Third-party cryptocurrency storage, more commonly called third-party crypto custody, is an arrangement in which a service provider safeguards crypto-assets or controls the means of accessing them on a customer’s behalf. In many arrangements, that means the provider manages or controls the private keys used to authorize transfers. The customer relies on the provider’s systems and terms to access or move the assets.

What does third-party crypto custody mean?

The key question is who controls access to the private keys. The U.S. Securities and Exchange Commission’s investor bulletin describes custody in plain language as “how and where you store and access your crypto assets.” It identifies exchanges and dedicated custody providers as examples of services that may hold or control access for customers. SEC Investor.gov’s crypto custody bulletin is educational guidance, not a binding legal definition.

In the European Union, MiCA Article 3(17) defines providing custody and administration on behalf of clients as “the safekeeping or controlling, on behalf of clients, of crypto-assets or of the means of access to such crypto-assets, where applicable in the form of private cryptographic keys.” This is the EU regulation’s definition; legal terminology and obligations can differ by jurisdiction and activity. ESMA’s interactive MiCA rulebook reproduces the provision.

What is being stored: the crypto or the keys?

Crypto-assets are represented on a blockchain or similar distributed ledger. A wallet is a tool for managing access to those assets: as the SEC explains, wallets store private keys or passcodes, not the crypto-assets themselves. A private key can authorize a transaction; a public key can be used to receive assets but does not authorize spending. Custody therefore concerns who safeguards or controls the means of access, rather than a provider physically holding coins in the way a bank holds cash.

How third-party custody differs from self-custody

Question Self-custody Third-party custody
Who controls access? The user manages and controls the private keys. A professional custodian or service provider manages or controls access.
Who handles key security and recovery? The user is responsible for securing and backing up keys or recovery information. Losing access can mean losing access to the assets. The provider handles key controls, while the customer depends on the provider’s systems, terms, and continued operation.
Common forms Software wallets and physical devices used for cold storage can be self-custody tools. An exchange account or a dedicated custody provider may offer custody, using hot wallets, cold wallets, or both.
Main trade-off Direct control comes with direct responsibility for setup, security, and recovery. Delegated key management reduces the customer’s day-to-day key handling but creates dependence on the provider and its access arrangements.

These are practical distinctions, not a ranking of every service or a statement about the legal treatment of a particular account. A hardware wallet is a physical tool that can support self-custody; the device alone does not make storage third-party custody or guarantee security.

Hot and cold storage are separate from who holds custody

“Hot” generally means connected to the internet; “cold” generally means kept offline. Those terms describe a storage method, while self-custody and third-party custody describe who controls access. A provider may use hot storage, cold storage, or a combination, and a person can also use hot or cold tools for self-custody.

  • Trusted by 6 million users worldwide - buy, sell, swap, stake, and spend cryptocurrency directly. The secure offline storage wallet designed for how people actually use crypto wallets

The SEC says cold wallets are generally less convenient for transactions and generally more secure from cyberthreats than hot wallets. Offline storage does not eliminate risks: a physical device can be lost, damaged, or stolen, and recovery can still fail. A storage label alone does not establish that assets are insured, immediately withdrawable, or recoverable if something goes wrong.

What risks remain when a provider holds the keys?

Delegating key management changes who handles the operational work; it does not remove risk. A custodian may be hacked, stop operating, or become insolvent. An intermediary may also restrict or suspend withdrawals. Whether a customer has a claim to particular assets, how assets are treated if a provider fails, and what recovery is possible depend on the applicable law, account agreement, and facts—not simply on the word “custody.”

Investor.gov warns that deposits with an unregistered intermediary may leave ownership and recovery uncertain, and that withdrawals have sometimes been suspended during intermediary distress. Registration obligations depend on the service and asset involved; this warning does not mean every crypto custodian is unregistered or that one securities rule governs every crypto arrangement. Investor.gov’s bulletin on crypto-asset custody and intermediaries discusses the issue in the securities-law context.

Questions to ask before using a custodian

Provider labels do not answer the practical questions. Ask for clear answers in the service terms or directly from the provider:

  • Storage methods: What hot- and cold-storage methods are used, and what safeguards protect the systems and any physical devices?
  • Use of customer assets: Are assets kept separate, or can they be commingled, lent, or used as collateral? Is customer consent required?
  • Insurance: What risks and assets does a policy actually cover, and what exclusions, limits, or conditions apply?
  • Supported assets: Which specific crypto-assets and networks can the provider custody and transfer?

  • Fees: What are the setup, recurring, transaction, transfer, and account-closure charges?
  • Failure and access: What happens to withdrawals and customer assets if the provider is hacked, suspends service, or becomes insolvent?
  • Regulatory status: Which regulator, if any, oversees the provider for this particular service in your jurisdiction? Check the relevant official register rather than treating a general claim of regulation as an answer.

These are due-diligence questions, not assurances that any provider follows a particular practice. The SEC’s retail bulletin recommends examining provider regulation, supported assets, insurance terms, key access, security, asset use, privacy, and fees before deciding.

Why the legal definition depends on location and service

European Union

MiCA Article 3(17) supplies the EU definition of providing custody and administration on behalf of clients. Article 3(15) defines a crypto-asset service provider as a legal person or other undertaking that professionally provides one or more crypto-asset services and is allowed to do so under Article 59. These provisions are EU-specific; they should not be treated as a universal definition for every country or service.

United Kingdom

UK government material uses the term “custodian wallet provider” for a firm or sole practitioner that safeguards or administers cryptoassets or private keys for customers. It distinguishes a hosted wallet, where a third party stores the keys, from an unhosted wallet, whose keys are administered by the user. These are UK terms in the source’s context, not universal legal labels. The UK government’s cryptoasset business guidance sets out this terminology.

United States

The SEC’s December 12, 2025 retail custody bulletin expressly says it represents staff views, is not a rule, regulation, or Commission statement, and has no legal force or effect. Separate SEC material addresses broker-dealer custody of crypto-asset securities specifically, including ledger assessment, private-key protection, and continuity arrangements; it should not be generalized to every cryptocurrency custodian. The SEC Division of Trading and Markets staff statement likewise says it reflects staff views and has no legal force or effect.

Regulatory proposals can also change. On October 1, 2026, the SEC’s Crypto@SEC index reported a proposed custody-rule change that would, subject to conditions, permit certain adviser or regulated-fund self-custody and state trust-company custody, among other changes. A proposal is not an effective final rule. The SEC’s Crypto@SEC page is the source for that proposal status.
