India’s GST Council has recommended a new set of process and credit reforms, including system-led refund handling, specified new refund eligibility, return-reconciliation changes and adjustments to enforcement rules. These are recommendations from the Council’s 57th meeting on 8 October 2026—not confirmation that the relevant law or portal processes have changed. Businesses should check the final amendments, rules, notifications and implementation instructions before relying on any measure.

What is the proposed next phase of GST intended to change?

The package follows the rate rationalisation discussed at the Council’s 56th meeting and focuses on how GST is administered: how refunds are processed, which credits may qualify, how returns are reconciled and how disputes are handled. Its central aim is to reduce blocked working capital and manual steps while making compliance and enforcement more structured.

The scale of the system helps explain why process changes matter. A Government of India Press Information Bureau explainer published on 9 October 2026 reported around 1.70 crore registered taxpayers as of September 2026, 3,053 crore cumulative invoice uploads and 833.82 crore cumulative e-way bills as of 30 September 2026, and gross GST collections of about ₹12.46 lakh crore during April–September 2026, up 11.6% year over year. These figures describe the stated dates and period; they do not measure the savings or processing-time gains any individual business will receive.

How would the proposed refund process work?

The Council recommended a two-phase approach to refunds of excess electronic cash-ledger balances, zero-rated supplies and inverted duty structure claims. The first phase combines automatic handling for some claims with risk-based provisional payment for others; the later phase proposes more system verification and automated sanction for a defined subset.

Proposed stage Refund workflow Key condition or qualification
Phase 1 Automatic full sanction of eligible excess cash-ledger refunds; acknowledgement or deficiency memo within 10 days, with deemed acknowledgement if none is issued; risk-based provisional payment of 90% of eligible zero-rated and inverted-duty-structure claims. The 90% provisional payment is risk-based, not a guaranteed advance for every claim. The 10-day period and deemed-acknowledgement mechanism are recommendations requiring implementation.
Phase 2 Automated acknowledgement after system verification and automatic full sanction for acknowledged zero-rated claims selected through system risk evaluation. Pending dues would be adjusted, and the proposal is limited to claims that meet the acknowledgement and risk-evaluation conditions.

The recommended supporting changes include making RFD-01 information system-readable and removing scanned-document uploads for specified zero-rated and inverted-duty claims. The Council also recommended removing the 1.5-times domestic like-goods turnover ceiling from the relevant zero-rated goods refund formula. It proposed clarifying that the ₹1,000 refund threshold applies to the combined CGST, SGST/UTGST and IGST amount.

Which additional input tax credits could qualify for refunds?

The proposals broaden refund eligibility for accumulated input tax credit (ITC) in specified situations. They distinguish the kind of credit and when it was availed, so the date attached to the credit—not simply the date a refund application is filed—may be important under the recommended transition rules.

How could enforcement and disputes change?

The Council recommended guidance for notices and adjudication that emphasizes adequate notice quality, timely orders, case-specific grounds and observance of natural justice, including personal hearings. It also recommended several changes to thresholds, penalties and appeal pre-deposits. The measures below would require the relevant legal changes before they alter taxpayers’ rights or liabilities.

Recommended measure Proposed effect
Show-cause notice threshold A ₹10,000 minimum tax threshold for issuing show-cause notices.
Specified non-fraud cases Reduced penalties of 5% in specified cases where tax and interest are paid within the applicable 30- or 60-day period after adjudication; removal of the minimum ₹10,000 penalty in non-fraud cases.
General penalty under section 125 Reduce the maximum from ₹25,000 to ₹10,000.
Penalty-only appeals Cap appeal pre-deposits at ₹40 crore.
Fraud grounds Require fraud, wilful misstatement or suppression grounds to be invoked on the merits of each case, rather than by default.

The Council also recommended omitting section 69 to withdraw GST arrest powers, narrowing the criminal offence for fraudulent ITC availment to cases involving no receipt of goods or services or no invoice or bill, and rationalising punishments. These recommendations should not be read as immediate immunity from investigation or prosecution; the operative law and facts of a case remain decisive.

What export and trade-facilitation changes are included?

Several recommendations concern specific cross-border or logistics fact patterns. The Council proposed changes intended to facilitate export-of-services treatment for supplies to or through foreign offices or branches; clarify acceptable payment in foreign currency or Indian rupees; and revise place-of-supply treatment for certain services where goods are physically made available to the supplier. It also proposed clarifying when specified deliveries to an SEZ or FTWZ for an overseas buyer qualify as zero-rated, subject to payment conditions.

These are technical issues whose outcome depends on the exact parties, supply, location and payment arrangement. A business should confirm the final statutory language before applying any proposed treatment to a transaction.

Which businesses should track the proposals first?

  • Exporters and zero-rated suppliers: monitor the refund phases, risk selection, revised formula and the proposed capital-goods refund transition.
  • Businesses with an inverted duty structure: check the proposed treatment of input-service and capital-goods credit, including the relevant credit-availment dates.
  • Employers and service providers: review spending in the specified categories, but do not assume the recommendations make all related expenses creditable.
  • Tax and finance teams: reconcile GSTR-1/1A/IFF, GSTR-3B and GSTR-2B data and retain supporting records while the correction and portal mechanisms are finalized.
  • Businesses facing notices or credit-ledger blocks: assess the live matter under the law currently in force; a Council recommendation alone does not decide a taxpayer’s rights in an existing proceeding.

The Council also recommended simplified registration processing, low-risk registration, measures relating to e-commerce sellers and e-way-bill enforcement, a hearing opportunity before certain credit-ledger blocking decisions, late-fee relief for some small taxpayers, common guidance for notices and proceedings, and an optional scheme for some small consumer-facing businesses up to ₹5 crore turnover. Eligibility and availability depend on the final conditions, so turnover alone should not be treated as sufficient.

What should a business do now?

  1. Map whether the business has zero-rated supplies, an inverted duty structure or costs in the specified credit categories.
  2. Record the date each relevant input-service or capital-goods credit is availed, and compare it with the proposed 1 November 2026 and 1 April 2027 transition dates.
  3. Keep reconciling outward-supply returns, GSTR-3B and GSTR-2B, and preserve invoices and reversal/reclaim records.
  4. Before filing a claim or changing a return position, confirm whether the corresponding amendment, rule, notification, circular or portal function has actually taken effect.
  5. For a live notice, blocked-credit decision or complex export transaction, use the operative law and case-specific professional advice rather than relying on the recommendation alone.

The official source for the recommendations is the GST Council’s 57th-meeting release reproduced by the Press Information Bureau on 8 October 2026. Its recommendations describe the intended reforms; final legal text and implementation determine when and how they apply.
