SurveySparrow publishes GDPR-related contracts and safeguards, but that does not automatically make every customer’s use compliant. Its public materials describe a data processing addendum (DPA), international-transfer terms, regional hosting options, and subprocessors. Your organization still needs to assess its role, data flows, settings, and obligations—and confirm which terms apply to its account.
What SurveySparrow’s GDPR materials establish
SurveySparrow says that when it processes customer data on a customer’s behalf, the customer is the controller and SurveySparrow is the processor. It says it processes that data on documented instructions and points to its DPA and Terms of Service. That is the vendor’s stated default arrangement; the roles for a particular use depend on the real processing relationship. See SurveySparrow’s GDPR statement.
The published DPA is marked effective 27 December 2022. It covers processing under customer instructions, security measures, assistance with data-subject requests, subprocessors, and international transfers. Its publication alone does not establish that this version governs your account. Check the contract documents incorporated into your order or account, including any negotiated terms.

Under GDPR Article 28, a controller must use processors that provide sufficient guarantees and must have a binding processor arrangement. The DPA is therefore an important part of due diligence, but it does not transfer all controller responsibilities to the software provider. The regulation’s requirements are set out in the official GDPR text.

Who is responsible for what?
In the customer-data arrangement SurveySparrow describes, the customer typically decides why and how personal data is collected and used; SurveySparrow processes it under the customer’s instructions. SurveySparrow’s Terms of Service require customers to maintain an appropriate privacy policy and have the rights, permissions, and consents needed to transfer data to the service and enable its processing.
As controller, your organization must determine and document the lawful basis for processing, explain the use in its privacy notices, limit collection to what is needed, set retention and deletion rules, protect access, and plan how it will handle data-subject requests. These responsibilities depend on your actual use; the vendor’s general statement cannot decide them for you.

Hosting regions do not answer every location question
SurveySparrow’s hosting policy lists primary hosting choices in India (Mumbai), the USA (Virginia), Canada (Central), the EU (Frankfurt), the UK (London), the UAE (Dubai), and Australia (Sydney). It says Virginia may be selected by default if a customer does not designate a primary location. Select and document the location rather than assuming one has been chosen.
A primary hosting region does not prove that every related processing activity, backup, service provider, or integration stays within that region. SurveySparrow also says customer data may be shared with third-party service providers enabled by the customer. Verify what applies to your account and the data flows created by your settings.

International transfers and subprocessors
Transfers outside the selected region
The DPA says SurveySparrow may transfer personal data to the United States and other countries where it or its subprocessors operate. It describes Standard Contractual Clauses (SCCs) and other required measures for restricted transfers. GDPR Articles 44 and 46 set conditions for international transfers and appropriate safeguards. The presence of SCC language is not, by itself, proof that a specific transfer meets those requirements; assess the exporter, importer, destination, transfer mechanism, and safeguards for each relevant data flow.
Subprocessor oversight
SurveySparrow’s subprocessor policy says it evaluates proposed providers’ security, privacy, and confidentiality practices. For customers that have executed its standard DPA, it describes a written objection window of ten days after a policy update. Review the current subprocessor roster and the notice and objection terms in the agreement that actually applies to your account.

Before collecting personal data with SurveySparrow
- Confirm the governing contract. Check which DPA and service terms are incorporated into your account. Ensure the agreement describes the processing, data types, purposes, and assistance your organization needs.
- Choose and record the hosting region. Verify the selected primary location and ask how relevant service data and backups are handled.
- Review subprocessors. Check each provider’s purpose and location, then confirm the applicable notice and objection procedure.
- Map integrations. Identify enabled integrations, what personal data they receive, and the separate processing relationships or transfers they create.
- Assess international transfers. For each transfer, identify the parties, destination, legal mechanism, and safeguards, then evaluate whether the GDPR’s applicable transfer conditions are met.
- Set controller-side controls. Establish a lawful basis, provide clear notices, minimize collection, define retention and deletion, restrict access, and prepare to respond to data-subject requests.
- Request current assurance materials. Obtain evidence relevant to your procurement and risk review; public statements alone do not independently verify every control or account configuration.
What the public evidence does—and does not—show
The available public materials are primarily SurveySparrow’s own statements and contract documents. They provide evidence of a processor framework and describe safeguards, but they are not an independent audit of every account, configuration, or data flow. Hosting and subprocessor policies can change, and the terms governing an existing customer may differ from the published documents reviewed here. A compliance decision therefore requires account-specific contract review and a practical assessment of how your organization uses the service.
