Yes. In the United States, records held by a platform, employer, business, or cloud provider may be sought and used in a legal case, even when you do not possess them yourself. But there is no blanket rule that every record can be obtained, that a provider must notify you, or that a record proves what someone says it proves. The process depends on who is requesting it, what kind of data it is, and the law that applies.
What it means for a third party to hold your data
Not having a copy of a record does not necessarily keep it beyond legal process. A provider or other custodian may possess account material, communications, logs, backups, or business records that a party seeks in an investigation or lawsuit. Possession, control, privacy protections, the type of record, and the applicable process all matter; the phrase “your data” does not answer those questions by itself.
This explainer focuses on U.S. federal law. State law, foreign law, agency-specific rules, private litigation, provider policies, and the facts of a particular case can lead to different results.

Government requests and civil subpoenas are different processes
Government investigations
For government requests to providers, 18 U.S.C. § 2703 distinguishes communications content from subscriber records and other non-content information. The process available to a governmental entity depends on the category of data and statutory conditions; it is inaccurate to say that police always need the same kind of warrant, or that a subpoena can obtain everything. Read 18 U.S.C. § 2703.
#1 Best Overall
- Massive capacity, up to 18TB capacity (1 1TB = one trillion bytes. Actual user capacity may be less depending on operating environment.).Specific uses: Business, personal
- Includes software for device management and backup with password protection (Download and installation required. Terms and conditions apply. User account registration may be required.)
- 256-bit AES hardware encryption
- SuperSpeed USB (5 Gbps); USB 2.0 compatible
The statute also provides a preservation mechanism: after a government request, a provider must “take all necessary steps to preserve records and other evidence in its possession.” The initial preservation period is 90 days, with a possible additional 90 days on renewed request. This is a statutory preservation period for records covered by the mechanism—not a promise that providers retain all data for that long, or disclose it. See § 2703(f).
Federal civil cases
In a federal civil case, Rule 45 of the Federal Rules of Civil Procedure governs subpoenas to nonparties. A subpoena may be challenged: the rule provides for objections and permits a court to quash or modify one in specified circumstances, including undue burden and disclosure of privileged or otherwise protected material. For electronically stored information, a subpoena recipient must produce it in its ordinary form or a reasonably usable form if the subpoena does not specify a form. Application depends on the case, local rules, and court orders. Read Federal Rule 45 and the current civil rules.

- USB 3.1 flash drive with high-speed transmission; store videos, photos, music, and more
- 128 GB storage capacity; can store 32,000 12MP photos or 488 minutes 1080P video recording, for example
- Convenient USB connection
- Read speed up to 130MB/s and write speed up to 30MB/s; 15x faster than USB 2.0 drives; USB 3.1 Gen 1 / USB 3.0 port required on host devices to achieve optimal read/write speed; backwards compatible with USB 2.0 host devices at lower speed
- High-quality NAND FLASH flash memory chips can effectively protect personal data security
Government investigative requests and civil discovery are not interchangeable. The identity of the requester and the type of proceeding shape what process is available and how a recipient can respond.

Communications content—such as the substance of a message—is different from subscriber information or transactional and other non-content records. Federal law sets different processes for different categories, so a request’s description matters. A request for an account holder’s identifying details is not automatically equivalent to a request for message content.

Likewise, data on a device is not necessarily the same as data held separately by a provider. A phone may contain local files while the provider holds account content, logs, or backups. Specialist guidance from the Scientific Working Group on Digital Evidence cautions that consent or legal process to search a device does not, by itself, authorize collection of separate cloud-stored data. Its guidance also recommends considering provider notification policies where relevant; it does not establish that every provider will notify a user. See SWGDE guidance and documents.
Obtaining a record does not settle whether it can be used as proof
There are separate questions: whether a record can be requested, whether it was lawfully obtained, whether it can be authenticated, whether it is admissible, and what it actually demonstrates. The Administrative Office of the U.S. Courts says, “The Federal Rules of Evidence govern the admission or exclusion of evidence in most proceedings in the United States courts.” A record’s source, context, integrity, and applicable objections can matter; its presence in a provider’s files does not, on its own, establish authenticity, accuracy, admissibility, or a particular interpretation. Read the Federal Rules of Evidence.

What to do if you receive a request or learn of an investigation
- Identify the process. Note who issued it, whether it is connected to a government investigation or civil case, the jurisdiction, and any stated legal authority.
- Read the scope and deadline. Identify the custodian or provider, the records named, the date range, and the response or objection deadline.
- Get advice promptly. A qualified lawyer can assess the applicable law, available objections, privacy or privilege concerns, and any court orders.
- Do not alter or destroy potentially relevant information. A general article cannot determine your obligations in a specific matter; ask counsel how to handle the records.
Limits of a general answer
No universal rule says that a provider must notify a user, retains every category of data for a fixed duration, or will disclose every record sought. This overview does not resolve state or foreign law, a particular provider’s retention or notification practices, or whether specific evidence will be admitted. The Federal Rules of Civil Procedure govern civil proceedings in U.S. district courts; the U.S. Courts’ current rules page reports amendments taking effect in 2025, so procedural details should be checked against the rules and orders applicable to a case. Check the current federal rules.
