some employers and circumstances can be cap-exempt; the exact basis must be verified for the case and current filing year.

Employer sequence
- Define the real job. Freeze the duties, work location, required degree field and employment start date. Changing the role after the labor step can create a mismatch.
- Check the worker’s credentials. Compare the degree or equivalent education and experience with the specialty required by the position. Keep diplomas, transcripts and an equivalency assessment when the case needs one.
- File the LCA with the Department of Labor. The employer attests to wage and working-condition requirements. A covered employer generally must offer and pay at least the higher of the actual wage paid to comparable workers or the prevailing wage for the occupation and area. DOL says an LCA generally cannot be filed more than six months before the employment start date.
- Complete the USCIS or consular step. The employer follows the filing route that fits the worker’s location and current status. A person outside the United States generally uses the approved petition for a visa application; a person already in the United States may have a status-change or extension strategy if the facts support it.
- Plan the start date and work location. The petition, LCA and actual employment must remain consistent. A material change in location or duties can require a new filing or other action.
What the LCA does—and does not do
An LCA is an employer attestation, not the worker’s visa and not an approval of the immigration petition. It addresses pay and working conditions under the covered program. The Department of Labor’s labor-condition role is distinct from USCIS adjudication and from the State Department’s visa issuance.
Cap planning for an Indian applicant
Cap-subject H-1B planning is calendar-sensitive. The employer must verify the current registration period, selection rules, fees and petition filing window for the relevant fiscal year rather than relying on an old checklist. A cap-exempt theory, if available, should be documented by the employer’s institutional facts; it is not created by the employee’s nationality, job title or graduate degree.

L-1: transfer from a related foreign operation
L-1A for managers and executives
L-1A is for an intracompany transfer into a primarily managerial or executive capacity. The employer must show a qualifying relationship between the U.S. and foreign entities and establish that both organizations are doing business as required. The proposed role must be genuinely managerial or executive; a senior-sounding title without authority, organizational responsibility or evidence of the function is weak.
L-1B for specialized knowledge
L-1B covers a transfer for specialized-knowledge work. The petition should identify the particular knowledge, explain how you acquired it through the foreign operation and connect it to the U.S. assignment. Generic programming ability or familiarity with widely available tools is not, by itself, a complete specialized-knowledge explanation. Evidence can include the company’s products and processes, your project history, internal training, architecture ownership and why the U.S. business needs this knowledge now.
Evidence the employer should assemble
- Ownership, control or other documents showing the qualifying relationship between the entities.
- Descriptions of the foreign and U.S. businesses and evidence that they are doing business as required.
- Payroll, employment and organizational records showing your qualifying work abroad.
- A detailed U.S. duty statement and organization chart.
- For L-1A, evidence of managerial or executive authority and the function managed.
- For L-1B, evidence explaining the knowledge, how it differs from ordinary industry skill and the business need for the transfer.
USCIS emphasizes that the filing should explain the business activities and the worker’s role, not merely attach a corporate chart and a résumé. An L-1 is therefore strongest when the transfer is part of a documented cross-border operating structure, not when a U.S. company is hiring an unrelated candidate for the first time.

Dependents and work authorization
An L-2 dependent spouse’s ability to work depends on the current L-2 documentation and applicable rules. The USCIS employer handbook explains the documentation used to evidence work authorization. Families should check the current USCIS instructions before relying on an older employment-authorization document or admission notation.

O-1: a high-evidence option, not a generic “top engineer” visa
O-1 may be relevant when a technology professional can document extraordinary ability or achievement under the current USCIS criteria. The category is evidence-intensive. Awards, published work, judging, original contributions, critical roles, compensation and comparable evidence may be relevant in a particular case, but no single résumé item guarantees eligibility and the criteria must be checked against the current USCIS policy and petition requirements.
Employers should obtain a case-specific assessment before treating O-1 as an alternative to H-1B. A strong salary, a prestigious employer or many years of experience can support a petition narrative but does not replace the required evidence. Because standards and acceptable evidence can change, use the current USCIS guidance when preparing the filing.
Why H-1B1 and E-3 usually are not options for Indian citizens
H-1B1 is limited to nationals of Chile and Singapore. E-3 is limited to nationals of Australia and covers specialty occupations. Both involve specialty-occupation concepts, but nationality is a threshold requirement. An Indian passport holder cannot use either classification merely because the job is in software, the employer is willing to sponsor or the worker has a qualifying degree.
These categories should not be confused with H-1B. The Department of Labor describes their nationality and LCA distinctions, while the State Department’s consular guidance sets out E-3 requirements and documentation. A person with dual nationality must analyze the nationality actually used for the application and the applicable evidence.

Employment-based green cards: EB-2 and EB-3 are a separate track
Eligibility is not the same as a visa number
EB-2 and EB-3 are immigrant classifications, so they pursue permanent residence rather than a temporary assignment. EB-2 generally concerns qualifying professionals with an advanced degree or exceptional ability; EB-3 covers qualifying professionals, skilled workers and other workers under the applicable definition. The employer and worker must select the category that fits the offered position and the worker’s credentials.
Approval of an employer’s petition does not automatically mean an immigrant visa is immediately available. The Department of State publishes a Visa Bulletin with employment-based dates. India is a separate chargeability area for these purposes, and its dates can differ substantially from the worldwide column. A priority date can therefore be established while the worker still waits for a visa number.
PERM and Form I-140 sequence
- Choose the category and job description. The employer and worker identify the permanent position, category and whether labor certification is required.
- Complete labor certification when required. The employer follows the Department of Labor’s PERM process, including the required recruitment and attestations for the permanent job.
- File Form I-140. After certification, the employer generally submits the certified labor certification with Form I-140 to USCIS. The filing must establish the category, the offered position and the worker’s qualifications.
- Wait for an available immigrant visa number. The worker follows either consular processing or adjustment of status when the priority date and the applicable monthly chart permit it.
How to monitor India dates
Check the latest State Department Visa Bulletin every month for EB-1, EB-2 and EB-3 India dates. If the worker is applying for adjustment of status, also check which chart—Dates for Filing or Final Action Dates—USCIS has designated for that month. A date printed in an older article is not a current wait-time estimate.
The State Department describes approximately 140,000 employment-based immigrant visas per fiscal year as an overall annual figure. It is not an India-specific allocation and does not predict the next bulletin’s movement. Demand, per-country limits, unused numbers and other statutory factors affect availability.
Visa, status and work authorization are different things
A visa stamp is a travel document used to seek admission at a port of entry. Immigration status is the classification granted for a period after admission or an approved change or extension. Work authorization comes from the applicable status and documents. The State Department handles visa applications and issuance; USCIS handles petitions and many status decisions; the Department of Labor handles LCAs and labor certifications.

That division matters when an employee changes location, changes employers, travels while a petition is pending or moves from a temporary case to an immigrant case. The correct path depends on whether the person is inside or outside the United States, current status, the petition posture and the facts of the job. Do not assume that an approved petition alone authorizes work or that an unexpired visa stamp proves current status.
Employer checklist before choosing a route
- Role: Write the actual duties, reporting line, worksite and start date before choosing the classification.
- Credentials: Map the degree, equivalent experience and specialized knowledge to the position rather than to the employee’s résumé in general.
- Corporate structure: For L-1, collect entity, ownership, control and business-operation evidence before promising a transfer.
- Wages: For an LCA, determine the actual and prevailing wage and use the higher required figure; preserve the supporting records.
- Timing: Identify cap registration or filing windows, LCA timing, the intended start date and travel constraints.
- Location: Confirm that the LCA, petition and actual worksite align and assess any material change.
- Family: Explain dependent classification and current work-authorization documentation separately from the principal worker’s case.
- Permanent plan: Decide whether an EB-2 or EB-3 strategy should begin independently of a temporary visa and identify any India visa-number issue early.
- Verification: Recheck current USCIS, Department of Labor and State Department instructions, fees, forms, dates and processing procedures before filing.
Common mistakes and how to correct them
Calling every software job an H-1B specialty occupation
Problem: The petition relies on the title “software engineer” but does not explain the degree requirement or the connection between duties and specialty.
Correction: Build the case around the real duties, required knowledge, degree field and comparable organizational requirements.

Assuming an approved I-140 ends the wait
Problem: The worker treats petition approval as permission to receive an immigrant visa immediately.
Correction: Track the India chargeability column and the monthly chart USCIS permits for adjustment. Petition eligibility and visa-number availability are separate decisions.

Problem: A plan uses last year’s registration window, filing fee or employment-based cutoff.
Correction: Recheck the current fiscal-year H-1B instructions, DOL procedures and the State Department’s current Visa Bulletin immediately before action.
Confusing travel documents with work permission
Problem: The employee assumes a visa stamp, an approval notice or a pending filing by itself authorizes employment.
Correction: Confirm the worker’s current status, the employer-specific authorization, admission record and any required employment-authorization documentation with qualified counsel.
A practical employer decision framework
- Is this a new U.S. hire with no qualifying foreign-company transfer? Start with H-1B if the job and credentials satisfy the specialty-occupation rules; assess O-1 only when the evidence is genuinely extraordinary.
- Is the worker already employed by a qualifying related foreign entity? Compare L-1A and L-1B based on the actual U.S. role and the evidence available.
- Is permanent residence the business objective? Analyze EB-2 or EB-3, PERM requirements and India visa-number availability separately from any temporary visa.
- Does the worker rely on Chilean, Singaporean or Australian nationality? Only then examine H-1B1 or E-3; Indian nationality alone is not enough.
- Is the person inside the United States? Determine whether the intended filing is a change or extension of status, a consular process or another route, and coordinate travel accordingly.
What to verify before filing
Immigration rules, forms, fees, selection procedures and visa dates change. Before an employer submits a case, verify the current USCIS H-1B registration and petition instructions, the Department of Labor LCA and PERM procedures, and the State Department Visa Bulletin. For an India-based employee, check the India dates for the relevant employment category and confirm whether USCIS is using Dates for Filing or Final Action Dates for adjustment in that month.
A U.S. business immigration lawyer can review the job description, corporate evidence, wage analysis, status history and immigrant strategy together. That review is especially valuable when an employer is deciding between a cap-subject H-1B, an L-1 transfer and a concurrent EB-2 or EB-3 plan.
