Dynamic pricing changes when market conditions change. Demand, time, inventory, capacity, or other factors affecting a broad market or customer group can move the price. Surveillance pricing uses information about a consumer or a segment of consumers—such as location, browsing behavior, shopping history, or inferred willingness to pay—to tailor a price, discount, product ranking, or product selection.
The methods can overlap. A demand surge might raise a price for everyone, while a system could also adjust the offer for a particular shopper using personal data. The most useful question is not simply whether the price changed, but what information drove the change: a market condition affecting the offer broadly, or information about the buyer specifically.
Dynamic pricing and surveillance pricing at a glance
| Question | Dynamic pricing | Surveillance pricing |
|---|---|---|
| What drives the offer? | Market conditions such as demand, timing, availability, capacity, or inventory. | Consumer characteristics, behavior, or inferred preferences, potentially combined with market conditions. |
| Must the offer be unique to one person? | No. The same change can apply to everyone or to a broad group facing the same conditions. | Individualized or segmented targeting is central to the Federal Trade Commission (FTC) staff description. |
| What can change? | Usually the listed price, but availability or service terms can also respond to conditions. | A price, discount, product ranking, recommendation, or product selection can be tailored. |
| Can the approaches overlap? | Yes. A market-based adjustment can be combined with customer-level targeting. | Yes. FTC staff says surveillance pricing can incorporate or overlap with dynamic pricing. |
| What should you investigate? | Whether demand, timing, inventory, or another market factor explains the movement. | Whether personal data appears to determine the price, discount, or products shown. |
These are practical descriptions, not mutually exclusive technical categories. An FTC issue spotlight says it does not attempt to establish one formal definition of “surveillance pricing.”

Dynamic pricing is a market-response system. A seller changes a price as conditions change, often through software that receives frequent updates about supply, demand, time, capacity, or competing offers. The price may be recalculated every few minutes or at scheduled intervals, depending on the business.

Typical inputs
- Demand: A heavily requested service or product can become more expensive while demand is high.
- Time: A ticket, room, or appointment may cost more near a deadline and less at a less popular time.
- Availability and inventory: Prices can move as remaining capacity or stock falls.
- Operational capacity: A service may charge differently when fewer providers, seats, vehicles, or appointments are available.
- Market conditions: Broad changes affecting a category or location can produce a new price for many shoppers at once.
A dynamic price does not have to be identical for every person. Two people in different locations or booking windows may face different market conditions. The defining feature is that the relevant condition is external to the individual shopper rather than a hidden estimate of that shopper’s spending limit.
What a changing price does not prove
Seeing a different amount after refreshing a page, returning later, or checking from another location is evidence of a difference, not proof of its cause. Inventory may have changed, a promotion may have ended, taxes or fees may have been recalculated, or a market-wide algorithm may have updated. A price change alone cannot establish surveillance pricing.
What surveillance pricing means
Surveillance pricing is a data-driven form of personalization. A seller, advertising platform, pricing vendor, or other intermediary uses information about a person or a group to decide which price, discount, or product presentation that person receives. The information may be supplied directly by the customer, observed through an interaction, obtained from another company, or inferred by a model.
Data that may be used
In a January 2025 release about its initial staff analysis, the FTC named examples including location, demographics, browsing patterns, shopping history, mouse movements, and products left in online carts. The agency described both direct and inferred consumer data from first- and third-party sources. These examples identify possible inputs; they do not establish that every retailer uses each one or that every changing price is personalized.
Outputs beyond the sticker price
Personalization may affect more than the number displayed beside a product. The FTC materials discuss possible tailoring of discounts, product rankings, and product selections. A shopper might therefore see a different promotion, a different order of results, or a different set of products rather than an obviously different base price.
How inference changes the issue
A system need not contain a field labeled “willingness to pay.” It might infer a likely budget, urgency, household situation, or interest from many signals and then assign an offer. An inferred characteristic is still different from a purely market-based input because it describes the buyer rather than the market.

Where the two methods overlap
Real pricing systems can combine both approaches. Suppose a hotel has fewer rooms left on a high-demand weekend. That market condition can raise the base rate for everyone searching that inventory. A separate model might then apply a loyalty discount, show a different room bundle, or choose which promotion to display based on a shopper’s account or behavior.
In that situation, the demand-driven increase is dynamic pricing, while the customer-specific adjustment is surveillance pricing. Calling the whole system one term can hide the important question: which component changed the offer for this particular person?
| Observed situation | Likely explanation to test | What it does not establish by itself |
|---|---|---|
| Everyone sees a higher price during a capacity shortage. | A market-wide dynamic adjustment. | That personal data was used. |
| Two logged-in customers see different discounts for the same item. | Account, segment, loyalty, or other customer-specific targeting may be involved. | Which data field caused the difference. |
| A product disappears from one shopper’s results while another sees it. | Personalized ranking, availability rules, or inventory allocation. | That the shopper was charged a personalized price. |
| A price changes after a busy period but is identical for anonymous visitors. | Demand, inventory, or timing may explain the change. | That browsing history influenced the price. |
Can a store charge different people different prices?
A seller can technically present different prices or discounts to different people, but whether a particular practice is lawful depends on the product, transaction, location, sector-specific rules, contracts, and anti-discrimination or consumer-protection law. The existence of a technical capability is not a ruling that every use is permitted.
There is also a difference between a different price and a different offer. A coupon tied to a membership, a negotiated business rate, or a promotion with stated eligibility can produce different prices under disclosed conditions. A hidden system that uses personal information to estimate what an individual will pay raises a different transparency question.
Consumers should separate three facts:
- Price difference: two people or two sessions received different numbers.
- Personalization evidence: the seller used an account, segment, behavior, or inferred attribute.
- Legal conclusion: a regulator or court determined whether the practice violated a specific law.
The first fact does not automatically prove the second, and the second does not by itself answer the third.

It can be one possible input, but there is no universal rule that browsing history changes every online price. The FTC’s January 2025 materials listed browsing patterns, shopping history, mouse movements, and abandoned carts among information that pricing intermediaries or retailers could access. The agency presented these as initial findings and described some scenarios as hypothetical.

A retailer could use browsing data to choose a discount, rank products, or decide which offer to display. That is different from proving that a particular visit produced a higher price because a person viewed the item before. Website experiments, inventory changes, location, taxes, currency, account status, and expired promotions can produce the same visible result.
To make a credible attribution, you need controlled observations and information about the seller’s rules or disclosures. A screenshot of two prices is useful evidence that the offers differed; it normally cannot identify the algorithmic cause.
What the FTC has reported—and what it has not proven
In January 2025, the FTC said its initial staff analysis found that intermediaries could access a wide range of data and that retailers could use consumer information to tailor prices. The release said the analysis drew on documents from Mastercard, Accenture, PROS, Bloomreach, Revionics, and McKinsey & Co. The agency also said it would publish information from its 6(b) studies only in aggregated or anonymized form to protect confidential business information.
The release included a hypothetical example of a consumer profiled as a new parent being shown higher-priced baby thermometers. That example illustrates a possible mechanism; it is not proof that a named retailer charged an actual shopper that way. The FTC’s January 2025 update likewise described initial insights and said more work remained.
Those qualifications matter. The public materials do not establish that surveillance pricing is universal, that a particular retailer used a specific signal in a specific transaction, or that every algorithmically changing price is individualized.
What changed in the FTC’s August 2026 policy discussion?
On August 19, 2026, the FTC announced that it was seeking public comment on a draft enforcement policy statement about personalized pricing. The release described personalized pricing as using personal data to set a price according to what a company believes an individual is willing to spend. The release was corrected on August 31, 2026, and said comments were due September 18, 2026; that deadline had passed by the time of this article.

The draft addressed potential FTC Act concerns when firms fail to disclose the use of personal data in pricing. It was a proposed agency position and comment process, not a finalized rule, adjudication, or blanket ban on personalized pricing. Do not treat the announcement as proof that every personalized price is illegal.
FTC Chairman Andrew Ferguson said in the release: “When consumers see a listed price, they expect it to be same price that everyone else sees, not the retailer’s estimate of how much they are willing to pay based on their personal data.” The quotation expresses his position in connection with the draft; it is not itself a binding legal standard.
How to investigate a suspicious price difference
You cannot reliably identify an algorithm from the page alone, but a disciplined comparison can distinguish a market change from a buyer-specific difference.
- Record the exact offer. Save the displayed price, currency, fees, taxes, product variant, quantity, delivery location, timestamp, account status, and promotion terms. A product with a different configuration is not a valid comparison.
- Repeat without changing several variables at once. Compare the same item, location, quantity, and purchase path. Use a second session only as a comparison, not as proof of causation.
- Check market explanations first. Look for changing inventory, appointment capacity, event demand, time-limited promotions, taxes, shipping, or currency conversion.
- Compare account and eligibility states. Note whether one session is logged in, enrolled in a loyalty program, using a business account, or eligible for a disclosed coupon.
- Look for personalization disclosures. Read the pricing, privacy, cookie, loyalty, and promotion terms for explanations of data use or eligibility. Absence of a disclosure is a transparency concern, not proof of a hidden algorithm.
- Ask the seller a precise question. Request the reason for the difference and whether personal data, account status, location, or browsing behavior affects the offer. Keep the response with your records.
- Escalate with evidence if appropriate. A regulator, consumer-protection office, or privacy authority will need the dates, screenshots, terms, and transaction details. Report the observed facts rather than asserting an unproven cause.
Can private browsing or a VPN stop surveillance pricing?
The FTC’s August 2026 release said informed consumers might consider a VPN or private browsing session as possible privacy measures. It did not establish that either reliably prevents personalized prices or reveals the seller’s underlying method.
Private browsing can limit some local browser storage after the session, but it does not make a visitor anonymous to a website, account provider, payment processor, or network service. A VPN can change the apparent network location, yet a logged-in account, device signals, cookies, loyalty record, or other data may still connect activity to a person. These tools may be useful for broader privacy goals, but they are not a guaranteed price-testing method.

Pick the symptom - the matching free tool is one click away.
If you compare sessions, change one variable at a time and document the result. Do not assume that a lower price in a private window proves that the ordinary session was personally targeted; the difference could result from a promotion, cache, inventory update, or location handling.

Common mistakes when interpreting personalized offers
Mistake: treating every changing price as surveillance pricing
A price that moves with demand, time, or availability is consistent with dynamic pricing. Personal data must be part of the explanation before the surveillance label is useful.
Mistake: treating two screenshots as causal proof
Screenshots show what two sessions displayed. They do not reveal whether the cause was personal data, inventory, taxes, account eligibility, or a market update.
Mistake: confusing product selection with price
A seller may tailor rankings, recommendations, or the products shown without changing the price of an item that both shoppers can see. That is still a form of offer personalization, but it is not evidence of a personalized price.

Mistake: treating a hypothetical example as a documented case
The FTC’s new-parent thermometer scenario was hypothetical. It should not be cited as proof that a named retailer applied that profile to an actual customer.
Mistake: treating a draft policy as current law
The August 2026 FTC announcement concerned a draft statement opened for comment. Until an agency issues a final action with legal effect, describe it as a proposed position and check the governing law for the transaction.
A practical decision framework
| If you observe… | Start by asking… | Most useful next evidence |
|---|---|---|
| The same price rises for many shoppers at a busy time. | Did demand, capacity, or inventory change? | Timestamped prices, availability, and published market conditions. |
| Different accounts receive different discounts. | Are account, loyalty, or eligibility rules disclosed? | Terms for each account type and the exact promotion shown. |
| A returning visitor sees a different price. | Did the product, location, stock, tax, or promotion change? | Matched-session records with all variables held constant. |
| Different shoppers see different products or rankings. | Is selection personalized even when the base price is not? | Comparisons of results, recommendation settings, and disclosure language. |
| A seller will not explain a data-driven difference. | What privacy, consumer-protection, or sector rules apply? | Written support responses, receipts, policies, and transaction records. |
What readers should remember
Dynamic pricing answers a market question: what should this offer cost under current demand, timing, and availability? Surveillance pricing answers a customer-data question: what price, discount, or product presentation does the seller think this person or segment should receive?
The categories can overlap, and a visible difference is not a complete explanation. Focus on the input that drove the offer, preserve the conditions of any comparison, and keep preliminary FTC findings and the 2026 draft policy in their proper context. No current source cited here establishes a universal test, a final nationwide ban, or proof that every changing online price is personalized.
