Short answer: A retailer does not automatically need consent simply because it calls an activity “customer research.” Start by defining the purpose, selecting and documenting the lawful basis that fits the context, and giving participants clear privacy information. If consent is the lawful basis, record exactly what each person agreed to, when, and under which notice. Keep survey answers, recordings and customer data only for a documented, purpose-based period, then securely delete or effectively anonymise them unless a continuing legal or qualifying research purpose justifies retention.
What must be decided before a retail research project starts?
Privacy compliance is easier when the project is designed around a precise purpose rather than a vague intention to “learn more about customers.” Write the question the research must answer, the decisions it will inform and the minimum data needed to answer it. A project asking why shoppers abandon a basket may need transaction details and interview comments; it may not need a full date of birth, government identifier or an entire loyalty history.
Map the activity and its data flows
Create a record for each method—survey, interview, focus group, usability session, diary study or panel. Identify the data source, every field collected, the people or systems receiving it, the countries involved, the retention trigger and the person accountable for deletion. Treat audio, video, free-text comments, device identifiers and combined datasets as potential personal data when they can single someone out.
Choose and document the lawful basis
There is no single mandatory lawful basis for all retail research. The appropriate basis depends on the retailer’s purpose, the relationship with participants, the data involved and the jurisdiction. Document why the chosen basis fits before collection begins. If the project uses a basis other than consent, explain that basis in the privacy information and retain the reasoning, including any balancing or compatibility assessment required by the applicable law.

Keep ethics consent separate from privacy-law consent
An ethics committee, professional code or internal policy may require a person to agree to participate. That participation agreement does not, by itself, establish consent as the data-protection lawful basis. Record the two decisions separately: one confirms that the person chooses to take part; the other explains why the retailer is legally permitted to process the resulting personal data.
Do we need consent to survey customers?
No blanket rule requires consent for every customer-research project. The retailer must identify the lawful basis that matches the actual processing. A survey invitation, interview request or panel enrolment should therefore not contain an unchecked assumption that “research equals consent.” The privacy notice should state the basis being relied on and the purposes covered.
When consent is the chosen basis
Consent must be specific, informed and freely given. A person needs a real choice, understandable information and an affirmative action; silence, inactivity or a pre-ticked box is not a reliable record of agreement. Do not bundle unrelated purposes into one vague permission. If a study has separate activities—such as taking part in an interview, recording audio, receiving follow-up invitations and allowing secondary analysis—consider separate choices where the purposes are not genuinely inseparable.

Make consent auditable
Keep evidence that allows the retailer to reconstruct the consent event. The record should include:
- The exact consent statement shown to the participant.
- The version and date of the privacy notice or form linked to that statement.
- The date and time of the affirmative action and the collection channel.
- The purposes, data categories and sharing scope covered.
- Any withdrawal, preference change or restriction, with the time it took effect.
The ICO states: “Where processing is based on consent, the controller shall be able to demonstrate that the data subject has consented to processing of his or her personal data.” A database flag that says only “consent=yes” cannot normally demonstrate what was agreed.

What must a research privacy notice say?
Give the notice at or before collecting the information, in language the intended participants can understand. A short notice can link to fuller detail, but the essential facts must be available before a person decides whether to participate.
Minimum content to cover
- Purpose: the research questions and the decisions or service improvements the work supports.
- Data categories: survey answers, contact details, purchase information, recordings, transcripts, demographic data and any sensitive information.
- Lawful basis: the basis selected for each purpose, not merely a general statement that the work is research.
- Retention: the period or the criteria used to set it, plus what happens at the review date.
- Recipients and sharing: internal teams, research agencies, transcription providers, analytics platforms and any international transfers.
- Rights and choices: how people can exercise applicable rights, withdraw consent where relevant, or raise a complaint.
- Contacts: the responsible retailer or controller and a privacy contact or data-protection officer where required.
The ICO summarises this obligation as follows: “You must provide individuals with information including: your purposes for processing their personal data, your retention periods for that personal data, and who it will be shared with.” Keep a copy of the notice version used for each recruitment wave.
Tell people before a new use begins
A notice for a satisfaction survey does not silently authorise every later use. Before combining responses with loyalty records, publishing quotations, training a model or inviting participants to a different study, assess whether the new purpose is compatible and whether additional information or a new choice is required. Update the notice and communicate the change before starting the new processing.
Can loyalty or transaction data be reused for customer research?
Possibly, but reuse requires a documented assessment rather than a simple data export. The retailer should record the original collection purpose, the proposed research purpose, the lawful basis for the new processing, the expected impact on customers and the safeguards that will be applied.
A practical secondary-use assessment
- Describe the new question. State what decision the research will support and why each proposed field is necessary.
- Check compatibility. Compare the context and expectations at original collection with the proposed use, the nature of the data and the possible consequences for individuals.
- Confirm the basis. Decide whether the existing basis covers the new activity or whether a different basis, fresh notice or fresh consent is needed.
- Reduce the dataset. Remove direct identifiers and unnecessary history; aggregate or generalise dates, locations and purchase details where that still answers the question.
- Apply safeguards. Restrict access, separate the key from analysis data, set deletion dates and prohibit decisions about individual customers unless separately justified.
- Record the decision. Keep the compatibility reasoning, approvals, notice version and supplier instructions with the project file.
If the original collection relied on consent for a different purpose, fresh consent is generally needed for a new processing activity unless a lawful research provision applies and all of its conditions are met. Do not assume that a loyalty-program enrolment checkbox covers interviews, profiling or unrelated experimentation.
Is pseudonymised feedback still personal data?
Usually. Replacing a name with a code, token or participant number is pseudonymisation when someone in the data environment can reconnect the record to a person. The coded record remains subject to duties such as lawful processing, access controls, transparency and storage limitation. Keep the re-identification key separately, limit who can use it and protect both datasets.
When data can be treated as anonymous
Effective anonymisation removes the information from personal-data scope only when identification is no longer reasonably possible in the circumstances. Test the result against the people, tools and auxiliary data available to the retailer and its suppliers. Rare combinations of age, postcode, purchase and quotation can identify someone even after names are removed. If reasonable re-identification remains possible, handle the material as personal data.
How long can survey responses be kept?
There is no universal retention number for surveys, interviews or customer panels. The UK GDPR does not set specific time limits for different types of data. Set a period or review criterion that matches the purpose, document it and revisit it when the project changes.
Build a purpose-based retention schedule
| Record type | Retention decision to document | End-of-period action |
|---|---|---|
| Recruitment and screening details | How long is needed to contact eligible participants, manage incentives and resolve disputes? | Delete or anonymise contact and eligibility fields when those needs end. |
| Raw survey responses | How long are the results needed for analysis, quality checks, reporting and reproducibility? | Delete unnecessary identifiers; retain only an anonymised dataset if it still serves a defined purpose. |
| Interview or focus-group recordings | How long are recordings required to verify transcription or resolve interpretation issues? | Securely erase recordings when verification ends unless a documented continuing purpose applies. |
| Transcripts and coded notes | What period supports reporting, audit and approved follow-up without keeping excess detail? | Remove direct identifiers, review quotations and delete or anonymise when the period expires. |
| Consent and notice evidence | How long must the retailer demonstrate the lawfulness of processing or defend a claim? | Keep only the evidence needed for that accountability purpose, under restricted access. |
The FTC recommends a written policy specifying what personal information is kept, how it is secured, how long it is retained and how it is disposed of. Your schedule should name an owner, a review date, the deletion method and the systems covered, including backups and supplier copies where feasible.
Use review triggers, not just calendar dates
A review can be triggered when the final report is accepted, the product decision is made, the participant relationship ends, a legal claim is resolved or a vendor contract closes. At review, choose one outcome: delete, irreversibly anonymise, shorten the dataset, or document why a continuing purpose requires another defined period. A legal hold can suspend deletion for the material it covers, but the hold should identify its scope and end condition.

Indefinite retention is an exception, not a default. It may be permitted for qualifying public-interest archiving, scientific or historical research, or statistical purposes when that remains the continuing purpose and appropriate safeguards protect people. The archive must not later be used for incompatible purposes or to make decisions about particular individuals. If the research purpose disappears, delete or anonymise the material.
An archive policy should define the collection’s public-interest or scientific purpose, access rules, prohibited uses, re-identification controls, review points and exit process. “We might need it someday” is not a continuing purpose.
How should recordings, transcripts and quotations be handled?
Audio and video can reveal a person’s identity, voice, appearance, household details and sensitive opinions. Explain recording, transcription, quotation and storage separately in recruitment materials. Offer a non-recorded route where the study can still work, or explain why recording is essential. Limit raw-file access to the smallest team, encrypt transfers and keep working copies out of shared folders.
Before publishing a quotation, assess whether wording, context or a combination of details could identify the speaker. Remove or generalise details that are not needed for the insight. If a participant withdraws and the applicable basis or agreement requires removal, identify where the recording, transcript, clips and vendor copies reside so the request can be handled consistently.

What security and supplier controls are needed?
Security should match the sensitivity and identifiability of the data. Use role-based access, multi-factor authentication where available, encryption in transit and at rest, audit logs, tested backups and secure deletion procedures. Keep the code key separate from pseudonymised analysis files. Train moderators and analysts not to download full loyalty histories or place identifiable comments in uncontrolled collaboration tools.
Research agencies, transcription services, panel providers and analytics vendors need written instructions covering purpose, fields, retention, deletion, confidentiality, incident reporting, subcontractors and international transfers. Confirm how a vendor will return or erase data at contract end and how it will respond to a participant request. Map each transfer and check the local legal requirements for the participants’ location and the retailer’s establishment.
Step-by-step launch checklist
- Define the objective. Write the decision the research will inform and reject fields that do not serve it.
- Map data and geography. List sources, categories, systems, recipients, vendors and countries.
- Select the lawful basis. Record the reasoning and keep participation consent as a separate ethics or recruitment record.
- Draft and version the notice. Include purpose, categories, retention or criteria, sharing, rights and contacts.
- Design consent capture if required. Store the wording, notice version, timestamp, scope and affirmative action, plus withdrawal handling.
- Set the retention schedule. Assign periods or review triggers for recruitment data, responses, recordings, transcripts and accountability records.
- Configure safeguards. Minimise exports, restrict access, separate keys, secure suppliers and document transfers.
- Review secondary uses. Reassess loyalty or transaction data before combining it with feedback or behavioural information.
- Close the project deliberately. Run the review, delete or anonymise records, document exceptions and update the processing inventory.
Common mistakes and how to correct them
- “Research means consent.” Correct the assumption by documenting the lawful-basis analysis and the separate participation decision.
- One permanent checkbox for every future study. Replace it with purpose-specific choices and a process for new notices or consent.
- Keeping everything because storage is cheap. Apply a written schedule, review dates and secure disposal; cost is not a retention purpose.
- Calling coded files anonymous. Test re-identification in the actual data environment and treat key-linked records as personal data.
- Deleting the report but retaining raw recordings indefinitely. Include recordings, transcripts, exports, backups and supplier copies in the same closure review.
- Publishing “anonymous” quotes with distinctive details. Edit or generalise context, or obtain a clearly scoped permission when identification remains possible.
Requirements also vary by jurisdiction, sector, participant age, data category, recording method and contractual or legal-hold obligations. UK organisations should recheck current ICO material before launch because the regulator notes that some guidance is under review following the Data (Use and Access) Act.
