Samsung Display has reportedly added a U.S. Patent and Trademark Office challenge to its defense against NeoLayer. ZDNet Korea reported that Samsung Display requested ex parte reexamination of NeoLayer’s U.S. Patents 8,698,712 and 8,093,592 on August 25 and 27, 2026, while NeoLayer’s infringement lawsuits against Samsung remain pending in the Eastern District of Texas. The requests challenge patentability; they are not a USPTO finding that either patent is invalid.
What Samsung Display filed
The reported USPTO filings create a second front in a dispute that began in federal court. NeoLayer LLC sued Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. in the Eastern District of Texas on December 31, 2025, in case 2:2025cv01259. The complaint lists a patent cause of action under 35 U.S.C. §271 and requests a jury.
NeoLayer filed a second Samsung case on June 9, 2026, case 2:2026cv00458, again naming the two Samsung entities. ZDNet Korea reported on August 30 that Samsung Display had sought ex parte reexamination of two NeoLayer patents, with the requests dated August 25 and 27.

The corporate parties should not be conflated. The court docket identifies Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc. as defendants, while the reported USPTO requests are attributed to Samsung Display.

Which NeoLayer patents are being challenged?
U.S. Patent 8,698,712: OLED pixel structure
The August report characterizes Patent 8,698,712 as covering OLED pixel-structure technology. Pixel architecture determines how a display’s light-emitting elements are arranged and driven, so a challenge to this patent addresses a core part of OLED panel construction rather than an incidental device feature.
U.S. Patent 8,093,592: TFT substrate technology
Patent 8,093,592 is described as a thin-film-transistor technology patent. Its listed title is “Thin Film Transistor Substrate, Electronic Apparatus, and Methods For Fabricating The Same.” TFT circuitry controls individual pixels and is built on the substrate that supports the display’s electrical operation.

Taken together, the two requests reach both sides of display construction identified in the report: OLED pixel architecture and the TFT substrate and fabrication layer. That selection gives Samsung a patentability challenge aimed at foundational display structures, not just one named consumer product.

How ex parte reexamination works
Ex parte reexamination is a USPTO proceeding that tests whether existing patent claims remain patentable in view of patents or printed publications. It is separate from a district-court infringement case.

- A request is submitted. Samsung’s reported requests identify the two NeoLayer patents it wants the USPTO to reconsider.
- The USPTO decides whether a substantial new question of patentability exists. Under MPEP §2246, a decision granting reexamination must identify the claims and issues, the patents or printed publications relied on, and a brief rationale for each new question.
- The examiner examines the challenged claims. MPEP §2258 states that the examination is based on patents or printed publications. Claims may not be enlarged in scope during the proceeding.
- The proceeding produces a patent-office result. That result can affect the strength or enforceability of the challenged claims, but it does not itself determine whether Samsung infringed, what products were sold, or what damages might be owed.
The available record does not show a final USPTO decision in either reported proceeding. “Requested reexamination” is therefore the accurate description; “invalidated patents” is not.
Why the filings broaden Samsung’s strategy
Parallel pressure in two forums
Samsung can contest NeoLayer’s rights before the USPTO while defending the infringement complaints in federal court. The two proceedings address different questions: the USPTO examines patentability, while the district court addresses infringement and remedies.

Focus on core display structures
Targeting one OLED pixel patent and one TFT-substrate patent places the challenge at the technology layers used to build panels. If claims in either patent are narrowed, cancelled, or otherwise changed, NeoLayer’s position in related infringement disputes could become less valuable. No such change has been reported yet.

Procedural leverage without a final ruling
A reexamination request can give Samsung another way to contest the scope and validity of claims cited in litigation. It does not automatically resolve the Texas cases, and the reported filings do not establish that the court has paused, dismissed, or otherwise changed those actions.

NeoLayer’s broader enforcement campaign
Related docket information shows NeoLayer pursuing display-technology cases involving ASUS and BOE as well as Samsung. The portfolio listings include Patents 8,093,592 and 8,698,712, suggesting that the Samsung actions form part of a wider enforcement campaign rather than a one-off complaint about a single device.
Samsung Display’s broader patent strategy has also included negotiated outcomes in other disputes. In 2025, Samsung Display and BOE agreed to settle OLED patent and trade-secret lawsuits and withdrew ongoing actions, demonstrating that settlement is another possible endpoint in display litigation. That separate resolution does not predict the outcome of NeoLayer’s cases.
