Previously collected personal data is not automatically safe to reuse for AI. A new model, application, or access path can change why information is processed, who can reach it, and what can be inferred. For UK organisations, the key questions are whether the new purpose is compatible with the original one, whether people could reasonably expect the reuse, and whether the data and access are limited to what the task needs.
When does reusing old data for AI create a new privacy risk?
The risk arises when data collected or held for one reason is later used to train, fine-tune, or operate an AI system for another. That shift can change the purpose and practical consequences of processing: an application may expose information to new users, combine it with other records, or support inferences that were not part of the original activity.
Age alone does not decide whether reuse is lawful, and AI reuse is not automatically prohibited. The answer depends on the original and intended purposes, what people were told and could reasonably expect, the data involved, the applicable lawful basis, and safeguards. The UK Information Commissioner’s Office (ICO) says these issues should be considered at the relevant stages of the AI lifecycle. Its analysis is guidance and consultation material, not a determination that any particular organisation’s processing is compliant. “AI” is not one single processing purpose. The ICO considers developing a generative-AI model and developing an application based on that model to be different purposes under data protection law. Collection or assembly of the data can be a further distinct purpose. The organisation should therefore map the actual processing and the parties responsible at each stage, rather than treating the whole chain as one activity controlled by a single vendor.

The ICO’s purpose-limitation analysis explains that compatibility is assessed in context, with people’s reasonable expectations at the start of processing among the relevant factors. Where a further purpose is incompatible with the original one, the organisation needs to establish a separate purpose and an appropriate basis for the processing under the applicable rules. A compatible purpose may be possible; so may a new purpose supported by a separate basis, such as specific consent or a legal obligation where those routes genuinely apply. How to assess a proposed reuse
- State the proposed purpose precisely. Describe the task, context, people affected, and processing stage. Avoid broad, catch-all wording that does not explain what this use actually covers.
- Recover the original context. Record why the data was collected, what people were told, who supplied it, and what expectations were reasonable at the time.
- Test compatibility. Compare the original and new purposes and document why the reuse is or is not compatible, taking account of people’s expectations and the circumstances of collection.
- Identify the basis and constraints. Establish an appropriate lawful basis for the actual processing and check other relevant legal requirements. Do not treat possession of the data or its age as a basis for reuse.
- Limit the data and its lifetime. Justify each category of personal information against the stated use. Remove unnecessary fields, records, and duplicates, and set a retention period based on the purpose rather than keeping data in case it proves useful later.
- Control access and explain the use. Determine which system components, people, tools, and databases need access. Provide relevant transparency and use safeguards suited to the risks.
- Reassess material changes. Revisit the assessment if the model, application, purpose, dataset, or access path changes.
This is a practical governance approach, not a substitute for assessing the facts and applicable law in a particular case. Restrict what an AI system can reach
Purpose review is not enough if a deployed system can retrieve personal information unrelated to its task. In its analysis of agentic AI, the ICO warns: “Organisations should not give agentic AI systems access to information just because it might be useful in the future.” Practical controls can include selecting only the required tools and databases, setting permissions, masking data, monitoring activity, and requiring human approval for sensitive access. These controls should match the system’s actual access paths. For example, review not only the dataset used to train or adapt a model, but also the records an application can retrieve during operation and the people or services that can inspect its outputs.

What the ICO consultation response does—and does not—show
The ICO’s consultation response reports that 46 organisations responded to its purpose-limitation consultation. Of 16 survey respondents, 12 (75%) agreed with the ICO’s overall analysis. That percentage describes those survey respondents only; it is not a measure of public opinion, all organisations, or the prevalence of AI privacy risk. The response and the ICO’s second call for evidence set out the regulator’s analysis and consultation position; they do not establish that a particular reuse is compliant. The ICO also says its AI security and data-minimisation guidance is under review following the Data (Use and Access) Act. UK organisations should check the current ICO guidance and applicable law when making a decision.
