Turkey’s Kayıtlı Elektronik Posta (KEP) is a regulated, closed email system that records key events in a message’s handling, including sending, delivery, timing, and reading. Those records can provide evidence about the communication, but they do not automatically prove that every statement in it is true or that every notice has legal effect.
What is Registered Electronic Mail (KEP)?
KEP is Turkey’s registered electronic mail system. The Information and Communication Technologies Authority (BTK) describes it as a qualified form of email that provides legal evidence about the use of electronic messages, including sending and delivery. Its records can also concern the sender as presented, delivery time, reading, and later access. BTK’s overview of Registered Electronic Mail explains the system’s purpose.

Unlike ordinary email, KEP operates in a closed environment: ordinary email services cannot send messages into KEP or receive messages from it. BTK says use is generally not compulsory under KEP regulations, although public bodies participating in the e-Correspondence Project must have infrastructure to accept KEP correspondence. KEP evidence concerns communication events and provider records. It may help establish that a message was submitted, reached a recipient’s KEP mailbox, was opened, or was later accessed, and when those events occurred. It is important to distinguish delivery from reading: delivery records indicate that the message reached the mailbox; reading evidence concerns the recipient opening it.

PTT’s documented workflow illustrates how these records are generated. A user signs into the KEP panel, prepares a message, and signs it using an electronic or mobile signature. PTT records receipt of the message, adds its electronic signature and a timestamp, and sends it to the recipient’s KEP mailbox. It then creates delivery evidence, followed by reading evidence when the recipient opens the message. An SMS described in PTT’s process is an alert that a KEP message has arrived, not itself evidence that the message was delivered or read. A record of sending or delivery is not, by itself, proof that every assertion in the message is true. Nor does using KEP automatically make any notice legally effective. The relevant law, the parties, the content, timing, and circumstances determine what a record proves and whether a legal requirement has been met. A court or other decision-maker may still have to assess the message and the dispute.

When does Turkish law specifically refer to KEP?
Merchant notices under Article 18(3)
Article 18(3) of Turkish Commercial Code No. 6102 addresses a defined set of notices or warnings between merchants: putting the other party in default, terminating a contract, or withdrawing from a contract. It lists several permitted methods, including KEP used with a secure electronic signature. As reproduced on BTK’s official legislation page, the provision says: “Notifications or warnings between merchants regarding putting the other party in default, terminating the contract, or withdrawing from the contract are made through a notary public, registered mail, telegraph, or the registered electronic mail system using a secure electronic signature.” BTK: Legislation
This provision is not a blanket rule that every message sent by KEP satisfies every legal notice requirement. Its stated scope and conditions matter, including the parties’ status, the type of notice, and use of a secure electronic signature. For a particular dispute or transaction, check the current rule that applies to that situation.

Electronic documents under Article 1525
Article 1525 addresses specified electronic documents and statements, including notices, warnings, objections, invoices, confirmation letters, participation undertakings, and meeting invitations. Subject to the parties’ express agreement and Article 18(3), it provides for these items and the electronic sending and storage agreement mentioned in the provision to be prepared, sent, objected to, and take effect in electronic form if accepted. It also assigns BTK responsibility for regulating the system, its transactions and consequences, account holders, and providers. Is KEP the same as formal electronic notification?
No. PTT says that, under Law No. 7101, electronic notification service moved to the National Electronic Notification System (NENS) on 1 January 2019, and that PTT stopped providing that service through KEP from that date. A KEP message should therefore not be assumed to constitute formal service of process or another statutory notification. Identify the service and procedure required by the rule governing your matter, and consult current official instructions for that specific case. PTT: General Information About KEP

Where can you get a KEP account, and what do you need?
BTK directs applicants to KEP service providers. PTT says individuals, public institutions, and legal entities can apply at a PTT branch with the required documents. Application routes and document requirements can change, so check the chosen provider’s current instructions before applying. BTK also says a user may have multiple KEP accounts. Signature needs depend on whether you send or only receive
BTK’s FAQ says an electronic signature is required to send through KEP, while a person who only receives KEP messages does not need one. PTT describes both electronic-signature and mobile-signature workflows. If you use a card-based electronic-signature setup, PTT’s FAQ refers to installing smart-card drivers for its application; check that your certificate, software, and reader are compatible. A compatible USB smart-card reader may be needed for that particular setup, but it is not a universal KEP requirement. PTT: Frequently Asked Questions About KEP
