Usually, no—but there is no universal yes-or-no answer for a live incident. The FBI says it does not support paying a ransom, and UK authorities do not encourage, endorse or condone ransom payments. Paying cannot guarantee a working decryptor, restoration of systems, deletion of stolen data or an end to extortion. A responsible decision compares clean recovery options, operational and data impacts, legal and sanctions exposure, and the risk of another attack, with independent technical and legal advice. FBI guidance, CISA and partner guidance and UK NCSC guidance all stress case-by-case assessment.
What paying a ransom can—and cannot—do
A ransomware demand is a criminal offer, not a service-level agreement. Attackers may promise a decryptor, a key, or deletion of copied files, but the victim has no reliable way to enforce those promises. The FBI states that payment does not guarantee an individual or organization will get its data back. Even when a decryptor arrives, restoring large, damaged or misconfigured environments can require substantial work, and systems may remain compromised. The FBI’s ransomware guidance explains this limitation.
Payment also does not prove that stolen information has been deleted. The UK National Cyber Security Centre (NCSC) advises victims to determine what data may have been compromised and warns that a victim cannot trust an attacker’s promise to delete it. Extortion can continue after payment, including demands directed at customers, employees or business partners. NCSC payment guidance sets out that risk.
Paying can leave the original intrusion path open. If attackers still control an account, remote-access tool, server or administrator credential, they may encrypt the environment again or steal more data. A payment therefore cannot substitute for containment, investigation and remediation.

Payment can also create legal and security consequences. Sanctions rules may prohibit transactions involving a sanctioned person, group, wallet, entity or jurisdiction. Funding a criminal operation can encourage repeat attacks against the payer and others. The applicable rules depend on the victim, payment route, jurisdictions and facts of the incident.

Those statements discourage payment; they do not eliminate the need for a documented, fact-specific decision by the victim’s authorized leadership.
Questions to answer before discussing the demand
Do not start with “How much is the ransom?” Start by establishing what is actually at stake and what alternatives exist. The following comparison gives an incident team a common decision record.
| Decision area | Questions to document | Why it changes the decision |
|---|---|---|
| Operational continuity | Which services are unavailable? What safe manual or third-party workarounds exist? How long can they continue? | A short outage with viable workarounds is different from a prolonged loss of a safety-critical or essential service. |
| Recovery prospects | Are backups present, isolated and clean? Have restores been tested? Is a reputable decryptor or other independent recovery method available? | A credible recovery route reduces dependence on an attacker’s promise. |
| Data exposure | What files, systems or accounts may have been accessed? How sensitive are they? Can attacker claims be verified? | Payment cannot undo copying or guarantee deletion; understanding the data informs containment and notification. |
| Total cost | What are the costs of downtime, restoration, specialists, legal work, security improvements, notification and possible regulatory action? | The demand is only one component of the financial impact. |
| Legal and sanctions exposure | Who would receive the funds? What payment channel and jurisdictions are involved? Do sector or contract rules apply? | A transaction can be unlawful or create enforcement risk even when operations are under severe pressure. |
| Residual risk | Has the intrusion been closed? Would payment make the organization a repeat target? Could disclosure continue? | A decryptor or promise does not resolve an undetected compromise. |
The NCSC recommends involving decision-makers and technical staff, considering insurers and independent cyber-incident-response experts, documenting the rationale, assessing business and data impacts, and investigating the original compromise. Its joint guidance with UK insurance bodies says, “The ultimate decision whether to pay the ransom is with the victim.” Read the NCSC payment guidance.

What to do immediately after discovering ransomware
These steps apply whether or not payment is eventually considered. They are not a substitute for an incident-response provider or legal advice.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- Activate your incident plan and limit further damage. Use a designated incident leader. Isolate affected devices and network segments when this can be done safely. Do not casually wipe machines, shut down systems or reconnect restored devices before responders advise you; those actions can destroy volatile evidence or spread the malware.
- Report promptly. In the United States, the FBI identifies the local FBI field office and the Internet Crime Complaint Center (IC3); CISA also accepts incident reports. Report whether or not you pay. UK organizations should use current UK incident-reporting channels and government signposting. Follow the authority and sector channels that apply where the victim operates. FBI reporting guidance, CISA advisory and NCSC guidance describe these routes.
- Preserve evidence. Where safe and feasible, retain forensic images, memory captures, relevant logs, malware samples, ransom notes, wallet addresses, email headers and indicators of compromise. Keep copies of communications with the attacker and record times, decisions and people involved. Coordinate collection with law enforcement and qualified responders. CISA’s StopRansomware guide explains evidence-preservation considerations.
- Protect remaining backups. Separate backup systems from compromised networks and prevent attackers from deleting or encrypting them. Do not assume a backup is clean because it is recent; scan and validate it before restoration.
- Engage independent expertise. Contact your cyber-insurance incident hotline if applicable, but ask for specialists who can investigate and remediate rather than relying on the extortionist’s technical claims. Obtain legal advice on sanctions, contracts, privacy and reporting.
- Build an accurate impact picture. Identify affected systems, unavailable functions, potentially accessed data, safety implications, dependencies and realistic restoration times. Treat claims that attackers downloaded particular files as leads to verify, not as proof.
- Find alternatives to payment. Ask law enforcement or recognized security researchers whether a decryptor exists for the specific ransomware strain. Evaluate clean backups, rebuilds, manual workarounds and third-party recovery options. The NCSC specifically recommends this broader assessment. NCSC payment guidance.
Recovery without paying
Use clean, tested backups
Restore only after responders have contained the intrusion, closed the entry route and verified that backup copies are not infected or attacker-controlled. Maintain a staged restoration: rebuild a clean environment, test critical applications and credentials, then reconnect systems in an order that limits reinfection. CISA recommends malware-free backups and careful restoration. CISA’s ransomware guide provides the operational principles.
Rebuild when decryption is uncertain
For systems with trustworthy configuration records and replaceable data, a clean rebuild may be safer than running an unknown decryptor. Reissue credentials, rotate keys and certificates, remove unauthorized remote-access tools, patch exploited vulnerabilities and monitor for persistence before declaring recovery complete.

Check for legitimate decryptors
Law enforcement, national cyber agencies and reputable researchers sometimes publish decryptors for particular ransomware families. A decryptor may be incomplete, may not work on every variant and does not remove the attacker’s access. Preserve encrypted samples and seek expert validation before running any tool.
Plan for data-extortion consequences
If personal, health, financial, confidential or regulated information may have been copied, involve privacy counsel and the relevant regulators. Payment cannot guarantee confidentiality, so notification and protective measures may still be required.

Legal, sanctions and reporting constraints
United States sanctions
The U.S. Treasury’s Office of Foreign Assets Control (OFAC) warns that ransomware payments can create sanctions exposure when a sanctioned person or entity is involved. Prompt reporting and cooperation with law enforcement may be considered mitigating factors in an enforcement matter, but they do not make an otherwise prohibited payment lawful or guarantee a particular result. Check current sanctions information, trace the proposed recipient and obtain qualified counsel before any transaction. OFAC’s ransomware advisory is dated September 21, 2021; sanctions lists and guidance can change.

United Kingdom and cross-border rules
UK NCSC guidance says payment may not be lawful when made to a sanctioned entity or area. An organization should consider the laws and regulations of every jurisdiction in which it operates, where affected people are located and where the payment or recipient is based. UK law enforcement and the NCSC do not endorse ransom payments. NCSC payment guidance and NCSC response guidance explain the position.
U.S. cyber-incident reporting deadlines
The 2024 text of 6 U.S.C. § 681b includes 72-hour deadlines for covered cyber-incident reports and 24-hour deadlines for covered ransom-payment reports. Those numbers are not universal deadlines for every victim: the statute does not by itself establish that an organization is covered or how the current implementing rule applies. Confirm entity coverage, the triggering event and the current rule with counsel or CISA. Read the statutory text.
How to handle the attacker’s communication
- Preserve ransom notes, chat transcripts, email headers, wallet addresses and claimed proof files for responders.
- Do not disclose internal information that could improve the attacker’s leverage or reveal uncontained systems.
- Do not let an attacker’s deadline replace your own evidence, legal and recovery assessment.
- If leadership authorizes communication, route it through trained responders and counsel; do not assume negotiation proves that payment is safe or effective.
- Never treat an attacker’s explanation of how the breach occurred as established fact. Independently identify and close the intrusion path, as the NCSC advises.
For an individual whose device is locked
Official payment-decision guidance is written mainly for organizations. A person with a locked computer or phone should disconnect the device from networks if that can be done safely, preserve the ransom note and contact current local authorities and qualified technical support. Do not send money, install an unverified “decryptor,” or erase the device before obtaining advice if the files may be evidence. Check whether your own offline or cloud backups are clean and whether the device’s operating system and accounts can be rebuilt. The right action depends on the device, ransomware family, data and local law; no general article can determine an individual’s legal or recovery outcome.
