The Thane Motor Accident Claims Tribunal reportedly awarded ₹5 lakh, plus 9% annual interest from the date the claim petition was filed, to the mother of 12-year-old Amit Jagdish Dhakad, who was killed by a Kalyan-Dombivli Municipal Corporation (KDMC) garbage truck in 2021. The insurer, The New India Assurance Company Ltd, was directed to deposit the award for the claimant; the tribunal also reportedly allowed the insurer to recover the amount from the civic side because of policy breaches.
What happened in Kalyan
According to a PTI report carried by Hindustan Times on October 1, 2026, Amit was playing on a road opposite a residential building on May 22, 2021, when a KDMC garbage truck reversing at high speed struck him and caused fatal injuries.
The tribunal’s reported decision concerns compensation to his mother and the allocation of responsibility for paying it. The available news accounts summarize the ruling but do not include the original tribunal order.

Separately, the tribunal reportedly permitted the insurer to recover the amount from the civic side because of breaches of the insurance policy. In practical terms, the direction to deposit the award for the mother and the reported right of recovery are distinct parts of the disposition: the insurer was to make the payment to the claimant, while recovery could shift the cost to the civic side. Why the tribunal reportedly allowed recovery
The PTI account says Regional Transport Office records showed that the truck’s fitness certificate expired on March 10, 2013, and was never renewed. The driver’s transport-class licence had expired on August 13, 2019.

KDMC reportedly argued that the driver had been supplied by its contractor, Vishal Expert Services Pvt Ltd, and relied on government resolutions associated with COVID-era extensions of certain document-validity periods. The tribunal reportedly rejected that defence because the licence had lapsed before the pandemic. It also said KDMC, as the truck’s owner, was expected to verify licences for contractor-supplied drivers; according to the PTI report, KDMC did not produce a verification report.
PTI quoted MACT Member R V Mohite as saying that KDMC was expected to verify the driving licences of drivers supplied by Vishal Expert. The report also reproduced the tribunal’s observation that there was no lockdown when the licence expired and that the driver had operated the vehicle without a valid licence and fitness certificate. These are quotations as carried in the news report; the original order was not available for independent verification.

How the reported ₹5 lakh award was calculated
The reports say the tribunal used a notional annual income of ₹30,000 and a multiplier of 15, along with conventional heads of compensation.
