The proposed 250-foot arch at Memorial Circle has received preliminary planning approval, but it has not received final action from the National Capital Planning Commission (NCPC), and its legality remains contested in court. The dispute includes a challenge over whether Congress must authorize the memorial, a separate environmental lawsuit by Arlington County, and a court order limiting construction-related activity while litigation proceeds. Concerns that the arch could become a military complex or affect flights near Reagan National Airport have been raised publicly, but the available official planning record does not establish final military features.
What is proposed, and what has been approved?
The Trump administration’s proposal is for an arch at Memorial Circle on Columbia Island, at the west end of Arlington Memorial Bridge. The NCPC lists the proposed height as 250 feet from the base to the top of the statuary. The applicant says the goals are to celebrate Americans’ achievements, inspire patriotism and love of country, and beautify the capital.
On July 9, 2026, the NCPC recorded preliminary approval of the site and building plans, with comments for the next review stage. That is not final NCPC action or, by itself, authorization to begin construction. The commissioners had not decided whether the Height of Buildings Act applies to the federal government and requested a justification for the proposed height before final action.
The NCPC’s outstanding requests also include updated off-site traffic information; details about pickup, drop-off and loading; information about FAA-related navigational or safety lighting; and a final choice of granite cladding. Its June 4 record called for a transportation and traffic study, review of pedestrian access, coordination with the Federal Highway Administration and other agencies, and parking and loading information.

Does the arch need congressional approval?
What the plaintiffs argue
In Lemmon v. Trump, three veterans and an architectural historian argue that the administration cannot build a permanent commemorative structure at the site without express congressional authorization. Their March 5, 2026 filing relies on the Commemorative Works Act (CWA) and 40 U.S.C. § 8106. This is the plaintiffs’ legal position, not a court ruling that Congress’s approval is required.
What the CWA review process provides
Separately from the dispute over congressional authorization, the NCPC says CWA section 8905 requires the NCPC and the Commission of Fine Arts to review and approve a commemorative work’s site and design when it is on land under National Park Service or General Services Administration jurisdiction in Washington, DC, and its environs. The CWA’s stated purposes include protecting the L’Enfant and McMillan plans, preserving public use of open space, and ensuring appropriate locations and designs for future commemorative works. Those review responsibilities do not resolve the plaintiffs’ separate argument about who must authorize this project.

What has the court ordered about construction?
A September 4, 2026 order by U.S. District Judge Tanya S. Chutkan imposes procedural restrictions while the case proceeds; it does not decide the arch’s ultimate legality. The order requires the defendants to give the court 48 hours’ notice before activity at Memorial Circle, except for limited on-site archaeological information-gathering.
The order also says that construction or demolition in preparation for construction would violate it and a prior consent order if it occurs before the National Park Service issues final agency action authorizing construction, or without 14 days’ notice. The 48-hour notice requirement and the 14-day construction-related notice condition are distinct parts of the restrictions.

Why did Arlington County file a separate lawsuit?
Arlington County filed a separate case in the U.S. District Court for the Eastern District of Virginia on October 8, 2026, according to the Associated Press (AP) on October 9. The county alleges that the project is being rushed toward ground-disturbing construction before full environmental review. It seeks compliance with the National Environmental Policy Act (NEPA), including proper analysis and testing. County Board Chair Matt de Ferranti said the county’s concerns about negative local effects had been ignored.
White House spokesman Davis Ingle told AP that the administration had complied with legal requirements and called the county’s lawsuit meritless. Those are opposing claims; the county’s filing is not a finding that the administration violated NEPA, and the White House response is not a court decision.

What are the objections to the arch’s scale and location?
Critics cited by AP have objected to the proposed height, potential effects on the skyline and historic views, safety in a busy area, and the project’s legal authority. One focus is the view between the Lincoln Memorial and Arlington House at Arlington National Cemetery, which critics regard as a symbol of post-Civil War reconciliation. The NCPC itself identifies urban design, visitors’ experience, historic preservation and transportation as considerations in its review.

Could the arch be used for military purposes?
On October 7, 2026, AP reported that President Trump had said he agreed, at the military’s request, to convert the planned arch into a “top grade Military Complex.” The official project record described here does not establish what that concept would include, or whether particular military facilities or equipment have been approved.
Sara Nelson, president of the Association of Flight Attendants-CWA, raised concerns about drones, snipers and stored ammunition near aircraft approaching Ronald Reagan Washington National Airport. In AP’s October 7 report, she said: “DCA is already stretched to its limit, we do not need an obstacle taking up space in our flight path. Nor should commercial aviation have to dodge military drones, missiles or snipers while attempting to take off or land at Washington National Airport. Safety first always.” These are her concerns about a possible military use, not evidence that such equipment has been approved or installed.
What the earlier aviation assessment does—and does not—show
Before Trump’s military-complex announcement, AP reported that the Federal Aviation Administration said the arch would not pose an aircraft hazard, while recommending that it be marked and lighted so pilots could see it. That assessment predates the reported military-use concept and does not establish how any later proposal would be reviewed. Separately, the NCPC’s July record says it requested information about any FAA-required navigational or safety lighting.

AP also reported that Gary Langston, a military veteran opposing the proposal, told the NCPC in June: “What’s required here, if anything, is a solemn memorial rather than a monument.” His statement reflects an opponent’s view of the project’s purpose, not an official determination.
