For a French individual investor, a direct exchange of one qualifying digital asset for another can be tax-deferred when it is completed without any balancing payment (a “soulte”). Selling a digital asset for euros is normally a taxable disposal. The result depends on the legal nature of the token, what you received, whether any cash or other legal tender was added, your total annual gross disposal prices and whether your activity is private or professional. A stablecoin label by itself does not decide the treatment.

The short answer: swap and cash-out are different events

French individual-investor rules focus on the consideration received and the taxpayer’s status. Under the private-wealth regime described by the Direction générale des Finances publiques (DGFiP), an exchange of digital assets without a balancing payment is an intermediary transaction benefiting from tax deferral when the statutory conditions are met. A disposal for euros, another legal-tender currency, goods or services is generally a taxable disposal.

That distinction affects both the tax calculation and the paperwork. A qualifying no-soulte swap is left out of the annual gross-disposal-price threshold and does not itself produce the gain reported on form 2086. A euro cash-out normally counts toward that threshold and must be included in the portfolio-based gain calculation if the threshold is exceeded or another rule makes the disposal reportable. The separate question of whether an exchange account held with an entity abroad must be disclosed is handled on form 3916-3916 bis; it is not answered by the fact that a transaction was a swap or a sale.

Comparison at a glance

Point No-soulte digital-asset swap Cash-out to euros
What happens One digital asset is exchanged for another and no balancing payment is received or paid. A digital asset is disposed of for euros or another legal-tender currency.
Private-investor tax treatment Generally an intermediary operation with tax deferral when the statutory conditions are satisfied. Generally a taxable disposal.
305-euro threshold Excluded when the exchange is genuinely tax-deferred. Gross disposal price counts toward the annual threshold.
Form 2086 The qualifying exchange itself is not entered as a taxable disposal. Used to calculate and report the year’s taxable digital-asset gains or losses.
What must be checked Both sides must qualify as digital assets, and there must be no soulte or other consideration that breaks the condition. Disposal date, euro value, acquisition records, portfolio value, fees and taxpayer status.
Foreign-account disclosure Still a separate question if a qualifying account is held abroad. Still separate from the gain calculation; a taxable disposal does not replace account disclosure.

When a stablecoin swap can be tax-deferred

The no-soulte condition

The deferral rule is aimed at an exchange between digital assets where neither side of the transaction includes a balancing payment. In practical terms, exchanging one token for another token through an exchange or other platform can fit the rule if the transaction is an asset-for-asset exchange and no euros, dollars or other legal tender is paid or received to balance the values.

“No balancing payment” is important. If you exchange tokens and also receive cash, or pay cash to complete the deal, the condition is no longer the simple no-soulte fact pattern. The transaction then needs to be analysed as a disposal under the applicable rules rather than assumed to be deferred.

Stablecoin branding is not enough

Do not treat every token marketed as a stablecoin as automatically covered. The relevant question is whether the asset falls within the legal definition of a digital asset for the rule and whether the particular transaction meets the no-soulte condition. A token’s marketing name, price objective or platform classification does not by itself establish the legal result.

Keep the token’s identifying information, the transaction record and evidence of what was received. If the token has unusual rights, is issued under a different legal structure or is bundled with another product, obtain advice before relying on the deferral treatment.

Why the swap is called an intermediary operation

For an occasional private investor, the qualifying exchange is treated as an intermediate step rather than the final taxable disposal described in Article 150 VH bis. The latent gain is not erased; taxation is deferred until a later taxable disposal, such as a sale for euros or a purchase of goods or services. Preserve the original acquisition information so that the later portfolio calculation can be supported.

When exchanging or using a token becomes a taxable disposal

Selling for euros or another legal tender

A sale for euros is the clearest cash-out example. The euro amount is the disposal price for the transaction and is included in the annual gross-disposal-price test. The same principle applies when the digital asset is sold for another legal-tender currency; convert the amount to euros using the exchange rate applicable on the transaction date.

Paying for goods or services

Using a digital asset to buy goods or services is also among the categories that can constitute a taxable disposal for a private investor. The fact that no euros pass through your bank account does not turn the payment into a tax-deferred swap. Record the euro value of what was received, the date and the asset units spent.

Swaps with a cash component

A transaction described commercially as a “swap” may still contain a cash leg, a fee paid in legal tender or another balancing amount. Read the settlement details rather than relying on the platform’s label. A soulte can change the legal analysis, so retain the order confirmation, execution report and settlement statement.

The 305-euro threshold: what it measures and what it does not

DGFiP individual guidance modified in 2026 states that private investors are exempt when the total annual gross prices of taxable disposals, excluding exchanges benefiting from tax deferral, do not exceed 305 euros. The threshold is based on the amount sold, not on the profit. DGFiP’s wording is explicit: the relevant figure is the “montant annuel brut des cessions” and not the capital gain.

  • Count the gross disposal prices of taxable sales during the tax year.
  • Leave out qualifying no-soulte exchanges that are tax-deferred.
  • Do not substitute the net gain or loss for the sale proceeds.
  • If the total exceeds 305 euros, the private-investor regime applies to all taxable disposals covered by the rule for that year, not merely to the amount above 305 euros.

DGFiP also says that form 2086 must be filed even when the annual disposals remain below 305 euros. The threshold can remove the tax charge under the exemption, but it does not remove the filing instruction. Keep the calculation showing how you reached the gross total and which exchanges were excluded as deferred.

How the French private-investor tax is calculated

Current rate stated by DGFiP

Current DGFiP individual guidance modified in 2026 describes a flat tax (prélèvement forfaitaire unique, or PFU) of 31.4%, made up of 12.8% income tax and 18.6% social levies. The guidance also refers to an option for the progressive income-tax scale. Rates and legislative rules can change between income years, so confirm the rate and election applicable to the year you are filing rather than carrying a 2026 figure into a different return.

The portfolio-based formula

French guidance does not calculate each sale simply as sale price minus the purchase price of the particular coins sold. DGFiP describes a portfolio-level method. In simplified form:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Gross gain = disposal price − [total acquisition price of the digital-asset portfolio × (disposal price ÷ global value of the portfolio)]

The “portfolio” is the total pool of digital assets covered by the calculation at the time of the taxable disposal. You therefore need the total acquisition price, the portfolio’s global value and the disposal price for each taxable event, not only the trade history for the units that left one wallet.

Illustrative calculation

Assume, solely as an illustration, that your total acquisition price for the portfolio is 10,000 euros, the portfolio is worth 20,000 euros immediately before a sale, and you sell assets for 4,000 euros. The allocated acquisition amount is 10,000 × (4,000 ÷ 20,000) = 2,000 euros. The gross gain for that disposal is therefore 4,000 − 2,000 = 2,000 euros before applying the relevant tax rules. This example is not a tax assessment; your actual portfolio values, transaction history and year-specific rules control.

Foreign-currency conversions and records

Amounts stated in a foreign currency must be converted to euros using the exchange rate on each transaction date under the calculation guidance in the Bulletin officiel des finances publiques (BOFiP). Keep the source of the rate, the timestamp or date used, and the original-currency amount. Also preserve transaction dates, units, acquisition prices, disposal prices, portfolio values and fees. A platform export alone may not show every value needed for the portfolio calculation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Losses

Under the official FAQ summarized by DGFiP, losses on digital-asset disposals are not freely deductible against unrelated capital gains and do not carry forward. A loss should still be recorded accurately on the applicable form, but it should not be treated like a general investment loss that can automatically offset other assets or future years.

Filing form 2086 for taxable disposals

Form 2086 is the annex used to calculate the year’s gains and losses from digital-asset disposals. DGFiP directs individuals to attach it to the annual income-tax return and to transfer the resulting amount to the main return as required for that income year.

  1. Identify the income year. Choose the form vintage for the return you are filing. DGFiP’s form page currently lists 2026, 2025 and 2024 vintages, so do not use a form from a different campaign merely because it is the first search result.
  2. Separate deferred swaps from taxable disposals. Mark the transactions that were genuine no-soulte digital-asset exchanges and exclude them from the taxable-disposal threshold and gain calculation under the deferral rule.
  3. List each taxable disposal. Capture the date, what was disposed of, the euro disposal price, the relevant portfolio value and the acquisition information needed by the portfolio formula.
  4. Calculate the annual result. Apply the portfolio-based method to the taxable events and distinguish gains from losses.
  5. Check the 305-euro test. Add gross prices of taxable disposals, not gains, and confirm whether the total is at or below 305 euros or exceeds it.
  6. Transfer the result to the main return. Use the boxes and instructions for the applicable income year; they can change between campaigns.
  7. Retain evidence. Keep exchange statements, wallet histories, bank records, valuation evidence and your calculations in case the administration asks how the result was obtained.

Even when the gross disposal total is no more than 305 euros, DGFiP says the 2086 annex is still required. The exemption concerns the tax treatment, not the existence of the reporting step.

Form 3916-3916 bis: a separate foreign-account disclosure

Whether you must disclose an account held abroad is independent of whether a particular swap produced a taxable gain. DGFiP says qualifying digital-asset accounts held with entities abroad are declared using form 3916-3916 bis, submitted with the income or results declaration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use two separate checks:

  • Transaction check: Did you dispose of a digital asset for euros, another legal tender, goods or services, or did you complete a qualifying tax-deferred exchange?
  • Account check: Was the account maintained with a foreign entity and does it meet the conditions for disclosure on 3916-3916 bis?

A foreign exchange account can require disclosure even in a year when all of your token-to-token swaps were tax-deferred. Conversely, reporting a foreign account does not itself create a taxable gain. The account form concerns the existence and details of the account; form 2086 concerns the calculation of taxable disposals.

Do not automatically treat every self-custody wallet as a reportable foreign account. The official guidance refers to accounts held with entities abroad. A wallet for which you alone control the keys is factually different from an account maintained by an overseas platform, so classify the arrangement from its legal and contractual facts.

Your status changes the answer

Occasional private investor

The 31.4% PFU summary, the 305-euro gross-price threshold and the no-soulte deferral explanation above describe the occasional private-investor framework. They should not be applied automatically to someone whose activity is organized and conducted as a business.

Commercial or professional-like activity

DGFiP distinguishes commercial activity that may be taxed as business and industrial profits (BIC) from activity carried out in conditions analogous to professional trading, which may fall under non-commercial profits (BNC). The classification depends on the facts, including the scale, frequency, organization and manner of the activity. Do not use the private-investor form sequence or PFU conclusion without checking the applicable professional regime.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mining and staking

The same official material identifies mining and staking income as BNC categories. Income from those activities is not simply a private-investor cash-out of an already-held asset. Separate the activity income from later disposals and obtain advice if you combine staking or mining with frequent trading.

A practical record-keeping workflow

  1. Export raw histories regularly. Download trade, deposit, withdrawal, fee and distribution records from every platform before records become unavailable.
  2. Maintain a wallet map. Record which addresses and custodial accounts you control, the entity operating each account and the country associated with that entity.
  3. Tag every transaction. Label acquisitions, no-soulte swaps, euro sales, payments for goods or services, transfers, staking receipts and mining receipts. Transfers between wallets are not the same fact as a disposal, but the trail must show that the asset remained yours.
  4. Capture euro values on the date. For foreign-currency transactions, retain the conversion rate and the source used under the BOFiP approach.
  5. Reconcile units and balances. Check that opening balances plus acquisitions and receipts minus disposals and transfers equal closing balances. Investigate missing units before calculating gains.
  6. Calculate the portfolio at each taxable event. Keep the global portfolio value and total acquisition-price figures supporting every 2086 line.
  7. Run both filing tests. Compute the 305-euro gross disposal total and separately identify foreign accounts that may require 3916-3916 bis.
  8. Archive the submitted forms. Save the 2086 annex, the main return, any 3916-3916 bis forms and the underlying evidence together for the relevant income year.

Common mistakes and how to correct them

Calling every stablecoin trade exempt

Mistake: Assuming that a stablecoin’s name guarantees tax deferral.
Correction: Verify that the asset is legally a digital asset covered by the rule and that the exchange had no soulte or other non-digital consideration.

Comparing gains with the 305-euro threshold

Mistake: Adding only profits and ignoring losing sales.
Correction: Add the gross prices of all taxable disposals. The threshold is about proceeds, and once exceeded it applies to all covered disposals for the year.

Leaving out a small year

Mistake: Skipping form 2086 because total disposals were below 305 euros.
Correction: DGFiP states that the annex is filed even below the threshold.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Reporting a euro sale but not the account

Mistake: Treating form 2086 as a substitute for foreign-account disclosure.
Correction: Review 3916-3916 bis separately for each qualifying account held with a foreign entity.

Using the purchase price of only the coins sold

Mistake: Applying a simple lot-by-lot calculation.
Correction: Use the portfolio-based formula and retain the global portfolio value and total acquisition price at each disposal.

Using the wrong year’s form or rate

Mistake: Copying a prior campaign’s form or assuming the 31.4% figure applies unchanged forever.
Correction: Identify the income year, select the corresponding form vintage and verify the law and rates for that campaign.

Ignoring professional status

Mistake: Applying the private-investor PFU treatment to organized trading, mining or staking.
Correction: Determine whether the activity belongs under BIC, BNC or another professional regime before filing.

Worked scenarios

Token A exchanged for a stablecoin, no cash added

You exchange one digital asset for another and neither party pays euros or another legal-tender balancing amount. If both assets meet the legal definition and the transaction is genuinely no-soulte, it is generally treated as tax-deferred for an occasional private investor. Keep the execution record and carry the acquisition information into the portfolio records for a later taxable disposal.

Token A sold for 900 euros

The 900-euro sale is a taxable disposal category and exceeds the 305-euro annual gross-price threshold by itself. Calculate it under the portfolio method and report it on form 2086, subject to your status and the rules for the relevant income year.

Several sales totaling 250 euros and one deferred swap

The deferred swap is excluded from the threshold. The taxable sales total 250 euros gross, so the threshold exemption may apply for a private investor, but the 2086 annex is still required according to DGFiP.

Several sales totaling 250 euros plus a 100-euro purchase paid in tokens

The purchase paid with digital assets is another potential taxable disposal category. Add its gross euro value to the other taxable disposal prices. The resulting total is 350 euros, which exceeds the threshold; the calculation then covers all taxable disposals for the year.

All activity occurs through an overseas platform

The platform’s location does not turn every transaction into a gain, and a token-to-token no-soulte exchange can still be deferred if it meets the conditions. Separately, determine whether the platform account is a qualifying foreign account requiring 3916-3916 bis. File the transaction calculation and account disclosure as separate obligations.

Which date and source should you rely on?

DGFiP’s individual guidance used for this explanation was modified on 17 July 2026 and states the 305-euro threshold and 31.4% PFU composition described above. DGFiP’s form pages list 2026, 2025 and 2024 versions of form 2086 and current versions of form 3916-3916 bis. The BOFiP calculation guidance cited for foreign-currency conversion is dated 23 April 2024.

These dates matter because tax forms, rates, thresholds and filing instructions can change. For a return filed for an earlier income year, use that year’s rules and form vintage. For a transaction involving a token with unusual legal characteristics, a cash component or professional-scale activity, the general comparison here is not a substitute for an individualized determination.

Decision checklist before you file

  • Was each token-to-token exchange truly between digital assets?
  • Was there no euro, foreign-currency or other legal-tender balancing payment?
  • Did any transaction pay for goods or services with a digital asset?
  • What are the gross prices of all taxable disposals for the year?
  • Have deferred exchanges been excluded from that gross total?
  • Do you have the portfolio’s total acquisition price and global value for each disposal?
  • Have foreign-currency amounts been converted to euros using the transaction-date rate?
  • Is your activity genuinely occasional and private, rather than commercial, professional-like, mining or staking activity?
  • Have you selected the form 2086 vintage for the correct income year?
  • Have you separately checked form 3916-3916 bis for qualifying accounts held with foreign entities?
  • Have you retained statements, wallet records, valuation evidence and calculations?

Bottom line for a French private investor

A no-soulte exchange of qualifying digital assets can defer taxation; cashing out to euros normally realizes a taxable disposal. The 305-euro test uses annual gross disposal prices, not gains, and qualifying deferred exchanges are left out. Form 2086 handles the disposal calculation even when the total is below the threshold, while form 3916-3916 bis addresses a separate foreign-account disclosure. Confirm the token’s legal status, the absence of a soulte, your taxpayer category and the form and rate for the exact income year before filing.
