There is no single “technology tariff.” Your cost depends on the product’s Harmonized Tariff Schedule (HTS) classification, country of origin, customs value, effective date, trade action and documented end use. For some semiconductor imports, U.S. Customs and Border Protection (CBP) guidance describes a 25% additional ad valorem duty under the semiconductor Section 232 regime established by the White House proclamation of January 14, 2026. Other chips, servers, components and finished electronics may face different rates, exclusions or no additional duty.
The practical answer for a technology importer is to build an item-level exposure file, verify every classification and exemption, calculate full landed cost, and compare diversification or reshoring against qualification time, capacity and total cost. Tariffs can be passed to customers, absorbed in margin or shared through contract changes; evidence from the U.S. International Trade Commission (USITC) indicates that importers bore nearly the full cost in the tariff cases it examined.
What technology tariffs change financially
A tariff is collected when a product enters the importing country. For a U.S. importer, the duty is normally paid to Customs and Border Protection based on the product’s customs value, classification and origin. The economic effect can then appear in several places:
- Higher landed cost: the importer pays the duty in addition to the supplier invoice, freight, insurance, brokerage and other import expenses.
- Customer pricing: a company may pass some or all of the increase through to hardware, cloud or managed-service prices.
- Margin compression: a company may hold its selling price and absorb the duty.
- Demand and sourcing changes: buyers may switch specifications, suppliers or countries, reducing exposure but adding qualification and operating costs.
USITC’s analysis of examined tariffs found that importers bore nearly the full cost rather than foreign suppliers reducing prices enough to offset the duty. Its Section 301 analysis reported a 72.3% reduction in semiconductor imports, a 4.1% increase in U.S. semiconductor prices and a 6.4% increase in U.S. semiconductor production value. Separately, USITC associated examined Section 232 tariffs with a $3.5 billion reduction in downstream U.S. production in 2021. These are study results for defined tariff measures and periods, not a forecast for every product or future policy change.

Use those findings as a reason to model incidence explicitly. A contract that says the supplier pays freight does not necessarily mean the supplier bears a new import duty; check the customs importer of record, delivery term and any duty-reimbursement clause.
How to determine whether a product is covered
Product names such as “AI server,” “memory module” or “network appliance” are not sufficient for customs treatment. Classification is based on the product’s technical characteristics, function, configuration and, in some cases, how it will be used after import. Start with the current HTS maintained by the U.S. International Trade Commission, then apply the legal instruments that modify the ordinary tariff schedule.
The classification and coverage record
For each imported item, retain a record containing:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- SKU, manufacturer part number and a plain-language description.
- Technical specifications relevant to the tariff provision, such as processor performance, memory type, bandwidth, integration and intended function.
- The proposed HTS subheading and any applicable Chapter 99 provision.
- Country of origin, supplier, manufacturer and manufacturing steps that support the origin determination.
- Customs value, currency, valuation method and the documents used to substantiate it.
- End use, consignee, installation site and evidence supporting an exemption or exclusion.
- Effective date, current duty rate, related proclamation or notice, and the date the classification was last reviewed.
CBP’s semiconductor bulletin demonstrates why this detail matters. It provides separate logic-chip performance parameters, DRAM bandwidth thresholds and distinct treatment for consumer, repair, research and data-center uses. A generic invoice description can therefore produce the wrong result even when the physical item appears similar to another chip.

Check the legal layers
After identifying the ordinary HTS provision, check whether a product is affected by Section 232, Section 301, another trade remedy, a Chapter 99 tariff number, or a country-specific measure. Read the operative proclamation and CBP implementation guidance together. The HTS archive shows the tariff number and notes; the proclamation establishes the policy scope; CBP instructions explain entry filing and documentary requirements. Because measures and exclusions can change, record the version and effective date used for every decision.
What the January 14, 2026 semiconductor regime covers
The White House proclamation issued January 14, 2026 established a Section 232 regime for semiconductors, semiconductor manufacturing equipment and derivative products. The proclamation states that semiconductors are essential to each of the 16 critical infrastructure sectors identified by National Security Memorandum 22 of April 30, 2024.
CBP describes a 25% additional ad valorem duty for certain covered semiconductor imports. “Additional” means the amount is added to any ordinary customs duty and other applicable charges; it is not automatically the total duty for every chip or equipment item. Coverage still depends on the HTS provision, technical parameters, origin, entry date and any applicable exclusion.

An exclusion is not a blanket exemption for a company or product family. The importer must establish that the particular item and documented use satisfy the applicable conditions. If a device can be diverted to another use, maintain controls that connect the imported quantity to the qualifying project, customer or facility. Ask customs counsel or the port of entry for a binding ruling or clarification when the technical facts are uncertain; do not rely on a sales label alone.
Build a complete landed-cost model
A tariff decision is incomplete if it models only the duty percentage. Finance should calculate the cost of receiving a usable product at the required location and date.
| Model element | What to include | Typical evidence |
|---|---|---|
| Customs value | Transaction value or the permitted alternative valuation, converted to the required currency | Commercial invoice, purchase order, assists and valuation file |
| Ordinary duty | Base HTS rate before additional trade actions | Current HTS entry and notes |
| Additional duty | Applicable Section 232, Section 301 or other Chapter 99 amount, including the 25% semiconductor rate where the item qualifies | Proclamation, CBP notice and entry instructions |
| Logistics | Freight, insurance, port, handling, brokerage and domestic delivery | Carrier and broker invoices |
| Compliance labor | Classification reviews, broker management, recordkeeping and legal advice | Internal time records and professional-fee budgets |
| Inventory and delay | Safety stock, financing, demurrage, expedited freight and production downtime | Planning assumptions and service-level data |
| Uncertainty | Potential exclusion denial, reclassification, rate change, foreign-exchange movement and shipment delay | Scenario ranges and documented probabilities |
A simple unit calculation is: landed cost = customs value + ordinary duty + additional duty + logistics + compliance cost + inventory and delay cost. Apply the additional duty to the correct customs-value base under the relevant rule; do not assume that the supplier’s invoice total is always the legal base.

A practical six-step compliance workflow
- Inventory the imports. Export purchase-order, receiving and bill-of-materials data and create one row per imported item or separable component.
- Classify under the current HTS. Match the item’s function and technical specifications to the full tariff provision, not merely a commercial category.
- Confirm origin and valuation. Document where the good underwent the origin-conferring production and how customs value is calculated.
- Apply trade actions. Check Chapter 99 provisions, Section 232 or Section 301 measures, country rules and the effective date for the planned entry.
- Test end-use conditions. Link an asserted exclusion to contracts, bills of materials, project records, facility information, repair orders or research documentation. Define controls for diversion or resale.
- File, monitor and review. Give the broker the approved classification and evidence, reconcile entry summaries to the model, and recheck the HTS archive and CBP notices after every policy change.
Should you diversify, nearshore, reshore or absorb the duty?
No option is universally cheaper. Treat sourcing changes as resilience investments and compare their complete cost with the cost of remaining exposed.
| Option | Potential benefit | Costs and risks to test |
|---|---|---|
| Keep the current source and absorb | No supplier-qualification delay; preserves established yield and capacity | Ongoing duty, margin loss, policy concentration and possible customer resistance |
| Pass through the duty | Protects gross margin if contracts and market conditions permit | Demand reduction, repricing work, competitive disadvantage and disputes over the importer of record |
| Diversify countries or suppliers | Reduces single-country, political and operational concentration | Audit, tooling, minimum orders, duplicate inventory, quality variation and limited alternate capacity |
| Nearshore | Shorter transit, easier visits and potentially faster recovery from disruption | Higher labor or component cost, local capacity constraints and a tariff that may still apply based on origin |
| Reshore | Greater domestic control and possible access to local customers or incentives | Capital expenditure, workforce, qualification time, domestic input dependence and loss of scale |
Score each option on total landed cost, time to qualify, available capacity, quality and yield, geopolitical and tariff exposure, working capital, contractual flexibility and reversibility. A second source that cannot supply during a demand spike is not equivalent to a validated substitute. Conversely, a modestly more expensive source may be rational if it materially reduces the probability or duration of a shutdown.
USTR’s 2025 resilience policy series emphasizes better data and analytical tools, including supplier diversity and transparency. IMF research describes the resilience-efficiency trade-off: redundancy can improve recovery from shocks while reducing the lowest-cost efficiency of a concentrated network. Use those concepts to set a documented risk tolerance rather than adopting “China plus one,” nearshoring or reshoring as an automatic rule.
Data management for finance and operations
Create a controlled tariff-exposure table keyed to the internal item number. At minimum, include SKU, HTS code, origin, supplier, bill of materials, end use, ordinary duty, additional actions, exclusion status, effective dates, customs value, annual quantity and evidence location. Give ownership to a named trade-compliance function, while finance owns the cost model and procurement owns supplier and capacity data.

Use internal purchase orders, bills of materials, receiving records and entry summaries for operational exposure. For economy-wide analysis, BEA’s Global Value Chain statistics can show how countries and the United States are linked through production of goods and services. The BEA Global Value Chain Analyzer is useful for country and value-added exposure, but it does not replace item-level customs classification.
Set a review cadence tied to risk: review high-value or semiconductor items monthly and after every proclamation, CBP Cargo Systems Messaging Service notice or HTS revision; review lower-risk items at least quarterly. Preserve the historical rate and evidence used for each entry so an audit can reproduce the decision.
Common failure modes and fixes
Using a product family code
Symptom: every server, memory device or controller receives the same code. Fix: classify by technical function and retain specifications, drawings and firmware or integration details that affect the provision.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Assuming country of shipment is origin
Symptom: a shipment routed through a distribution hub is treated as originating there. Fix: document the substantial transformation and manufacturing records that establish origin.
Claiming an end-use exclusion without controls
Symptom: a purchase order says “data center” but units can be sold into an unqualified channel. Fix: tie the quantity to a named project or customer, restrict diversion, and retain installation or research evidence.
Modeling only the duty
Symptom: the business case ignores broker fees, inventory, delay and qualification. Fix: use the landed-cost components in this article and show sensitivity ranges.
Failing to refresh the rule
Symptom: an old exclusion or rate remains in the enterprise resource-planning system. Fix: assign an owner, record effective dates and trigger a review whenever the HTS archive, proclamation or CBP notice changes.
Quick Recap
Management decision checklist
- Do we have a defensible HTS classification for every material imported technology item?
- Can we prove origin, customs value and the asserted end use from records available to a broker or auditor?
- Does the model separate ordinary duty from additional Section 232, Section 301 or Chapter 99 amounts?
- Have we included freight, insurance, brokerage, compliance labor, inventory and delay?
- What happens to cash and margin if a claimed exclusion is unavailable?
- Can an alternate supplier meet required capacity, quality and qualification timing?
- Who reviews tariff changes, and how quickly are approved rates and instructions updated?
