No completed Taiwan-wide ban on advanced AI-chip sales to China has been announced. Reporting in June 2026 described Taiwanese officials consulting with Washington and drafting stronger controls, potentially covering every Chinese customer rather than only blacklisted companies. The proposal was still awaiting policy details and senior approval, so it should not be described as a final condition already exchanged for U.S. tariff concessions.

What Taiwan has—and has not—agreed to

Taiwan is considering tighter controls on advanced artificial-intelligence chips and AI servers moving to China. Bloomberg reporting carried by Taipei Times on June 10, 2026, said the draft approach could restrict sales to all customers in China, not just named entities such as Huawei. The report also said the scope required senior review and sign-off.

Taiwan’s Ministry of Economic Affairs described the status cautiously: “At present, Taiwan and the US are continuing consultations regarding issues such as the inclusion of advanced chips under regulatory control.” Taiwan News reported on June 18 that Economics Minister Kung Ming-hsin said the ministry had started drafting legal amendments while coordinating with national-security, science-and-technology, and finance agencies.

Those statements establish consultations and drafting, not an enacted export ban. No final processing-power threshold, product schedule, effective date, or completed legal text has been published in the material available for this agreement.

What the January 2026 U.S.-Taiwan trade framework contains

The public economic documents center on investment, tariffs and semiconductor capacity in the United States. They do not publish a completed AI-chip export prohibition as a tariff-agreement clause.

Credit guarantees At least $250 billion to support additional Taiwanese investment U.S. Department of Commerce, January 15, 2026
Section 232 treatment during construction Projects could import up to 2.5 times their planned U.S. capacity without Section 232 duties while construction is under way Commerce fact sheet; applies to qualifying Taiwanese companies building new U.S. semiconductor capacity
Section 232 treatment after completion Completed projects could import 1.5 times their U.S. capacity duty-free Commerce fact sheet; applies to qualifying completed projects
Reciprocal tariff 15%, without stacking the normal most-favored-nation tariff on top Taiwan’s Executive Yuan description of the framework

The U.S.-China Economic and Security Review Commission summarized the same investment and tariff-linked semiconductor provisions. The Executive Yuan also described preferential treatment for Taiwanese semiconductors and a “Taiwan Model” linking investment to supply-chain expansion.

What controls Taiwan is considering

A broader customer scope

The current policy discussion could move beyond an entity-based system that targets companies on an export blacklist. The broader option described by Bloomberg would apply to Chinese customers generally. That distinction matters because a shipment to a company not yet named on a blacklist could still be restricted if the rule covered all customers in China.

A technical performance trigger

Reporting indicated that Taiwan was likely to follow the U.S. direction by using a processing-power threshold for advanced AI chips. The threshold itself has not been published, so it is not possible to identify which exact GPU, accelerator, server configuration or future product would fall inside the proposed rule.

A possible criminal-law change

The proposed amendments could give Taiwanese authorities a clearer standalone offense for unauthorized transfers. Under the reporting, sellers had been warned that certain transactions could violate U.S. rules, while Taiwanese law did not necessarily provide a direct criminal offense for every comparable export. A new offense would strengthen Taipei’s ability to investigate and prosecute smuggling, but the final legal wording remains pending.

Why the proposal emerged

Taiwan’s concern is diversion of high-end AI hardware, including servers equipped with advanced Nvidia processors, to China through unauthorized channels. A control that covers only listed entities can leave room for transactions involving intermediaries or customers not yet designated. A processing-power rule could focus on the capability of the hardware rather than relying only on a buyer’s name.

An August 2026 Associated Press report illustrates the enforcement challenge without proving that every Taiwan-China shipment is illegal. Taiwanese prosecutors charged nine people over alleged unlawful exports of high-end AI servers to mainland China, including servers with B300 GPUs. Prosecutors said 74 servers reached China. The case is an allegation under prosecution, not a finding that all sales of those servers or all shipments from Taiwan violate the law.

How the export-control proposal fits the trade deal

The investment-and-tariff framework and the export-control consultations are related to the same supply-chain and technology-security relationship, but the available public documents do not show that a completed AI-chip ban was formally exchanged for tariff relief.

The Commerce fact sheet presents the arrangement as a strategic partnership to expand U.S. semiconductor and AI capacity. The USTR description links Taiwan’s semiconductor investment commitment with the 15% U.S. tariff framework, while Taiwan’s Executive Yuan emphasizes preferential semiconductor treatment. Against that background, tighter controls would represent parallel alignment with U.S. technology-security policy rather than a clearly published final clause of the tariff memorandum.

Policy choices and likely effects

Issue Narrow, entity-focused model Broader proposal described in reporting
Scope Restrictions centered on named Chinese entities Potential coverage of all Chinese customers
Technical trigger Buyer or entity status is the main licensing screen Processing-power threshold for advanced AI chips
Legal effect Administrative export review and licensing Possible criminal offense for unauthorized transfers
Supply-chain effect China sales could continue after screening and approval Greater pressure on diversion through intermediaries or third countries
Diplomatic cost Closer U.S. alignment with a narrower disruption to commerce Stronger technology controls, with greater risk of Chinese retaliation against Taiwan’s firms

The broader model could improve enforcement, but it would also require companies to classify products, customers and end uses against rules that have not yet been finalized. Its commercial and diplomatic effects therefore cannot be measured precisely from the current announcements.

What remains unresolved

  • The exact processing-power threshold.
  • The definitive list of chips, accelerators, servers or related products covered.
  • Whether the rule would cover every Chinese customer or only specified entities and destinations.
  • The agencies responsible for licensing, investigation and prosecution.
  • The effective date and any transition period for existing orders or contracts.
  • Whether the export-control language will appear in a signed U.S.-Taiwan text, a separate Taiwanese law, or an implementation notice.
  • Whether Washington will provide reciprocal licensing treatment or other formal commitments.

What companies should watch next

Businesses selling advanced chips or AI servers from Taiwan should look for an official Taiwanese rule, enacted amendments, a published product schedule and an implementation notice before treating the proposal as binding. A signed U.S.-Taiwan text that expressly connects export controls to the tariff framework would also clarify whether the measures are legally part of the trade arrangement or are parallel commitments.

Bottom line

Taiwan was considering and drafting stronger controls on advanced AI-chip exports to China in 2026, potentially using a processing-power threshold and covering all Chinese customers. The January trade framework confirms major investment, tariff and semiconductor-capacity commitments, but the available evidence does not confirm a completed export ban or show that such a ban was already exchanged for those concessions.
