Yes, goods can be detained under Section 129 of the Central Goods and Services Tax (CGST) Act when they are transported or stored in transit in contravention of the Act or its rules, and a missing or invalid e-way bill can be treated as that kind of contravention. However, CBIC Circular No. 64/38/2018-GST says proceedings under Section 129 may not be initiated for specified minor discrepancies when the consignment carries both the required invoice (or other specified document) and an e-way bill. A typo is not automatically harmless, and not every mismatch qualifies as a minor error.

This explanation is based on the CBIC Section 129 text and CBIC Circulars No. 64/38/2018-GST (14 September 2018) and No. 41/15/2018-GST. The circulars must be read with amendments in force on the date of interception, applicable State or Union territory GST law, rules and court decisions. The statutory text and administrative guidance checked for this article were current as of 13 October 2026.

What Section 129 covers

Section 129 applies while goods are being transported or are otherwise in transit. It authorises detention or seizure of the goods and the conveyance when the movement contravenes the CGST Act or its rules. The trigger is therefore a contravention, not the mere fact that an officer notices a typographical difference.

An e-way bill is one part of the transport documentation. The officer will normally consider the bill, the tax invoice or another specified document, the vehicle and route, and the physical goods together. A consignment with no e-way bill presents a different risk from a consignment with a valid bill containing one of the narrowly described minor errors.

Can a missing e-way bill lead to detention?

No e-way bill, but an invoice is present

CBIC Circular No. 64/38/2018-GST states that when goods are accompanied by an invoice or other specified document but there is no e-way bill, proceedings under Section 129 may be initiated. The invoice does not substitute for an e-way bill where the e-way bill rules require one.

The officer still has to follow the statutory procedure and issue the relevant documents. “May be initiated” means the circular recognises exposure to Section 129; it is not a statement that detention is automatic in every fact pattern.

Neither required document is available

The absence of both the e-way bill and the supporting invoice or specified document creates a more serious documentation problem. The goods may be treated as moving in contravention of the Act or rules, and the owner or transporter should expect the officer to examine tax, penalty and release requirements under the current Section 129 text.

Part B is missing or incomplete

Circular No. 64 says that omission of Part B information generally makes an e-way bill invalid for road movement. It records an exception for goods transported up to 50 kilometres within the same State or Union territory, from the transporter’s place of business to the consignor’s or consignee’s place of business, subject to the conditions stated in the circular and rules.

That exception is limited. A journey outside the stated 50-kilometre situation should not be treated as covered merely because the distance is short. Check the actual origin, destination, transporter address and State or Union territory before relying on it.

Which e-way bill errors are treated as minor?

The key protection is conditional. The consignment must be accompanied by both an invoice or other specified document and an e-way bill. Circular No. 64 uses the wording: “Further, in case a consignment of goods is accompanied with an invoice or any other specified document and also an e-way bill, proceedings under section 129 of the CGST Act may not be initiated, inter alia, in the following situations:”

The listed examples are:

  • Names: a spelling mistake in the consignor’s or consignee’s name when the GSTIN is correct.
  • PIN code: a PIN-code error where the correct address is stated and the mistake does not extend the e-way bill’s validity.
  • Consignee address: a limited address error where the locality and other relevant address details are correct.
  • Document number: one or two incorrect digits in the invoice or other document number.
  • HSN: a specified four- or six-digit HSN error where the first two digits and the applicable tax rate are correct.
  • Vehicle number: one or two incorrect characters in the vehicle number.

These categories are narrower than the phrase “any typo.” For example, a vehicle number with several wrong characters, a wrong GSTIN, an address that points to a different place, or an HSN and tax-rate mismatch may fall outside the circular’s examples. The officer can examine whether the documents identify the actual parties, goods and movement.

No e-way bill versus a listed minor error

Situation Document context What Circular No. 64 indicates Practical risk
No e-way bill Invoice or specified document is present Section 129 proceedings may be initiated High; the invoice alone does not cure the missing e-way bill
Part B omitted E-way bill exists but is generally incomplete for road movement Generally invalid, subject to the stated intra-State/UT 50-kilometre exception Depends on route, addresses and whether the exception actually applies
Listed minor discrepancy Both invoice or specified document and e-way bill are present Proceedings under Section 129 may not be initiated Lower, but only if every listed condition is met
Mismatch outside the listed examples Documents may be present but materially inconsistent No blanket exemption in the circular Officer may treat it as a contravention

The circular’s language is discretionary (“may not be initiated”), not an absolute prohibition on detention. It should not be read as preventing an officer from investigating a discrepancy that appears connected with evasion, an unidentified consignment or another rule breach.

What penalty applies to a listed minor error?

For the listed minor-error situations, Circular No. 64 describes a separate penalty under Section 125: Rs. 500 under the CGST Act and the respective State GST Act, or Rs. 1,000 under the IGST Act, for each consignment. The circular directs that the penalty be recorded in FORM GST DRC-07.

Those figures are the amounts stated in the 2018 circular. They should not be copied into a notice or payment calculation without checking the law and notifications applicable on the interception date. Section 129 and related rules have been amended over time, and State or Union territory administration and later binding decisions can affect how a particular discrepancy is handled.

  1. Document and goods verification: The proper officer checks the transport documents and may inspect the goods and conveyance.
  2. Statement of the person in charge: The driver or other person responsible for the conveyance may be asked to provide a statement about the goods, documents, route and movement.
  3. Inspection records: The officer records the inspection in the prescribed forms and prepares an inspection report.
  4. Completion of inspection: The circular contemplates completion within three working days, with a written extension where permitted.
  5. Detention order, if considered necessary: The circular identifies FORM GST MOV-06 for the detention order.
  6. Notice of tax and penalty: FORM GST MOV-07 sets out the proposed tax and penalty.
  7. Objection and decision: The person affected can make objections. The officer should issue a speaking order explaining the decision.
  8. Release: Release follows payment under the applicable law or furnishing eligible security, subject to the current statutory conditions.

Keep every form and record served at the interception. A detention is not resolved merely by a telephone conversation; the written notice, order and payment or security record determine what has happened procedurally.

The 14-day point and possible Section 130 action

The CBIC’s currently displayed Section 129 page states that if the statutory tax and penalty are not paid within 14 days of detention or seizure, further proceedings under Section 130 are initiated. The 14-day period is therefore a critical deadline shown in the current official text.

Do not assume that an older article’s tax or penalty formula remains current. Earlier versions of Section 129 used different amounts and deadlines. Use the version of the Act and rules in force on the detention date, and compare the notice with that text before deciding whether to pay, furnish security or challenge the action.

What to do if your goods are detained for an e-way bill error

1. Secure the complete document set

  • Print or download the e-way bill, including all vehicle and Part B details.
  • Collect the tax invoice or other specified document and confirm its number, date, value, GSTINs, addresses, description, HSN and tax rate.
  • Record the vehicle registration, driver details, transporter information, route, loading point and destination.
  • Preserve the interception memo, statements, inspection report, MOV-06, MOV-07, DRC-07 and any written extension or order.

2. Classify the discrepancy precisely

Ask whether the issue is no e-way bill, missing Part B, a wrong GSTIN, an address mismatch, an incorrect document number, an HSN or tax-rate problem, or one of the narrow errors listed in Circular No. 64. Compare each character and address detail rather than describing the issue generally as a “small typo.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Test the two-document condition

For the minor-error route, verify that both the invoice or specified document and the e-way bill accompanied the goods. If either document was absent, the circular’s listed protection does not fit the stated facts.

  • What You Get: Anker 332 USB-C Hub (5-in-1), welcome guide, our worry-free 18-month warranty, and friendly customer service.

4. Check the route and distance

If Part B was omitted, map the actual movement. The circular’s exception concerns transport up to 50 kilometres within the same State or Union territory to or from the transporter’s place of business and the consignor’s or consignee’s place of business. Keep address and route evidence showing why the exception applies.

5. Respond in writing before the order

Use the notice’s procedure and deadline to identify the exact circular category, attach corrected document data and explain why the goods, parties and route are identifiable. Ask that the officer record the objection and issue a speaking order. Do not alter historical records; preserve the original e-way bill and show any lawful correction separately.

6. Decide on payment, security or challenge

Compare the proposed tax and penalty with the current Section 129 text and the facts. If release is commercially urgent, obtain advice on the available payment or security route while preserving the right to challenge an incorrect classification. A tax professional should review a disputed detention, especially where Section 130 action, a large tax demand, repeated interceptions or a writ or appeal may follow.

Common mistakes that weaken a response

  • Calling every mismatch “minor” without matching it to a category in Circular No. 64.
  • Relying on the invoice while ignoring that no e-way bill was generated.
  • Assuming the 50-kilometre Part B exception applies to any short journey or any State boundary crossing.
  • Using penalty amounts copied from an old article without checking the current Act, rules and notice date.
  • Failing to obtain the written inspection report, detention order or notice.
  • Missing the 14-day period stated on the current official Section 129 page.

Limits of the circular protection

Circular No. 64 is useful administrative guidance, but it does not establish that every officer, State authority or court will resolve every factual mismatch identically. Its examples also do not decide questions such as suspected undervaluation, an unregistered supplier, goods that do not match the invoice, a false vehicle number or a route inconsistent with the documents. Those facts can create issues independent of a typographical error.

No reliable official statistic establishes how often goods are detained, how often taxpayers obtain release, or how frequently a particular error is excused. The outcome depends on the documents, the actual movement, the officer’s order and the law applicable at that time.

Practical bottom line

Section 129 is a real detention and seizure mechanism for goods moving in contravention of GST law. A missing e-way bill, and generally an e-way bill without required Part B information, can expose a consignment to proceedings. Where both the invoice or specified document and an e-way bill accompany the goods, Circular No. 64 says proceedings may not be initiated for its specifically listed minor errors, with the circular’s stated Section 125 penalty route. The safest response is to identify the exact discrepancy, preserve the written record, answer the notice promptly and apply the current Section 129 text rather than relying on an outdated amount or deadline.
