South Korea’s National Court Administration proposed new civil-enforcement procedures for virtual assets on July 2, 2026, but the official notice does not establish that the amendment was finalized or that it will take effect in November. The draft would let creditors seek court orders against either a debtor’s claim to crypto held by a service provider or virtual assets themselves; those are separate enforcement routes.
Are South Korea’s proposed crypto seizure rules in force?
The National Court Administration announced a proposed partial amendment to the Civil Execution Rules on July 2, 2026. The public-comment period was scheduled to close on August 11, 2026. The notice describes draft procedures, not a final rule. The official material cited here does not confirm promulgation or a November commencement date, so “new November rules” should not be treated as established fact.
The proposal responds to virtual assets becoming more common targets in civil execution, according to the National Court Administration’s notice. Its practical significance is procedural: it sets out ways a creditor could ask a court to restrain and liquidate crypto-related property through civil enforcement. It does not authorize a creditor to take Bitcoin directly, without a court process.

What property could a creditor target?
The draft distinguishes between a debtor’s right to receive virtual assets from another party and the virtual assets themselves. Which route matters depends on where the asset or right is held and what the creditor seeks to enforce.

| Draft route | What the creditor targets | Who would be involved | How seizure and recovery are described |
|---|---|---|---|
| Claim against a third party | The debtor’s claim to receive virtual assets from a service provider or another third party | The court and the third party holding or owing the assets | The court could order seizure and prohibit the third party from transferring assets to the debtor, while also prohibiting the debtor from disposing of or receiving them. The claim could later be converted to cash. |
| Virtual assets themselves | The virtual assets directly | The court and an enforcement officer | The proposed sequence is a seizure order, a restriction on the debtor’s disposition, and transfer of the assets to an enforcement officer. The notice says seizure would take effect when the officer receives them. |
How the service-provider route would work
For a claim to receive crypto held by a service provider, the proposed order would restrain both sides of the transfer: the provider could be barred from sending the assets to the debtor, and the debtor could be barred from disposing of or receiving them. This route addresses the debtor’s claim against the provider, rather than treating that claim and the underlying assets as interchangeable.
The creditor could also ask the court to require the third party to report whether the claim exists, what amount and type of virtual assets are held, and whether priority claims or other enforcement actions affect them. That information could help clarify what is available for enforcement; the proposal does not make recovery automatic simply because a creditor requests it.

If the claim is subject to enforcement, the draft describes conversion to cash by assignment, sale, or another appropriate method. Potential sale mechanisms include a sale by the service provider or transfer to an enforcement-officer account before sale. These are proposed options, not proof that every provider can or will complete a sale in a particular case.

How seizure of the virtual assets themselves would work
For assets directly subject to enforcement, the draft lays out a different sequence: a court issues a seizure order, the debtor is restricted from disposing of the assets, and the assets are transferred to an enforcement officer. Under the notice’s description, seizure takes effect when that officer receives the assets—not merely when a creditor identifies them or asks for enforcement.

After seizure, liquidation could proceed through an assignment order, a sale order, or another appropriate method. The notice includes sale through a virtual-asset service provider as one possible method. It does not establish that all types of virtual assets are accessible, transferable, or recoverable in every case.
How this fits into existing civil debt enforcement
South Korea’s ordinary civil-enforcement process requires an enforceable title, such as a final judgment, a provisionally enforceable judgment, or a notarial deed. The Supreme Court describes monetary enforcement as proceeding through seizure, liquidation, and distribution. Its civil-enforcement explainer outlines existing enforcement against property such as real estate, tangible goods, vehicles, ships, and claims.

The Civil Execution Act, Article 227, in the version effective February 1, 2026, provides that a court’s seizure order for a monetary claim is served on both the third-party debtor and the debtor. For that kind of claim, the seizure takes effect when served on the third-party debtor. The proposed crypto-specific rules would add procedures tailored to virtual assets and claims to receive them; they do not eliminate the need for the underlying civil process.

Why a Supreme Court Bitcoin decision does not settle the civil-debt question
A separate Supreme Court decision dated December 11, 2025 addressed Bitcoin seizure under criminal procedure. The Court’s English summary of Order 2025Mo45 says Bitcoin’s independent manageability and transferability can make it an item subject to seizure by a court or investigative agency under the Criminal Procedure Act, when legal requirements are met. That decision concerns criminal-procedure seizure; it is not evidence that the proposed civil debt-enforcement rules are already in effect.

What debtors and creditors should take from the proposal
- For creditors: the draft offers potential court-directed routes to identify, restrain, and liquidate crypto-related property, but creditors still need an enforceable title and must use the applicable court process.
- For debtors: the proposal describes court restrictions and enforcement-officer involvement, not an informal transfer initiated by a creditor. Whether any particular asset can be reached depends on the applicable order and circumstances.
- For anyone relying on the November date: the July notice and August comment deadline do not verify final adoption or commencement. The timing claim remains unconfirmed in the official sources cited here.
