Federal prosecutors allege that Abdulrahman Alfozan, a 35-year-old Saudi national who joined OpenAI as an engineer in July 2025, planted a concealed audio recorder in an executive conference room in San Francisco. He was arrested on Oct. 9, 2026, and appeared in federal court on Oct. 13.
The publicly filed complaint describes a device hidden in toilet paper and inserted into a television’s USB port, a second recorder found in a bag linked to Alfozan, surveillance footage and chatbot prompts about building and concealing recording equipment. The filings do not establish that confidential data was exfiltrated, that anyone received recordings or what Alfozan intended to do with them.
What prosecutors allege happened
A recorder was found behind a conference-room television
According to the U.S. Department of Justice complaint, OpenAI personnel discovered “Recording Device 1” on or about Sept. 30, 2026. It had allegedly been installed around Sept. 28 in an executive conference room in San Francisco and concealed in toilet paper before being inserted into a USB port on the back of a television. The device contained encrypted material, the DOJ says.
The room was used for discussions about proprietary research, product plans, business-development opportunities, technical progress, strategic decisions, government engagements and commercial relationships. Those subjects explain why investigators treated the device as a potential interception of sensitive oral communications; they do not by themselves show that any particular secret was recorded or removed.

A second device was allegedly found in a bag
The complaint says Alfozan did not have authorization to access the room or attend its meetings. After OpenAI installed an additional camera, footage dated Oct. 5 allegedly showed him entering the room and looking behind the television. Security personnel allegedly found a second similar recording device the same day in an unattended bag containing his wallet and identification.
Digital prompts are part of the allegation
The DOJ says a productivity tool was used to ask about OpenAI buildings, meeting rooms, capacities, calendars, leadership and executive locations, as well as partner meetings. A chatbot account associated with Alfozan’s spouse allegedly submitted prompts between Sept. 24 and Sept. 30 about building and customizing a continuous audio recorder, adding Wi-Fi connectivity, improving live listening, encrypting an SD card, testing, concealment and remote access.

The complaint characterizes those prompts as evidence under investigation. An account associated with a spouse is not, on the public record, proof of who typed every prompt or how any device was ultimately used.
What is known, and what remains unproven

- Sept. 24–30: The DOJ says prompts from a chatbot account associated with Alfozan’s spouse concerned recorder design, connectivity, encryption, testing, concealment and remote access.
- Around Sept. 28: Prosecutors allege that the first device was installed and concealed in the executive conference room.
- Sept. 30: OpenAI personnel allegedly found the device behind the television, concealed in toilet paper and plugged into a USB port.
- After discovery: OpenAI added a camera aimed at the room’s access area.
- Oct. 5: CCTV allegedly showed Alfozan looking behind the television. Security personnel allegedly found a second recorder in an unattended bag containing his identification.
- Oct. 9: Federal authorities arrested Alfozan.
- Oct. 13: He appeared in federal court, and the DOJ publicized the charge and allegations.
This sequence combines physical evidence, surveillance and digital records. The public materials do not state that any single item, by itself, proves who operated a recorder or what information it captured.

What charge does he face?
The DOJ says Alfozan is charged with using or endeavoring to use an electronic, mechanical or other device to intercept oral communications. For the charged offense, the department states a maximum penalty of five years in prison, a $250,000 fine and three years of supervised release.
Those are statutory maximums, not a prediction of a sentence. Any eventual penalty would depend on the precise conviction, the sentencing process and other factors. The complaint is the government’s account of probable cause; it is not a final finding by a judge or jury.

What OpenAI has said
OpenAI told the Associated Press that it used its models to understand the device and determine where it came from, identifying a specific employee who allegedly planted it days earlier. The company said it referred the matter to the FBI and would continue supporting the investigation.

What happens next in court
The FBI investigation remains ongoing. The Associated Press reported that Alfozan was due back in court on Oct. 19, 2026. Subsequent proceedings are expected to address the case’s procedural status, evidence and any defense response, but the public materials available for this report do not state the outcome of that hearing.
Until prosecutors prove the charge in court, the legally accurate description is that Alfozan is an OpenAI engineer who was arrested and charged over an alleged covert recording device. The public record currently supports the existence of the devices, the surveillance and the digital prompts described by the DOJ, while leaving intent, transmission of recordings and successful capture of confidential information unresolved.
